7. IGA WITH CITY OF KINGMAN FOR REIMBURSEMENT OF PASS-THROUGH HOMELAND SECURITY FUNDS, AZLINK PROJECT Approve the Intergovernmental Agreement with the City of Kingman for the purpose of reimbursement of $4,000 in funds from the State Homeland Security Grant Program (SHSGP) of the Arizona Department of Homeland Security (AZDOHS)-555208-02, AZLink Intelligence Systems Expansion Project. The term of this agreement is October 1, 2010 through December 31, 2010. This Intergovernmental Agreement is funded by a grant from Arizona Dept of Homeland Security (C-50-10-044-G-00), which was initially approved by the Board of Supervisors on October 7, 2009, and amended on October 6, 2010 to extend the funding end date to December 31, 2010 (C-50-10-044-G-01). These are pass-through federal funds through the State of Arizona and the Sheriff's Office is the administering agency. Because this funding is for a sub-recipient, indirect costs do not apply. 8. WAIVER TO LEAVE PLAN OFFICER INJURED IN THE LINE OF DUTY Approve a waiver to leave plan for Deputy Stephen Chervenak (S1918), who was injured in the line of duty on September 5, 2010, during an arrest. Deputy Chervenak's left ankle was broken to the extent that surgery was required. His recovery necessitates time off work for the injury to heal and for follow-up doctor appointments. This waiver allows Deputy Chervenak to receive normal salary and benefits while under doctor's care for this injury. All workers compensation received will be returned and no future claims for workers compensation will be made by this employee as a result of this injury. Unless otherwise authorized, this waiver expires one year from the date of this action. The estimated cost of this waiver is $7,090 which is the calculated difference between this deputy's salary and benefits less the worker's compensation credit over 13 weeks and will be covered by the Sheriff's Office general fund. 9. ADMINISTRATIVE CORRECTION TO THE ACCEPTANCE OF THE U.S. DEPARTMENT OF EDUCATION TEACHER INCENTIVE FUND (TIF) GRANT, FUNDED THROUGH THE AMERICAN RECOVERY AND REINVESTMENT ACT (ARRA) Approve an administrative correction to the action taken on October 6, 2010 (C-37-11-096-G-00), for acceptance of federal grant funding from the US Department of Education Teacher Incentive Fund (TIF) in which the action requested was to approve the funds via the American Recovery and Reinvestment Act (ARRA) funds. This administrative correction eliminates funding via the American Recovery and Reinvestment Act as the funding will be from the US Department of Education Teacher Incentive Fund. All other conditions remain the same. Additionally, retroactively approve application to the U.S. Department of Education Teacher Incentive Fund (TIF) grant. This grant requires matching funds. Per the County’s grant policy, the Education Service Agency should have sought approval to apply. This action was overlooked. The matching fund requirement is 46.05% ($5,040,652 for the first three years) and will be provided solely through the participating school districts. Maricopa County funding sources will not be participating in the grant match. (C-37-11-096-G-02)

The grant does not allow for indirect cost recovery. Unrecoverable indirect costs on this award are $92,597. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 12. SUPERIOR COURT CASE MANAGEMENT SYSTEM Pursuant to A.R.S. § 42-17106, transfer FY 2010-11 expenditure appropriation in the amount of $1,225,000 from Non-Departmental (470) Non-Departmental Grants Fund (249) Non-Recurring/Non Project (0001) to Superior Court (800) Superior Court Special Revenue Fund (259) Non-Recurring/Non Project (0001). In addition, pursuant to § 42-17106, transfer FY 2010-11 expenditure appropriation in the amount of $400,000 from Non-Departmental (470) Non-Departmental Grants Fund (249) Non-Recurring/Non Project (0001) to Superior Court (800) Judicial Enhancement Fund (208) Non-Recurring/Non Project (0001). Approval of this action will allow the Judicial Branch to secure needed licenses and hardware to support the iCISng (Integrated Court Information System Next Generation) project as it replaces the current iCIS Court Case Management System (CMS). In Non-Departmental, the adjustment will be made in the line item "Potential Expenditures from Fund Balance" line. Approval of above action request will allow the Judicial Branch to secure needed licenses and hardware to support the iCISng project as it replaces the current iCIS Court CMS. iCIS is the enterprise CMS that is used by the entire Judicial Branch and was originally built in year 2000. It has grown to include modules specific to the following divisions and departments: Family, Civil, Initial Appearance, Pretrial Services, Criminal, Probate, Mental Health, Conciliation, Alternative Dispute Resolution, Justice Courts (25), Juvenile Detention, Juvenile Court, Juvenile Probation, Adult Probation, Lower Court of Appeals, Clerk of the Superior Court Financials, and many justice partners and supporting agencies. The current system is written in aging Microsoft software technology and runs on aging Hewlett-Packard hardware, both of which will no longer be supported. Therefore, it is critical that the Judicial Branch secure the needed licenses and hardware for the iCISng project as support is nearing its end on the current iCIS Court CMS technology. Without the upgrades the court information system is at risk for failure, loss of data, system down time, etc., which may in return cause lost cases and delayed court processing. The Court believes that the re-architected system can be viable for another eight-years – with a three to five year hardware refresh cycle. Additionally, the requested system aligns with the best practices used in the Judicial Branch and the Technology Advisory Committee (TAC), which is a standing subcommittee of the Commission on Technology (COT) at the Administrative Office of the Courts (AOC). 13. SUPERIOR COURT PARENT CONFERENCING Pursuant to A.R.S. § 42-17106, transfer FY 2010-11 expenditure appropriation in the amount of $200,000 from the Non-Departmental (470) Non-Departmental Grants Fund (249) Non-Recurring/Non Project (0001) to Superior Court (800) Conciliation Court Fees Fund (257) Non-Recurring/Non Project (0001). In addition, pursuant to § 42-17106, transfer FY 2010-11 expenditure appropriation in the amount of $200,000 from the Non-Departmental (470) Non-Departmental Grants Fund (249) Non-Recurring/Non Project (0001) to Superior Court (800) Expedited Child Support Fund (271) Non-Recurring/Non Project (0001). Approval of this action will allow the Superior Court Family Court Division to continue providing parenting conferences as an affordable alternative to gathering information in order to address statutory requirements regarding custody and parental fitness. In Non-Departmental, the adjustment will be made in the line item "Potential Expenditures from Fund Balance" line. Approval of the above action will allow the Superior Court Family Court Division to continue providing parenting conferences as an affordable alternative to gathering information in order to address statutory requirements regarding custody and parental fitness. Although not statutorily mandated, parenting conference reports are a highly-effective means to isolate and identify issues of concern in family dynamics. When polled, the Family Court judges and commissioners rated this service the most important tool for them in developing an understanding of what needs to be ordered in a particular case. Many, if not most of Family Court litigants are self-represented and therefore, a privately produced evaluative study is nearly unattainable as it is too costly. Parenting conferences provide an affordable alternative to gathering information in order to address statutory requirements regarding custody and parental fitness. A well-documented report following a meeting with both parents leads to earlier resolution of a case based on the needs of the child(ren). (C-80-11-007-2-00)

14. PROBATE COURT FUND BALANCE UTILIZATION Pursuant to A.R.S. § 42-17106, transfer FY 2010-11 expenditure appropriation in the amount of $113,000 from the Non-Departmental (470) Non-Departmental Grants Fund (249) Non-Recurring/Non Project (0001) to Superior Court (800) Probate Fees Fund (256) Non-Recurring/Non Project (0001). Within the appropriated budget for Non Departmental, the amount to be transferred will be deducted from Potential Expenditures from Fund Balance. Approval of above action request will allow the Superior Court to contract with the NCSC to provide a Probate Study of the SCPC which will involve but not be limited to a site assessment, draft of an issues paper, conduct an analysis of individual case data and aggregate data, collect external data, research best practices, assess judicial staffing and produce a report that primarily addresses caseflow management and judicial oversight. In addition, approval of above action request will allow the Superior Court to purchase four (4) replacement computer laptops and contract with consultant programmers who will install specialized software. Total amount not to exceed $15,400. The need for equipment is due to current equipment failing preventing the SCPC Investigators from completing work thus not allowing the SCPC to consider petitions for guardianship. Both the Board of Supervisors and the Head Start Policy Council must approve the Policy Council Bylaws as required by the Head Start Act Section 642.c(1)(E)(iv)(VI). The Maricopa County Head Start Zero-Five Program Policy Council approved this revision to the By-Laws on August 27, 2010. (C-22-09-080-M-03)

29. APPROPRIATION ADJUSTMENT FOR HUMAN SERVICES DEPARTMENT GRANT BUDGET Approve increases in the appropriated budget for the Human Services Department (220) Human Services Grant Fund (222) Operating (0000) in the amount of $6,384,004 in revenues and expenditures as identified on the Fiscal Year 2010-11 Grant Summary Worksheet on file in the Office of the Clerk of the Board. This appropriation adjustment brings the Human Services Department grant budget to the amount of $56,564,366. The approval of this budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The appropriation adjustment is necessary because the carry forward amounts of prior year grants and award amounts of new grants differ from the amount approved in the FY 2010-11 Budget Appropriation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. On November 19, 2003, the Board of Supervisors approved Maricopa County Parks and Recreation to apply for trade names for 11 parks (Agenda Item C-30-04-009-M-00). In addition, Maricopa County Parks and Recreation requests approval to prepare and submit applications for trade names and trade marks on behalf of the County for the following: Trade Names: Protect-a-Park Pleasant Paddlers Program Lake Pleasant Regional Park Dam Good Run, Walk, Hike Dust Devil Series Maricopa Trail Estrella Mountain Golf Course Trademarks for the following locations: Adobe Dam Regional Park Buckeye Hills Regional Park Cave Creek Regional Park The Desert Outdoor Center Estrella Mountain Regional Park Lake Pleasant Regional Park McDowell Mountain Regional Park San Tan Mountain Regional Park Spur Cross Ranch Conservation Area Usery Mountain Regional Park White Tank Mountain Regional Park Protect-a-Park Maricopa Trail The need for official names – trade names – includes internal consistency, external control, exclusive naming right, marketing and promotion, and protection from the business community. F-2. IGA WITH CITY OF SCOTTSDALE FOR DIGITAL AERIAL ORTHO-PHOTOGRAPHY Approve Intergovernmental Agreement (IGA) FCD 2010A014 between the Flood Control District of Maricopa County (District) and the City of Scottsdale (City). The purpose of this Agreement is to define the roles and responsibilities of the District and City for the cost sharing and data sharing of Digital Aerial Ortho-Photography. Since December of 2000, the Flood Control District (District) has been acquiring digital ortho-rectified aerial photography with a horizontal accuracy of +/- 5 feet. This accuracy is necessary for the District’s regulatory and technical responsibilities. The District’s acquisition of the imagery for the 2010-2011 fiscal years are hereinafter called the PROJECT. When the project is complete, the information will be used for Zone A floodplain determinations, for accurately depicting features on the ground and for floodplain determinations on the District Web site. The total cost for the area to be photographed is estimated to be $73,000. The City will reimburse the District their cost share obligation estimated to be $56,000. The City will be responsible for performing quality control of the final products. This project impacts Supervisory District 1, Supervisory District 2 and Supervisory District 3 (C-69-11-023-3-00)

F-4. IGA (FCD 2010A002) AMENDMENT NO. 1 WITH NRCS FOR POWERLINE FRS FISSURE RISK ZONE MITIGATION PROJECT Approve Amendment to Intergovernmental Agreement (IGA) FCD 2010A002 for the Powerline Flood Retarding Structure (FRS) Fissure Risk Zone Mitigation Project (Project[#310]) between the Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District). The Amendment adds an additional 90 calendar days for a total of 180 calendar days for the District to award a contract for construction before the Agreement becomes null and void. This IGA (signed by the District in July 2010) establishes the cost-share for the design, land acquisition, construction, and operation and maintenance of the Project. NRCS will pay for 100% of the NRCS eligible construction costs. The District will pay for the design, construction management, land acquisition and operation and maintenance. Powerline FRS is one of a system of three flood retarding structures (Powerline FRS, Vineyard Road FRS and Rittenhouse FRS) that were constructed by the U.S. Soil Conservation Service (now Natural Resources Conservation Service or NRCS). Powerline FRS was constructed in 1967 and 1968. District staff identified a fissure risk zone associated with the structure, and near term action is required to mitigate the associated dam safety and public safety concern. In July 2008, the District submitted this Project to the District's Capital Improvement Program (CIP) Prioritization Procedure for fiscal year (FY) 2009-2010, and the District’s Flood Control Advisory Board, with staff concurrence, recommended the project for future implementation. The Project was authorized by Resolution 2008R015 on April 1, 2009 (C-69-09-056-6-00) and 2008R015A on, March 17, 2010 (C-69-10-060-6-00). The Board approved Intergovernmental Agreement (IGA) FCD 2010A005 on August 18, 2010 (C-69-11-003-3-00) between the District and Natural Resources Conservation Service (NRCS) for cost sharing, design, rights-of-way acquisition, construction, construction management, operation and maintenance of the Project. The IGA was signed by the NRCS on September 24, 2010. Per the IGA, 100% of the eligible cost of construction of the project will be paid by NRCS. The District will be the lead agency for construction of the project. This Agenda Item impacts Supervisory District 1. (C-69-11-028-3-00)
