16. EXEMPTION TO THE POST EMPLOYMENT (RETIREMENT) HEALTH PLAN ENHANCEMENT PROGRAM (RHEP/PEHP) Approve an exemption to the Post Employment (Retirement) Health Plan Enhancement Program (RHEP), approved by the Board on November 16, 2009 and allow Attorney–Capital Co-Counsel position 00034078 to remain an active position in the Office of the Legal Advocate. The Office of the Legal Advocate requests an exemption to the RHEP requirement that positions vacated as a result of program participation be inactivated. Also, approve an exemption to the RHEP to allow the Office of the Legal Advocate to utilize the full hiring range to place the attorney selected to fill position 00034078 at the appropriately mapped rate. The potential range for the position is $42.26/Hour to $64.15/Hour, based on the hiring range for Attorney-Senior positions with the additional Special Management Assignment pay associated with the co-capital attorney role ($17,500/yr). Position 00034078, in the Office of the Legal Advocate, will be vacated as a result of the current employee’s participation in the FY2009-10 Retirement Health Enhancement Program. The position attributes are as follows: MRT: ATTORNEY – CAPITAL CO-COUNSEL Status: Classified Budgeted Rate: $57.77 Legal representation is mandated for defendants charged in felony cases, including capital murder cases. Therefore, any cases that would have previously been handled by the retiring attorney in the Office of the Legal Advocate will have to be assigned somewhere in Indigent Representation. The other two staffed offices handling capital cases are already operating at capacity. Any additional capital cases will have to be assigned to outside contract counsel if the Office of the Legal Advocate is not able to rehire for the Attorney–Capital Lead Counsel position (00034078). The contractor attorney rate for capital representation is $125 per hour for lead attorneys. Therefore, allowing the Legal Advocate to recruit and fill this position will produce a cost savings to the Indigent Representation System as a whole, and probably within the Office (depending on the range placement of the attorney selected). Due to the impending retirement of an Attorney–Capital Co-Counsel, the department expects to achieve personnel savings for FY 2009-10. Assuming a Senior-Attorney at mid-range is found to fill this position, this will result in an estimated $27,151 in savings as required under the 2009 Retirement Health Enhancement Program.

38. EXEMPTION TO THE POST EMPLOYMENT HEALTH ENHANCEMENT (RETIREMENT) PROGRAM-ACCOUNTANT COUNTY POSITION Approve an exemption to the Post Employment (Retirement) Health Plan Enhancement Program (PEHPEP), approved by the Board of Supervisors on November 16, 2009, and allow Accountant-County Position #30084, grant-funded, classified, to remain an active position in Human Services Department (HSD). Also, approve an exemption to the PEHPEP in order to recruit for the Accountant position with a hiring range of $18.76 per hour to $23.00 per hour. The PEHPEP requires that positions vacated as a result of the Program participation be inactivated. However, HSD has determined that maintaining this position is critical to the execution and success of fiscal and grants operations of the Finance Division, and to meeting the mission of the Department. The requested recruitment hiring range is more than the required recruiting range. However, due to the retirement of an Accountant, recruiting at this range and filling the position will not create additional cost to HSD, and will result in a minimum budgeted annual savings of $1,851.00. F-3. RESOLUTION TO GRANT EASEMENT TO TOWN OF GILBERT Approve Resolution No. 2010R001 which requests permission to grant an easement to the Town of Gilbert over property acquired from the United States Government. The Flood Control District of Maricopa County acquired property from the United States Government for the Sossaman Road Drain Project in December 2002 by Quit Claim Deed. There was no charge for this purchase and the deed was processed through the District’s right of way/consent agenda. In that purchase, there were deed restrictions about utilizing the property for any other purpose than for flood control projects. The Town of Gilbert has recently asked for permission to utilize a portion of the property for roadway purposes. The United States Government has agreed, however, it has asked for a Board Resolution authorizing this use and concurring with the release of a portion of this property to the District, free of the original restrictions. This item impacts Supervisor District No. 1. (C-69-10-055-6-00)

F-4. AMENDMENT TO RESOLUTION FOR ACQUISITION OF LAND RIGHTS FOR IMPROVED ACCESS TO EXISTING STRUCTURES AND PROJECT AREA PROPERTIES Adopt Amendment No. 1 to Resolution FCD 2009R002 for Acquisition of Land Rights for Improved Access to Existing Structures and Project Area Properties for the Flood Control District of Maricopa County (District). This Amendment adds to the list of structures and areas identified in Resolution FCD 2009R002 for which the Chief Engineer and General Manager of the District is authorized and directed to pursue and improve additional access for operations and maintenance activities, and the Amendment adds authority to expend District Operating Budget funding in pursuit of these acquisitions. The District has constructed, and operates and maintains, flood control structures within and without Maricopa County that protect the residents of Maricopa County from flooding. The District authorized the acquisition of rights-of-way, under Resolution FCD 2009R002 dated March 18, 2009 (C-69-09-052-6-00), using Capital Improvement Program funding, to provide additional operations and maintenance access to certain District structures. District staff subsequently identified additional structures and properties operated and maintained by the District requiring additional operations and maintenance access acquisitions, including the Agua Fria River Levees, I-10 Basin Properties, Casandro Wash Dam, Centennial Wash Levee, Harquahala Floodway, Saddleback Floodway, Indian School Road Drain, McMicken Dam Outlet Channel, Powerline Flood Retarding Structure (FRS), Powerline Floodway, Vineyard FRS, Sun City Drains, 48th Street Drain and Rittenhouse FRS. The acquisition of additional rights-of-way for operations and maintenance access will require the expenditure of District Operating Budget funding in addition to District Capital Improvement Program funding. This Amendment authorizes the acquisition of access rights to the additional structures identified above, and adds authority for the expenditure of Operating Budget funding in addition to previously-authorized Capital Improvement Program funding. Individual acquisitions are subject to the ratification and approval of this Board. This Agenda Item impacts all supervisory districts. (C-69-09-052-6-01)

F-5. IGA WITH ARIZONA DEPARTMENT OF TRANSPORTATION FOR THE SR303L DRAINAGE IMPROVEMENTS Approve Intergovernmental Agreement (IGA) FCD 2007A005 for the SR 303L Drainage Improvements (Project [#470]) between the Arizona Department of Transportation (State) and the Flood Control District of Maricopa County (District). This IGA is for cost sharing of the Project design, right-of-way acquisition, construction, construction management and operation and maintenance. The estimated cost of the IGA to the District is $28,235,000. The IGA shall become effective upon signing and dating of the Determination Letter by the State Attorney General and shall remain in effect until completion of the construction of the Project. Operation and maintenance terms of the IGA shall survive the expiration of the IGA. The SR 303L/White Tanks Area Drainage Master Plan (ADMP) was developed in 1995 and updated in 2005 (ADMPU) to identify and develop solutions to mitigate flooding hazards in the White Tanks drainage area. The ADMPU recommended the construction of a regional 100-year drainage system adjacent to the SR 303L to intercept storm water flows and provide an outfall to the Gila River. The drainage features consist of 19 miles of channel and associated basins from Clearview Boulevard to the Gila River along the proposed SR 303L alignment. The District will fulfill its cost share obligation by funding the implementation of the channel and related basin from 250 feet south of Van Buren Street to the Gila River (a distance of 4.6 miles), and by being responsible for operation and maintenance of that portion of the Project. The State will fulfill its cost share obligation by funding the implementation of the channel and related features from Clearview Boulevard to 250 feet south of Van Buren Street (a distance of 15 miles), and by being responsible for operation and maintenance of that portion of the Project. This Agenda Item impacts Supervisory District 4. (C-69-10-056-3-00)
