10. ACCEPT GRANTS FOR THE CLERK OF THE SUPERIOR COURT FOR FY 2009-10 Accept FY 2009-10 grants for the Clerk of the Superior Court in the amount of $1,695,330. The indirect costs (based upon a rate of 31.2% as calculated by the Department of Finance) of $528,943 are not fully recoverable, as reflected in the funding agreements. FY 2009-10 grants allow for $307,207 of recoverable indirect costs and $221,736 of unrecoverable costs. Grant revenues are not local revenues for the purpose of constitutional expenditure limitation, and therefore, expenditure of these revenues is not prohibited by the budget law. Administrative Order #95-50, approved by Presiding Judge Robert D. Myers on June 29, 1995, adopted for the Judicial Branch a policy for the administration of grant funding. The policy, identical in form and substance to policy A2505 "Policy for Administering Grants" and all revisions adopted by the Board of Supervisors for all County departments. 14. IGA WITH ARIZONA STATE LAND DEPARTMENT FOR ENFORCEMENT OF OFF HIGHWAY VEHICLE (OHV) USE Approve an intergovernmental agreement (IGA) with the Arizona State Land Department (ASLD) and Maricopa County on behalf of the Maricopa County Sheriff's Office which compensates Sheriff's Office for deputy overtime and vehicle use to enforce off highway vehicle use on weekends during Lake Patrol off season. The term of this agreement is effective on the date it is executed by both parties and shall expire five years from that date. This agreement is terminable within 60 days written notice of either party. The value of this agreement for FY 2010 is estimated to be $15,000. Also per A.R.S. 42-17106(b) approve an increase to FY 2010 Sheriff's Office (50) revenue and expenditure authority not-to-exceed $15,000 in General Fund (100) recurring (0000). Intergovernmental revenues are not local revenues for the purpose of the constitutional expenditure limitation and are therefore not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-50-10-079-M-00)

15. ACCEPT GRANTS AND OTHER ASSOCIATED REVENUES FOR THE ADULT PROBATION DEPARTMENT FOR FY 2009-10 Accept the FY 2009-10 grants and other associated revenues for the Adult Probation Department of the Judicial Branch. The indirect cost rate as of July 2009 is 10.0% as approved by the Department of Finance. Some of the grants for FY 2009-10 do not allow the indirect cost recovery as reflected in the funding agreements. The status of indirect costs for each grant is noted on the attached summary sheets. For FY 2009-10 we anticipate accepting twenty new awards for Grant Fund revenue of $7,451,442 and carrying over Grant Fund revenue balances of $584,529 on seven previously accepted awards. On the new awards, indirect costs on eligible expenditures are estimated to be $694,653 with $309,339 of indirect costs recoverable and $385,314 unrecoverable. In addition, approve an increase to the FY 2009-10 Adult Probation (110) Adult Probation Grants Fund (211) Operating (0000) revenue and expenditure appropriation in the amount of $3,558,914. This increase is necessary because actual grant funding to be received is more than anticipated and budgeted. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Administrative Order #95-50, approved by Presiding Judge Robert D. Myers on June 29, 1995, adopted for the Judicial Branch a policy for the administration of grant funding. The policy is identical in form and substance to policy A2502 "Policy for Administering Grants" and all revisions adopted by the Board of Supervisors for all County departments. The policy states that the Presiding Judge will make a presentation to the Board of Supervisors on an annual basis of the Judicial Branch's grants. A summary of each grant has been prepared in accordance with the provisions of the policy. All supporting documents are electronically attached to this agenda. (C-11-10-008-G-00)

17. SUPERIOR COURT ADMINISTRATION GRANTS FOR FY 2010 Accept the FY 2010 grants and associated revenue for Superior Court Administration of the Judicial Branch in the amount of $1,460,210 total. The indirect costs (based upon a rate of 40.7% certified by the Dept of Finance) of $592,824 are not fully recoverable from the funding, as most of the grants for FY 2010 do not allow for indirect cost recovery. Grant revenues are not local revenues for the purpose of constitutional expenditure limitation, and, therefore, expenditure of these revenues is not prohibited by the budget law. Administrative Order #95-50, approved by Presiding Judge Robert D. Myers on June 29, 1995, adopted for the Judicial Branch a policy for the administration of grant funding. The policy, identical in form and substance to policy A2505 "Policy for Administering Grants" and all revisions adopted by the Board of Supervisors for all County departments, states that the Presiding Judge will make a presentation to the Board of Supervisors on an annual basis of the Judicial Branch's grants. A summary of each grant has been prepared in accordance with the provisions of the policy. The amount of the grants and associated revenue for Superior Court Administration for FY 2010 is $1,460,210 total. The amount of the indirect cost recovery is $592,824 total. The amount of unrecoverable indirect costs is $589,184 total. One grantor (the Office of the Governor) allows for cost recovery of a maximum of 5% ($3,640)--the other grants for FY 2010 do not allow for indirect cost recovery, as reflected in the funding agreements. 50. DELEGATE AUTHORITY TO DIRECTOR OF FACILITIES MANAGEMENT TO ENTER INTO AGREEMENTS WITH SOLE SOURCE UTILITY PROVIDERS Delegate to the Director of Facilities Management the authority to enter into agreements, that are approved as to form by legal counsel to the County, with sole source utility providers as necessary to affect the delivery of utility services for County buildings and facilities and to effectuate modifications to utility lines and appurtenant facilities necessary for the completion of County construction projects. This authority includes, but is not limited to, entering into any agreements necessary for the installation and maintenance by the provider of necessary lines and equipment or as needed by the County to complete construction, regardless of whether or not this work provides direct services to a County owned or leased facility. This delegation of authority is limited to situations where no discretion or choice exists in selecting the provider, and, therefore, no competitive procurement is possible. In the course of normal operations and maintenance for existing facilities and as a result of the construction of or the leasing of new facilities, there are several circumstances that necessitate the execution of new or revised agreements with sole source utility providers. An example of the these circumstances are when the county purchases or leases new facilities and needs to establish various utility service agreements to provide electric, water, sewer and natural gas service to accommodate occupancy of the facility. With the Downtown Court Tower Project, the Capital Improvement Plan and the County’s Major Maintenance Program, among other potential future projects or programs, there is a need to enter into agreements with utilities to establish service connections and distribution systems to new facilities in order to initiate service and to enter into licensing and other agreements to move existing utility connections in order to complete the County’s projects and programs as intended and approved by the Board of Supervisors. In all cases, these services are sole source agreements between the County and the regulated provider of the specific utility in that geographical area. These agreements are standard format, will be approved as to form by legal counsel for the County, and outline each party’s financial responsibilities associated with the initiation and maintenance of the service as well as the service levels and/or the rate tariffs to be assessed. F-12. IGA WITH CITY OF PHOENIX FOR DOWNTOWN PHOENIX STORM DRAIN SYSTEM IMPROVEMENTS Approve intergovernmental agreement (IGA) FCD2009A009, between the Flood Control District (District) and the City of Phoenix (City) for the Rights-of-Way Acquisition, Utility Relocations, Construction, Construction Management, and Operation and Maintenance of the Downtown Phoenix Storm Drain System Improvements for Areas 1 and 2 (Project [#625]) as identified in the Metro Phoenix Area Drainage Master Plan (Metro ADMP). The approximate costs of this IGA are estimated at: $8,000,000 for Area 1, $4,500,000 for Area 2, and $12,500,000 for the combined total. The City shall serve as the lead agency for the Project. The District and the City shall each fund 50% of the costs of the Project, making the District’s total estimated cost $6,250,000. The IGA shall become effective when recorded at the office of the County Recorder and shall expire ten years from the date of recording, or upon Project completion, whichever occurs first. The District, in association with the City, initiated the Metro ADMP. Several floodprone areas were identified within the study area. The Downtown Phoenix Drainage (Downtown) area was identified as one of the floodprone areas. The area is bounded on the west by 19th Ave, the north and east by I-10, and the south by Salt River. The recommended Downtown plan identifies construction of new storm drains as well as utilization of existing storm drains. Once all the proposed improvements are in place, the Downtown area will have protection from a 10-year flooding event. The City requested in the FY 2007-08 CIP Prioritization Procedure that the District participate in funding for design, right-of-way acquisition, construction, and construction management of a few elements of the recommended Downtown plan. The Board adopted Resolution FCD 2008R001 on March 26, 2008, authorizing the Chief Engineer and General Manager of the District to negotiate IGAs for design and construction of different elements of the recommended Downtown plan. IGA FCD2008A001, for design of the Downtown Phoenix Storm Drain System Improvements for Areas 1, 2, and 3, was approved by the Board on June 4, 2008 (C-69-08-057-2-00) and design of the Project was initiated by the City of Phoenix. MAINTENANCE AGREEMENT WITH THE CITY OF TEMPE REGARDING HABITAT RESTORATION AREA IN THE INDIAN BEND WASH Approve a maintenance agreement between the City of Tempe (City) and the Flood Control District (District) regarding the maintenance of Tempe’s Habitation Restoration Area in the Indian Bend Wash. Such an agreement establishes the duties of maintenance activities in the Indian Bend Wash Habitat area and saves the District time and monies by clarifying duties of each agency. This agreement is effective upon filing with the Maricopa County Recorder and shall remain in full force and effect for the same duration of the Easement C2003-32, recorded April 14, 2003, Recorder No. 2003-0460494. The Flood Control District granted the City of Tempe a habitat easement in 2003 (C2003-32) which obligated the City of Tempe to operate and maintain a habitat restoration in accordance with the US Army Corps of engineer requirements. The easement referred to operation and maintenance of the habitat area. In order to define the exact maintenance requirements, an operation and maintenance agreement was necessary.
