9. SELF SERVICE CENTER FEES Pursuant to A.R.S. §11-251.08, convene the scheduled public hearing to solicit comments and consider adopting an increase to the existing fee structure for copying and printing fees for the Maricopa County Superior Court Self Service Center and Court Law Library. Also, authorize the Court Law Library to waive library fines assessed in error. Upon Board approval, these items will become effective January 23, 2013. A.R.S. § 11-251.08 authorizes the Board of Supervisors to adopt fees for any specific service the County provides to the public as long as that fee is attributable to and defrays the expense of the service for which the fee is assessed and the fee does not exceed the actual cost of that service. The formal establishment of the revised fees proposed below is essential to the Court’s continued success in providing high-quality judicial services to litigants, other government agencies, and the citizens of Maricopa County. The proposed fees proceeds will be deposited into the Superior Court Special Revenue Fund (259) and the Law Library Fund (261) for disbursement as appropriate. Proposed Fees, current to new: EzCourtForms Printing Fee - $0.10 to $0.20 per page, (estimated annual revenue of $12,700, estimated FY13 revenue of $6,350); Library Photocopy While-You-Wait Service and Copy Fee for any library-staffed copy service - $0.20 to $0.50 per page, (estimated annual revenue of $385.20, estimated FY13 revenue of $192.60); Library and Self Service Center Photocopier and Print Release Fee - $0.10 to $0.20 per page, (estimated annual revenue of $11,342, estimated FY13 revenue of $5,671). The latter fee is collected by vendors and offset against library photocopier invoices. Upon determination by library management that library fines and/or fees were assessed in error, the Law Library may waive those incorrectly assessed fines and/or fees. (C-80-13-005-2-00)

16. REMOVE AND DISPOSE OF MISCELLANEOUS SURPLUS ITEMS Authorize Goodwill Industries International of Arizona to remove and dispose of miscellaneous surplus from the Judicial Branch. 27. AGREEMENT WITH HOUSING AUTHORITY OF MARICOPA COUNTY FOR PAYBACK OF NEIGHBORHOOD STABILIZATION PROGRAM (NSP) FUNDS Approve the Payback Agreement between the Housing Authority of Maricopa County (HAMC) and Maricopa County through its Human Services Department. Effective July 1, 2013, HAMC shall pay $2,212.61 per annum for ten years to the County for a total of $22,126.09. The HUD Community Planning and Development office reviewed the Public Housing Finding Memo issued to HAMC on August 20, 2010, and established a violation of the HAMC conflict of interest agreement rule per 24 CFR 570.611, resulting in a $22,126.09 payback requirement of NSP funds from non-federal sources. Per section 13 A. of the Intergovernmental Agreement (C-17-09-048-3-00) between HAMC and Maricopa County, HAMC agreed to undertake the same obligations as the County undertook for the U.S. Department of Housing and Urban Development pursuant to the Annual Action Plan Amendment and Assurances and to hold County harmless and indemnify it against any damage or other liability which HAMC may incur with respect to HUD as a result of any failure on the part of HAMC to comply with the requirements of any such obligations. As HAMC has limited access to funds from non-federal sources, payback shall occur over a ten year period as access to non-federal sources becomes available. (C-22-13-035-M-00)

42. IGA WITH THE CITY OF SCOTTSDALE FOR EMERGENCY TRAFFIC MANAGEMENT MUTUAL AID (REACT) Approve the Agreement between Maricopa County and the City of Scottsdale for Emergency Management Traffic Management Mutual Aid (REACT). The Board of Supervisors at the meeting held on Wednesday, April 1, 2009 formally approved the expansion of the MCDOT REACT program to three cities: Glendale, Peoria, and Scottsdale and authorized MCDOT to apply for $852,459 in reimbursement funding from the Maricopa Association of Governments (MAG) Transportation Improvement Program. The total cost of the REACT expansion project is $1,238,859. A local match of 31.19% or $386,400 is required. The partners, including MCDOT, agreed to share equally in the local match required; the respective local contributions are as follows: Glendale: $96,600, Peoria: $96,600, Scottsdale: $96,600 and MCDOT: 96,000. Since then, the Peoria REACT program was formalized under IGA C-91-10-182-M-00, and the Glendale REACT approach was formalized under IGA C-91-12-043-M-00. The remaining program, the Scottsdale REACT component, is the subject of this Agreement. The Regional Emergency Action Coordinating Team (REACT) is a highly specialized arterial incident response program that provides emergency traffic management. The purpose of this Agreement is to identify and define the rights and responsibilities of the Parties in their efforts to provide mutual aid for emergency traffic incident management services during the duration of the project. It was anticipated that the Scottsdale REACT program would be expanded through federal funds apportioned to the County in the Maricopa Association of Governments (MAG) Transportation Improvement Program (TIP) Project MMA09-801, such that the City would establish a City operated REACT program. Instead, the parties have established a new short term goal to enhance emergency traffic management operations in the City. The County will administer the expansion and utilize the Project Funds to provide REACT services in the City. The goal of the partners is to allow the City an opportunity to obtain additional information regarding the operational and financial commitments required so that the City can proceed with establishing a City operated REACT program. The County will utilize the MAG TIP funding to procure equipment and supplies and support emergency traffic management in the City. The County will retain ownership of equipment, and supplies acquired with MAG TIP grant funding. As a part of the Project funds, the City was expected to provide cash contribution in the amount of $96,600. In lieu of this, however, the City will instead provide an in-kind contribution through training, development and assistance to the County REACT members for incident management signal timing plans. Supervisory District No. 2 (C-64-13-104-M-00) 43. EASEMENT, RIGHT-OF-WAY, AND RELOCATION ASSISTANCE DOCUMENTS Approve easements, right-of-way documents, and relocation assistance for highway and public purposes as authorized by road file resolutions or previous Board of Supervisors’ action. 49. SETTING OF HEARING FOR COURT AUTOMATION FEES Pursuant to A.R.S. §11-251.08, set a public hearing for March 27, 2013 to solicit comments and consider adopting an increase to the Court Automated Services Fee. Upon Board approval, this item will become effective March 27, 2013. A.R.S. §11-251.08 authorizes the Board of Supervisors (BOS) to adopt fees for any specific service the County provides to the public as long as that fee is attributable to and defrays the expense of the service for which the fee is assessed and the fee does not exceed the actual cost of that service. The Court requests a public hearing to authorize and approve an increase of $10 (currently $20) to the base Court Automated Services Fee (CASF) to a new amount of $30. The CASF was established by the Board with agenda number C-38-98-010-7 and is assessed upon the filing of initial complaints and answers or responses, in all civil, family, probate and tax cases. Upon Board approval the fee increase will be assessed on cases filed after BOS approval following the hearing required pursuant to A.R.S. §11-251.08. The proposed fee increase proceeds will be deposited by the Clerk of the Court (COC) into the Superior Court Special Revenue Fund 259 (SRF) for disbursement by the Court Presiding Judge with expenditure of funds subject to appropriation by the BOS. Increasing caseloads, case complexity, ongoing mandated court integration efforts and resulting staff workloads have created tremendous demands on the Court’s resources. To meet these demands, the Court continues to develop, improve and integrate case, financial and public access information management systems. The Court is seeking additional Court Automation Fund resources to support strategic technology projects, including consulting services, staff training and infrastructure requirements. Prime examples of these projects are: the enhanced use of technology for judges, commissioners and probation officers to perform their duties away from physical courtrooms and offices, specialized applications that allow the citizens of Maricopa County to interact and conduct business with the Court’s and Probation departments from home or intelligent devices and enhanced workflow and case processing timelines (business process improvements). The current $20 CASF collected is allocated between the Court and COC by an 87.5% and 12.5% distribution, respectively; the proposed new $30 CASF would adjust the allocation to a 91.67% and 8.33% distribution, respectively. The proposed increase to the SRF better reflects the actual cost of the services provided, and is essential to the Court’s continued success in providing high-quality court services to litigants, other government agencies, and the citizens of Maricopa County. The previous increase to the CASF was approved by the Board on January 19, 2005 when the fee was increased from $10 to $20. (C-80-13-011-2-00)

F-3. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF WATER RESOURCES FOR DETAILED PRE-APPLICATION REVIEWS OF FLOOD CONTROL DISTRICT DAM SAFETY REHABILITATION PROJECTS AND MODIFICATION PROJECTS Approve Amendment No. 1 to Intergovernmental Agreement (IGA) FCD 2010A006 for detailed pre-application reviews by the Arizona Department of Water Resources (ADWR) of Flood Control District of Maricopa County (District) dam safety rehabilitation and modification projects. This IGA is currently effective and funded through June 30, 2013. Amendment No. 1 will update the list of current District dam safety and dam modification projects applicable to the IGA for a total of seven projects. ADWR is the jurisdictional agency for the 22 flood control dams managed by District. Seven projects are currently in various stages of design for overall rehabilitation or modification. These projects are traditionally funded by the District and, where applicable, federal partners. By law the District must obtain “a permit to construct” from ADWR for any rehabilitation, repair, alternation or modification of the flood control dams managed by the District. Also by law, the District must provide 100% complete construction plans and specifications and supporting design documents for formal application of the ADWR “permit to construct”. This IGA was implemented to minimize schedule delays and increased dam rehabilitation and dam modification re-design costs due to revised design requirements by ADWR after designs are completed. The third year of the IGA is ongoing and the IGA is fully serving its intended purposes. Amendment No. 1 is needed to update the list of current District dam safety and dam modification projects applicable to the IGA for a total of seven projects and thus allow ADWR to invoice under this IGA to all current District dam rehabilitation and dam modification projects applicable to the IGA. This Agenda Item impacts Supervisorial Districts 1, 3, 4 and 5. (C-69-10-071-3-01)

H-2. AGREEMENT WITH MARICOPA COUNTY HUMAN SERVICES DEPARTMENT FOR PAYBACK OF NEIGHBORHOOD STABILIZATION PROGRAM (NSP) FUNDS Adopt Resolution 13-001 and approve the Payback Agreement between the Housing Authority of Maricopa County (HAMC) and Maricopa County through its Human Services Department. Effective July 1, 2013, HAMC shall pay $2,212.61 per annum for ten years to the County for a total of $22,126.09. The U.S. Department of Housing & Urban Development Community Planning and Development office reviewed the Public Housing Finding Memo issued to HAMC on August 20, 2010, and established a violation of the HAMC conflict of interest agreement rule per 24 CFR 570.611, resulting in a $22,126.09 payback requirement of NSP funds from non-federal sources. (C-66-13-023-M-00)
