10. APPOINT A JUSTICE OF THE PEACE FOR THE SAN TAN JUSTICE COURT Pursuant to A.R.S. §11-251(16) and the vacancy created by the resignation of Samuel T. Goodman, Justice of the Peace, San Tan Justice Court, consider nominations and make an appointment to fill the vacancy for a Justice of the Peace for the San Tan Justice Precinct. Such appointment shall be effective January 11, 2023 . (C-06-23-430-X-00) Chairman Gates said one of the important roles as the Board of Supervisors is filling vacancies in different positions. He took item # 10 out of order to appoint a Justice of the Peace for the San Tan Justice Court. Supervisor Sellers said there were four viable candidates with individual strengths, and any of them would have been a benefit to the C ourts. He took the time to speak to each on e and decided to move forward with a candidate who has many years of Judicial experience and has served as a Justice of the Peace Pro Tem since 2008. The candidate’s experience will allow him to contribute to the position immediately. Supervisor Sellers made a motion to appoint Sherwood Johnston III as the Justice of the Peace for the San Tan Justice Court. Supervisor Galvin seconded the motion.

Macho is a 7-year-old K9 and has been rapidly deteriorating with decreased physical ability, agility, and stamina to perform effectively and reliably. Macho's primary assignment is searching for contraband before it can enter the jails. The veterinarian has recommended Macho be retired due to his inability to cool down and exercise intolerance. Detention Officer Villanueva will accept full care and financial responsibility for Macho upon adoption and will be asked to sign the Canine Release and Indemnification. IGA WITH CITY OF APACHE JUNCTION DETENTION TRAINING ACADEMY Approve an Intergovernmental Agreement (IGA) between Maricopa County on behalf of the Sheriff’s Office (MCSO) and City of Apache Junction regarding the Maricopa County Sheriff’s Office Detention Training Academy. This Agreement allows City of Apache Junction detention recruits to participate in scheduled MCSO Detention Academies at a cost of $250 per registrant as space permits. City of Apache Junction is responsible for providing worker’s compensation insurance, salary, benefits, uniforms, and other items for its participants. ONE TIME ADDITIONS TO FLEET AND EXEMPTION FROM MARKINGS Approve six (6) one-time additions to fleet (321477, 321402,321618,321220, 311651, 312055), that are described in the attached list for use as MCSO Fleet Management loaner vehicles. Two are patrol vehicles and four are detective vehicles and they are currently scheduled for decommissioning. They will be assigned for loaner use by MCSO Fleet Management when active MCSO patrol and detective vehicles are being repaired or during wait times while newly purchased vehicles are being equipped prior to deployment. The annual operating expense for these vehicles is expected to be $5,000 each for a total of $30,000 to be absorbed by the Sheriff’s General Fund budget. The vehicles will be retired at the end of useful life with no funding from the General or Detention funds for replacement. DELEGATION OF AUTHORITY FOR FY 2022 SCAAP APPLICATION PROCESS Approve delegation of authority to the Sheriff to apply for FY 2022 SCAAP (State Criminal Alien Assistance Program) reimbursement funds, per Part I: SCAAP Guidelines issued by the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice. SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens who have at least one felony and two misdemeanor convictions for violations of state or local law and who are incarcerated for at least 4 consecutive days. The reporting period is July 1, 2020 through June 30, 2021. The application deadline is February 6, 2023. Approval of this action allows the application process to continue. MCSO has applied for this funding on behalf of Maricopa County for approximately 20 years. The final award amount is formulaic using jail information system inmate data downloads and payroll system data for the specific reporting period. AGREEMENT WITH US ENVIRONMENTAL PROTECTION AGENCY AIR POLLUTION CONTROL PROGRAM CLEAN AIR ACT SECTION 105 GRANT Approve an Agreement between the US Environmental Protection Agency and Maricopa County through the Air Quality Department in the not-to-exceed amount of $1,130,617. This agreement is funded by a grant from the US Environmental Protection Agency, Award ID# A00905222. This assistance agreement provides full funding. This agreement is retroactively effective from October 1, 2021, to September 30, 2022. The FY2022 Air Quality composite indirect rate of 19.75% will be applied to the direct charges of $944,148. The recoverable indirect cost of administering this grant is $186,469; the non-recoverable indirect cost is $0. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The grant award is mandated by the EPA Clean Air Act, Section 105. The grant award is noncompetitively bid. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. 24. JUDICIAL OFFICER SALARY ADJUSTMENT In accordance with A.R.S. 42-17106(B), approve the following adjustments to the FY 2023 budget: 1. Decrease the expenditure appropriation in the Non-Departmental (D470) General Fund (100) Operating (OPER) “Judicial Officer Salary Increase” (4711) budget line by $1,587,040. 2. Increase the expenditure appropriation in the Superior Court (D800) General Fund (100) Operating (OPER) budget by $1,342,418. 3. Increase the expenditure appropriation in the Justice Courts (D240) General Fund (100) Operating (OPER) budget by $244,622. The State legislature passed HB2862 in the most recent session, which increased the Judges salary to $180,000 over a two-year period. The first increase to $164,700 is effective on 1/1/23. This also impacts Court Commissioners who earn 90% of a Judges salary and Justices of the Peace who earn 70% of a Judges salary. AMENDMENT TO IGA WITH CITY OF EL MIRAGE Approve Amendment No. 2 to the Intergovernmental Agreement (“Agreement”) between City of El Mirage (the “Subrecipient”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for the Subrecipient to construction a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. The Subrecipient and the County shall be referred to as the “Parties.” The purpose of the Amendment No. 2 is to address the following items: 1. Add Point of Contact for Maricopa County. 2. Extend the Agreement term from March 31, 2023, through June 30, 2023. 3. The County shall provide the Subrecipient with an additional $250,000 to complete construction of a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. Funding is provided under the (ALN) 14.218, U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds. 4. The Agreement amount shall now be increased to a total not-to-exceed amount of $1,200,000. 5. Revise Section 3 (Work Statement) Paragraph 2.0 (Scope of Work) to revise 2.6 Implementation Schedule 6. Revise Section 4 (Budget and Compensation) Paragraph 1.0 (Budget) to reflect new Agreement amount. The Agreement is amended to incorporate the changes contained in this Amendment No. 2. All other terms and conditions of the Agreement and previously approved Amendment shall remain unchanged and in full force and effect as executed by the Parties. This amendment provides funding with a not to exceed amount of $800,000 for Component C of the IGA for the budget period August 1, 2022 through July 31, 2023. The HIV Prevention portion has a not to exceed amount of $280,000 for budget period January 1, 2022 through December 31, 2022. The RWPB portion is in the not-to-exceed amount of $821,400 for the budget period April 1, 2022 through March 31, 2023. The IGA term is January 1, 2018 through December 31, 2023. Effective upon signature by all parties and pursuant to the Terms and Conditions, Provision Six, (6), Contract Changes, Section 6.1, Amendments, Purchase orders and Change orders, it is mutually agreed that the Intergovernmental Agreement referenced is amended as follows under this amendment three (3 ); 1.1 The Scope of Work is revised and replaced; and 1.2 The Price Sheet is revised and replaced. The RFP was released on December 7, 2022 and responses are due by 2:00pm on December 27, 2022. All responses will be reviewed by a Public Health Evaluation Committee utilizing evaluation criteria included in the RFP and select those most advantageous to Maricopa County. The contract will be for six (6) months beginning January 1, 2023 through June 30, 2023. The total amount of initial funding available for this project is $600,000 and funding is being provided by the Centers for Disease Control Health Disparities Grant. Should the funding source cease and alternate funding not be available, Section 4.2 of the RFP, Availability of Funds, will apply allowing for a change or termination of the agreement. The awarded contract intends to modernize its core data, reporting, analytics, and existing integration infrastructure across the department by implementing an Enterprise Data Warehouse (“EDW”) as a solution to modernize core foundation technology for better situational awareness and forecasting, define and address state and county level policy changes and challenges that impact public health, and establish data governance for managing ongoing operational data and systems processes. Responses were due by 2:00pm on January 17, 2023, and all responses are being reviewed by a Public Health Evaluation Committee utilizing evaluation criteria included in the RFP. The highest scoring respondents shall be invited to present their proposed plan to MCDPH who will then select the Contractor deemed to be the most advantageous to Maricopa County with a contract start date of March 13, 2023. MCDPH hopes to have the proposed solution completed and in place no later than December 2023. The total amount of initial funding available for this project is $2,000,000 and funding is being provided by COVID Fiscal Recovery Funds (ARPA), Public Health IT Platform (COVID Data), Surveillance, Modernization, and Informatic Systems.
