11. REMOVE AND DISPOSE OF MISCELLANEOUS SURPLUS ITEMS Authorize Goodwill Industries International of Arizona (Goodwill) to remove and dispose of miscellaneous surplus from the Judicial Branch. The Judicial Branch in Maricopa County (Judicial Branch) has many items which the Maricopa County Surplus Program has deemed to have no resale value and can be liquidated. These items include metal desks, chairs, and other office furniture. Rather than dispose of these items in the county landfill, the Judicial Branch and the Maricopa County Green Government Program respectfully request approval to donate these items to a local charity - Goodwill. Goodwill has viewed the items and is willing to take the items. Donating the items to Goodwill will result in less waste and will help the residents of Maricopa County. THIS ITEM REQUIRES UNANIMOUS CONSENT OF THE BOARD. (C-80-10-023-2-00)

12. TRANSFER EXPENDITURE AUTHORITY FOR INCREASED PUBLIC DEFENSE SERVICES COSTS Pursuant to A.R.S. §42-17106B, transfer FY 2009-10 expenditure authority in an amount not-to-exceed $13,000,000 from the Non-Departmental (470) General Fund (100) Operating (0000) Contingency “Reserve for Criminal Justice Caseload” line to the Office of Contract Counsel (560) General Fund (100) Operating (0000). The purpose of the transfer is to cover increased mandated case representation costs. The transfer will only be used if, following a County Manager-authorized transfer of FY 2009-10 year-end General Fund savings from the Offices of the Public Defender (520), Legal Defender (540), Legal Advocate (550), and Juvenile Defender (570), the Office of Contract Counsel (560) is unable to cover remaining General Fund expenditures within its current appropriation. The Office of the Public Defender projects full-year expenditures of $33,709,559 ($1,003,689 under budget). The Office of the Legal Defender projects full-year expenditures of $9,804,389 ($51,512 under budget). The Office of the Legal Advocate projects full-year expenditures of $8,768,924 ($1,691 under budget). The Office of the Juvenile Defender projects full-year expenditures of $4,157,507 ($7,342 under budget). The Office of Contract Counsel projects full-year expenditures of at least $27,077,410 (approximately $12,700,000 above its FY 2009-10 appropriation). The total anticipated FY 2009-10 overrun, after savings are reallocated from the staffed offices to the Office of Contract Counsel, is $11.7 million. However, due to the delay in billing from contractors, and the normal monthly variances, an additional $1.3 million is requested to be set aside to ensure full funding is available. That funding will not be utilized unless required after financial transfers. Current forecasts indicate the Public Defense System will spend approximately $300,000 less than spent in FY 2008-09, in spite of demand increases and complicating issues. This is the first time since at least FY1999-00 that spending is projected to decrease from the prior year. This reduction in spending is of special note when coupled with the fact that the inflation in FY 2008-09 spending was less than one-fourth of the average inflation for the previous eight years. 13. RENEWAL OF IGA WITH THE ARIZONA BOARD OF REGENTS FOR AND ON BEHALF OF ARIZONA STATE UNIVERSITY FOR THE ARIZONA ARRESTEE REPORTING INFORMATION NETWORK PROJECT Approve renewal #5 of the Intergovernmental Agreement (C200701500) between Maricopa County and the Arizona Board of Regents for and on behalf of Arizona State University for the AARIN (Arizona Arrestee Reporting Information Network) Project. The purpose of this renewal is to provide funding in the amount not-to-exceed $170,243 for the period of July 1, 2010 through June 30, 2011, subject to availability of funds. Approval of this IGA will allow the Arizona State University Center for Violence Prevention and Community Safety to continue gathering data from inmates during booking, providing the Maricopa County Criminal Justice System with crucial information for decision making. The term of this agreement shall commence July 1, 2010 and shall terminate on June 30, 2011. A study similar to AARIN was previously funded on a nationwide basis by the Federal Government. Maricopa County was part of this study which surveyed inmates during booking regarding their drug habits; a urine sample was also taken at this time. This data was crucial to determining trends and helping policymakers make appropriate decisions. Federal funding for this program was terminated in 2003, just as it was raising a growing concern about methamphetamine. Since January 2007 the ASU Center for Violence Prevention and Community Safety has conducted the AARIN Study in the Maricopa County jails. As a result, Maricopa County is receiving important data that is providing valuable information about the population in the jails and how that population and its behavior may be changing as a result of various crime prevention and treatment programs. This extension reduces the scope of the study to include 4th Avenue Jail only, due to budget constraints. Especially important is that ASU staff is working closely with Maricopa County justice system partners to tailor the survey to our needs. (C-20-07-015-0-05)

15. GRANT BUDGET APPROPRIATION ADJUSTMENTS Approve an increase in the appropriated budget for Correctional Health Services (260) Correctional Health Grant Fund (292) Operating (0000) in the amount of $10,773 for revenues and expenditures. The appropriation adjustment is necessary because the carry forward amount of prior year grants and the award amounts of new grants differ from the amount approved in the FY 2009-10 Budget appropriation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The approval of this budget does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Indirect costs are allowable at 5%. Adjustment is necessary to increase grant budget appropriation. (C-26-10-007-G-00)

Rescind the action taken by the Board on February 10, 2010, agenda C-88-97-046-4-05 regarding the early termination of Lease L-7210 on, or about June 30, 2010, and direct the staff of Real Estate Services not to give written notice of the subject lease termination to the Lessor, 3101 East Shea Boulevard L.L.P., as successor in interest to Karl Capital Management, LLC. The current Environmental Services North Valley facility is located at 3101 E. Shea Boulevard (FMD Site No. 3814) in Phoenix. The county leases approximately 3,800 square feet of office space at the subject site under lease agreement L-7210. The current space is no longer suitable for Environmental Services’ use due to the location (too far south) and the condition of the facility. Environmental Services with the help of Real Estate Services is now in the process of identifying a Maricopa County owned facility to move into. Until the move in date into the new facility is confirmed and provided by Real Estate Services, Environmental Services will have to continue to occupy the facility located at 3101 E. Shea Boulevard (FMD Site No. 3814) in Phoenix. (C-88-97-046-4-06)

37. ACCEPT GRANT FUNDS FOR REPAIRS TO THE ALMA SCHOOL BRIDGE Accept a federal grant in the amount of $1,542,964 for repairs to the Alma School Bridge which was damaged by flooding in 2005. Authorize to accept the funds in Fiscal Year 2009-10 in the Public Works (910) Transportation Capital Projects Fund (234) Bridge Preservation Project (BRIG), Sub-Project T142, Alma School Bridge. In January 2005 the Alma School north bridge was damaged by water releases of approximately 30,000 cubic feet per second (cfs) from Bartlett and Horseshoe reservoirs. The repairs were eligible for federal reimbursement and since that time staff has been trying to get the repair costs reimbursed. Staff persistence paid off and in March 2010 two invoices were submitted to Arizona Department of Transportation and payment received in the amount of $1,542,964. A review of the records indicates that board permission was never requested to accept the grant since at the time of the repair conversations with both ADOT and the Federal Highway Administration indicated that the likelihood of receiving federal funds for the repair costs was negligible. This project is located in Supervisor Districts No. 1 and 2 (C-91-10-188-M-00)

46. SET PUBLIC HEARING ON PROPOSED REVISIONS TO AIR POLLUTION CONTROL REGULATIONS RULES 317, 321, 360, 370, 371 AND APPENDIX G Set a public hearing, as required by A.R.S. §49-479(b), for July 7, 2010 , at 9:00 a.m. to solicit comments on proposed revisions to the following Maricopa County Air Pollution Control Regulations: Rule 317 – Hospital/Medical/Infectious Waste Incinerators, Rule 321 – Municipal Solid Waste Landfills, Rule 360 – New Source Performance Standards, Rule 370 – Federal Hazardous Air Pollutant Program, Rule 371 – Acid Rain, and Appendix G - Incorporated Materials. Following the public hearing, the Board is requested to adopt proposed revisions to Maricopa County Air Pollution Control Regulations Rules 317, 321, 360, 370, 371, and Appendix G. The Maricopa County Air Quality Department (department) is proposing to incorporate by reference various federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA) and published in the Federal Register, including actions related to New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 of the Code of Federal Regulations (CFR). These rules implement federal requirements according to each federal program identified or applicable source type subject to these regulations. The proposed action will include amending the incorporation by reference date from “2008” to “2009” in each of the rules to remain current with federal regulations. This incorporation by reference is necessary before requesting the EPA’s delegation of authority to Maricopa County for the implementation and enforcement of the federal rules documented in the Maricopa County Air Pollution Control Regulations Rules 317, 321, 360, 370, 371, and Appendix G. In addition, the proposed amendments will also correct typographical or other clerical errors; make minor grammatical changes to improve readability or clarity; modify the format, numbering, order, capitalization, punctuation, or syntax of certain text to increase standardization within and among rules; or make various other minor changes of a purely editorial nature. As these changes do not alter the sense, meaning, or effect of the rule, they are not described in detail here, but can be readily discerned in the “strikeout and underline” version of the rule contained in Item 14 of the notice of expedited rulemaking. County funding for services to the seriously mentally ill (SMI) under this IGA will be $39,483,497 for FY2010-11. This increases the level of County funding based on medical inflation for services to the seriously mentally ill by $1,880,167 over the funding paid under the previous IGA in FY2009-10. A-4. IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR MENTAL HEALTH SERVICES TO REMANDED JUVENILES Approve an Intergovernmental Agreement (IGA) between Maricopa County and the Arizona Department of Health Services (ADHS) authorizing ADHS or its contracted Regional Behavioral Health Authority (RBHA) to provide mental health services to remanded juveniles (of a screening agency, an evaluation agency and mental health treatment agency) when evaluation is ordered by the Maricopa County Superior Court pursuant to Arizona Revised Statutes, (A.R.S.) Title 36, Chapter 5, Article 4 and treatment is ordered by the Superior Court pursuant to Arizona Revised Statutes, Title 36, Chapter 5, Article 5. The IGA authorizes ADHS or its RBHA to expend up to $200,000 from the “Non-SMI” payment funds that the County already provides to ADHS pursuant to the IGA executed in connection with Arnold vs. Sarn for behavioral health services as referenced in agenda item C-49-10-052-2-00. This IGA is in effect upon filing with the Arizona Secretary of State's office and is coterminous with the IGA between the Maricopa County Board of Supervisors and ADHS executed in connection with the parties’ statutory duties to provide mental health services to the Seriously Mentally Ill and which is identified as Maricopa County IGA # (C-49-10-053-2-00) (“the SMI IGA”). This Agreement shall remain in effect until June 30, 2011, unless further amended, extended, or terminated pursuant to the provisions of this Agreement. A “remanded juvenile” means a person under the age of eighteen who has been transferred to the criminal division of the Superior Court pursuant to A.R.S. § 8-327 or who has been charged with an offense pursuant to A.R.S. § 13-501; and has not been sentenced, pursuant to A.R.S. § 13-701 on the charges pending against the juvenile in the criminal division of the Maricopa County Superior Court pursuant to A.R.S. § 8-327 or A.R.S. § 13-501. The Department of Health Care Mandates and ADHS, in conjunction with the Superior Court, previously negotiated to provide evaluation services for remanded juveniles using funds that are not part of the County’s mandated obligations under Arnold v. Sarn. Funding for this IGA is capped at $200,000 and is included in the $3,366,705 “Non-SMI Payment” amount noted in the behavioral health services IGA between Maricopa County and ADHS executed under agenda item C-49-10-053-2-00. Executing this IGA will not increase the County’s cost for SMI and Non-SMI treatment under the agreement executed in connection with Arnold v. Sarn. This IGA will remain in effect until June 30, 2011. (C-49-10-054-2-00)

A-7. APPLY AND ACCEPT YEAR 2 AMERICAN RECOVERY AND REINVESTMENT ACT HEAD START EXPANSION GRANT FUNDS Approve the application and acceptance of funds for the second year of a two-year grant through the American Recovery and Reinvestment Act (ARRA) for Head Start Expansion, in the amount of $858,258. This grant is awarded by the U.S. Department of Health and Human Services (DHHS)/Administration for Children and Families (ACF)/Office of Head Start (OHS) to Maricopa County though it’s Human Services Department to continue services for 114 Head Start children. (Grant Award Number 09SA7096). The second year of the grant award begins September 30, 2010, and ends on September 29, 2011. This amendment also authorizes the Chairman to sign all documents related to these grant funds, as applicable. The sub-recipient (delegate agency) of this grant will receive $255,700 of the total grant funds. The fiscal year Human Services Department estimated indirect cost rate for FY2009-10 is 18% and the current approved DHHS indirect rate is 16.2%. The total grant funds are $858,258, of which $272,860 is passed through in sub-recipient and other costs are not subject to indirect cost recovery. The estimated indirect cost amount is $90,681. The allowable indirect cost recovery amount is $81,613. The unallowable indirect cost recovery amount is $9,068, which is absorbed through departmental administrative spending reductions. This grant requires a 25% non-federal share match in the amount of $214,565, which is generated through in-kind contributions of goods and services. This grant and any matching funds do not impact any Maricopa County General funds. The Human Services Department (HSD) is requesting an exception to the current ARRA process established by the Board of Supervisors to include acceptance of funds with this action. This is necessary because the Board’s meeting schedule does not ensure timely acceptance of funds prior to the required start date. If the final award is different from the amount approved, the Human Services Department will process a correction with the Board of Supervisors. This second year of funding of the two-year ARRA Head Start Expansion project period will allow for the continuation of services to 114 low income children 3-5 years of age. The funding will also extend the terms of the 35 teaching and other positions that were created in the first year of funding. (C-22-10-073-G-00)

A-9. APPLY AND ACCEPT FUNDING FOR YEAR 2 OF THE AMERICAN RECOVERY AND REINVESTMENT ACT EARLY HEAD START EXPANSION GRANT Approve the application and acceptance of funding for the second year of a two-year grant through the American Recovery and Reinvestment Act (ARRA) for Early Head Start Expansion, in the amount of $1,515,210. This grant is awarded by the U.S. Department of Health and Human Services (DHHS)/ Administration for Children and Families (ACF), Office of Head Start (OHS) to Maricopa County through its Human Services Department to continue services for 118 Early Head Start children (Grant Award Number 09SH7906). The second year of the grant award begins September 30, 2010 and ends September 29, 2011. This amendment also authorizes the Chairman to sign all documents related to these grant funds, as applicable. The sub-recipient (delegate agency) of this grant will receive $443,271 of the total grant funds. The fiscal year Human Services Department estimated indirect rate for FY2009-10 is 18% and the current approved DHHS indirect rate is 16.2%. The total grant funds are $1,515,210, of which $478,263 is passed through in sub-recipient and other costs are not subject to indirect cost recovery. The estimated indirect cost amount is $160,629. The allowable indirect cost recovery amount is $144,566. The unallowable indirect cost recovery amount is $16,063, which is absorbed through departmental administrative spending reductions. This grant requires a 25% non-federal share match in the amount of $378,803, which is generated through in-kind contributions of goods and services. This second year of funding of the two-year ARRA Early Head Start Expansion project period will allow for the continuation of services to 118 low income children 0-3 years of age and pregnant women. The funding will also extend the terms of the 24.5 teaching and other positions that were created in the first year of funding. (C-22-10-072-G-00)

A-17. APPLY AND ACCEPT GRANT FUNDS FOR EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/ DRUG ENFORCEMENT ACCOUNT FUNDING Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/ Drug Enforcement Account (DEA) in an amount not-to-exceed $445,651 for the Office of the Public Defender (520) portion. That amount is the FY 2009-10 actual grant award and is the amount that was budgeted for this grant in FY 2010-11 through the normal annual budget process. This grant is a recurring grant from the Arizona Supreme Court/Administrative Office of the Courts (AOC). The Office of the Public Defender applies for this grant jointly with Adult Probation, Clerk of the Superior Court, and Superior Court. These funds support the justice system by providing staff in all of these departments. In FY 2009-10, this grant funds 24.35 full-time equivalent positions. The Office of the Public Defender is requesting authorization to again apply for the DEA Grant for FY 2010-11. This grant does not require Maricopa County to provide any matching funds. The grant award begins on July 1, 2010 and ends on June 30, 2011. However, the application for funding has historically been received after the start of the applicable fiscal year and with extraordinarily short turnaround time requirements. Therefore, the Office of the Public Defender is requesting advance approval to apply for the departmental share of these funds through a joint application with the Superior Court, Clerk of the Superior Court, and Adult Probation. The grant does not allow for the recovery of indirect costs in FY 2009-10, and no change is anticipated in future years. Therefore, the Office of the Public Defender and Maricopa County may receive no administrative cost recovery for this grant in FY 2010-11. The Maricopa County Department of Finance has calculated the Office of the Public Defender's composite indirect cost rate at 7.4%. The nonrecoverable indirect cost will not exceed $32,978.17.
