7. SOUTHWEST BORDER PROSECUTION FUNDS FROM U.S. DEPARTMENT OF JUSTICE Approve the acceptance of grant funds from U. S. Department of Justice, for the Southwest Border Prosecution Initiative Program in the amount of $72,376.00. These grant funds are for the reimbursement of the County Attorney for prosecution of federally declined criminal cases. The grant award begins on October 1, 2013 and ends on September 30, 2017. The grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney's Office or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the County Attorney's Office composite indirect cost rate at 13.9%, or $10,060. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $10,060. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, budget law does not prohibit expenditure of the funds. These funds are for cases that were investigated by federal law enforcement agencies, declined for prosecution by the U.S. Attorney, and were subsequently prosecuted by the Maricopa County Attorney's Office under state law because the crimes were committed in Maricopa County. These funds are reimbursement for cases adjudicated between July 1, 2011 and June 30, 2012. These cases are already prosecuted and therefore there are no indirect costs to accepting this grant money. The Federal government has funded this program under 2012 Public Law 112-55 H.R. 2112: Div B. Title II and 2012 P. L. 112-175 A House Joint Resolution H.J. 117 to continue appropriations through September 30, 2013. There are no agreements and therefore, no signatures are required. (C-19-14-013-G-00)

By its terms, the Termination Agreement releases the parties of any and all past, present, or future obligations, duties, and liabilities arising out of the Economic Development Funding Agreement. Maricopa County and First Solar, Inc. entered into that certain Economic Development Funding Agreement dated April 20, 2011 (approved by the Board of Supervisors on March 30, 2011). At that time, Maricopa County determined that a photovoltaic solar module manufacturing facility established by First Solar would advance the County’s economic development strategic goals. First Solar intended to invest in land, plant facilities, and equipment and sought the assistance of the County. The increased employment opportunities would enhance economic vitality of the County and increase revenues. First Solar invested $155,000,000 in Phase One of the project and generated over 500 jobs, with average salaries exceeding $100,000. Due to various business and economic factors, First Solar has elected to defer commencement of manufacturing within Phase One of the project. The County did not make any disbursement of money during the course of the Economic Development Funding Agreement. In view of the changed circumstances, First Solar and the County now desire to terminate the Agreement. (C-20-11-049-2-01)

37. 13082-CI, CGI/AMS 3.0 UPGRADE Approve the award of a Competition Impracticable firm fixed price contract with CGI Technologies and Solutions to implement an upgrade of the County’s current financial system to an Enterprise Resource Planning system and provide future operational support for a not to exceed price of $44,812,465.00 Maricopa County originally purchased its current financial system in 1989 under contract number 89426. The system was brought online July 1, 1993 and has been continuously used by the County since that time with minor upgrades. This contract will permit the County to upgrade its current mainframe based 2X version to CGI’s most current server based 3X version of its Enterprise Resource Planning system which includes finance, budget and procurement. In addition to implementation costs, the contract contains costs for ongoing software support and maintenance and hosting services which are operations costs and which will be budgeted through the annual County budgeting process. Implementation of CGI’s Enterprise Resource Planning system will integrate all financial, budget and procurement activities onto one platform. Currently, each of these functions uses different applications that do not effectively communicate with each other which makes data integration and reporting difficult and expensive. This will be the first time Maricopa County has had a fully integrated system that encompasses all three functions. CGI has notified Maricopa County that it will discontinue supporting and host the 2X version of its software effective September 2016. The following is a breakdown of implementation project costs and ongoing maintenance, support and hosting costs which represent the ten year total cost of ownership for this system. Upgrade Project Costs Software Licenses $ 1,651,261 Implementation Services $20,567,370 Total Project Costs $22,218,631 Ongoing System Costs Software Support and Maintenance $ 9,344,941 Managed Advantage Hosting Services $13,248,893 Operational Costs $22,593,834 Total Contract Coast $44,812,465 (C-73-14-015-3-00)
