11. AGREEMENT WITH SCOTTSDALE HEALTHCARE, DBA FORENSIC NURSE EXAMINERS TO PERFORM DOMESTIC VIOLENCE EXAMINATIONS Approve an agreement with Scottsdale Healthcare, DBA Forensic Nurse Examiners (FNE), to aid in the investigation and prosecution of intimate partner domestic violence involving strangulation. The term of the agreement begins effective upon approval of the Board of Supervisors, and terminates after a six month pilot period, May 30, 2012, unless otherwise extended, or amended. The cost for examinations performed during the pilot project are estimated to be at least $24,000. These monies are not budgeted, but will be absorbed by the County Attorney’s (100) General Fund (190) recurring (0000) operating budget. Scottsdale Healthcare, through the FNE, will provide specially trained medical personnel to conduct examinations of victims of intimate partner domestic violence and sexual assault and abuse and gather evidence for use in the investigation of criminal cases and prosecution of offenders. Authorize the Chairman to sign any and all documents related to this action. The Maricopa County Attorney’s Office has had similar agreements with Scottsdale Healthcare in the past. This program is necessitated by adoption of revisions to State Statute elevating certain types of domestic violence to the level of a felony. Domestic violence is a serious issue in the community and this change in statute provides law enforcement and prosecutors a means to aggressively pursue offenders and potentially save lives. The County Attorney requests that the Board of Supervisors approve this pilot project so that the impact can be studied before further implementation. These services are vital to the investigation, apprehension, and prosecution of domestic violence. The County Attorney is able to absorb the costs of the initial pilot ($24,000). After review of the results from the pilot, a better understanding of the financial impact will help determine future funding needs. (C-19-12-026-3-00)

January 1, 2012, and in any event on the date of preclearance by the U. S. Department of Justice under Section 5 of the Voting Rights Act, as the boundaries from which candidates are nominated and officers are elected in the 2012 elections and each election hereafter until amended or changed by the Board of Supervisors; (5) To direct the appropriate pre-clearance submission be prepared and forwarded to the United States Department of Justice in compliance with Section 5 of the Voting Rights Act; (6) To direct that these lines shall not affect or restrict any case management or appropriate caseload or resource transition plan as deemed necessary by the Justice of the Peace Courts, the Maricopa County Superior Court or Maricopa County Justice Court Administration; (7) To Direct the County Recorder and Director of Elections accept the: a) nomination paper of any candidate for the office of precinct committeeman who is otherwise in compliance with applicable law, and b) signatures of qualified electors who otherwise meet the statutory requirements for signing nomination petitions as set out in A.R.S. §§16-314, 16-315, 16-321, 16-322, 16-822, on any nomination petition for a candidate to the office of precinct committeeman; if such candidate and signers, respectively, are qualified electors of a voting precinct in which the candidate resides at the time of filing as reflected by voting precinct boundaries adopted by the Board of Supervisors as of November 30, 2011, or any subsequent voting precinct boundaries precleared by the Department of Justice or implemented by a Federal Court for use in the 2012 elections; and (8) To authorize the County Recorder and Director of Elections calculate the nomination petition signature requirements based on the March 1, 2012, voter registration figures for the election precincts as designated by the County Board of Supervisors as of November 30, 2011, or by this action of the Board of Supervisors when it becomes effective, or by any subsequent precinct boundaries precleared or implemented by a Federal Court for use in the 2012 elections. The County Recorder or Director of Elections shall certify for the ballot or pursuant to A.R.S. §16-822 any candidate who is qualified by law and who obtains the minimum number of valid signatures from within the voting precinct in which he or she resides at the time of filing as designated by the County Board of Supervisors as of November 30, 2011, or by this action of the Board of Supervisors when it becomes effective, or by any subsequent precinct boundaries precleared or implemented by a Federal Court for use in the 2012 elections, whichever number of required signatures is fewer. State law requires the County Board of Supervisors define the boundaries of its supervisorial districts on or before December 1 following the release of the U. S. decennial census data (A.R.S. § 11-212), to make the division of supervisorial districts equal or with not more than ten per cent difference in population. The Board of Supervisors shall define the boundaries and limits of each district within a special health care district so that each district equal or as nearly equal in population as is practicable (A.R.S. § 48-5502). In addition, the Board of Supervisors shall, on or before December 1 of each year preceding the year of a general election, establish and set the boundaries of election precincts (A.R.S. § 16-411). The five community college district boundaries are redefined at the same time as the election precincts are redefined (A.R.S. §15-1441). Finally, state law allows the Board of Supervisors to establish and redistrict justice of the peace precinct boundaries as convenience requires and, in any event, to redraw the boundaries in order to reduce judicial productivity credits for any precinct which exceeds twelve hundred (1,200) credits (A.R.S. § 22-101, 22-125). The precise changes are shown on the Supervisor/Special Health Care District/ Community College District Boundary Map, the Justices of the Peace Precinct Boundary Map, and the Election Precinct Boundary Map, and accompanying legal descriptions, which are proposed for adoption by the Board of Supervisors and incorporated herein by reference. The final boundary line proposals reflect an extensive program of public hearings, public comment, notices, announcements, invitations to participate and special outreach to minority communities, Indian communities, disabled, and local governments, among others. The attached maps and exhibits provide further details. It is important to note that approval of the boundary changes by the Board of Supervisors only become effective if the lines are precleared, and if those lines are incorporated by the State’s Independent Redistricting Commission for the congressional and legislative redistricting to be implemented in the 2012 elections. The State’s Independent Redistricting Commission has yet to approve a final congressional or legislative district map. Therefore, although the Board is required to establish election precincts by December 1, 2011 pursuant to A.R.S. § 16-411, upon which candidates, signers and the County Recorder and Department of Elections shall rely for the 2012 elections, these new election precinct lines are subject to change depending upon the maps to be adopted by the Independent Redistricting Commission, or due to any other lines being precleared or implemented by a Federal Court for use in the 2012 elections. 14. ACCEPT FY2011 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) FUNDS Approve acceptance of $2,241,068 Federal FY2011 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-11-095-G-00), on June 8, 2011. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as designated by the County's Office of Management and Budget, will be stated in the electronic request to drawdown the funds. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law The Sheriff's Office has applied for this formula-based reimbursement on behalf of the County for many years. SCAAP reimburses state and local government agencies a portion of the costs to incarcerate undocumented criminal aliens who are convicted of felony offenses. Indirect costs are not recoverable since only staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates are allowable in the calculation. 18. EXEMPTION TO THE CAPITAL PURCHASING FREEZE AND A ONE-TIME ADDITION TO THE COUNTY FLEET Approve an exception to the FY 2012 capital purchasing freeze and a one-time addition to the fleet of 14 vehicles to be purchased by the Adult Probation Department for a total cost not-to-exceed $310,000. The vehicles include 12 to be purchased from operating savings from the Adult Probation General Fund (100) and 2 to be purchased from operating savings from the Adult Probation Detention Fund (255). Also, approve an exemption from markings and issuance of non-governmental license plates per A.R.S. 38-538-03 because these vehicles will be used to provide surveillance of felony probationers, provide supervision of pretrial defendants and apprehend felony probation absconders. Markings are detrimental to the mission. These will be take home vehicles because surveillance and fugitive apprehension are not a regularly scheduled assignment with set hours. The vehicle information, including make, model, year, color, and VIN numbers will be provided to the Clerk of the Board upon approval of this agenda and purchase of the vehicles. Additional costs for operating expenses are estimated to be approximately $35,000 per fiscal year and will be absorbed in the Adult Probation General Fund and Detention Fund operating budgets. These vehicles will be retired at the end of their useful lives with no funding from the General Fund or Detention Fund for their replacement. The equipment will be utilized by various probation programs to provide surveillance and supervision of convicted felons residing in the community, supervision of pretrial release defendants and the apprehension of felony probation absconders. 49. ONE-TIME ADDITION OF VEHICLES TO THE FLEET Approve a one-time addition to the County fleet of four sports utility vehicles, valued at $30,000 each, and one trailer, valued at $5,000, for the purpose of providing staff transportation and hauling of equipment in order to collect air quality data and maintain 22 air monitoring sites located across the county. Funding for the four vehicles is provided by the US Department of Homeland Security (DHS) Biowatch grant (2006-ST-091-000003-06), which was approved by the Board of Supervisors on October 19, 2011 (item C-85-11-019-3-02). Funding for the trailer is included in the FY 2011-12 Air Quality (850) General Fund (100) budget. Annual operating and maintenance costs for the vehicles are estimated to be $2,500 per year for each vehicle, which will be funded by the grant. Annual operating and maintenance costs for the trailer are estimated to be $200 per year and will be funded by the Air Quality Department’s fee fund (504). A detailed, cross-referenced list of vehicle identification numbers is kept on file in the Clerk of the Board’s Office. Due to the expansion of the number of air monitoring sites that was requested by the US Department of Homeland Security, additional vehicles are required to provide necessary transportation of Air Monitoring staff to these sites to ensure the monitors are functioning correctly and to collect air samples as required by DHS. The trailer is required in order to haul air monitoring equipment, replacement parts, filters, and other supplies to these sites across the county. Funding for the vehicles was requested via the grant application process and was approved by DHS as noted in the grant award notice. (C-85-12-007-V-00)

F-5. SUPPLEMENTAL WATERSHED AGREEMENT NO. 3 FOR THE SPOOKHILL FLOOD RETARDING STRUCTURE REHABILITATION PROJECT Approve the Supplemental Watershed Agreement No. 3 for the Supplemental Watershed Plan for the Buckhorn-Mesa Watershed which is inclusive of the Spook Hill Flood Retarding Structure (FRS). Supplemental Watershed Agreement No. 3 identifies that Spook Hill FRS has been rehabilitated, with a new 100-year life commencing June 25, 2009. A Watershed Agreement is required by the Natural Resources Conservation Service (NRCS) project authorization process at the end of the planning phase of dam rehabilitation projects. The Watershed Agreement is an agreement between NRCS and the District for the specific dam rehabilitation alternative selected for final design and construction. The Watershed Agreement is not, however, a cost share agreement. The Supplemental Watershed Plan outlines the project costs and benefits as well as the measures that differ from the original Watershed Plan. Several non-emergency dam safety deficiencies were identified at Spook Hill FRS and the District, in conjunction with the Arizona Department of Transportation (ADOT), completed studies during the design of the Red Mountain Freeway (State Route 202) which analyzed modification to correct the deficiencies, maintain the flood control benefits to downstream properties, and comply with state dam safety requirements. The engineering design for the modifications was reviewed and approved by NRCS in 2006 and construction of the modifications was completed in 2009. This item impacts Supervisorial District 2. F-6. AMENDMENT TO IGA WITH DESERT RESEARCH INSTITUTE FOR RAINFALL INFILTRATION LOSSES Approve Amendment No.1 (Intergovernmental Agreement [IGA] FCD 2010A015A) to IGA FCD 2010A015 for the Desert Soil Hydraulic Characterization Project For Rainfall Infiltration Losses between the Desert Research Institute (DRI) and the Flood Control District of Maricopa County (District), changing the 2011 Work Plan project completion date from October 31, 2011 to December 31, 2011. This Amendment extends the completion time for the initial work plan and grants the Chief Engineer and General Manager of the District the authority to increase District funding for the Agreement to a maximum of $320,000 ($80,000/year for the final four years). This Amendment No.1 shall become effective when executed by all parties. This Agreement is a continuing professional relationship and cooperative activity between the District and DRI. The DRI will be responsible for completion of all work items under this IGA. The purpose is 1) to evaluate runoff potential and physically measure infiltration rates on a test watersheds in Maricopa County, 2) to develop Green and Ampt parameters using the measured data and compare the results with the District’s current method and a new method for estimating Green and Ampt parameters developed by the USDA Agricultural Research Service, and 3) to apply the developed parameters to test watersheds with the goal of updating the current District procedures for estimating rainfall infiltration. The results are expected to be published and may be used in refining the District’s current hydrologic methodology, if appropriate. The DRI is a recognized authority for water resource data collection and analysis in the arid southwest. The information generated by the DRI's ongoing work in conjunction with the U.S. Army Corps of Engineers is vital to the safety of Maricopa County residents, and to the continuing hydrologic studies performed by the District and the maintenance of its flood control structures. Of the District’s $80,000 cost share under this IGA, $36,409 was paid in Fiscal Year 2011; the estimated Fiscal Year 2012 cost to the District for the originally-authorized amount is the remaining $43,591. The District anticipates authorizing an additional contribution of $36,409 to be funded in Fiscal Year 2012 for Work Plan 2, for infiltration testing on a City of Scottsdale watershed to support ADMS/ADMPs in progress and forthcoming, and for updating the District’s Hydrology Manual. Payments are to be made monthly. This agenda item impacts all Supervisorial Districts. (C-69-11-026-3-01)
