The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions and stipulations. In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. This item was continued from the March 13, 2013 meeting. (C-44-13-085-M-00)

9. COURT AUTOMATION FEES Pursuant to A.R.S. §11-251.08, convene the scheduled public hearing, to solicit comments and consider the adoption of the Court Automated Services Fee Increase. Upon Board approval, this item will become effective March 27, 2013. A.R.S. §11-251.08 authorizes the Board of Supervisors (BOS) to adopt fees for any specific service the County provides to the public as long as that fee is attributable to and defrays the expense of the service for which the fee is assessed and the fee does not exceed the actual cost of that service. The Court requests a public hearing to authorize and approve an increase of $10 (currently $20) to the base Court Automated Services Fee (CASF) to a new amount of $30. The CASF was established by the BOS with agenda number C-38-98-010-7 and is assessed upon the filing of initial complaints and answers or responses, in all civil, family, probate and tax cases. Upon BOS approval the fee increase will be assessed on cases filed after BOS approval following the hearing required pursuant to A.R.S. §11-251.08. The proposed fee increase proceeds will be deposited by the Clerk of the Court (COC) into the Superior Court Special Revenue Fund 259 (SRF) for disbursement by the Court Presiding Judge with expenditure of funds subject to appropriation by the BOS. Increasing caseloads, case complexity, ongoing mandated court integration efforts and resulting staff workloads have created tremendous demands on the Court’s resources. To meet these demands, the Court continues to develop, improve and integrate case, financial and public access information management systems. The Court is seeking additional Court Automation Fund resources to support strategic technology projects, including consulting services, staff training and infrastructure requirements. Prime examples of these projects are: the enhanced use of technology for judges, commissioners and probation officers to perform their duties away from physical courtrooms and offices, specialized applications that allow the citizens of Maricopa County to interact and conduct business with the Court’s and Probation departments from home or intelligent devices and enhanced workflow and case processing timelines (business process improvements). The current $20 CASF collected is allocated between the Court and COC by an 87.5% and 12.5% distribution, respectively; the proposed new $30 CASF would adjust the allocation to a 91.67% and 8.33% distribution, respectively. The proposed increase to the SRF better reflects the actual cost of the services provided, and is essential to the Court’s continued success in providing high-quality court services to litigants, other government agencies, and the citizens of Maricopa County. 10. VICTIMS’ RIGHTS GRANT FUNDING FROM ARIZONA ATTORNEY GENERAL Approve receipt of FY 2012-2013 grant funds from the State of Arizona, Office of the Attorney General, in the amount of $529,600. These grant funds will support the direct costs of implementing victims’ rights laws pursuant to Arizona Revised Statues Title 13, Chapter 40 and Title 8, Chapter 3, Article 7 that impact prosecutorial agencies as an entity type. This agreement commenced July 1, 2012 and terminates on June 30, 2013. In accordance with FY 2013 Victims’ Rights Program Guidelines, Section IV, page 5, the grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the County Attorney’s FY 2013 composite indirect cost rate to be 14.2%, or $75,203. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $75,203. Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents related to this award. Grant revenues are not "local revenues" for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This award agreement is in the amount of $529,600. This award will ensure that victims of crime are notified of the progress of criminal proceedings. This grant will expire at the end of the agreement. There is no long-term expectation of continued funding for this grant; however, the County Attorney’s Office has been receiving grant funds from the Attorney General’s office for victim services since FY 96/97, the most recent award was for FY 11/12 in the amount of $529,600. 24. TRANSFER EXPENDITURE AUTHORITY FOR INTEGRATED CRIMINAL JUSTICE INFORMATION SYSTEM DISASTER RECOVERY AND REQUIRED STAFF REDUNDANCY Pursuant to A.R.S. § 42-17106B, authorize: 1) the transfer of $52,359 in FY2012-13 expenditure authority from Non-Departmental (472) Detention Fund (255) Contingency (4711) Operating (0000) to the Integrated Criminal Justice Information System Department (421) Detention Fund (255) Operating (0000) for a new Information Systems Architect position, and 2) the transfer of $784,236 in FY 2012-13 expenditure authority from Non-Departmental (472) Detention Fund (255) Contingency (4711) Non-Recurring/Non-Project (0001) to the Integrated Criminal Justice Information System Department (421) Detention Fund (255) Non-Recurring/Non-Project (0001) for the Disaster Recovery/Data Center Relocation project. ICJIS has maintained an extremely small technical staff since 2008. A new IS Architect is critically needed to allow for skill-set redundancy and for ongoing assistance with new projects and support of existing functionality. The Disaster Recovery/Data Center Relocation Project requires additional funding to ensure that ICJIS production infrastructure is re-built in a co-located facility with the Sheriff’s Data Center in the new Sheriff Headquarters building. The ICJIS functionality needs to be moved before the Sheriff’s Data Center is relocated, and that project is anticipated to start in the summer of 2013. The planned ICJIS relocation will occur at an opportune time in that its current infrastructure is aged and in need of replacement. The relocation project provides ICJIS with the perfect opportunity to purchase and transition to the next generation of IT infrastructure. The planned move allows ICJIS to be deliberate with overall architecture evolution, rather than reacting tactically as the aged equipment falls out of service. (C-56-13-009-M-00)

27. SOLE SOURCE CONTRACT WITH ARCADIS Approve a Sole Source Contract between Arcadis and Maricopa County through the Facilities Management Department, in the not-to-exceed amount of $850,000. The purpose of this Sole Source Contract is to Continue Project Management Services for the Hail Damage Project. This Sole Source Contract is effective from April 4, 2013 until May 1, 2014. Arcadis has been providing project management services to Maricopa County on the hail damage restoration project since 2010. It was anticipated that the hail storm restoration project would be completed on or before the expiration date of the contract. Due to the size, complexity of damage and a change in the contract delivery method required by the insurance carrier, the project will not be completed by April 3, 2013 which requires a continued need for these services. Arcadis has unique knowledge and experience specific to this project which cannot be obtained or duplicated without incurring significant additional expense and further delay if a new contractor was engaged on the project. Arcadis currently holds Maricopa County contract FMD-06-021 which will expire April 3, 2013. All renewal and extension options contained in the contract have been exercised and no further contractual options are available to continue to obtain these services from Arcadis. Maricopa County’s insurance carrier will pay Arcadis directly for this additional service which relieves the County from any additional financial burden. (C-70-13-017-3-00)
