18. GRANTEE AGREEMENT WITH ARIZONA EARLY CHILDHOOD DEVELOPMENT AND HEALTH BOARD (FIRST THINGS FIRST) Approve an Agreement between Arizona Early Childhood Development and Health Board (First Things First) (GRA-STATE-12-0434-01) and Maricopa County through the Office of Research and Reporting, in the not-to-exceed amount of $60,000. This Agreement is funded by a grant from Arizona Early Childhood Development and Health Board (First Things First) , (GRA-STATE-12-0434-01). The purpose of this Agreement is to conduct the 2011 Child Care Compensation, Credentialing, and employment of childcare providers in the state of Arizona Survey. This Agreement is effective from December 1, 2011 until April 30, 2012. The Departments indirect rate for FY12 is 18.4%. The grantor restricts indirect cost recovery to 10%. Recoverable indirect costs are estimated at $5,455 and unrecoverable costs are estimated at 4,582. The methodologies developed by R&R for conducting this survey have resulted in a continued demand for updated information relating to the child care industry in Maricopa County and the State of Arizona. This previous involvement and other considerations translate into savings for all Arizona Residents if R&R conducts the survey again this year. The data is used to support executive and legislative decision making related to the provision of child care in the state. The data collected is beneficial to the Maricopa County Human Services and Public Health agencies. (C-46-12-001-3-00)

19. PEAK PERFORMERS (SPOT AWARD) PROGRAM FY 2011-12 Approve the Peak Performers Program (also known as the Spot Award Program) as a continuing employee recognition program for FY 2011-12, with a maximum award of $50 per employee per event; for both General Fund and Non-General Fund departments, with total program cost of not-to-exceed $924,000: $477,900 General Fund and $446,100 Non-General Fund. The Peak Performers program was initially implemented in FY 1997-98. This program has proven to be a successful component of Maricopa County’s Performance Incentive Program. The purpose of this program is to allow departments to present spot awards throughout the course of the fiscal year to employees that have clearly demonstrated excellence on a project, task or function. The Peak Performers Program (also known as the Spot Award Program) is an employee recognition program for FY 2012. This program will allow both General Fund and non-General Fund departments to award deserving employees per the attached schedule. Non-General Fund departments will utilize available funds within their budget. Spot awards will only be able to be used two different ways: 1) given to employees within the department; and 2) used by the department for employee recognition events. If given directly to an employee, both the employee and the department will be responsible for paying their share of taxes and retirement for this benefit. Human Resources will work closely with all County departments to ensure compliance and accountability to this program. Departments choosing to participate in other employee recognition programs must obtain Board of Supervisors approval. The General Fund portion of $477,900 is budgeted in Dept (470) Fund (100) Org (4712) Operating (0000) Other Programs line item "Human Resources Peak Performers". The Non General Fund portion of $446,100 must be absorbed in the other funds budgets by department. A new on-line tracking system will be used to track the distribution of the cash awards, thus eliminating the administrative fee associated previously with the use of gift cards. The program will cover the period through June 30, 2012. (C-31-12-001-M-00)

S-1. CONSENT AND AGREEMENT REGARDING CONCESSION AGREEMENT Approve the "Consent and Agreement Regarding Concession Agreement" (the "Consent Agreement") among the Stadium District, AZPB FM Limited Partnership (the "Facility Manager") and Compass Group USA, Inc., a Delaware corporation (“Compass”), which has an effective date of April 1, 2011. Through the Consent Agreement, the District consents to the “Second Amended and Restated Concession Agreement” (the "Second Restated Agreement") between the Facility Manager for Chase Field and Compass, dated as of April 1, 2011, which amends, restates and replaces the Amended and Restated Concession Agreement dated July 12, 2000 (the First Restated Agreement”) to which the Stadium District previously consented (C78-01-001-1)(C6788). Compass is the parent corporation of Restaurant Associates, Inc., the concessionaire under the First Restated Agreement. Through the Second Restated Agreement, Compass now directly contracts with the Facility Manager to provide concession services at the Stadium through its subsidiary, Levy Premium Foodservice Limited Partnership, an Illinois Limited Partnership. The Facility Management Agreement dated March 20, 1996 which governs the management of Chase Field requires the Facility Manager to contract for concession services at the Stadium. The Stadium District is not a direct party to that contract but is a third party beneficiary to provisions that affect the District, and such provisions cannot be amended without Stadium District consent. The Facility Manager and Compass have now revised the Concession Agreement in various ways, but the interests of the Stadium District have been maintained and protected in the Revised Agreement. One change in the Revised Agreement that was added at District Staff request was to incorporate provisions governing concession sales and profit allocation for Day Use activities at the Stadium, which is now a Stadium District responsibility assigned to the District's Booking Manager. These Day Use concession sale provisions had been set forth in a separate agreement between the Booking Manager and the Concessionaire. District Staff and the Booking Manager felt it beneficial to bring those provisions into the Concession Agreement. Approval of the Consent Agreement provides the Stadium District's consent to the Second Restated Agreement. (C-68-12-009-3-00)

AMENDMENT TO IGA WITH MARICOPA COUNTY HUMAN SERVICES DEPARTMENT FOR THE ACQUISITION OF A MULTI-FAMILY PROPERTY THROUGH THE NEIGHBORHOOD STABILIZATION PROGRAM Approve Resolution No. 11-047 and adopt Amendment No. 1 to the Intergovernmental Agreement ( IGA) between Housing Authority of Maricopa County (HAMC) and Maricopa County Human Services Department (County). The amendment decreases the funding by $279,045.34 from $1,506,670, to $1,227,624.66 because HAMC only acquired the property. The amendment thereby completes any HAMC obligation within the agreement. Pursuant to the CHANGES clause, page 2 Section F, paragraph 2, Special Provisions, "Change orders shall not increase or decrease the Operating Budget Total without written approval of both Parties." HAMC and The County mutually agree that the stated purpose of the IGA is achieved. The purpose was for the HAMC to acquire the property and transfer it to Arizona Housing Inc. "for the purpose of rehabilitation and management/operation of permanent supportive housing." The Parties to this IGA acknowledge the attorneys involved in preparing this Agreement are both employed by the Maricopa County Attorney's Office and have acted ethically on behalf of the Parties to this Agreement. The Parties do hereby consent to such representation and will not raise this representation as an issue in any dispute between the Parties or in any arbitrating proceedings or before any court of competent jurisdiction.
