If at any time the property, applicant or operations are not in full compliance with all ATF, HS or CBP requirements or if the applicant uses the property for commercial recreational and sporting purposes (such as charging a fee to allow members of the public to target practice or otherwise use the property), the zoning may be scheduled for public hearing by the Maricopa County Board of Supervisors (Board), upon recommendation by the Maricopa County Planning and Zoning Commission (Commission), to consider revocation of zoning. f. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. 32. EXCEPTION TO MULTILINGUAL PAY POLICY Approve an exception to the Multilingual Pay Policy (B7005) and allow Head Start/Early Head Start employees who were receiving journey level multilingual pay prior to their contracts ending at the end of FY 2016 due to a change in funding and who were rehired in FY 2017 to receive multilingual pay on their rehire date without retaking the multilingual pay test. The Multilingual Pay Policy states “An employee who has or is receiving journey level multilingual pay must retake the journey level test b) If reinstatement of multilingual pay is desired when the employee leaves County employment and subsequently returns.” The policy also states “Unless otherwise specified, the effective date for the implementation of journey level multilingual pay will be the first day of the next pay period after the employee passes the journey level test.” Because the separation was temporary due to a change in funding, Human Services would like to request this exception. This would reduce the time and resources needed for these employees to retake the journey level multilingual pay test that they already passed. (C-22-17-024-6-00)

44. IGA WITH CITY OF GLENDALE FOR THE EXCHANGE OF SERVICES(ENTENTE) Approve the Intergovernmental Agreement between Maricopa County and the City of Glendale for the exchange of services or reimbursement of services (Entente). The term of the Agreement will not exceed five years unless extended by appropriate actions by the County and the City. Either party may terminate this Agreement at any time prior to the expiration date of this Agreement by furnishing the other party with a thirty (30) day written notice. The purpose of this Intergovernmental Agreement is to identify and define both Parties’ respective roles in the execution of the responsibilities of specific maintenance tasks in areas that cross jurisdictional boundaries. The Agreement provides the opportunity to focus on routine maintenance tasks or emergency highway projects and the availability of the most economical resources by extending beyond jurisdictional or geographical boundaries. The application of the Agreement will benefit areas in the County and the City where certain types of routine maintenance or emergency highway project activities could be completed by the other party based on scheduled work within the area. Individual tasks performed by either party will be executed upon completion of a Letter of Agreement (LOA) approved and signed by the County Department of Transportation Director and the City Manager, or their designees. If the value of goods or services exchanged by the Parties is not of equal value, the total aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If no services are exchanged, there is no financial impact. An accounting mechanism will be utilized to track each LOA, as applicable, to identify specific tasks and services and to ensure the exchange of these services is of similar value. 47. AQ-2016-003-RULE 280 (PROPOSED FEES) Pursuant to A.R.S. §49-479(b), set a public hearing for January 4, 2017 to solicit comments and consider the adoption of proposed amendments to Maricopa County Air Pollution Control Regulations Rule 280 (Fees). Following the public hearing, the Board is requested to adopt the proposed amendments to Rule 280 (Fees). Upon Board approval, this item will become effective January 4, 2017. Rule 280 establishes the fees charged to owners and operators of sources of air pollution. The Maricopa County Air Quality Department (department) is largely funded by a fee for service model by charging permit application fees, annual administrative fees, hourly fees for staff time to process Title V and Non-Title V permit applications and emission based fees. Revenues generated from fees cover the operating costs of several programs within the department. Currently, revenues generated by fees exceed the expenses of the fee funded programs within the department, resulting in a yearly positive balance in the department’s fee fund. The department is proposing dust control permit fee reductions in Rule 280 to balance fee revenues with the expenses of the department’s fee funded dust program. Rule 280 was last revised in 2010 and fees have been adjusted annually thereafter per the Consumer Price Index (CPI). The department is unable to revise the fee rule annually; therefore, fee adjustments are made annually per the CPI and a revised fee schedule is established annually. The revised fee schedule is posted annually on the department’s website. The department is proposing to update all of the Title V, Non-Title V and General Permit fees to the most current 2017 Air Quality Fee Schedule. In addition, the department is proposing to make several other revisions to update and improve Rule 280, including asbestos refunds options, accelerated permit processing, and expanded general permit options. L-3. AGREEMENT AMONG MARICOPA COUNTY AND JOSEPH ARPAIO, THE MARICOPA COUNTY SHERIFF AND THE MARICOPA COUNTY LIBRARY DISTRICT Approve the following Agreement among MARICOPA COUNTY (the “County”) and JOSEPH ARPAIO, THE MARICOPA COUNTY SHERIFF (“the Sheriff”) and the MARICOPA COUNTY LIBRARY DISTRICT. On July 22, 2016, United States District Judge G. Murray Snow, ordered the Sheriff to make complaint forms (“Complaint Forms”) widely available at locations around the County, including websites for the Sheriff and the County, the lobby of the Sheriff’s headquarters, each patrol District, and the County government offices. See Paragraph 242, Item No. 1760, Docket No. 2:07-cv-2513-PHX-GMS). Judge Snow also ordered the Sheriff to ask public library branches and the offices and gathering places of community groups to make these Complaint Forms available. The Sheriff has asked the County to assist him in complying with those Orders by granting him permission to work directly with building management of the various buildings and facilities addressed in them for the placement and maintenance of complaint forms (“Complaint Forms.”) Although the Sheriff, the County and the District agree that the County and District have no legal duty to comply with those Orders, the County and District are willing to cooperate with the Sheriff to assist him in his own compliance with the Order.
