A Plan of Development is approved subject to site plan entitled “Love’s Travel Stop,” consisting of 3 full-size sheets, dated August 27, 2026, and stamped received September 17, 2026. The Plan of Development may be amended administratively under separate application as long as the amendment complies with the established CUPD development standards as approved by the Board of Supervisors. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Love’s Travel Stop,” consisting of 14 pages, dated September 16, 2026, and stamped received September 17, 2026, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Traffic Study must be approved by MCDOT prior to issuance of any building permits. Conditions of approval for the traffic study must be addressed with building permits. 2. If ROW dedication is required by MCDOT, Applicant, at their own expense, must provide Maricopa County with Owner’s ALTA Title Insurance for ROW dedication prior to obtaining building permit approval. 3. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction permits. 4. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the drainage infrastructure. 5. Detailed Grading and Drainage Plans and a Final Drainage Report must be submitted with the application for Building Permits. d. The following C-3 CUPD standards shall apply but only for a travel center / truck stop use and ancillary uses: 1. Max. Freestanding Sign Area: 620 SF 2. Max. Freestanding Sign Height: 65’ 3. Max. Height of Site Lighting in Truck Parking Areas: 43’ 12. Min. Screening along North, West, and South Lot Lines: 5’ Vinyl Chain-Link Fence e. The CUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic or onsite wastewater treatment systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. f. Prior to issuance of building permits, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The owner shall submit construction permits to establish the land use and for site improvements as shown on the site plan and receive final inspection status from the Planning & Development Department Inspections Division establishing the use prior to the operation of business. Violation of this condition may be grounds for revocation as set forth in the Maricopa County Zoning Ordinance. h. Noncompliance with any of the conditions assigned to the approval of this Zone Change by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures set forth in the Maricopa County Zoning Ordinance. i. The property owners and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell, or possess the property, and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. 24. BUSINESS ASSOCIATE AGREEMENT WITH MERCY CARE FOR SERIOUS MENTAL ILLNESS (SMI) Approve the Business Associate Agreement with Mercy Care. The Maricopa County Attorney Office (MCAO) Diversion Strategies Group (DSG) has maintained a longstanding partnership with Mercy Care, the primary Managed Care Organization and Arizona Health Care Cost Containment System (AHCCCS) Complete Care health plan serving Maricopa County. MCAO administers a Serious Mental Illness (SMI) Diversion Program that requires a verified SMI designation for participant eligibility. For the past seven years, Mercy Care has granted MCAO DSG limited access to its portal to confirm SMI designations, a function critical to determining program suitability and supporting timely decisions by MCAO, defense counsel, and the courts. Throughout diversion, defendants undergo clinical assessments, receive risk‑based treatment planning, and receive coordinated care from their AHCCCS clinical teams. Mercy Care has recently advised MCAO DSG that its internal approval process for portal access has been revised and now requires a formal agreement to maintain continued access. (C-19-27-057-X-00)

25. REPLACEMENT WARRANTS - FELONY PRETRIAL INTERVENTION PROGRAM AND FELONY DIVERSION PROGRAM Approve the issuance of replacement warrants for county warrants related to the Felony Pretrial Intervention Program (FPIP) and Felony Diversion Program (FDP) that have been outstanding for more than two years. Necessary affidavits have been filed with the Board. FPIP and FDP provide an alternative to traditional prosecution and allow eligible individuals to participate in community-based education or treatment programs that promote long-term behavioral change. One requirement for successful completion is payment in full of all restitution to any victims. When restitution has been received, the Maricopa County Attorney's Office (MCAO) issues a warrant to the victim. Unfortunately, in some cases, warrants are returned to MCAO or remain uncashed because of an address change or an incorrect address on file. The MCAO Investigations Division has located current contact information for eight victims who were issued warrants after October 13, 2020, and whose warrants remain outstanding. MCAO requests the issuance of replacement warrants to these victims in the amount of $11,613.42. These funds will directly benefit victims by making them financially whole. (C-19-27-058-X-00)

28. FFY27 GRANT FROM ARIZONA DEPARTMENT OF PUBLIC SAFETY FOR MCAO GANG AND VIOLENT CRIME ADVOCACY PROGRAM - STATE FUNDING Approve the application and acceptance of grant funds from the Arizona Department of Public Safety (DPS), Victims of Crime Act, Victim Assistance Grant Program, in the amount not to exceed $127,159.00 for the purpose of the Maricopa County Attorney's Office (MCAO) Gang and Violent Crime 2026 Advocacy Program. The grant award begins on October 1, 2026, and ends on September 30, 2027. Authorize the Chair to sign all documents related to these grant funds, as applicable. Victims of Crime Act (VOCA) Victim Assistance grants are awarded once per federal fiscal year, and the Maricopa County Attorney’s Office has received this competitive funding annually since FY2000. In FFY26, DPS funded the project with 100 percent federal funds. Due to a reduction in available federal funding for FFY27, the grantor split our award equally between federal and state funds. This allocation structure allows MCAO to receive the same total funding amount in FFY27 as in FFY26, ensuring the project continues at the prior year's funding level. The department has a cash-equivalent match requirement of $31,790.00 and sufficient general fund resources to meet it. The Maricopa County Attorney’s Office's indirect rate for FY27 is 21.720%. The grantor allows up to 15% for indirect cost recovery, but due to budget award constraints, $0 was allowed for this award. Total grant indirect costs are estimated to be $27,618.93, with $0 recoverable and $27,618.93 not recoverable. MCAO has general fund resources to provide indirect costs. Grant revenues are not local revenues for the purpose of constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This funding does not require future contributions. This grant provides critical funding for our victim advocates so they may work to ensure Maricopa County victims of crime receive each of the services mandated by the Arizona Constitution and the Crime Victim’s Bill of Rights. AGREEMENT WITH THE MARICOPA COUNTY DEPARTMENT OF EMERGENCY MANAGEMENT FOR SECURING THE CITIES (STC) FY27 FUNDING Approve the Agreement and acceptance of grant funds to the Sheriff’s Office (Subrecipient) from the Maricopa County Department of Emergency Management (County), Securing the Cities (STC) in the amount of $187,102 for the award period beginning July 1, 2026, and terminating on June 30, 2027. This Agreement may be terminated immediately by the County upon written notice to Subrecipient due to loss or reduction of Federal grant funds. Both the County and the Subrecipient may terminate, in whole or in part, as set forth in 2 CFR §200.340. The purpose of the award is to prevent the successful possession, movement, and deployment of a nuclear or radiological weapon and component materials by an adversary within Maricopa County by enhancing the nuclear detection capabilities of the county and local agencies. Funding will be used to cover personnel costs (regular and overtime salaries) of the Maricopa County Sheriff’s Office (MCSO) employees participating in DEM’s training events and MCSO’s personnel costs to cover the normal duty posts of those participating in the training events. On January 26, 2022, the BOS approved the Memorandum of Understanding (MOU) between Maricopa County Securing the Cities Program through the Department of Emergency Management (DEM) and the MCSO in connection with the Securing the Cities (STC) Program for Maricopa County (C-5-22-094-X-00). The Sheriff’s Office indirect cost rate for FY27 is 25.38%, applicable to the award amount of $187,102 with no capital expenses for an indirect cost base of $187,102 and indirect costs of $47,486.49. Indirect costs will be absorbed by the General Fund. This is not a mandated function although it supports the MCSO public safety mandate. The Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro area that participate in this effort. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law.
