33. AMENDMENT TO TWO-YEAR LOCAL WORKFORCE INVESTMENT PLAN 2008-2010 FOR MARICOPA WORKFORCE CONNECTIONS ACTIVITIES Approve a non-financial amendment to the Two-Year Local Workforce Investment Plan 2008-2010 (C-22-08-189-M) for Maricopa Workforce Connections (MWC). Arizona Department of Economic Security (DES) issued a Guidance Letter clarifying the definitions of “Limited” and “Unlimited” funding as they pertain to the disbursement of Workforce Investment Act (WIA) training funds. The existing MWC Two Year Plan does not conform to those definitions set forth by DES. Technical changes to the Two-Year Local Workforce Investment Plan 2008-2010 in the ‘Priority of Services’ area will ensure compliance with WIA guidelines. Maricopa County, exclusive of the City of Phoenix, is a designated Local Workforce Investment Area (LWIA) under the federal WIA Title, 1B Federal Grant program of 1998. As a LWIA, Maricopa County enters into Intergovernmental Agreements (IGAs) with DES for WIA activities administered by the Human Services Department Workforce Development Division, Maricopa Workforce Connections. At the direction of the U.S. Department of Labor, DES oversees Arizona’s WIA state plan. (C-22-08-189-M-02)

38. SALE OF MODULAR BUILDING TO CATHOLIC CHARITIES COMMUNITY SERVICES FOR USE AS A HEAD START CLASSROOM Pursuant to A.R.S. 11-251-9, approve the sale to a qualifying non-profit for one dollar of a County owned 24’X60’ double-wide modular building located at 201 E. Centre, Buckeye, Arizona, via quitclaim deed to Catholic Charities Community Services, a 501c(3) tax exempt, non-profit corporation which is a sub-recipient (delegate agency) to Maricopa County’s federal Head Start grant. This action was reviewed and approved by the Facility Review Committee on March 25, 2010. Due to the age and depreciation of the modular building, the depleted value, and the tenant improvements that have altered the original design, this building has no value and would create a negative cost to the County to dispose of the structure. The County is unable to locate a VIN number on the modular or the Title to the building. Therefore, Facilities Management has determined that the most cost efficient way to dispose of the modular building is to pass all interest, rights, and obligations via quitclaim deed to the user, Catholic Charities Community Services, for use as a Head Start classroom. THIS ITEM REQUIRES A UNANIMOUS CONSENT OF THE BOARD . (C-22-10-070-D-00)

F-3. IGA FOR DETAILED PRE-APPLICATION REVIEWS BY ARIZONA DEPARTMENT OF WATER RESOURCES Approve Intergovernmental Agreement (IGA) FCD 2010A006 for detailed pre-application reviews by the Arizona Department of Water Resources (ADWR) of Flood Control District of Maricopa County (District) dam safety rehabilitation and modification projects. The estimated cost of this IGA is $96,000, with options for up to two one-year extensions at up to $176,000 per one-year extension. The IGA shall be effective once it has been executed by both parties, may be terminated by either party, and shall expire after June 30, 2011 unless the option to extend is implemented. ADWR is the jurisdictional agency for the 23 flood control dams managed by District. Six projects are currently in various stages of design for overall rehabilitation or modification. These projects are traditionally funded by the District and, where applicable, federal partners. By law the District must obtain “a permit to construct” from ADWR for any rehabilitation, repair, alteration or modification of the flood control dams managed by the District. Also by law, the District must provide 100% complete construction plans and specifications and supporting design documents for formal application of the ADWR “permit to construct”. In order to minimize schedule delays and increased dam rehabilitation and dam modification re-design costs due to revised design requirements by ADWR after designs are completed, the District has requested that ADWR review designs as they progress and provide input during the design process rather than beginning ADWR reviews only when all design documents are fully completed. ADWR has indicated that while they recognize that such advance reviews by ADWR would significantly benefit all involved in the process, they do not have staff resources available to perform such advance reviews. The purpose of this IGA is to implement a pre-application review process with ADWR for District dam safety projects such that the District would reimburse ADWR for costs incurred for pre-application reviews during the design process. The estimated total cost of the pre-application reviews for the District dam safety projects is $448,000, assuming both one year extensions are implemented, to be fully funded by the District through ADWR invoices and subsequent District reimbursements to ADWR. This Agenda Item impacts Supervisor Districts 1,3,4 and 5. (C-69-10-071-3-00)
