7. APPLY AND ACCEPT GRANT FUNDING FOR HEALTH AND HUMAN SERVICES, ELECTION ASSISTANCE FOR INDIVIDUALS WITH DISABIITIES Authorize the Election's Department to submit application for grant funding for the State Subgrants for Health and Human Services (HHS), Election Assistance for Individuals with Disabilities (EAID) program administered by the Secretary of State, and authorize the Chairman to approve receipt of any and all such funds awarded. The funding will support the Department's Help America Vote Act of 2002. The total amount of funds requested is $58,322. The grants must be completely drawn down by September 30, 2014. The department's indirect cost rate is 37.3%. Since the grant funds are being used to purchase ADA compliant mailing supplies, Braille related materials, and provide for ADA training, indirect costs ($21,754.11) are unrecoverable, and no matching dollars pertain to the grant. Grant revenues are not "local Revenues" for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This budget request does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-21-11-009-G-00)

22. APPLY AND ACCEPT GRANT FUNDS FROM EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/ DRUG ENFORCEMENT ACCOUNT Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/ Drug Enforcement Account (DEA) in an amount not-to-exceed $443,925 for the Office of the Public Defender (520) portion. The original requested budget amount for this grant was $445,651 through the normal annual budget process. However, this amount has been decreased due to communications with the Arizona Supreme Court/Administrative Office of the Courts (AOC) with regards to FY2011-12 funding availability. This grant is a recurring grant administered by AOC. The Office of the Public Defender applies for this grant jointly with Adult Probation, Clerk of the Superior Court, and Superior Court. These funds support the justice system by providing staff in all of these departments. In FY 2010-11, this grant funds 25 full-time equivalent positions countywide. The Office of the Public Defender is requesting authorization to again apply for the DEA Grant for FY2011-12. The grant award begins on July 1, 2011 and ends on June 30, 2012. However, the application for funding has historically been received after the start of the applicable fiscal year and with extraordinarily short turnaround time requirements. Therefore, the Office of the Public Defender is requesting advance approval to apply for the departmental share of these funds through a joint application with the Superior Court, Clerk of the Superior Court, and Adult Probation. The grant does not allow for the recovery of indirect costs in FY 2010-11, and no change is anticipated in future years. Therefore, the Office of the Public Defender and Maricopa County may receive no administrative cost recovery for this grant in FY 2011-12. The Maricopa County Department of Finance has calculated the Office of the Public Defender's composite indirect cost rate at 6.5%. The non-recoverable indirect cost will not exceed $28,856. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law.
