(in the Tonopah area) Site Size: Approx. 960 acres Commission Recommendation: By a vote of 7-0, recommended approval subject to conditions ‘a’ – ‘aa’ as follows: [The conditions below reflect the Commission’s action and have been revised and renumbered accordingly.] a. Development shall comply with the Development Master Plan document entitled “Desert Whisper Development Master Plan”, a bound document, dated January 30, 2008 and stamped received April 28, 2008, including all exhibits, maps, and appendices, except as modified by the following stipulations. b. Changes to the Desert Whisper Development Master Plan with regard to use and intensity, or changes to any of the stipulations approved by the Maricopa County Board of Supervisors, shall be processed as a revised application with approval by the Board of Supervisors upon recommendation by the Maricopa County Planning and Zoning Commission. Revised applications shall be in accordance with the applicable Development Master Plan Guidelines, subdivision regulations, and zoning ordinance in effect at the time of application(s) submission. The Maricopa County Planning and Development Department may approve minor changes administratively as outlined in the Maricopa County Development Master Plan Guidelines in effect at the time of amendment. Non-compliance with the approved Desert Whisper Development Master Plan narrative report, maps, and exhibits, or the stipulations of approval will be treated as a violation in accordance with the provisions of the Maricopa County Zoning Ordinance. c. The applicant shall submit a written report every five years from the date of Board of Supervisors approval of DMP2013003 which details the status of this project, including progress on obtaining necessary entitlements, licenses, and permits; compliance with the conditions of approval; compliance with the approved narrative report; compliance with the approved land use plan; and justification as to how the approved land use plan still represents appropriate land use planning for the property and unincorporated Maricopa County in accordance with the goals and policies in its comprehensive and applicable area plan. This report shall be scheduled for public hearing by the Maricopa County Board of Supervisors (Board), upon recommendation by the Maricopa County Planning and Zoning Commission (Commission), to consider whether the planning justification for this DMP is still present, and whether the land use designations associated with this DMP still represent appropriate and better long-term land use planning in accordance with the goals and policies of the Maricopa County Comprehensive Plan and applicable area plan. If the Board rescinds this DMP and reverts the current land use designations back to Rural (0-1 du/ac), all entitlements associated with this project that were conditional pursuant to the Maricopa County Zoning Ordinance may also be considered by the Board, upon recommendation by the Commission, for reversion to the prior entitlements. In such an event, the comprehensive plan land use map, area plan land use map, and, as applicable, zoning map shall be altered to reflect Board action. d. Prior to approval of any zone change, the master developer shall enter into a development agreement with Maricopa County. All irrigation water supplied for common/open space areas and/or lakes over ten (10) acres in size shall be provided entirely by a renewable supply of water, such as treated effluent, surface water, or Central Arizona Project (CAP) water, within five (5) years after issuance of the first building permit. Interim water for the purposes noted may be supplied by groundwater and shall comply with all Arizona Department of Water Resources regulations. Proof of conversion from groundwater to a renewable water supply shall be provided to the Maricopa County Planning and Development Department within the five year requirement. i. All plats shall be submitted with appropriate and detailed model to reflect the existing and proposed development conditions. 3. Hydrology analysis for this development is dependent on the conditions of upstream area around Central Arizona Project. Luke Air Force Base executes over 200,000 flights per year, at an average of approximately 170 over flights per day. Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range, and other flight training areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 A.M. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends.” Such notification shall be permanently posted in front of all home sales offices on not less than a 3 foot by 5 foot sign, be permanently posted on the front door of all home sales offices on not less that an 8½ inch by 11 inch sign, be included in all covenants, conditions, and restrictions (CC&Rs) and be included in the public report. x. Prior to any zoning change, the applicant shall submit to the Maricopa County Planning and Development a “will serve” letter and an approved Certificate of Convenience and Necessity (CC&N) from the Water Utility of Greater Tonopah which demonstrates a willingness and capability to serve the entire Desert Whisper Development Master Plan. y. The Desert Whisper Development Master Plan is not a protected development right plan. aa. At the time each residential building permit is issued, two-hundred fifty dollars ($250) per residential unit will be paid by the developer to a park enhancement fund for trails and facilities enhancement and maintenance. The county shall deposit and hold all receipts in the parks special revenue fund for the specific purposes stated above. All interest earned on the fund shall remain an asset of the fund. The assets of this fund are not intended to replace existing county appropriations for similar purposes, but rather are intended as supplemental resources resulting from additional park usage by desert whisper residents. Details regarding this assessment are to be addressed in the development agreement. (C-44-13-107-M-00)

CONTRACT PURSUANT TO SOLE SOURCE WITH TEMPE COMMUNITY ACTION AGENCY FOR CRISIS CASE MANAGEMENT AND FINANCIAL ASSISTANCE SERVICES Approve a sole source Contract with Tempe Community Action Agency, a non-profit Arizona corporation, and Maricopa County in the amount of $169,077.00, and authorize the Chief Procurement Officer to sign all contract-related documents on behalf of Maricopa County. The Contract term is effective from July 1, 2013 to June 30, 2014. The resulting Contract Pursuant to Sole Source is between Tempe Community Action Agency (TCAA) and Maricopa County, administered by its Human Services Department (MCHSD). The purpose of this Contract is to award funds to TCAA for the delivery of Crisis Case Management and Financial Assistance Services within the Central East Community Service Area, which includes the Tempe city limits and Fountain Hills. This Contract will renew the partnership with TCAA for one additional year and incorporates an updated Work Statement from TCAA regarding its policies and procedures for implementing these services. Expenditures totaling $102,407 under this Contract will be reimbursed from an Intergovernmental Agreement (C-22-10-083-3-08) with the State of Arizona’s Department of Economic Security (DES # DE111071001), which was approved by the Board of Supervisors on July 17, 2013. The remaining $66,670 will be paid from HSD’s appropriated general funds. This Contract does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. A Solicitation was issued by Maricopa County’s Office of Procurement Services (OPS) in April 2013 for all pertinent Community Service Areas in need of non-profit corporate providers. Although TCAA met the proposal content requirements, the submission was past the legal notice deadline. The TCAA proposal response was the only submission for that Community Service Area. Based on the more than 30 year sub-contractor relationship with MCHSD, and to ensure timely & continued services to the residents of the area, OPS management made the decision to not reissue the solicitation and to issue a sole source contract. 33. REVISIONS TO HEAD START ZERO-FIVE POLICY COUNCIL BY-LAWS AND OPERATING PROCEDURES Approve revisions to: a. The Maricopa County Head Start Zero-Five Policy Council Bylaws, b. Policy Council Parent Representative Election Procedure (11.05), and c. Policy Council New Hire Procedure (11.02) regarding parent involvement for the new hire committee. Revisions are in accordance with Section A3 of the Memorandum of Understanding between the Maricopa County Board of Supervisors and the Maricopa County Head Start Zero – Five Policy Council (C-22-12-028-M-00 approved October 19, 2011). The bylaw revision modifies Article 3 Membership and Duties, Section 3.1A Membership, in revising the By-Laws by: changing the number of parent representatives per cluster (a cluster is a group of classrooms organized by program type and geographic location) based on the number of children served within each cluster of sites or program options. The change is to add an additional representative for clusters that have enrollment larger than 250 children to address the reduction in policy council members that occurred due to sequestration budget cuts. The revision to the election procedure is to address changes to the election process that includes the bylaw change and to utilize the technology available currently to the program. The revision to the new hire procedure changes the process of involving parents in the hiring process to include a review of hiring decisions when parents cannot be included in the initial hiring decision. The Policy Council has reviewed and approved these changes at the June 28, 2013 Policy Council meeting. These changes will become effective upon approval by the Board of Supervisors. This action is non-financial and will not affect the County General Fund. This revision to the membership section of the bylaws is to add representatives to the policy council to replace the members lost using the existing formula in determining representation. Due to the sequestration cuts the number of center based clusters (classroom groups) was reduced from four to three with each cluster growing larger. To retain the same proportionate representation by program type, the number of representatives for these larger clusters was increased to maintain the same number of policy council members from the previous year. The revision to the election procedure was required due to the bylaw change to address the revision to the process of selecting representatives. At this time we also addressed changes to the election process to utilize electronic systems available to the program to provide more convenient access to the parents participating in the voting process. The revision to the new hire procedure was to provide an alternative way for parents to remain involved in the hiring decision when they were unable to be included in the original interview processes. Timely replacement of classroom staff is required for our program to adhere to licensing and federal performance standards. Both the Board of Supervisors and the Head Start Policy Council must approve the Policy Council Bylaws as required by the Head Start Act Section 642.c(1)(E)(iv)(VI). The Maricopa County Head Start Zero-Five Program Policy Council approved this By-Law revision at the August 26, 2011 Policy Council meeting. (C-22-14-005-6-00)

76. SET A PUBLIC HEARING FOR AMENDMENT TO RULE 100 Pursuant to A.R.S. §49-479(b), set a public hearing for September 25, 2013 to solicit comments and consider the adoption of proposed amendments to Maricopa County Air Pollution Control Regulations, Rules 100 (General Provisions and Definitions). Following the public hearing, the Board is requested to adopt the proposed amendment to the rule and to submit the amended rule as a revision to the (Arizona) State Implementation Plan (SIP ). Upon Board approval, this item will become effective September 25, 2013. This is a text amendment to add to one sentence in Rule 100 (General Provisions and Definitions), Section 108 (Hearing Board) the requirement that County Air Quality Hearing Board members not have a substantial interest in any person required to obtain an air pollution permit or subject to enforcement orders issued under the Maricopa County Air Pollution Control Regulations. This amendment is intended to resolve the U.S. Environmental Protection Agency’s (EPA’s) disapproval of the 2009 Infrastructure State Implementation Plan (SIP) - a deficiency in a SIP revision submitted by the State of Arizona to address the requirements of section 110(a)(2)(E)(ii) of the Clean Air Act for the 1997 8-hour ozone national ambient air quality standards (NAAQS) and the 1997 and 2006 NAAQS for fine particulate matter (PM2.5). 77. SET A PUBLIC HEARING ON AIR QUALITY RULE DEFINITION REVISIONS Pursuant to A.R.S. §49-479(b), set a public hearing for September 25, 2013 to solicit comments and consider the adoption of proposed amendments to Maricopa County Air Pollution Control Regulations, Rules 100 (General Provisions and Definitions); Rule 330 (Volatile Organic Compounds); Rule 33l (Solvent Cleaning); Rule 333 (Petroleum Solvent Dry Cleaning); Rule 334 (Rubber Sports Ball Manufacturing); Rule 335 (Architectural Coatings); Rule 336 (Surface Coating Operations); Rule 338 (Semiconductor Manufacturing); Rule 339 (Vegetable Oil Extraction Processes); Rule 340 (Cutback and Emulsified Asphalt); Rule 341 (Metal Investment Casting); Rule 342 (Coating Wood Furniture and Fixtures); Rule 343 (Commercial Bread Bakeries); Rule 344 (Automotive Windshield Washer Fluid); Rule 345 (Vehicle and Mobile Equipment Coating); Rule 346 (Coating Wood Millwork); Rule 347 (Ferrous Sand Casting); Rule 348 (Aerospace Manufacturing and Rework Operations); Rule 349 (Pharmaceutical, Cosmetic, and Vitamin Manufacturing Operations); Rule 352 (Gasoline Delivery Vessel Testing and Use); Rule 353 (Gasoline in Stationary Dispensing Tanks); Rule 358 (Polystyrene Foam Operations); and Appendix G (Incorporated Materials) . Upon Board approval, this item will become effective September 25, 2013. The definition of “non-precursor organic compound” and the definition of “volatile organic compound (VOC)” are proposed to be revised in 22 rules in the Maricopa County Air Pollution Control Regulations in order to incorporate the most current U.S. Environmental Protection Agency (EPA) definitions of each. The department is further proposing to list the EPA-recognized non-precursor organic compounds in Appendix G (Incorporated Materials). Non-precursor organic compounds are compounds that the EPA has determined make a negligible contribution to the formation of ground-level ozone. A consistent and current list of non-precursor organic compounds will benefit the department, sources and citizens of Maricopa County. It is to the department’s advantage to regularly update this list to provide sources alternatives to ozone creating VOCs as well as provide consistent application of the non-precursor organic compounds to all sources. It is to the source’s advantage to utilize the non-precursor organic compounds to reduce VOC emissions and the associated recordkeeping requirements. Citizens will benefit due to the reduction of ozone in our air. Although this rulemaking affects many rules and essentially any source that uses non-precursor organic compounds and VOCs, the rulemaking has been non-controversial. (C-85-14-003-7-00)

A-2. THE MARICOPA COUNTY BENEFITS PLAN THIRD AMENDMENT AND RESTATEMENT Approve the third amendment and restatement of the Maricopa County Benefits Plan document which governs how employee health and welfare benefits (such as medical, pharmacy, behavioral health, etc) are administered. This Plan document governs basic issues of plan eligibility, enrollment and payroll withholding pursuant to the Internal Revenue Code. This document does not define specific benefit programs, which are adopted annually by the Board of Supervisors in separate actions. This amendment and restatement consolidates two existing plan documents and makes technical corrections and updates to reflect current applicable laws and regulations, but does not include substantive changes to County benefit plans. This Maricopa County Benefits Plan (Third Amendment and Restatement) amends and consolidates the Maricopa County Cafeteria Plan (Second Amendment and Restatement) and the Maricopa County Accident and Health Insurance Plan (Third Amendment and Restatement) into one Plan effective July 1, 2013. The Benefits Plan incorporates recent changes to federal law and benefits changes previously approved by the Board of Supervisors. The changes were reviewed with the Maricopa County Benefits Board of Trustees. As stated in the plan document, effective January 1, 1985, the Board of Supervisors of Maricopa County, Arizona, adopted the Maricopa County Cafeteria Plan, pursuant to section 125 of the Internal Revenue Code (the Code), in order to establish a “cafeteria plan” to provide to the County’s employees certain health, welfare and other benefits. The County also adopted and established certain other benefit plans which, subject to the eligibility requirements set forth in each plan, became available to the County’s employees for the purpose of providing the benefits described therein. Effective as of January 1, 1988, the County also amended and restated the Dependent Health Care Payment Plan in its entirety by adopting the Maricopa County Accident and Health Insurance Plan. Effective as of January 1, 2006, the Cafeteria Plan and the Maricopa County Accident and Health Insurance Plan were amended and restated to incorporate all prior amendments made to those Plans since their original Effective Date. Effective June 22, 2011, the Second Amendment and Restatement of the Cafeteria Plan and the Third Amendment and Restatement of the Maricopa County Accident and Health Insurance Plan were implemented. F-2. SUPPLEMENTAL WATERSHED AGREEMENT FOR THE POWERLINE FLOOD RETARDING STRUCTURE Approve the Supplemental Watershed Agreement FCD 2013A005 for the Supplemental Watershed Plan / Environmental Assessment for the Powerline Flood Retarding Structure. A Supplemental Watershed Agreement is required by the Natural Resources Conservation Service (NRCS) project authorization process at the end of the planning phase of dam rehabilitation projects. The Supplemental Watershed Agreement is an agreement between NRCS and the local sponsors, which are the Flood Control District (District) and the East Maricopa Natural Resources Conservation District. This Supplemental Watershed Agreement allows for the specific dam rehabilitation alternative that has been selected to move forward to final design and construction. In addition, the Supplemental Watershed Agreement outlines the intended project cost share participation by NRCS and the District, authorizes NRCS to seek federal funding for the project and provides formal notification that the District is ready, willing, and able to proceed with the project. The Supplemental Watershed Agreement is not, however, a cost share agreement. This term of this agreement is for the installation period and evaluated life of the project (103 years). The Powerline Flood Retarding Structure (FRS) is one of three earthen flood retarding structures (Vineyard Road FRS and Rittenhouse FRS are the other two) located in northwestern Pinal County, east of the Central Arizona Project (CAP) canal and south of Baseline Road. The Powerline, Vineyard Road, and Rittenhouse FRSs Rehabilitation or Replacement Project (Project) was a District sponsored planning study which analyzed alternatives and selected a preferred alternative that would; correct the dam deficiencies, maintain the flood control benefits to downstream properties, and comply with state dam safety requirements. The selected alternative for Powerline FRS involves replacing Powerline FRS with a channel system that discharges into the Vineyard Road FRS flood pool. The Powerline FRS is a structural plan element of the Apache Junction-Gilbert Watershed Work Plan. Therefore a Supplemental Watershed Plan and Environmental Assessment (Plan/EA) was prepared that presents the alternatives evaluated and the preferred alternative for Powerline FRS. A separate Supplemental Watershed Plan/EA and Supplemental Watershed Agreement have also been prepared for the Vineyard Road FRS and Rittenhouse FRS as these two dams are structural elements of the Williams-Chandler Watershed Work Plan. The District has also coordinated with and obtained input on the PROJECT from the Arizona State Land Department (ASLD), local stakeholders and the public. This item impacts Supervisorial Districts 1 and 2. (C-69-14-003-3-00)

The Vineyard Road and Rittenhouse FRSs are structural plan elements of the Williams-Chandler Watershed Work Plan.
