21. WITHDRAW MARICOPA COUNTY AIR POLLUTION REGULATION FOR EXCESS EMISSIONS FROM THE STATE IMPLEMENTATION PLAN Approve Maricopa County Air Quality Department (MCAQD) to withdraw Rule 140 (Excess Emissions) of the Maricopa County Air Pollution Control Regulations from the (Arizona) State Implementation Plan (SIP). Maricopa County Air Pollution Control Regulation Rule 140 grants sources an affirmative defense if there are emissions in excess of an applicable emissions limitation due to malfunction, startup and shutdown. Rule 140 is currently in the (Arizona) SIP, and locally and federally enforceable. In May 2015, the Environmental Protection Agency (EPA) determined that affirmative defenses should not be allowed in the SIP. MCAQD has until November 2016 to withdraw Rule140 from the SIP. To comply with the EPA’s deadline, the MCAQD is requesting the Board of Supervisors approve the withdrawal of Rule 140 from the SIP. Rule 140 would remain locally enforceable and not be federally enforceable. Upon the Board’s approval, the MCAQD will request the Arizona Department of Environmental Quality (ADEQ) to submit to the EPA a request to withdraw Rule 140 from the SIP. ADEQ has a similar excess emissions/affirmative defense rule; currently locally and federally enforceable. ADEQ will be requesting the EPA to remove their rule from the (Arizona) SIP. Permit fees are not changing due to this action. (C-85-16-009-M-00)

39. PUBLIC FIDUCIARY REQUEST FOR REVIEW OVER BASELINE Approve an exception to FY2017 Budgeting Guidelines and Priorities allowing the Office of Management & Budget to review the following request over baseline: • $352,431 expenditure increase to personnel services for four new Fiduciaries assigned primarily to front-end case administration and stabilization, along with the addition of one support position • $200,871 revenue increase for additional fees anticipated as a result of the increased positions • The net increased impact is $151,560. Currently, the Public Fiduciary caseloads are too high to be maintained. The Office of the Public Fiduciary is mandated to limit the fiduciary caseload to a size that allows each fiduciary acting as a guardian to accurately and adequately support and protect the person under his/her care. This includes a minimum of one visit per month with each person and regular contact with all service providers. The current staff-to-client case ratio is 1:77 and includes both guardianship and conservatorship appointments. The standards governing the fiduciary industry recommend caseloads not exceed 1:40. Client visitation, assessment, and monitoring services are only performed once within a quarter as a result of the high client-to-staff ratios. The additional staffing requested will allow for better service to the clients, more timely responses, and will reduce the potential for liability. The Public Fiduciary is able to collect revenue only when a client’s accounts are sufficient to fund it after the client’s needs have been met. By better staffing front-end case management to obtain client entitlements, the Public Fiduciary will be able to collect more revenue to partially offset additional costs for the requested positions. Triage and revenue collection will be the majority of the work performed by the new positions, and the most active cases will be handled by this unit. This will help to alleviate some of the significant workload strain currently an issue for the regular line Fiduciary caseloads. (C-56-16-005-M-00)

The City of Glendale initially assumed lead agency responsibilities for acquisition of Northern Parkway right-of-way and relocation of affected property owners. The City contracted with Acquisition Sciences to perform this work. In 2010, Maricopa County assumed the lead role. Approximately half of the relocation work on the project is ongoing, and federal processes mandate an 18-month follow-up on completed work. Seeking a new vendor is impractical, as ensuring a continuity of service is critical to avoiding delays to the Northern Parkway project and to avoiding jeopardizing federal funding for the project. F-1. COMPETITION IMPRACTICABLE PROCUREMENT WITH SMITH & ANNALA ENGINEERING COMPANY FOR QUALITY ASSURANCE AND MATERIALS TESTING SERVICES Approve a Competition Impracticable Procurement, Maricopa County Procurement Code, MCI-351, in the amount of $700,000.00, with Smith & Annala Engineering Company to provide Quality Assurance and Materials Testing Services for the construction of the Buckeye FRS No. 1 Rehabilitation Project. The Contract will be effective for 1,095 calendar days from the date of execution or the expenditure of $700,000.00, whichever comes first. As an option, the Contract may be extended by change order for an additional period of 730 calendar days, or expenditure of the remaining funds. Smith & Annala Engineering Co. provides Quality Assurance and Materials Testing Services under the current On-Call Contract FCD2013C008 for the Buckeye FRS No. 1 Rehabilitation Project which is presently under construction. The original contract was $500,000.00 and will be fully expended by March of 2016. Due to unforeseen conditions, the allocated funds under the present Contract will not be sufficient to complete the Project. The proposed funds will provide continuity of Quality Assurance and Materials Testing Services by the same firm during and following construction of the Buckeye FRS No. 1 Rehabilitation Project. As Smith & Annala Engineering Co. is the Quality Assurance and Materials Testing Firm of Record for the Buckeye FRS No. 1 Rehabilitation Project, it is the only firm with sufficient project expertise to provide Quality Assurance and Materials Testing Services. The project needs to retain the Firm of Record until project completion. This Agenda Item impacts Supervisorial District 4. (C-69-16-031-5-00)

F-2. IGA WITH CITY OF PEORIA FOR FUNDING OF SECTION OF NORTHERN COMMUNITY PARK PROJECT AT NEW RIVER DAM Approve Intergovernmental Agreement (IGA) FCD 2016A001 for Funding of the Peoria Northern Community Park Project Section 408 Permit at New River Dam between the City of Peoria (City) and the Flood Control District of Maricopa County (District). The IGA details the necessary coordination and responsibilities of each party for obtaining a U.S. Army Corps of Engineers (USACE) Section 408 permit. All costs shall be borne by the City. There is no cost to the District. The City is planning and designing for a Northern Community Park proposed to be located within the limits of the New River Dam Project flood impoundment area. The City has formally requested, through the District, to develop and use a portion of the New River Dam Impoundment Pool area for recreational and multi-use facilities and activities, and associated utility (or utilities) that may or may not cross New River Dam Dike No. 1. The USACE has determined that a Section 408 permit is required for the Project. The District is the single local sponsor with the USACE for the New River Dam Project. In accordance with the USACE rules and regulations, the USACE only issues Section 408 permits to local sponsors for USACE projects. Therefore the local sponsor, the District, in partnership with the City, intends to apply for and obtain a Section 408 Permit for the PROJECT. This Agenda Item impacts Supervisorial District 4.
