Prior to any issuance of any permits for construction/grading on the site, the Owner/Applicant must apply for and obtain a Drainage Waiver to allow for a reduced storm water retention volume for the site. The minimum retention shall be the grater of the pre vs post or first flush volume of runoff. 2. Prior to issuance of building permits, the owner/applicant must provide an erosion setback analysis conforming to ADWR State Standards (SSA 5-96) or Section 11.9 of the FCDMC Design Manual – Volume 2. 3. Detailed grading and drainage plans must be submitted with building permit application(s). 4. Engineering review of planning cases such as this is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 5. ADOT reserves the right to review any future plans, additions and/or changes to this development in regards to any impact they may have on the State Highway System. 6. ADOT would like to remind the developer there is ADOT Right of Way in the area and they must not encroach upon it without a permit. No work shall begin on ADOT right of way until said permit is obtained. 7. ADOT would like to review any impacts that may arise regarding ADOT facilities such as utility tie ins, drainage, fencing along right of way, traffic control if necessary, or landscape encroachment within ADOT R/W during construction, along with any other potential impact items. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. i . Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. 16. COMMUNITY SOLUTIONS FUNDING Authorize the Community Solutions Funding request for Stand Up Expo 2023 in the amount of $2,400, with an expected start and end date of May 6, 2023. The Maricopa County Mental Health Task Force has partnered with Valleywise Behavior Health and other stakeholders to offer the “Stand Up Expo 2023". The purpose of this event is to educate, inspire, and empower in the areas of behavioral health advocacy, services, wellness, the justice system and more. This event brings the community and service providers together to gain awareness and increase connections to behavioral health resources. The Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover the cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals and provide a clear public benefit for Maricopa County residents. The Associated Maricopa County Strategic Goal is: Safe Communities. Also, pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 2023 budget: 1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by $2,400. 2. Increase the expenditure authority in the Non Departmental (D470) General Fund (100) Non Recurring (NRNP) budget in the line “D3 – Community Solutions Funding” (4763) by $2,400. ACCEPT SUPPLEMENTAL FY23 VICTIM COMPENSATION FUNDING FROM ARIZONA CRIMINAL JUSTICE COMMISSION Accept additional grant funds from the Arizona Criminal Justice Commission (ACJC) in the amount of $275,000.00 for FY23 Victim Compensation claims. The funds are $275,000.00 in ARPA (Federal Funding) CFDA #21.027. The addition of the supplemental funding brings the total amount of the FY23 grant award to $2,556,593.00. The supplemental funding is limited for use in paying Victim Compensation claims and cannot be used for indirect costs. The Arizona Criminal Justice Commission Grant Number VC-23-oo8 commenced on July 1, 2022, and terminates on June 30, 2023. ACJC Victim Compensation Grant funding is recurring. The Maricopa County Attorney's Office's composite indirect cost rate for FY23 is 22.35% or $61,462.50 for the additional funding. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $61,462.50. Non-recoverable indirect costs will be covered by the departmental general fund budget. There is no requirement for matching funds. The original grant was competitive and does not require ongoing cash contributions after the grant period's end date. Grant revenues are not “local revenues” for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by budget law. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR REFUGEE SCREENING MEDICAL ASSISTANCE PROGRAM Approve the release order for funding increase from the Arizona Department of Economic Security (AZDES), Refugee Resettlement Program for Coordination-Refugee Preventive Health Sreening , to Intergovernmental Agreement (IGA) Dl18-002141 between AZDES and Maricopa County by and through its Department of Public Health. The funding is increased to the not-to-exceed amount of $402,412.93 for the budget period of October 1, 2022 through September 30,2023. The IGA term is September 01, 2017 through September 30, 2023. The grant award is reoccurring and has been awarded to the department since 1983. There is no cash or in-kind match requirement nor is there currently a requirement for continued contributions should the grant end. The grant award is not a mandated function but provides a benefit to the citizens by coordinating medical exams for refugees settling in Arizona. The grant award is competitively bid. Maricopa County Department of Public Health’s indirect rate for FY23 is 17.24%. This grant allows for full indirect, therefore, the estimated amount of $59,174.33 is fully recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. There is no cost to the County’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. This grant award is reoccurring and has been awarded to the department in previous years. It is non-competitive and there is no cash or in-kind match required. The grant award is a mandated function; should it be discontinued, on-going contributions may be required. This grant deviates from County policy A2505 and does not allow for full indirect cost reimbursement but a maximum of 15% of salaries and employee related expenses. The Department of Public Health’s indirect rate for FY23 is 17.24%. Total indirect expenses based on full award are estimated to be $17,361.13 of which $15,105.39 is recoverable and $2,255.74 is not recoverable; and, if necessary will be absorbed by the departments operating budget. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of revenues is not prohibited by the budget law. The Agreement is between EPNG-KM and Maricopa County for the relocation of the gas pipeline facilities in conflict with the MCDOT Roadway Improvement Project TT0600, Northern Ave.: 99th Avenue to Agua Fria. The estimated cost to design and relocate the 16-inch high-pressure natural gas line is $2,294,945.00. Funds are budgeted in Transportation System Management (TMAN) project, Sub-Project TT0600 Northern Ave.: 99th Avenue to Agua Fria. Flood Control is in involved in the determined easement relocation adjustment. EPNG-KM has confirmed prior rights, therefore MCDOT is responsible for all costs related to the design, construction, and relocation of these facilities. INTERSECTION Approve the Deactivation Agreement for the removal of the SRP above ground Irrigation Structure that is in direct conflict with the MCDOT Transportation Improvement Project, TT0712: 51st Ave. and Olney Ave. SRP Land and Water services has provided the County with a means to work in partnership to eliminate an above ground irrigation structure. 55. IGA WITH CITY OF MESA FOR THE PERMITTING AND ANNEXATION OF POWER ROAD Approve the Intergovernmental Agreement between Maricopa County and the City of Mesa for the permitting and annexation of improvements to Power Road from Baseline Road to Guadalupe Road. The City of Mesa is currently constructing Monterey Park which is adjacent to Power Road. In 2006, Maricopa County and the City entered into a separate Intergovernmental Agreement for Improvements to the roadway (C-64-07-210-0-00). As part of that Agreement, the City was required to annex the improvements. As a result of the annexation not being completed, the City is required to obtain permits to work within the County’s right-of-way to construct the necessary driveway access points to Monterey Park. The City will begin the annexation process upon the Board of Supervisors’ approval of this Agreement. Either Party may terminate this Agreement at any time before the expiration date by furnishing the other Party with a thirty (30) day written notice. Supervisory District No. 2 (C-64-23-272-X-00)

58. IGA WITH CITY OF SAFFORD FOR THE SALE OF TRAFFIC SIGNAL EQUIPMENT Approve the Intergovernmental Agreement between Maricopa County and the City of Safford for the Sale of Traffic Signal Equipment. The City of Safford is constructing the widening of 20th Avenue from Relation Street to Golf Course Road from the current width of three lanes to five lanes. This project will include an underground storm drain system, curbs, and gutters, widening of the concrete crossing at the Highline Canal, sidewalks, traffic signals, and new pavement in partnership with the Arizona Department of Transportation. The City is requesting assistance in the procurement of traffic signal parts and equipment for the City’s Project as there are long lead times for the items. In a partnering effort, the County has the items available and will sell parts and equipment for the City’s Project at a cost, as shown in Exhibit A. 59. ROAD FILE NO. 1026-R Set a hearing for May 10, 2023 to adopt Road File No. 1026-R altering Road File No. 1026 following the described alignment(s) into the County Transportation System. In accordance with A.R.S. § 28- 6701(A ),( B), it is recommended by the Department of Transportation Director, that the Board of Supervisors alter Road File No.1026 by adopting Road File No. 1026-R along the following described alignment into the County Transportation System. Road File No. 1026-R: A roadway having a width consistent with the existing right-of-way and appurtenant rights as well as any additional right-of-way and appurtenances necessary to provide for construction, operation, and maintenance of the roadway as designed and constructed by the Maricopa County Department of Transportation; the centerline of the road is described to-wit: Commencing at a point 85 feet westerly and 650 feet northerly of the East quarter corner of Section 31, Township 5 South, Range 4 West; thence in a Northerly direction along the centerline of Old U.S.80 to a point 300 feet Westerly and 500 feet Northerly of the Southeast corner of Section 11, Township 1 South, Range 4 West. The roadway is known as Old U.S. 80 from State Route 85 on the north to State Route 85 on the south lying in Supervisor Districts 4 and 5 and in an unincorporated area. A map depicting the beginning, ending, and alignment of the road is attached. Direct the Clerk of the Board to record the Board of Supervisors resolution with the County Recorder. CHANGE ORDER NO. 4 WITH (SAECO) FOR QUALITY ASSURANCE MANAGEMENT AND MATERIALS TESTING Approve Change Order No. 4 in the amount of $500,000 and an extension of one year to the contract that will allow the on-call consultant to perform Quality Assurance Management and Materials Testing of four CIP and Dam safety Projects. Those four projects are under construction and SAECO is doing Quality Assurance Management and Materials Testing under this contract. LISTING AGREEMENT WITH ROI PROPERTIES, LLC Request the Board to approve and execute a Listing Agreement between the Flood Control District (District) and ROI Properties, LLC (ROI) authorizing ROI to list and market real property to the public that has been declared as excess to the needs of the District . The District is authorized to offer up to a 3% brokerage fee pursuant t Resolution 2007R012. Interested buyers procured by ROI will be required to bid at public auction pursuant to A.R.S. § 48-3603. The District utilizes its disposition program on all excess properties to evaluate them for the best potential of sales or leasing, depending on current market information. The properties would be sold at public auction with the minimum bid being market value as determined by appraisal, unless to another agency for public purposes, at market value without auction. TERM OF AGREEMENT AND CONDITIONS OF SALE: The term of this Listing Agreement (the “Agreement”) shall be from March 1, 2023- February 29, 2024 (the “Term”) (I). The prices for which the Properties are offered shall be in accordance with A.R.S.§ 48-3603 and as set forth in Addenda issued upon the listing/broker engagement of each Property.
