COMMUNITY SOLUTIONS FUNDING Authorize the Community Solutions Funding Proposal request to the Library District for tenant improvements for the new Anthem Library project in the amount of $4,000,000 with an expected start date of March 27, 2024, and an expected end date of December 31, 2024. The Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover the cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals and provide a clear public benefit for Maricopa County residents. The Associated Maricopa County Strategic Goal is: Regional Services. A. Authorize an increase to the transfer from the General Fund (100) to the General Fund County Improvements (445) of $4,000,000. B. Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 2024 budget: 1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by $4,000,000. 2. Increase the expenditure authority in the Non Departmental (D470) General Fund (100) Non Recurring (NRNP) budget in the line “D3 – Community Solutions Funding” (4763) by $4,000,000. 3. Increase the revenue authority in the Non Departmental (D470) General Fund County Improvements (445) Non Recurring (NRNP) budget by $4,000,000. 4. 13. RESOLUTION APPROVING THE SUBMISSION OF PROJECTS FOR CONSIDERATION IN ARIZONA’S 2025 GOVERNOR'S OFFICE OF HIGHWAY SAFETY PLAN Adopt a Resolution approving the application and acceptance of up to $704,038 in reimbursable grant funding from the Governor’s Office of Highway Safety (GOHS). This pass-through federal funding will be used for overtime, training and equipment to accomplish projects related to highway safety. This resolution for Maricopa County specifically authorizes the filing and acceptance of grant funding from the priority Program areas: 1) a. Impaired Driving (DUI Enforcement; Underage Drinking Enforcement; Officer Training for Recognizing Impairment) $429,870; and b. Impaired Driving (Warrant Details) $46,000; 2) Accident Investigation, $128,728; and 3) Police Traffic Services (Aggressive Driver Education and Enforcement, Speed Related Patrol Enforcement, School Speed Zone and Construction Zone Enforcement and buckle Up AZ Enforcement) $99,440. The anticipated term of the funding is October 1, 2024 through September 30, 2025. The Sheriff’s Office has received this funding for approximately 21 years. It is competitive, and recurring. There is no match requirement. The funding limits employer related expense reimbursements to 40% and the Sheriff’s Office is required to fund the difference ($173,296) from its general fund appropriation. This funding does not allow indirect cost recovery. The Sheriff’s Office indirect cost rate for FY2024 is 16.72%. This funding is earmarked primarily for overtime expense, training and the purchase of program related equipment. There are two capital equipment purchases, for an indirect cost base of $657,310 and estimated unrecoverable indirect costs of $109,902. There are no future or ongoing contributions required after the grant ends. This funding supports and enhances the Sheriff’s Office public safety mandate. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. ANNUAL RENEWAL OF DEEP UNDERCOVER VEHICLE REGISTRATIONS Approve renewal of deep undercover registrations and exemptions from markings which includes non-government license plates, per A.R.S. 38-538-03, for Sheriff’s RICO vehicles that are used for conducting investigations into major felony crimes, narcotics operations, and organized crime activity throughout Maricopa County. The Sheriff’s Office maintains a fleet of RICO deep undercover vehicles that are approved by the Board on a case-by-case basis as one-time additions to fleet with exemptions from markings and non-governmental plate registrations. Annual approval by the Board is required per A.R.S. 35-538-03 in order to renew these undercover vehicle registrations. 20. RESCIND AND REPLACE IGA WITH CITIES OF AVONDALE, BUCKEYE, GOODYEAR AND MARICOPA COUNTY FOR OPERATION OF SOUTHWEST FAMILY ADVOCACY CENTER Rescind the action taken by the Board of Supervisors on 12/06/2023 under C-50-24-107-X-00 and approve the attached Intergovernmental Agreement with the Cities of Avondale, Buckeye, Goodyear and Maricopa County for the operation of the Southwest Family Advocacy Center. This is a financial agreement to fund the operations and management of a Center used by a multidisciplinary team for the investigation, prosecution, assessment, treatment, protection, and prevention of child sexual and physical abuse, child neglect, child endangerment, adult sexual abuse, sexual assault, domestic violence and elder abuse cases. The estimated cost to MCSO is $304,480 for FY 2024 with similar costs each year of the Agreement. Agencies are invoiced at least quarterly and are provided estimates of their annual proportionate share of Center funding by February 1st of each year. The Center is located at 2333 North Pebble Creek Parkway, Goodyear, Arizona. This Agreement is effective as of January 1, 2024 and terminates December 31, 2026, the “Initial Term”, unless terminated otherwise. This Agreement automatically renews for three successive three-year terms. An agency can voluntarily terminate this agreement with a 60-written notice to terminate. This Agreement supersedes the previous agreement approved in Agenda items C-50-13-022-3-00, C-50-13-022-3-01; C-50-19-074-3-00 and C-50-19-074-3-01. SUPPLEMENT TO AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) – INITIATIVE XXXII Approve Supplement #3 to the Agreement with the Office of National Drug Control Policy (ONDCP) Award Number G22SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The amount of supplement #3 is ($62,002.75), decreasing the amount from $689,277.38 to $627,274.63. The term of this funding is unchanged, January 1, 2022, to December 31, 2023. This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. This is a competitive award. The Sheriff’s Office indirect cost rate for FY24 is 16.72%. There are no unrecoverable indirect costs associated with this decrease in funding. This award was initially accepted in BOS action C-50-21-186-X-00 on June 9, 2021. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 22. TRANSFER OF OWNERSHIP OF RETIRING K-9 – UTAH Approve the transfer of ownership of retiring K-9, Utah, #K159, to Deputy Jesus Godinez, #S2115. Utah was originally purchased from Adlerhorst International in May 2021 immediately started K9 Academy and graduated. Working alongside of Deputy Godinez on patrol in MCSO District 2 and 3 and assisting on several SWAT missions. Over the last 16 months there have been many deficiencies noted such as lack of drive and engagement, handler dependency, aversion to loud noises, reluctancy to show aggression and avoidance during real life deployments, etc. Utah’s lack of confidence shown by the list of failures exhibited results in his lessened performance statue. Due to the list of failures and lack of confidence for the health and safety of Utah and his handler Godinez and the public we ask Utah to be retired. Deputy Godinez has created a strong bond with Utah over the years as his handler/partner and will accept full care and financial responsibility for Utah upon adoption and will be asked to sign the Canine Release and Indemnification. 23. TRANSFER OF OWNERSHIP OF RETIRING K-9 – HIGHWAY Approve the transfer of ownership of retiring K-9, Highway, #K135, to Detective Matthew Shay, #S2148. Highway is part black lab and pitbull mix canine that was originally rescued through Maricopa County Animal Care and Control in February 2020. He was fully trained and certified in late April 2020 by MCSO K-9 academy. In May 2020 Highway made his first “real world” find during a execution of search warrant. Thereafter with more than a dozen successful deployments and significant drug and cash seizures. Highway was utilized both as training aid and representative of the Sheriff’s Office for public events & training. In 2022 the need for a K-9 in the Maricopa County Drug Suppression Task Force was significantly reduced, with less than 3 deployments in a year. There is no longer a need for Highway in the current job assignment for Detective Shay for the canine to remain active and certified. Detective Shay has created a strong bond with Highway over the years as his handler/partner and will accept full care and financial responsibility for Highway upon adoption and will be asked to sign the Canine Release and Indemnification. These grants are for emergency planning within Maricopa County. The grant award begins on July 1, 2021, and ends June 30, 2025. The department’s indirect rate for FY24 is 11.98%. The grantor does not permit indirect cost recovery and unrecoverable indirect is 194,722.40. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant award is reoccurring and has been awarded to the department for the past thirty (30) plus years. The department has a match requirement of $1,625,395.69. during the grant award period, the match for this grant comes from the General Fund (100-D150-1510), Palo Verde (207-D150-1510), and the Intergovernmental Agreements (215-D150-1510-CTIGA), and the Emergency Management Capital Improvement Project (D470-443-4713-FACM-EMDF). Maricopa County does not have to fund any additional costs for the program. The grant award is a mandated function for emergency preparedness through the Robert T. Safford Act. This grant provides funds for recipients to build and maintain emergency management programs at the state and local level. This grant award is non-competitive and all counties in the state are eligible to apply for funds to support their Emergency Management Programs. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. AGREEMENT WITH NEWTOWN COMMUNITY DEVELOPMENT CORPORATION AND CITY OF AVONDALE Approve a financial Agreement (“Agreement”) between Newtown Community Development Corporation, a Community Housing Development Organization (“CHDO”), the City of Avondale (“Administrator”) and Maricopa County (“County”) administered by its Human Services Department. The CHDO, the Administrator, and the County are collectively referred to in this Agreement as the “Parties” and individually as a “Party.” The purpose of the Agreement is for Newtown Community Development Corporation, as the designated CHDO, to acquire land from the City of Avondale and construct three affordable (3) single-family homes to be made available to the residents of Maricopa County. The Legacy Avondale Infill Housing Redevelopment Project-Phase 3 is in a Qualified Census Track located at 305 and 309 East Hill Drive, Avondale, Arizona 85323. The land will be re-platted and sold by the Administrator to the CHDO at closing. The new homes to be constructed will be included in Newtown’s Community Land Trust Program (CLT) program and remain affordable per 24 CFR 92. The County shall provide the CHDO and the Administrator with PY23/FY24 funds through the U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program funds in the amount of $796,326. The Agreement term shall begin March 27, 2024, and will expire December 31, 2026. The County shall provide the CHDO with an agreement amount of $796,326. Per Section 1 (General Provisions), Paragraph 6.0 (Administrative Change Orders), also request authorization for the Chairman of the Board of Supervisors to approve and execute, upon the recommendation of the Human Services Department Director and Legal Counsel, changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representatives for the CHDO and the Administrator. The purpose of the Agreement is for the Contractor to provide services to individuals experiencing homelessness. The purpose of Amendment No. 7 is to address the following items: A. The County shall provide the Contractor with an additional $2,108,421 in American Rescue Plan Act (“ARPA”) funds under Assistance Listing Number 21.027. The period of funding availability for Amendment No. 7 shall extend through January 31, 2026. The total available funding under this Amendment No. 7 shall not exceed $2,108,421. Contractor shall continue to provide shelter services for homeless individuals at the St. Vincent de Paul 2739 E. Washington Street location to include meals, laundry and clothing services, support case conferencing efforts and connecting individuals to needed services and housing. B. AMENDMENT TO THE IGA WITH CITY OF MESA FOR WORKFORCE DEVELOPMENT AND TRAINING SERVICES Approve a financial Amendment No. 1 to the Intergovernmental Agreement (Agreement) between the City of Mesa (City) and Maricopa County (County), administered by its Human Services Department. The purpose of this Agreement is to integrate the County’s workforce development system into the City’s social and community services resource network. The integrated service delivery model will be located at the New Leaf/Mesa CAN building located at 635 East Broadway Road, Mesa, Arizona 85204 (Workforce Development/Jobs Access Center). A Workforce Development staff will be utilized to provide services under this Agreement, as a Workforce Development Coordinator (WDC). The City of Mesa will share 50% of the cost of personnel salary and related expenses for the administration and operation of the program. The purpose of the Amendment No. 1 is to address the following: A. Extend the Agreement termination date from July 1, 2024, through June 30, 2027. The City shall compensate the County a not to exceed amount of $158,797 ($51,193 FY25; $52,911 FY26; $54,693 FY27) for service delivery. B. Revise Section 6.0 (FUNDING), by adding subsections that list Itemized Service Budgets for years: FY2025, FY2026 and FY2027. C. Revise Section 9.0 (RESPONSIBILITIES OF ORGANIZATIONS) 1. Removing subsection 9.1.1.6 and replacing with new language 2. Delete Subsection 9.1.1.7 in its entirety. 3. Add the following sections to the Agreement: 30.0 FORCED LABOR OF ETHNIC UYGHURS 31.0 PROVISIONS REQUIRED BY LAW This Agreement is entered by the parties through a non-competitive process. The City will provide an increase funding to the County to support the workforce development system provided in the City of Mesa area for the Agreement term. Cash, match, or in-kind are not applicable. The County does not have any obligations after the Agreement term. The services provided under this Agreement are not mandated services but provide a benefit to residents in the Mesa area as residents can receive job-seeking services and local employers are assisted with filling vacancies. The Human Services Department provisional indirect rate for FY2025 is 22.2% from the U.S. Department of Health and Human Services for salaries and employee related expenses. MEMORANDUM OF AGREEMENT WITH THE ARIZONA DEPARTMENT OF HEALTH SERVICES FOR COORDINATION OF SERVICES Approve a non-financial Memorandum of Agreement (MOA) between Arizona Department of Health Services (ADHS) and Maricopa County administered by its Human Services Department Early Education Division Head Start Program. Maricopa County is a designated member of the Arizona Head Start Association. The purpose of the MOA is to facilitate coordination of services and ensure confidentiality of data to improve health outcomes and access to WIC services among at-risk children at local WIC and Head Start offices throughout Arizona. It also serves to streamline administrative procedures for staff, participants and applicants of both the WIC and Head Start programs. The WIC and Head Start programs at the state and local level will partner to meet this goal. These agencies will work together to promote and support State, regional and local efforts to improve program coordination and services delivery for low-income children and their families who are eligible to participate in the Head Start Program and the Special Supplemental Food Program for Women, Infants, and Children (WIC). The term of the MOA is for five (5) years upon signature of the Agreement. By mutual written Agreement Amendment, this Agreement may be extended for four (4) years in one (1) year increments. The total Agreement term, including extension, shall not exceed a total of five (5) years from the effective date of the Agreement. 43. EQUIPMENT AND ASSET DISPOSITION Request authorization to dispose of the assets assigned to the Maricopa County Human Services Department and listed on the Department Asset Inventory list. The Department will have items picked up and disposed of through the County’s Surplus Disposition process. Items were acquired utilizing funds provided through Intergovernmental Agreements with Arizona Department of Economic Security (DES) for Workforce Innovation and Opportunity Act (WIOA) Title 1 B and grants provided by the U.S. Department of Health and Human Services (DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS). The items for disposition are no longer useable and require repairs that exceed the costs of the items. Disposition of items include audio visual systems, Computer Servers and Mondo pads. Approval of this action will allow the Maricopa County Human Services Department to dispose of items and have them removed from the Department’s Asset Inventory list. The disposition of the assets will result in a net decrease in the Human Services Department Asset Inventory list as referenced in Exhibit A Asset Disposition List. The not-to-exceed amount is $950,000.00 for a period of 12 months to begin on the date of the last authorized signature and not exceed a period of 5 years without mutual agreement of extension. The Department of Health’s indirect rate for FY24 is 15.65%. Indirect costs are estimated at $67,661.05 all of which is recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and future indirect rates will be collected at the corresponding rates. This grant has been awarded to MCDPH in the past, but it is unknown if it will be awarded again. It is non-competitive and there is no cash or in-kind match required. The services this grant provides are not mandated functions but provide valuable benefits to the community. This grant does not require an in-kind match, indirect cost is fully recoverable, and ongoing contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by providing the dental sealant services necessary to promote oral health and provide authorized preventive dental services to at-risk children in Maricopa County. The grant award is competitive. All program costs are allocated to the grant so there will be no additional burden on the department's operating budget. MCDPH's indirect rate for FY 2023-24 is 15.65%. The indirect costs are estimated at $17,937.21, all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rate. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. APPROVAL TO SUBMIT APPLICATION FOR CONTINUATION FUNDING FOR HEAD START/EARLY HEAD START FY25 PROGRAM ACTIVITIES Request approval for the Maricopa County Head Start program to submit a continuation grant fund application to the U.S. Department of Health and Human (DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS), for the Grant No. 09CH012079. The grant application is for fiscal year 2025 (FY25) and is for 4th year Head Start/Early Head Start program performance. The grant funding application is due on April 1, 2024. The Grant application is for $21,817,858 and the period of funding availability is July 1, 2024, through June 30, 2025. The Office of Head Start awarded Maricopa County with Grant No. 09CH012079 for Head Start/Early Head Start program for the project period of July 1, 2021, through June 30, 2026. The Maricopa County Human Services Department administers the Head Start/Early Head Start programs. The County is a current recipient of the stated grant and the funding opportunity is non-competitive. The Head Start Program goals are: 1. Better physical, cognitive, and social and emotional development in children 2. Improved Parent and Child Interactions that lead to Decreased Rates of Child Abuse and Neglect 3. Increase Parent Self-Reliance and Empowerment 4. Expand and Improve the Quality of the Early Childhood Workforce Also request authorization for the Chairman to sign documents related to this funding application. The Office of Head Start requires the Maricopa County Board of Supervisors Chairman to sign all grant applications, applications for additional funds, as well as amendments and budget revisions to the Grant. Amendments are required if the program needs to transfer funds between budget line items in an aggregate amount of $250,000 or more. The Grant requires a 20% non-federal share (NFS) match of the total approved project costs. The total required NFS for FY2025 is $5,454,465 for the budget period of July 1, 2024, through June 30, 2025. NFS is generated through in-kind donations of goods and services as well as parent volunteering. Once notified of funding award by OHS, the Human Services Department will seek approval for the acceptance of funds from the Board of Supervisors in a separate agenda item. IGA WITH TOWN OF PARADISE VALLEY STORMWATER MANAGEMENT MASTER PLAN Approve FCD 2024A006 Intergovernmental Agreement (IGA) with the Town of Paradise Valley for a Stormwater Management Master Plan (STUDY) which will develop comprehensive long-range planning for development activities and implementation of drainage flood control infrastructure improvements, regulatory floodplain mapping projects, or other flood hazard mitigation measures. The IGA will be effective for up to five years from the date of execution or the expenditure of $316,000, whichever comes first. The Flood Control District is empowered by Arizona Revised Statutes Section (A.R.S.) 48-3603, to enter into this Agreement. The Town of Paradise Valley is empowered by A.R.S. § 11-952 as amended, to enter into this Agreement. A consultant will be retained by the Town of Paradise Valley for a Stormwater Management Master Plan which will develop comprehensive long-range planning for development activities and implementation of drainage flood control infrastructure improvements, regulatory floodplain mapping projects, or other flood hazard mitigation measures. The study will be completed in accordance with applicable statutes and requirements and will focus on stormwater including, but not limited to: drainage and flooding issues, data evaluation, stormwater infrastructure, floodplain mapping, system resiliency, capital improvement planning, future infrastructure impacts, and compliance with the National Pollution Discharge Elimination System (NPDES) standards, and will provide a methodology for regular study updates.
