10. POST APPOINTMENT INVESTIGATIONS FEE Pursuant to A.R.S. § 11-251.13, convene the scheduled public hearing to solicit comments and consider the adoption of POST APPOINTMENT INVESTIGATIONS FEE. Upon Board approval, this item will become effective February 6, 2013. This new fees will be assessed upon those individuals or entities who failed to comply with a court's order to properly protect a ward or the estate. Costs are not assessed on the ward or the estate, but upon the individual or entity who failed to obey the court's order. As part of the Court’s mandated duties to oversee guardianships and conservatorships, the Court may order an investigator to locate the ward when a guardian or conservator fails to notify the court of a change of address. When this occurs, the Court attempts to locate the parties using skip-trace technology called Accurint. When database searches fail to locate a ward, or the guardian does not respond to Court notices to appear, the Court may order an investigator to conduct a field investigation. The Court may also order an investigation when it is concerned about the quality of care the ward is receiving, or has information to suggest that the ward may be a victim of financial exploitation. These post appointment investigations typically require more resources than initial investigations because they require more interviews and documentation. Authorizing the Post Appointment Investigations Fee of up to $400 will provide the Court needed resources to oversee guardianships and conservatorships and ensure the proper care of vulnerable adults as well as pay for the hours that the investigators spend locating the ward and guardian. The new Post Appointment Investigation Fee will be assessed to the guardian/conservator and will not be paid from the ward’s estate. Parties may request a waiver or deferral of fees using the established process. Revenue generated from this fee will be deposited into the Superior Court Special Revenue Fund 259 and used to offset the costs associated with post appointment investigations. Revenue projections for the fiscal year 2013 (FY13) are projected at $12,800 and (FY14) $25,600 annualized. The $400 fee amount is based on the average hourly rate paid to investigators plus their mileage reimbursement and also the cost of the Accurint database subscription. The proposed fee is intended to recover (but not exceed) the full cost of the service. (C-80-13-007-2-00)

20. ACCEPT GRANTS AND OTHER ASSOCIATED REVENUES FOR THE ADULT PROBATION DEPARTMENT FOR FY 2012-13 Accept the FY 2012-13 grants and other associated revenues for the Adult Probation Department of the Judicial Branch. The indirect cost rate as of July 2012 is 11.7% as approved by the Department of Finance. Some of the grants for FY 2012-13 do not allow indirect cost recovery as reflected in the attached funding agreements. The status of indirect costs as well as matching funds for each grant is noted on the attached summary sheet. For FY 2012-13, we anticipate accepting eleven (11) new awards for Grant Fund revenue of $3,244,130, carrying over Grant Fund revenue balance of $496,499 on seven (7) previously accepted awards and $2,076 in interest on two carryover grants. On the new awards, indirect costs on eligible expenditures are estimated to be $347,149 with $46,858 recoverable and $300,291 unrecoverable. In addition, approve an increase to the FY 2012-13 Adult Probation (110) Adult Probation Grants Fund (211) Operating (0000) revenue and expenditure appropriation in the amount of $273,844. This increase is necessary because actual grant funding to be received is more than anticipated and budgeted. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures (C-11-13-004-G-00)

54. IGA WITH THE CITY OF GOODYEAR FOR THE EXCHANGE OF SERVICES (ENTENTE) Approve the renewed Entente Agreement between Maricopa County (County) and the City of Goodyear (City) to address regularly scheduled or emergency maintenance projects of mutual benefit in both jurisdictions. The parties desire to implement a cooperative highway maintenance program whereby routine or emergency highway maintenance will be performed more efficiently (the Entente Program). The Entente Program is designed to look beyond geographical or jurisdictional boundaries and instead focus on the task at hand and availability of resources. The maximum dollar amount that may be exchanged under the Entente Program, per fiscal year, is $200,000. For each project that the Entente Agreement addresses, the County Transportation Director and City Manager shall enter into a Letter of Agreement (LOA) to memorialize the collaboration. This agreement is necessary because it provides a means of completing routine or emergency highway maintenance more efficiently and cost-effectively for the County and the City. Supervisory Districts No. 4 and 5 (C-64-13-113-M-00) 55. IGA WITH THE CITY OF PEORIA FOR THE DEER VALLEY PROJECT: EXTENDING FROM 117TH AVENUE AND WILLIAMS DRIVE TO 109TH AVENUE TO DEER VALLEY ROAD Approve Intergovernmental Agreement (Agreement) between Maricopa County (County) and the City of Peoria (City) for the Deer Valley Project, extending from 117th Avenue and Williams Drive to 109th Avenue and Deer Valley Road (Project). The cost of the Project is $28.99 million over four years of which the County is paying 100%. Funds are available through the Transportation Department (640) Transportation Capital Projects Fund (234) County Arterials (ARTS) Project, Sub-Project T248. Also, approve to change the Sub-Project description for T248 from Deer Valley Road, El Mirage to Lake Pleasant to Deer Valley Road, 117th Avenue to 109th Avenue. The change is necessary due to the revision in the project limits. The County is currently designing a new above-grade crossing over the Agua Fria River. The Project will cross the Agua Fria Truck Route Reliever at the Deer Valley Road alignment. The Project consists of the construction of the 16’ clear bridge structure allowing the Agua Fria Truck Route Reliever to pass under Deer Valley Road. Construction of the bridge by the County is currently planned to start in FY 2015. In addition, upon completion of the Project, the City has agreed to annex the land occupied by the Agua Fria Truck Route Reliever and the land between the Agua Fria Truck Route Reliever and the City’s current western boundary as well as a portion of Deer Valley Road between the western boundary of the Truck Route Reliever and 109th Avenue. This agreement is necessary because both Parties agree that the bridge is required to prevent truck traffic from turning onto Deer Valley Road from the truck route and entering residential neighborhoods. The Project is funded through federal and Highway User Revenue Fund (HURF) monies. The estimated cost of the Railroad Crossing Project is approximately $1,134,564 with a federal share of $1,073,620 and a local share of $60,944. Funds for the project are programmed in the Transportation Capital Projects Fund (234) Traffic Improvements (TIMP) Project, Sub-Project T391, Improvements to the Intersection at MC-85 and Avondale Boulevard. Authorize the Department of Transportation to apply for, acceptance and expend any and all Federal Highway Administration (FHWA) Railroad Safety Program (23 USC Section 130) funds, currently estimated to be $1,073,620 on this project. The County’s FY 2012-13 indirect cost rate is 6.9%. All costs under this agreement are for capital expenditures which are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. The Project consists of the installation of cantilevers to cover all existing lanes of traffic on Avondale Boulevard and the replacement of the existing timber crossing with concrete. F-3. RESOLUTION FCD 2013R001 PERMISSION TO GRANT WASTE WATERLINE EASEMENT TO THE CITY OF MESA ACROSS FLOOD CONTROL DISTRICT PROPERTY ACQUIRED FROM THE UNITED STATES GOVERNMENT Approve Resolution FCD 2013R001 which requests permission to grant an easement to the City of Mesa over property acquired from the United States Government. The Flood Control District of Maricopa County (District) acquired property from the United States Government for the Rittenhouse Road Drain Project in December 2002 by Quit Claim Deed. There was no charge for this acquisition and the deed was processed to the District Board of Directors. There was a deed resolution in that deed concerning utilizing the property for non-flood control related purposes. Any conveyance of land rights to another party needs to be approved by the United States. The United States has asked for a special resolution to be processed authorizing an easement conveyance to the City of Mesa, which is needed for a waste water line for a municipal improvement project. A previous resolution was passed (Resolution 2012R003) and the US has asked for a more specific resolution which outlines the process for granting this easement and the fact that a formal abrogation document needs to be processed before the easement can be granted to the City of Mesa. This Resolution FCD 2013R001 will supersede Resolution FCD 2012R003. This Agenda Item impacts Supervisorial District 2. (C-69-13-030-8-00)
