Commission Recommendation: On 1/13/22, the Commission voted 6-0, to recommend approval of Z2021098 subject to conditions ‘a’ – ‘k’: a. Development of the site shall be in substantial conformance with the Site Plan entitled, “Carefree RV Center Expansion” consisting of one full-size sheet dated December 21, 2021, and stamped received December 21, 2021, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled, “Special Use Permit Major Amendment to Z2015014 for Carefree Crossings RV & Boat Extension”, consisting of 11 pages, dated, revised December 17, 2021, and stamped received December 17, 2021, except as modified by the following conditions. c. The property owner shall submit a ‘will serve’ letter from the Daisy Mountain Fire District for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. d. Deleted. e. The following Maricopa County Environmental Services Department (MCESD) conditions shall apply: 1. The owner will abandon the septic systems and connect to a public sewer system when one is available, and participate in a fair share of the public sewer system funding. 2. Development and engineering design shall be in conformance with the Maricopa County Stormwater Quality Management and Discharge Control Regulation. The owner/developer shall prepare a Stormwater Site Plan (SWPP) and obtain approval by MCESD prior to construction (a separate submittal to MCESD is required). 3. Upon completion of construction, the owner shall fulfill MCESD post-construction requirements. This will include appropriate operation and maintenance requirements. f. The following Planning Engineering conditions shall apply: 1. The site contains a small area of regulated floodplain and jurisdictional washes in its southeast corner. Floodplains must be clearly mapped on construction plans. Any disturbance to the floodplain will require a floodplain use permit concurrent with building permit(s). Owner/Applicant is responsible for identifying and procuring any permit(s) for disturbance of, or work within delineated jurisdictional (404) washes. 2. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits indicating that the site will drain to an existing retention basin. 3. No new driveways to Carefree Highway or 7th Street are included with this entitlement. Access to the development site shall be via the existing driveway located on 7th Street. 4. The subject site is located within the County’s Urbanized Area. A Storm Water Pollution Prevention Permit (SWPPP) from the County will be required prior to issuance of any construction permits. 5. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 6. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. i . The drainage channel included within the SUP area shall be maintained in perpetuity by the property owners of all parcels within the C-2 CUPD zoning district. j. GSA Pavement shall be permitted as an acceptable pavement for parking spaces and internal driveways with the approval of a dust control plan in accordance with the requirements of Maricopa County Air Quality Control. k. Development of the site shall comply with all conditions of Z2015013 except that the undulating setback shall comply with the Site Plan entitled “Carefree RV Center Expansion” consisting of one full-size sheet dated December 21, 2021, and stamped received December 21, 2021. Prior to approval of the initial final plat or precise plan of development approval, the applicant shall provide the Maricopa County Planning and Development Department with an executed pre-annexation service agreement with the City of Phoenix that identifies the detail for when the proposed project will be annexed and the provision of water and sewer service. In lieu of pre-annexation service agreement, the developer must provide a ‘will serve’ letter from the certificated water and sewer providers. e. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. COMPETITION IMPRACTICABLE WITH LDV CUSTOM SPECIALTY VEHICLES Approve a Competition Impracticable with LDV Custom Specialty Vehicles for an amount not-to-exceed $185,000, to upgrade from 2008 technology to 2022 technology and systems on the current 2008 Freight Liner Vehicle #45709 assigned to Incident Command Post. As LDV has built our Explosives Truck (EOD), Hostage Negotiations Vehicle, Scene Intelligence Vehicle (TACMAV) and this Incident Command Vehicle they are set up to share the resources and data from the scene between them. The vehicles are also set up to share power in case of a failure of one to provide seamless scene information. These vehicles are used during special events like the Super Bowl, Phoenix Raceway, Chase Field major events. They are also used for Palo Verde, Major Flooding like recently in Gila Bend, Major Fires or other natural or man-made disasters. Equipped with ability to work between the vehicles which is a LDV umbilical cord that allows the monitors to share data on different TV channels between all the trucks. This allows any truck to go to a channel and see what the others are looking at. As LDV has all the build specs from the original builds this would make other company's trying to make this all work impossible. By upgrading the ICP this will prolong the life of the vehicle by another 10-15 years at a fraction of the cost of a new up-fitted command vehicle. (C-50-22-107-X-00)

GRANT FUNDS FROM ARIZONA STATE DEPARTMENT OF HOMELAND SECURITY FOR RENEWAL OF EMERGENCY PLANS SOFTWARE Authorize Emergency Management to apply for grant funds from Arizona State Department of Homeland Security, (FFY22 SHSGP), in the not-to-exceed amount of $85,000 for the MaricopaRegionPrepares.com subscription renewal. This is a Continuity of Operations Planning (COOP) software package for all jurisdictions within Maricopa County. The grant period for this grant is October 1, 2022 through September 30, 2023. The Maricopa County Department of Finance has calculated the Department of Emergency Management's composite indirect cost rate at 9.5% or $8075. The Department will not be recovering indirect costs off of this grant. The amount of unrecoverable indirect cost is $8075. Emergency Management will absorb these indirect costs within their general budget. The grant award is non-recurring, the department has to apply every year however, we have received the grant for the past five years. The department does not have an in-kind match requirement for this grant. The grant award is not a mandated function but it is a department strategic goal to have all county departments with a viable Continuity of Operations Plan (COOP). The grant is awarded through the Arizona State Homeland Security Department-State Homeland Security Grant Program (SHSGP), which is a competitive grant program. Maricopa County jurisdictions compete for projects based off the State grant initiatives. Maricopa County has spear headed the grant for the Emergency Operations Plans (EOP)/COOP software project for all county departments and jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring cost of the software maintenance and training funds. Maricopa County does not have to fund any additional costs for the program. The grant is intended to renew the MaricopaRegionPrepares.com subscription. This software tool benefits Maricopa County in developing Emergency Operations Planning (EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG) Planning for local government. The Department was awarded a grant for the software in 2015, we are applying for a grant to cover the cost associated with the maintenance of the system. Funding for this agreement is provided by a grant from the State of Arizona Department of Homeland Security in the amount not to exceed $85,000. The overall grant budget will be adjusted as necessary to accommodate this grant through future reconciliation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. The Department will be recovering the allowable 9.5 % rate based on the total direct charges, which totals $93,923. The grant award is reoccurring and has been awarded to the department for the past thirty (30) plus years. The department has a match requirement of $1,082,582 during the grant award period, the match for this grant comes from the General Fund (100-D150-1510), Palo Verde (100-D150-1510), and the Intergovernmental Agreements (100-D150-1510-CTIGA). Maricopa County does not have to fund any additional costs for the program. The grant award is a mandated function for emergency preparedness through the Robert T. Safford Act. This grant provides funds for recipients to build and maintain emergency management programs at the state and local level. This grant award is non-competitive and all counties in the state are eligible to apply for funds to support their Emergency Management Programs. The mitigation plan identifies and establishes county policies and tools that will be implemented in the unincorporated areas of the county, over the long term, which will result in a reduction of risk and potential future losses from a disaster event. The Maricopa County Unincorporated Area Hazard Mitigation Plan is incorporated into the Maricopa County Multi-Jurisdictional Hazard Mitigation Plan which also includes plans from the cities, towns, and tribes within Maricopa County. This multi-jurisdictional plan establishes a framework to ensure that the most appropriate and equitable mitigation projects are undertaken. State and local governments that have established mitigation plans that meet the Disaster Mitigation Act of 2000 criteria and have their mitigation plans approved by the Federal Emergency Management Agency (FEMA) are eligible to receive increased future grant funding. Conversely, if states and local governments to do not have a FEMA-approved mitigation plan, they will not be eligible to apply for certain grant funding. 45. REGISTERED NURSE RETENTION INCENTIVE Approve retention incentives for registered nurses that mirror the County’s registered nurse sign-on incentives. The County continues to struggle to recruit and retain registered nurses. To address recruitment issues and be consistent with market practice, the County implemented a registered nurse sign-on incentive program in June of 2021. The registered nurse retention incentives below will help address retention issues for nurses who are not eligible for the sign-on incentive. Incentive: $2,000 on 3/2/22, $2,000 on 6/22/22, and $2,000 on the first pay check in June 2023 Eligibility: Registered nurses hired before 6/26/21 (effective date of the nurse sign-on incentive program) who are meeting performance standards Repayment Clause: Employees who receive a nurse retention incentive and voluntarily leave County employment before two (2) years of consecutive County service must repay all retention incentives received during the last 12 months prior to their separation. The amount owed or a portion thereof may be deducted from the final paycheck. Employees whose final paycheck is insufficient to cover the total amount owed must establish a repayment plan to be completed within one (1) year from the date of their separation from employment. IGA WITH THE TOWN OF GILBERT FOR RIGHT-OF-WAY ASSISTANCE FOR OCOTILLO ROAD FROM 148TH STREET TO GREENFIELD ROAD Approve the Intergovernmental Agreement between Maricopa County (County) and the Town of Gilbert (Town) for assistance in acquiring right-of-way and related easements within County’s jurisdiction and authorize the County’s Legal Representative to perform all acts in the manner required by law to acquire, including condemnation, the property necessary for the Town’s roadway improvements to Ocotillo Rd (Val Vista to Green Field Rd) (Project). The purpose of this Intergovernmental Agreement is to identify and define the respective roles and responsibilities of the County and the Town related to the Project, including rights-of-way acquisition and annexation of the project area. Pursuant to ARS §§ 9-241, the Town is seeking Real Estate support from the County to acquire right-of-way and related easements within unincorporated Maricopa County required for the Project. The Town will reimburse the County for all costs associated with the right-of-way acquisition. When completed, the roadway will be widened to four lanes of traffic and striped center left turn lane. Improvements will also include bike lanes, sidewalk, streetlights, fiber and conduit, and sanitary sewer line with stub outs. The project includes the relocation of 12KV and 69KV power lines and coordination and design of RWCD facilities. APPROPRIATION ADJUSTMENT FOR THE LIBRARY DISTRICT NON RECURRING NON PROJECT FUNDING Approve an expenditure appropriation adjustment for the relocation of the El Mirage Library increasing the FY2022 Library District (D650) Library Fund (244) Non Recurring Non Project (NRNP) expenditure appropriation by $600,000. The expenditure adjustment will utilize accumulated fund balance for the library relocation costs. (C-65-22-020-X-00)
