10. ADULT ADOPTION FEE Pursuant to A.R.S. §11-251.08, convene the scheduled public hearing, to solicit comments and consider the adoption of ADULT Adoption Fee. Upon Board approval, this item will become effective November 5, 2014. Several years ago adult adoption case processing was transferred from Juvenile Court to Probate and Mental Health Court. When this change in responsibility occurred, the Probate and Mental Health Court continued the practice of assessing a $150 filing fee and $150 investigation fee. This fee was assessed in order to recoup expenses billed by outside contractor services that performed the adult adoption case processing. Since statutory authority for these assessments could not be identified, the Clerk of Court discontinued accepting these fees for adult adoption cases on November 1, 2013. Probate and Mental Health Court is now seeking to have the Board of Supervisors approve the assessment of a $140 filing fee and a $140 investigation fee ($280 total per case) for adult adoption cases. The assessment will recoup the expense of providing the service for which the fee is assessed. As noted in table below, as part of processing these case types, there is a substantial amount of staff time dedicated to conducting the investigation and drafting the report mandated by A.R.S. § 14-8101(D). From FY2010 through FY2013, there was an average of 30 adult adoption cases filed with the Court annually. It is projected that this trend will continue over the next several years. These fees, therefore, will generate approximately $8,400 in revenue. Monies collected will offset expenses for personal services costs. This fee does not require approval from the Arizona Supreme Court Administrative Office of Courts. The assessment of the fee would commence following BOS approval of the fee. The Court is seeking for the fee to be deposited into a special revenue fund that will be determined by the Judicial Branch Finance Department. The proposed fee is intended to recover (but not exceed) the full cost of the service. Parties may request a waiver or deferral of fees using the established process. (C-80-15-002-2-00)

11. MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of incorporating federal standards into Maricopa County Air Pollution Control Regulations, Rule 321 (Municipal Solid Waste Landfills), Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Upon Board approval, this item will become effective November 5, 2014. The Maricopa County Air Quality Department (department) is proposing to revise Rules 321, 360, 370, 371, and Appendix G by incorporating federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA): New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2013, to July 1, 2014, in each of the rules and appendix to remain current with federal regulations. The adoption of the proposed amendments to Maricopa County Air Pollution Control Regulations Rules 321, 360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of authority to the department for the implementation and enforcement of the federal regulations and documents. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rule or law was proposed and adopted. The department did not receive any public comments during the public comment period. (C-85-15-005-7-00)

This action is to allow MCESA to move the purchase of 2 vehicles from the TJST program to the small school service program and reimburse the Detention Fund for their purchase. It will also allow the revenues from the Secure Rural Schools and Community Self Determination Act (SRS Act) to be expended for Education Services. These actions will have a County-wide net expenditure impact of zero and do not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Total funds appropriated for the Transforming Juvenile Transition Pilot Program in FY 2013 were $2,787,056. To stretch the original funds (2 years, 2 months) to cover a third year with a slower than anticipated implementation, the additional $260,027 will fill the gap and provide services through FY 2014-15. Expenditures for FY 2012-13 and FY 2013-14 were $734,075 and $1,195,785, respectively, totaling $1,929,860. The forecasted expenditures in FY 2013-14 underestimated expenditures by $260,027. This agenda item reconciles the expenditure carry forward amount and increases the 3 year budget by $260,027. (C-37-15-004-2-00)

The agreement is being terminated through mutual agreement as listed in Section I paragraph J. Termination. 45. GRANT FUNDING FROM THE ARIZONA DEPARTMENT OF EDUCATION FOR THE CHILD AND ADULT CARE FOOD PROGRAM Approve the acceptance of grant funds from the Arizona Department of Education/Child and Adult Care Food Program (CACFP) Permanent Agreement (Arizona A.G. Contract No. KR02-1170-ALS) to Maricopa County through its Human Services Department/Education Division/Head Start Zero-Five Program in the not-to-exceed amount of $260,828. Also request authorization for the Chairman to sign all documents related to these grant funds, as applicable. Although the grant award is provided through a permanent agreement between the Arizona Department of Education and Maricopa County for the CACFP funds, Maricopa County must reapply annually for the specific grant amount which fluctuates annually based on changes in food costs. Grant funds begin on October 1, 2014 and end on September 30, 2015. Grant funds are utilized to reimburse school districts under contract with Maricopa County to provide meals to Head Start program participants. The FY 2015 Human Services Department negotiated U.S. Department of Health and Human Services approved indirect cost rate is 18.4% of salaries and employee related expenses. However, the indirect cost agreement signed with the Department of Health and Human Services specifies that food costs are not subject to indirect cost recovery. Because the Human Services Department only seeks food cost subsidies, the total indirect costs would be zero. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The grant funds do not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. § 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Meals are provided to low-income Head Start/Early Head Start program participants, (1,432 children 1,264 in Head Start and 168 in Early Head Start). Children will receive 1/3 to 2/3 of their daily nutritional needs by these meals and/or snacks, based on the length of time a child spends in the classroom. (C-22-14-027-G-01)

These funds will be used to benefit homeless residents of Maricopa County during the 2014 holiday season. In addition, unspent funds from this holiday season may be used for future holiday events. This action authorizes the Chairman of the Board of Supervisors to execute all documents necessary to receive this donation and grant on behalf of the Department of Public Health. Also, approve an increase in appropriation for both revenue and expenditures in fund 532 in the amount of $5,000. Donation funds are not local revenues for the purpose of the constitutional expenditure limitations, and therefore expenditures of these revenues are not prohibited by the budget law. Approval of this action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall budget will be adjusted as necessary to accommodate this donation through a future reconciliation. This donation will not affect the County General Fund. (C-86-15-034-D-00)

Resolution FCD2008R005 approved by the Board of Directors on June 18, 2008 authorized the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to negotiate Project Intergovernmental Agreements; include Project funding in the District’s current and future Five-Year Capital Improvement Programs; advertise, select, negotiate, and award contracts for Project Engineering and Construction Services; conduct permitting and public involvement activities and construct, operate and maintain flood control works and storm drainage facilities within or without the District for the benefit of the District, subject to the ratification and approval of the Board. H-2. RESOLUTION 14-021 RESTRUCTURE THE OWNERSHIP, OPERATIONS AND FINANCING OF THE AFFORDABLE HOUSING SITE COLLECTIVELY KNOWN AS MARICOPA SCATTERED SITE REVITALIZATION Adopt Resolution 14-021 and authorize the Executive Director to: (1) Take any and all actions for the purpose of restructuring the Revitalization Project, including but not limited to negotiation and execution of management, operational and financial documents to effectuate the reorganization; (2) Take any and all actions for the purpose of restructuring the Revitalization Project, including but not limited to the negotiation and execution of organizational documents related to the formation of an entity for the purpose of holding title to property or otherwise, and including, but not limited to, Articles of Amendment to Articles of Organization, Amendments to Operating Agreements, Resolutions, and Articles of Termination; and (3) Take any and all acts for the purpose of restructuring the Revitalization Project including but not limited to the negotiation and execution of all government-related documents and any such other documents in support of purposes set forth in this Resolution. This item is effective upon Board approval. Maricopa Scattered Site Revitalization is a low income residential housing project consisting of thirty-five (35) Units on scattered sites in Maricopa County. The Revitalization Project was developed as a mixed finance partnership among the predecessor to HAMC, Community Services of Arizona, Inc. (“CSA”), and Enterprise Housing Partners X Limited Partnership. CSA and HAMC formed an Arizona LLC known as CSA-Maricopa Revitalization, LLC (“CSA-Maricopa”) and CSA-Maricopa and Enterprise formed an Arizona LLC known as Maricopa Revitalization Partnership, LLC (“MRP”) of which CSA-Maricopa is the managing member. CSA is withdrawing its membership from CSA-Maricopa and MRP, and HAMC wishes to become the Managing Member to protect its public housing investment in the project and to ensure the integrity and long-term availability of the housing for residents. HAMC seeks to restructure the Revitalization Project because it has multiple layers of financing and subsidies, each of which Housing Authority has the expertise to manage without the assistance of CSA. HAMC has received conditional approvals regarding its restructure efforts for the Revitalization Project from HUD and Enterprise, subject to further negotiation finalization of certain transaction documents.
