9. TRANSFER INTERNET DOMAIN NAMES TO PARTNERSHIP FOR DRUG FREE AMERICA, ARIZONA AFFILIATE Pursuant to A.R.S. §§ 11-201;11-251(57)-(58), and for valuable consideration received, the Maricopa County Board of Supervisors (BOS) conveys to the Partnership for a Drug-Free America, Arizona Affiliate, four internet domain names, licensed and registered to the Maricopa County Attorney’s Office (the Office). These domain names are: www.DrugFreeAZ.com, www.DrugFreeAZ.org, www.DrugFreeAZ.net, and www.DrugFreeAZ.us, and are valued at approximately $280.00. Further, authorize the Chairman to sign any necessary documents to accomplish the conveyance of the above-mentioned domain names to the Partnership for a Drug-Free America, Arizona Affiliate. , The Partnership for a Drug-Free America, Arizona Affiliate shall pay no less than $100.00 and agrees to promote a drug prevention strategy by continuing to use these internet domain names in furtherance of their drug prevention and awareness mission. The Office currently owns the registration to four internet domain names: www.DrugFreeAZ.com, www.DrugFreeAZ.org, www.DrugFreeAZ.net, and www.DrugFreeAZ.us. These domain names have been used to administer websites aimed at increasing public awareness within Maricopa County of the dangers of drug and alcohol abuse. During the past four years, the Office combined several stand-alone websites into one thus making the four internet domain names listed above superfluous to the Office’s crime prevention strategy. The Partnership for a Drug Free America, Arizona Affiliate, is a not-for-profit organization under Section 501(c)(3) of the U. S. Internal Revenue Service Code. They operate in Arizona providing statewide drug prevention and awareness messages. It is in the best interest of Maricopa County that this organization utilize these internet domain names to promote drug prevention in the county. The Board of Supervisors is authorized under statute, specifically A.R.S. § 11-251(57)-(58), to sell intellectual property at less than fair market value to another governmental entity or benevolent non-profit organization. Such a conveyance does not violate the Arizona Constitution’s gift clause, A.R.S. Const. Art. 9, § 7, as long as Maricopa County receives due consideration. This conveyance constitutes a public purpose and the Partnership for Drug Free America, Arizona Affiliate, will provide consideration of an amount no less than $100 and agrees to promote a drug prevention strategy using these internet domain names, for the benefit of Maricopa County’s citizenry. THIS ITEM REQUIRES UNANIMOUS CONSENT OF THE BOARD. (C-19-11-002-M-00)

10. TRANSFER EXPENDITURE AUTHORITY FOR CHECK ENFORCEMENT DATA ENTRY PROJECT Pursuant to A.R.S. § 42-17106, transfer FY 2010-11 expenditure appropriation of $75,000 from the Non-Departmental (470) Non-Departmental Grants Fund (249) Non-Recurring/Non-Project (0001) “Potential Expenditures from Fund Balance” line to County Attorney (190) Check Enforcement Program Fund (266) Non-Recurring/Non-Project (0001). Approval of this action will allow the County Attorney’s Office to hire temporary personnel to enter data into the Check Enforcement’s accounting and case management system. It will also allow the County Attorney to procure training from the accounting software vendor for program and technical support personnel. In 2008, the County Attorney’s Office implemented a new financial and case management system that integrated the County Attorney Information System (CAIS) software with a robust accounting system purchased from a third-party developer. At the time, historical data prior to 2008 was not entered into the new system, nor could it be converted. The missing data has proven problematic and made reconciliation of accounts difficult and time consuming. Once all the historical records are entered into the system, it is expected that future reconciliations will be more accurate and timely. This request is to utilize unexpended fund balance for a one-time purchase of temporary services and vendor training. There is no expectation of a continuation of expenditures past FY 2010-11. FOR PHYSICAL MAP REVISION/MAP MAINTENANCE SERVICES Award Contract FCD 2010C003, Physical Map Revision/Map Maintenance Services for professional engineering services to Michael Baker Jr., Inc. The contract is necessary to perform remaining services under a current FEMA grant through the District’s Cooperating Technical Partner agreement with FEMA. The type of contract is an On-call, which means that work will be performed through individual Work Assignments and billed by time and materials for the individual assignments. The total contract amount shall not exceed $700,000.00, all of which will be reimbursed by FEMA. The performance period will not exceed a total of nine hundred and forty (940) calendar days. This was a qualification-based selection in accordance with Maricopa County Procurement Code, Article 5, Paragraph 504. In conjunction with updating the DFIRMs, the contractor will update the Flood Insurance Study (FIS). Recently, FEMA has encouraged this practice for the larger flood studies produced by the District, and it is an extension of their existing program for issuing Letters of Map Revision (LOMRs) down to the local management level.
