28. DISCLAIMER OF INTEREST REAL PROPERTY Approve a Notice of Non-Acceptance which disclaims any real property interest and renunciates a quit claim deed recorded in document number 19580317, Docket No. 2428, Page 111 1, official records of Maricopa County, Arizona. Authorize the Chairman to execute the Notice of Non-Acceptance. A property owner attempted to deed over interest in real property to Maricopa County for roadway purposes in 1958. The property was never accepted by the Maricopa County Board of Supervisors and construction of a roadway never took place. The Town of Paradise Valley annexed the area several years later and never constructed a roadway. An adjacent property owner desires to develop his property but is unable to ascertain the actual ownership of the area. Since the Maricopa County Board of Supervisors never accepted the deed on behalf of Maricopa County, the quit claim deed is a cloud on title. The Maricopa County Department of Transportation has reviewed this deed and has determined this property will not be needed for roadway purposes. It is believed that a disclaimer of real property interest document will assist in clearing the title of the property and save Maricopa County future legal costs in quiet title litigation. 30. ASSIGNMENT OF EASEMENT FROM MARICOPA COUNTY TO THE CITY OF MESA Approve and execute an Assignment of Easement from Maricopa County to the City of Mesa. This Assignment of Easement identifies a drainage easement obtained by Maricopa County as part of the County Arterials (ARTS) Project, Sub-Project No. T068, Ellsworth Road from Germann Road to Ray Road; a road widening improvement project accomplished in partnership with the City of Mesa. This improvement project was conducted in accordance with an Intergovernmental Agreement with the City of Mesa recorded in Maricopa County Records 2000-0203874 and approved by the Board of Supervisors on March 15, 2000. This drainage easement was acquired by Maricopa County in an unincorporated Maricopa County lying within Section 34 of Township One (1) South, Range Seven (7) East. Maricopa County entered into an Intergovernmental Agreement (C-64-00-169-2) with the City of Mesa to widen and reconstruct Ellsworth Road between Germann Road and Ray Road. This Intergovernmental Agreement was approved by the Board of Supervisors on March 15, 2000 and was recorded in Maricopa County Records 2000-0203874. As part of this project it was necessary to acquire roadway right-of-way and drainage easements for the improvement of Ellsworth Road. The City of Mesa, per said Intergovernmental Agreements, is required to annex the right-of-way and operate and maintain the roadway after completion of the project, which has occurred. A drainage easement acquired by Maricopa County and recorded in Maricopa County Records 2008-0853012 is located in an area that Mesa is unable to annex. 31. CONTRACT WITH QUEEN CREEK IRRIGATION DISTRICT Approve and authorize the Chairman of the Board to execute the contract between Maricopa County (County) and Queen Creek Irrigation District (QCID) to relocate QCID’s facilities within the project limits of Riggs Road, from Hawes Road to Ellsworth Road. The cost of the completed work is estimated to be $1,218,971.47. Funds are available in Transportation (640) Transportation Capital Projects Fund (234), County Arterials (ARTS) Project, Sub-Project T375. The purpose of this relocation effort is to move QCID facilities out from under roadway improvements occurring on Riggs Rd. between Ellsworth Rd. and Hawes Rd. and to relocate QCID facilities located in the intersection of Hawes Rd. and Riggs Rd. This project requires QCID to relocate approximately 3500’ of 48” reinforced concrete pipe as well as the road crossing and siphon structure at the intersection. This project is necessary because Riggs Rd. will be a major traffic artery in the community. This will be part of building Riggs Rd to a five lane section from Ellsworth Rd. to Power Rd. QCID also is a major irrigation water provider in the local community and helping them relocate their facility so as to provide the best service to the area allows the area to continue to grow and develop. 44. AMENDMENT TO THE MARICOPA COUNTY LAW ENFORCEMENT OFFICERS MERIT SYSTEM RULE 11.07 Amend Law Enforcement Officers Merit System Rule 11.07 as follows: "Each party will have a maximum of three and one-half (3.5) hours to present the case including opening statement; direct exam, cross exam, and re-direct/re-cross of witnesses; objections; and closing argument. Time spent on cross examination and re-cross counts against the total time allotted to the party conducting the examination. The Hearing Officer shall have the authority to grant up to an additional 7 hours (total) of testimony. The Hearing Officer shall not allow testimony beyond 14 hours total without prior approval from the Law Enforcement Officers Merit System Commission chairman or designee. The Maricopa County Law Enforcement Officers Merit System Commission recommends that the Board of Supervisors amend Law Enforcement Officers Merit System Rule 11.07 to define a stated amount of time for each party to represent their side of the case in a merit appeal hearing, as well as limit the Hearing Officer’s authority to grant additional time for testimony. This proposal arises from the fact that Rule 11.07 currently does not dictate a time limit for merit appeal hearings. Without specific time limits, it is difficult for the Human Resources Department to plan and budget for hearing costs, especially in instances where hearings extend into days and weeks in length. Additionally, Rule 11.07 currently does not define the Hearing Officer’s authority when determining the length of a hearing. While the proposed amendment includes specific timeframes, it is acknowledged that some hearings may require more time than others due to the scope and complexity of the appeal. In these rare instances, the Commission chairman or designee will have the authority to allow for additional time if requested by the Hearing Officer. (C-31-13-001-6-00)

F-1. IGA AMENDMENT WITH TOWN OF GILBERT AND TOWN OF QUEEN CREEK FOR THE SONOQUI WASH CHANNELIZATION - QUEEN CREEK WASH TO CHANDLER HEIGHTS ROAD Approve Amendment FCD 2004A015A to Intergovernmental Agreement (IGA) FCD 2004A015 for the Sonoqui Wash Channelization – Queen Creek Wash to Chandler Heights Road Project (Project) among the Town of Gilbert (Gilbert) and the Town of Queen Creek (Queen Creek) and the Flood Control District of Maricopa County (District). IGA FCD 2004A015 was approved by the Board on March 23, 2005 (C-69-05-100-2-00) and defined construction and operation and maintenance responsibilities. The IGA Amendment modifies the operation and maintenance obligations for the District and Gilbert. The IGA shall become effective when recorded at the office of the County Recorder. The project includes channelization of Sonoqui Wash from the confluence with Queen Creek Wash upstream to Chandler Heights Road and includes a large sediment basin within the channel at the confluence with Queen Creek Wash, located downstream of Higley Road within the jurisdiction of Gilbert. IGA FCD 2004A015 includes responsibilities for both Gilbert and Queen Creek to operate and maintain the project within their respective jurisdictions. The District has on-going operation and maintenance responsibilities for Queen Creek Wash including at the confluence with the project, and including removal of sediment from Queen Creek Wash. Sediment from the project that is captured in the large sediment basin is generated from both Gilbert and Queen Creek. The District has operation and maintenance capabilities for sediment removal that the towns do not have. By this Amendment the District will be responsible for occasional sediment removal from the large sediment basin, and Gilbert will retain all of its other operation and maintenance responsibilities of the project. The total estimated Project cost is $27,500,000. NRCS has determined that $6,070,257 of this amount is not eligible for federal cost share. This IGA establishes the cost-share for the design, land acquisition, construction, and operation and maintenance of the Project. The estimated total federally eligible project cost is $21,419,743, with the District’s estimated share being $7,409,203 and NRCS’s estimated share being $14,020,540.
