20. OFFER OF SETTLEMENT AND ABATEMENT SUBJECT TO RECEIPT OF PAYMENT Approve an offer of $50,000 from receiver of Pizza Revolucion, LLC (“Debtor”) in full satisfaction of taxes, interest and penalties due for personal property (equipment) tax due on the parcels noted below and for the specified tax years. Debtor owns 11 stores which were placed in receivership by a judge. The Receiver sold the restaurants, including the equipment, in March, 2015 without notice to the Treasurer. When the County learned of the sale and approached the Receiver about the personal property taxes, the Receiver agreed to hold funds to pay the taxes, but requested that a portion of the taxes be abated. The purchase price was not allocated between the real property, the franchise agreements and the personal property and the Receiver contends the buyer would not have paid more than $50,000 for the equipment if sold separately, based on the age and condition of the property sold. On August 11, 2016, after negotiations, the Receiver offered to pay $50,000 of the amount due. Treasurer recommends the County accept the settlement subject to receipt of payment from the receiver. Authorize the Chair to execute settlement documents and release of unpaid taxes conditioned on receipt of payment. Authorize the Treasurer to abate remaining unpaid taxes for parcels numbers, tax years and amounts shown below upon finalization of the settlement: 992-32-042, 2013, $3,137.46 992-32-061, 2013-2016, $16,385.79 992-32-070, 2013-2016, $16,385.79 992-32-089, 2013-2016, $19,744.37 (C-43-17-010-M-00)

RESOLUTION FOR PARTICIPATION IN STATE OF ARIZONA FAMILY COUNSELING PROGRAM Participate, by resolution, in the State of Arizona Family Counseling Program for FY2016-17, administered by the Juvenile Court pursuant to A.R.S. §8-261 through 8-265 for the purpose of strengthening family relationships and prevention of juvenile delinquency. Authorize $69,290 (budgeted) matching General Funds for FY2016-17. The Juvenile Probation Department in Maricopa County has participated in the Family Counseling Program provided by the Arizona State Legislature, A.R.S. §8-261 through 8-265 for over 40 years. The objective of the program is to divert delinquent or incorrigible offenders from the court process by providing counseling until the family can mobilize its own resources for meeting its problems. In addition, the counseling is provided to reduce referral frequency to the Juvenile Probation Department. The allocation to Maricopa County for FY2016-17 is $360,532 which will be disbursed by the Administrative Office of the Supreme Court. A 4 to 1 ratio County match is required in the amount of $69,290 and is included in the Juvenile Probation Department's FY2016-17 budget. A resolution by the Board of Supervisors will make it possible for approximately 1,500 families to participate in the Family Counseling Program during the next fiscal year. (C-27-17-001-G-00)

44. GRANT FUND NON-RECURRING BUDGET APPROPRIATION ADJUSTMENT FOR OFFICE OF EPIDEMIOLOGY Approve a one-time expenditure of $109,437 from fund balance in the Department of Public Health Grant Fund (532). In addition, per A.R.S. 42-17106(B), reduce the FY2017 expenditure appropriation in the Non-Departmental (470) Non-Departmental Grants Fund (249) Non-Recurring (1001). Potential Expenditures from Fund Balance line by $109,437 and increase the FY2017 expenditure appropriation in the Department of Public Health (860) Department of Public Health Grant Fund (532) Non-Recurring/Non-Project (1001) by $109,437. Approval of this action will support the Office of Epidemiology’s mandated investigations of communicable diseases by allowing the hiring of two County Contract positions for the period of October 1, 2016 through December 31, 2018. This appropriation will provide the funding for October 1, 2016 to June 30, 2017. The Department of Public Health’s FY2016-17 indirect rate for grants is 15.1%; therefore $14,357 is allowable and fully recoverable. The Office of Epidemiology (EPI) would like to request a one-time use of grant fund balance moneys to create two (2) contract positions for communicable disease investigators to support the nurse epidemiologists with a surge in Zika investigations and to assist with additional outbreak investigations. We are currently in the midst of a county wide Cryptosporidium and a large Salmonella outbreak that are continuing to spread in the community, both of which have caused us to exceed our epidemiology capacity, which is already stressed with over 400 Zika investigations ongoing. Because we anticipate the workload from Zika investigations to continue and likely increase for at least one year, and the backlog of additional cases from prioritizing work to take even longer, this position would be active until December 31, 2018 Detailed cost list below: Salary: $65,458 Benefits: $29,622 Indirect Costs: $14,357 Total: $109,437 Continuation of these positions will be requested in the FY2017-18 budget. 57. RULE REVISIONS TO ADDRESS THE REQUIREMENTS OF THE STATE IMPLEMENTATION PLAN FOR “MODERATE” NONATTAINMENT FOR THE 2008 EIGHT-HOUR OZONE NATIONAL AMBIENT AIR QUALITY STANDARD Pursuant to A.R.S. §§ 49-479(b), set a public hearing for November 2, 2016 to solicit comments and consider the adoption of Maricopa County Air Pollution Control Regulations: Rule 322 (Power Plant Operations), Rule 323 (Fuel Burning Equipment From Industrial/Commercial/Institutional Sources), Rule 324 (Stationary Internal Combustion (IC) Engines), Rule 336 (Surface Coating Operations), Rule 342 (Coating Wood Furniture And Fixtures), Rule 350 (Storage Of Organic Liquids At Bulk Plants And Bulk Terminals), Rule 351 (Loading Of Organic Liquids), Rule 352 (Gasoline Delivery Vessel Testing And Use), Rule 353 (Gasoline In Stationary Dispensing Tanks). The Board is requested to authorize the Maricopa County Air Quality Department to submit the amended rules as a revision to the (Arizona) State Implementation Plan. Upon Board approval, this item will become effective November 2, 2016. Volatile organic compounds (VOCs) and nitrogen oxides (NOx) are precursors of ozone. Since Maricopa County has been reclassified to “moderate” nonattainment for the 2008 eight-hour ozone NAAQS, the Clean Air Act requires Maricopa County to implement reasonably available control technology (RACT) to control VOC and NOx emissions. The following six rules are being revised to address RACT for VOCs: AQ-2015-005-Rule 336 (Surface Coating Operations) AQ-2015-006-Rule 342 (Coating Wood Furniture And Fixtures) AQ-2015-008-Rule 350 (Storage Of Organic Liquids At Bulk Plants And Bulk Terminals) AQ-2015-008-Rule 351 (Loading Of Organic Liquids) AQ-2015-008-Rule 352 (Gasoline Delivery Vessel Testing And Use) AQ-2015-008-Rule 353 (Gasoline In Stationary Dispensing Tanks) The following three rules are being revised to address RACT for NOx: AQ-2015-002-Rule 322 (Power Plant Operations) AQ-2015-003-Rule 323 (Fuel Burning Equipment From Industrial/Commercial/Institutional Sources) AQ-2015-004-Rule 324 (Stationary Internal Combustion (IC) Engines) Permit fees are not changing due to this action.
