50. ADMINISTRATIVE CORRECTION FOR SUPPLEMENTAL FUNDS FOR THE MARICOPA COUNTY FY2011-12 HEAD START/EARLY HEAD START BASE FUNDING GRANT Approve an Administrative correction to the action taken on July 1, 2011 (C-22-11-078-G-00) to apply for and accept supplemental funding for the Maricopa County FY2011-12 Head Start/Early Head Start Base Funding Grant (C-22-11-050-P-00) from the U.S. Department of Health and Human Services (DHHS)/Administration for Children and Families (ACF/Office of Head Start (OHS), 09CH7096. This action reflects a decrease of $581,992 from the funding originally applied for ($2,327,972) and the actual amount awarded ($1,745,980) for FY2011-12. The sub-recipient (delegate agency) of this grant received $522,068 of the supplemental funds awarded. The decrease will reduce the total not-to-exceed amount for the Maricopa County FY2011-12 Head Start/Early Head Start Base Funding Grant with supplemental funding from $22,261,869 to $21,679,877. The Fiscal Year 2012 Human Services Department indirect cost rate is 16.1%. The total decrease in grant funds are $581,992, of which $174,020 would have passed through to sub recipients. These funds were not added to the overall grant budget as they were never awarded. On May 11, 2011, Maricopa County Head Start Zero-Five Program received notification that the program was eligible to apply for $2,327,972 (annual funding) in base supplemental funding for Head Start and Early Head Start services for FY2011-12. The funding was initially provided for only six months (one-half the total funding) pending approval of the FY12 federal budget. Three months of additional FY12 funds were awarded by the Office of Head Start without further application being required ($581,993). As indicated in the July 1, 2011 (C-22-11-078-G-00) board action, changes to the total award amounts are being submitted as a correction item to the Board of Supervisors. The supplemental funds require a twenty-five percent match (up to $581,994) from in-kind contributions. The revised award will reduce this in-kind requirement by $145,499. The grant and matching funds do not include any Maricopa County General Funds. (C-22-11-078-G-01)

Subsequent to the action taken on August 31, 2011, it was determined that the communities of Mesa, Chandler and Tempe contributed CDBG funds towards the construction and/or expansion of the Mesa Food Bank building; therefore entitling them to a portion of the repayment of CDBG funds from the County. This amended action changes the distribution of the funds to transfer only $252,127 to the County Community Development Block Grant (CDBG) program as a result of the change in use of the Mesa Food Bank building. In addition, approve payments totaling $53,873 to be paid to the cities that contributed CDBG funds to the Mesa Food Bank building. While the total repayment of CDBG funds totals $306,000 as originally approved by the Board, this action changes the payment schedule as follows: Maricopa County CDBG: $252,127 City of Mesa - CDBG: $ 44,523 City of Chandler - CDBG: $ 7,866 City of Tempe - CBDG: $ 1,484 Total Repayment to Cities: $ 53,873 Total Repayment of CDBG: $306,000 The Mesa Food Bank was constructed and subsequently expanded using County Community Development Block Grant funds received from the U.S. Department of Housing and Urban Development. The Mesa Food Bank building is no longer being utilized as a food bank. In accordance with 24 CFR §570.505, if the County wishes to change the use of a CDBG–funded building, a public hearing must be held to solicit comments on the proposed changes. If the proposed use does not meet CDBG requirements, the CDBG program must be repaid at the fair market value of the building. (C-22-12-006-G-02)

72. PROPOSED AMENDMENT TO RULE 314 (OPEN OUTDOOR FIRES AND INDOOR FIREPLACES AT COMMERCIAL AND INSTITUTIONAL ESTABLISHMENTS) Pursuant to A.R.S. §49-479(b), set a public hearing for July 25, 2012 to solicit comments and consider the adoption of proposed amendments to Rule 314 (Open Outdoor Fires and Indoor Fireplaces at Commercial and Institutional Establishments) and to submit the amended rule as a revision to the (Arizona) State Implementation Plan (SIP). Upon Board approval, this item will become effective July 25, 2012. The Maricopa County Air Quality Department is proposing to revise Rule 314 (Open Outdoor Fires and Indoor Fireplaces at Commercial and Institutional Establishments) in order to clarify circumstances under which limited testing of potentially explosive-containing products during restricted-burn periods would be allowed. The testing in question was found to emit a trivial amount of particulate matter, however, failure to conduct the testing as scheduled would result in potentially significant negative impacts on the operations and finances of the affected companies. The tests consist of a limited number of discrete events usually lasting mere seconds and releasing minimal particulates. (C-85-12-023-7-00)

AMENDMENTS TO MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS RULES 321, 360, 370, 371 AND APPENDIX G Pursuant to A.R.S. §49-479(b), set a public hearing for July 25, 2012 to solicit comments and consider the adoption of proposed amendments to Maricopa County Air Pollution Control Regulations, Rule 321: Municipal Solid Waste Landfills; Rule 360: New Source Performance Standards; Rule 370: Federal Hazardous Air Pollutants Program; Rule 371: Acid Rain; and Appendix G: Incorporated Materials. Upon Board approval, this item will become effective July 25, 2012. The Maricopa County Air Quality Department is proposing to revise Rule 321: Municipal Solid Waste Landfills; Rule 360: New Source Performance Standards; Rule 370: Federal Hazardous Air Pollutant Program; Rule 371: Acid Rain; and Appendix G: Incorporated Material by incorporating by reference federal regulations and documents promulgated by the EPA and published in the Federal Register: New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. These revisions should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rule or law was proposed and adopted. (C-85-12-022-7-00)

74. AMENDMENTS TO RULE MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS RULE 358 (POLYSTYRENE FOAM OPERATIONS) Pursuant to A.R.S. §49-479(b), set a public hearing for July 25, 2012 to solicit comments and consider the adoption of proposed amendments to Maricopa County Air Pollution Control Regulations, Rule 358 (Polystyrene Foam Operations). Upon Board approval, this item will become effective 07/25/2012. Maricopa County Air Quality Department is proposing a limited revision to Rule 358 (Polystyrene Foam Operations) to address requirements of performance test frequency. Rule 358 currently requires expandable polystyrene foam operations to test their Emissions Control Systems (ECS) once a year. At the time of adoption of Rule 358 on April 20, 2005, the department and the Environmental Protection Agency (EPA) believed annual performance testing was necessary because the expandable polystyrene (EPS) industry did not have a Control Techniques Guideline, standard AP-42 emissions factors, or a track-record of comparable performance test results. Since the adoption of Rule 358, there is sufficient compliance and performance test history to demonstrate the necessity of conducting a performance test only once every five years. F-1. PRESENTATION FOR COMMUNITY RATING SYSTEM CLASS 4 Presentation regarding the Community Rating System Class 4. Unincorporated Maricopa County is being recognized by the National Flood Insurance Program’s (NFIP) Community Rating System (CRS) with a Class 4 rating. Unincorporated Maricopa County is one of only 12 communities in the country to have a CRS Class 4 rating or better. Flood insurance policyholders located within special flood hazard areas (SFHA) will receive a 30 percent reduction on flood insurance premiums, and those outside the SFHA will receive a 10 percent discount. The average annual discount for a policy located in the SFHA will be $215. The CRS rewards communities that voluntarily implement programs and policies that go beyond the NFIP’s minimum requirements. These actions reduce a community’s vulnerability to flooding and help to make the community more resilient and sustainable. Unincorporated Maricopa County earned its CRS Class 4 rating because of higher regulatory standards, public outreach, floodplain management planning, flood warning, watershed master planning, buy out programs, open space preservation, identification of floodplains, and drainage system maintenance. Over 21,000 communities in the country participate in the NFIP and 1,200 participate in CRS. The Flood Control District manages unincorporated Maricopa County’s participation in both the NFIP and CRS. H-2. APPROVE AMENDED SEVERANCE POLICY HHR-19 Adopt Resolution No. 12-011 and approve amended Severance Policy previously approved on March 30, 2011. The U.S. Department of Housing and Urban Development (HUD) conducted a Management and Financial review of the Housing Authority of Maricopa County (HAMC) in March 2010 which resulted in several Findings, Concerns and Observations. HAMC submitted a Corrective Action Plan (CAP) to HUD regarding the deficiencies that were noted. Finding #4 of the CAP stated that Severance Pay to Executive Director did not Meet Cost Allowability Requirements in 2 CFR Part 225 (OMB Circular A-87). Per HUD's recommendation HAMC added a clause that any severance pay paid that exceeds the “one week pay for each completed year” provision will not be paid from federal funds without prior approval of the cognizant Federal agency. HAMC has made the needed additions and the amended Severance Policy HHR-19 is now ready for approval and submission to HUD. The policy will become effective upon Board of Commissioners approval and has no financial impact.
