26. REFUND TO ALL DELTA DENTAL INSURANCE POLICYHOLDERS Authorize the Employee Benefits and Health Department to pay a pro rata refund of up to $470,000 to employees who were Delta Dental policy holders through The Delta Dental Insurance Co. during the period July 1, 2014 to June 30, 2015. Delta Dental is a fully Insured dental plan. It is intended to be cost neutral to the Trust as premium costs paid to Delta should be 100% recouped thorough the premiums charged to employees and their departments. In the spring of 2014, Delta Dental reduced rates for Plan Year 2015 after employees had already enrolled in dental plans through open enrollment. This resulted in employees being charged the rate that was approved by the Board of Supervisors during plan year 2015, while the Trust paid Delta Dental the lower rate which appeared in the Contract. The result was a surplus for FY2015 of approximately $455,840. The Maricopa County Self-Insured Benefits Trust Fund Board of Trustees was informed of the proposed action at their regular meeting on August 17, 2015. (C-39-16-005-2-00)

29. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY Approve financial Amendment No. 3 to the financial Intergovernmental Agreement (IGA) with Arizona Department of Economic Security (DES) and Maricopa County, administered by its Human Services Department (HSD) for Workforce Investment Act Activities. The purpose of the Amendment is to decrease the unobligated fund balances for Program Year 2014 by $4,285,085 and Fiscal Year 2015 by $5,946,794 a total of $10,231,879. This decreases the reimbursement ceiling from $26,545,209 to $16,313,330. The funds were provided under the Workforce Investment Act (WIA) Title, 1B Federal Grant program from the U.S. Department of Labor passed through DES. The Workforce Innovation and Opportunity Act (WIOA) was signed into federal law on July 22, 2014 as Public Law 113-128. WIOA replaces and supersedes the Workforce Investment Act of (WIA) of 1998. Therefore, these funds are no longer available. Amendment No. 3 also revises the termination date of the IGA from June 30, 2018 to December 31, 2016. This will allow for all final expenditure reporting for the funds to be completed. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. These unobligated WIA funds will be converted to WIOA funds by DES and an amendment will be issued to apply the funding dollars to the IGA between DES and Maricopa County (C-22-16-004-3-00) that was approved by the Board of Supervisors on August 14, 2015, under the Workforce Innovation and Opportunity Act. F-1. CHANGE ORDER WITH STANTEC CONSULTING SERVICES INC. FOR THE POWERLINE, VINEYARD RD, AND RITTENHOUSE FLOOD RETARDING STRUCTURES ON-CALL DESIGN PROJECT Approve Change Order No. 1 for Contract FCD2013C004 – Powerline, Vineyard Road, and Rittenhouse Flood Retarding Structures On-Call Design Project to Stantec Consulting Services, Inc. Change Order No. 1 is to authorize a cost increase of $2,700,000. This cost increase would bring the total Contract cost to $5,500,000. The contract performance will remain 1825 calendar days effective the date of the Notice to Proceed. On February 26, 2014 the Board authorized award of Contract Number FCD 2013C004 (C-69-14-028-5-00) under qualification based procurement. This contract included the designs of both the Vineyard Road Flood Retarding Structure (Vineyard FRS) Rehabilitation Project and the Powerline Channel (Channel) Project. The original contract amount was based on the design of the selected alternative from the Planning Study that was completed in July 2013. The selected alternative was for a Channel to replace the Powerline FRS which is to be decommissioned and for Vineyard FRS to be raised and rehabilitated while Rittenhouse FRS is to be converted to a levee that would discharge to Vineyard FRS flood pool. Federal funding was received from the Natural Resources Conservation Service (NRCS) based on the stipulation that both the Channel and the Vineyard FRS Projects be completed by September 30, 2018. Rittenhouse FRS design and construction was not included in this funding. During the design phase, it was determined that the Rittenhouse FRS would need to remain a dam. The selected alternative needed to be revised and multiple revisions occurred due to changes to the hydrology per ADWR requirements. Because of the revised hydrology, developing the height of the dam and the height of the spillway crest took multiple iterations. Vineyard FRS Project is being constructed by a Construction Manager at Risk to help facilitate completing construction by September 2018 while producing a high quality project. The consultant was designing Vineyard FRS Project in two phases but the contractor recommended three phases so construction could begin sooner. The consultant now has to produce three sets of design plans instead of two. The Powerline Channel also needed multiple revisions to determine the final alignment due to constraints that were identified in the design stage. The Channel has to be located between SRP power poles, cannot extend outside of the District easement, needs to avoid the dam extension, and be able to drain to the Vineyard FRS flood pool. The original contract amount did not account for this additional work. Additional funds are needed to complete both designs and to keep both projects on schedule which will help assure no loss of federal funding. This additional funding will also include post design services, such as surveying for pay quantities and addressing contractor “Request for Information” memos. These projects protect areas located in Supervisorial Districts 1 and 2. (C-69-14-028-5-01)

F-4. AMENDMENT TO CONSTRUCTION MANAGER AT RISK CONTRACT FOR WHITE TANKS FLOOD RETARDING STRUCTURE #4 - PHASE 2 Amend the authorization under agenda item number C-69-12-049-5-00 for the Flood Control District of Maricopa County (District), which authorized the award of a Pre-Construction Contract and a Construction Services Contract (FCD 2011C022). This amendment will increase the not to exceed amount to $27,000,000. The previous authorized amount was $19,000,000. This action will allow the construction contract to be processed more expeditiously when signed. The Joint Venture of Sundt/Rummel was selected under a qualification-based selection in accordance with Maricopa County Procurement Code, Article 5, Paragraph 504(F) and Article IV of the Maricopa County Procedures Manual. White Tanks Flood Retarding Structure (FRS) No.4 is an earth embankment flood control dam designed and built by the Soil Conservation Service (now the Natural Resources Conservation Service, or NRCS) in 1954. The dam is located one half mile south of Interstate 10 on the west side of Jackrabbit Trail. The dam is operated and maintained by the District and is regulated by the Arizona Department of Water Resources (ADWR). The planning phase of the Project recommended overall rehabilitation of the dam. Phase I of the overall rehabilitation is completed and consisted of the removal of the existing central filter material and replacement with a suitably engineered filter material. The central filter is an element of the dam that is designed to prevent a failure of the dam due to embankment cracking. Phase II will remove the two existing corrugated metal pipe outlets and replace them with a single concrete outlet pipe system. The left auxiliary spillway will also be removed by extending the left abutment of the dam to the north. The right auxiliary spillway will be widened to accommodate the removal of the left spillway and the flood pool will be graded to remove the existing pit and dead storage. In addition the embankment will be raised to accommodate future land subsidence and regulatory requirements for freeboard and modified as needed to address all remaining dam safety issues.
