The land use enhances the value of the property above its value as of the date the land use change is granted and reverting to the prior land use designation results in the same value of the property as if the land use change had never been granted. In response to requests from the Directors of the Flood Control District, Transportation and Facilities Management, staff recommends an amendment to the single work assignment limit on a job order contract from $1 million to $2 million. Due to rising construction costs, this change is necessary in order to continue to use the JOC project delivery method effectively. • MC1-346.D & E Increase nominal value from $5,000 to $10,000 in order to conform with 2 C.F.R.§200.67 (Uniform Guidance) and Arizona Administrative Code §R2-7- D302. MOU WITH THE INTERNAL REVENUE SERVICE, CRIMINAL INVESTIGATION Approve the Detect Financial Crimes Task Force Memorandum of Understanding (MOU) between the Internal Revenue Service, Criminal Investigation and the Maricopa County Sheriff’s Office, for joint operations/task force expenses from the Treasury Forfeiture Fund and acceptance of up to $15,000 per officer per federal fiscal year for reimbursable monthly overtime for MCSO task force members. This MOU is for a period of two years from the date signed. This is a recurring, non-competitive funding award that the Sheriff’s Office has received for more than six (6) years. There is no in-kind or cash match requirement nor are there future or ongoing contributions required after the grant period ends. The Sheriff’s Office indirect cost rate for FY21 is 14.6% and is applicable the entire award amount of $15,000 which result in indirect costs of $2,190 to be absorbed by the Sheriff’s General Fund. The trade-in credit of $13,600 per machine ($27,200 total) will be applied to the purchase of newer models. This trade-in credit is a significant discount for the County as similar PCR models are typically sold for half the price Environmental Services has been quoted. Were the Department to take the PCR machines to auction, Environmental Services would need to pay for professional decontamination of the machines and average auction price for similar machines is significantly less than what the department has been quoted for the trade-in. The overall benefit to the County for exchange of these items in this manner is projected to far exceed the expected auction value. (C-88-21-024-X-00)

50. ACCEPTANCE AND USE OF GIFT CARDS FOR THE TUBERCULOSIS CONTROL INCENTIVE PROGRAM Approve the acceptance and use of gift cards provided by Arizona Department of Health Services (ADHS), to Maricopa County by and through its Department of Public Health (MCDPH), Tuberculosis Control Program. The MCDPH TB Clinic has received a donation of 500 cards at $10 each for a total value of $5,000. Gift card and voucher donations have been received by the TB program for a number of years. We expect them to continue. Cash and/or in-kind match is not applicable, nor will ongoing cash contributions be required should they cease to be provided. TB Services are a mandated function and donations such as these incentivize the treatment program. Awareness and treatment of TB patients is a benefit to our citizens. To our knowledge, the donations to the TB program are not given in a competitive manner. Program costs associated with the donations are absorbed by the TB programs grant budget. Administration costs are absorbed the department’s operating budget. MCDPH’s indirect rate for FY21 is 18.8%. This in-kind donation does not allow for indirect, therefore, indirect expense estimated at $791 are not recoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This donation does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this donation through a future reconciliation. Funding is provided by a donation from Walmart and ADHS and will not affect the County’s general fund. The gift cards are to be used solely as incentives for clients receiving anti-tuberculosis treatment. Active cases of TB will have the highest priority, however, if warranted, these vouchers can be offered to high-risk contacts, particularly children receiving treatment for latent Tuberculosis infection. 56. ADMINISTRATIVE CORRECTION TO WIC LEASE L-7461 WITH CHICANOS POR LA CAUSA Approve an administrative action to confirm the commencement date of original WIC lease agreement L-7461 between Chicanos Por La Causa, Inc. and Maricopa County to begin June 1, 2016 (“Commencement Date”) and all other documents approved by legal counsel required to complete this action item. Maricopa County, on behalf of Public Health WIC, lost its lease with Maryvale hospital and needed a new site to operate a regional WIC facility. The new site Agreement was approved on November 18, 2015 as (C-86-16-044-01-00) for the use of leased retail office space located at 6850 W. Indian School Road, Phoenix, AZ. This Agreement was tentatively scheduled to commence on February 1, 2016 once the tenant improvement and space buildout were complete. However, the scheduled tenant improvements were not completed in time for occupancy. The original Agreement was put on hold and replaced with temporary lease agreement L-7461A, approved on February 3, 2016 as (C-86-16-044-01-02). This temporary agreement allowed for use of a different leased space within the same building, on a month to month basis, beginning February 1, 2016 until the new site’s tenant improvements were complete and ready for tenant move in. The temporary agreement was retroactively terminated to end on May 31, 2016, approved on July 20, 2016 as (C-86-16-044-01-03). The tenant was able to move in and began paying for the new site on June 1, 2016, the commencement date. The Agreement term of the WIC facility site is for 60 months, commencing on June 1, 2016 and expires on May 31, 2021. (C-86-16-044-1-04)

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES Approve Amendment 1 to IGA CTR047666 between Maricopa County and ADHS - STD Program-Perinatal Caseworker, in the not-to-exceed amount of $107,000 for the project purpose of promoting a linkage to care to prevent syphilis and improve health outcomes in women and babies. The budget period is March 1, 2021 through February 28, 2022. The IGA term is extended through July 31, 2024. This is a new grant award and it is not certain whether it will reoccur. The award was non-competitive and there is no cash or in-kind match required. This is not a mandated service, but provides benefit to our community with efforts to link women with early pre-natal care to support healthy pregnancies and prevent congenital syphilis. Should this grant be discontinued, ongoing cash contributions should not be required. The Department of Public Health indirect rate for FY20 is 18.8%. Full indirect costs are estimated at $16,933, all of which are recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. All program costs are allocated to the grant so there will not be additional burden on the department’s operating budget. This contract is possible through a Federal Award to ADHS from the Centers of Disease Control and Prevention titled ‘Project W – Infants with Congenital Exposure’. The CFDA number is 93.323. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. Approval of this action does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-86-20-050-3-02)

65. CHANGE ORDER NO. 12 WITH PULICE CONSTRUCTION INC. FOR IMPACTS DUE TO PLAINS GAS LINES: NORTHERN PARKWAY - DYSART TO 111TH AVENUE Approve Change Order No. 12 with Pulice Construction Inc. to allow MCDOT to compensate the Contractor for negotiated compensation, inclusive of all subcontractors, for constructability delays and costs incurred due to impacts associated with Plains LPG Service Gas Lines. This change order shall be full and complete compensation for all direct cost, (labor, vehicles and equipment standby), and indirect cost, (Corporate overhead) submitted by and negotiated with the Contractor. This date range covers work that was ongoing as of April 2019 and prevented the planned phasing of the work by the Contractor through December 2020. Plains LPG Services has three high pressure gas lines in the Dysart Road alignment which do not have prior rights. Plains LPG Services issued a utility clearance letter for the project prior to it being advertised for construction bids. In February 2019 after construction had started, it was discovered that the gas lines did not have sufficient cover for the construction activities. Due to the age and condition of the pipes and the minimal cover, the work became a changed condition from the contractor’s planned construction methods. Change Order No. 12 will provide a cost increase to the current contract amount resulting from conflicts with the Plains LPG Services underground high pressure gas lines in Dysart Road. This Change Order provides compensation to the contractor for cost impacts that affected work activities due to conditions that were not defined in the contract bid documents. MCDOT concurred with the cost impacts of these differing conditions while work was being performed under the construction contract. Supervisory District No. 4 (C-64-17-135-5-12)

NORTHERN PARKWAY- DYSART TO 111TH AVENUE Approve Change Order No. 13 with Pulice Construction Inc. to allow MCDOT to compensate the Contractor for work completed on three bid item with significant quantity overruns. This change order also provides full and complete compensation for repairs to existing pavements that became necessary for traffic safety during the course of the project. Final field measured quantities exceeded the bid amounts by a significant amount for three bid items. This impact has affected the contract budget by reaching and exceeding the total funding that was encumbered. The work associated with the quantity overruns was requested and/or authorized by MCDOT during the course of the project. The total Bid item overrun is $ 245,697.12 and is eligible for federal reimbursement. During the course of the project, repairs to existing pavements became necessary to maintain traffic safety. This change order creates a pay item to fund Letter of Agreements between the Contractor and the Engineer for the repairs. A $10,000.00 (Non – Federal Aid) Allowance is requested to pay the contractor for this work. Supervisory District No. 4 (C-64-17-135-5-13)
