This Agreement will provide matching funds to support MCAQD’s Fireplace Retrofit Program which encourages the conversion of wood burning fireplaces to cleaner burning gas fireplaces, to aid in the reduction of particulate matter 2.5 (PM 2.5) during the wood burning season. This funding will supplement funding provided by MCAQD to residents in two targeted areas in the MCFRP program area, closest to the highest concentrations of PM 2.5 readings. PM 2.5 is an EPA pollutant that is known to cause damaging health issues, including acute asthma symptoms leading to hospitalization and heart disease, as the tiny pollutant can deposit deep into the lungs and enter the blood stream. If PM 2.5 should exceed the EPA 24 hour or annual standard, this could lead to more stringent regulations and negative economic impacts for Maricopa County. Donation revenue funds are deposited into Fund 504 as they are received. Also request authorization for the Chairman to sign Renewal Focus Award Letter and all documents related to these grant funds, as applicable. The purpose of the grant funds is to support HIV and/or hepatitis C testing and testing-related services (“Project”). The grant award availability begins on 07/01/2018 and ends on 06/30/2019. This grant award is a non-competitive award, but Correctional Health Services (CHS) submitted a continuation funding application in May 2018. This is the second year that Maricopa County has received the grant funds for participation in the Frontlines of Communities in the United States (Focus) grant from Gilead for the development of Hepatitis C and HIV programs with linkages to care. The grant allows up to a 10.0% rate for indirect costs. The Maricopa County Department of Finance has calculated the CHS’ composite indirect cost rate at 7.3%, which is fully recoverable and retroactive back to July 1, 2018. The indirect costs are estimated at $29,816.24, which are fully recoverable. There is no in-kind matching requirement. There are future ongoing contributions required after the grant period ends in the amount of $102,620, which was previously covered by the Ryan White Grant Fund for AIDS testing and ongoing contributions of $155,529, which was previously covered by the Detention Fund for Hepatitis C testing. This fulfils the mandated function of testing for Hepatitis C and HIV. The receipt of the grant award will not impact county funds. Also, request approval of revenue and expenditure appropriation adjustments to the Department of Correctional Health Services (D260) Grant Fund (292) Operating (OPER) associated with the grant in the amount of $436,032 for FY 2019. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The County was awarded initial grant funds from Gilead in April, 2017 in the amount of $339,377 for Project activities to begin on July 1, 2017. (C-26-17-007-G-01)

Weatherization activities can be extended to more than one project per home to allow additional measures to be implemented within the program calendar year. 6. For Lack of Regulatory Approval. In the event that the Program is not approved by the Arizona Corporation Commission ("ACC") or in the event that such approval is subsequently withdrawn or significantly changed, then the Company may immediately terminate this agreement upon written notice to Supplier. 7. Subsequent Year Allocation. Per the original Agreement, Section 3.A, the Allocation may be amended from time to time by APS. With regards to cost Allocation plans, APS reserves the right to review sufficient verification and pertinent reporting data as of November 1st of the 2018 program year and based on the percent of the Allocation spent, authorize the subsequent year Allocation forecast on this basis. However, if the 2018 year spend is equal to or more than 75% of the Allocation by November 1st, then the subsequent year Allocation shall be based on 100% of the Allocation as specified in the APS 2019 DSM Implementation Plan, subject to approval by APS or the “ACC”. 8. For work performed after that date and to the end of the Term, the Agency must email an estimate of expenses to the APS program coordinator no later than January 4, 2019. Reimbursement for late invoices for work performed in 2018 will be considered on a case by case basis. 10.
