ZANJERO TRAILS PARCEL 34D SUBDIVISION ASSURANCE AGREEMENT & RESOLUTION Approve Zanjero Trails Parcel 34D Subdivision Assurance Agreement with Maricopa County Municipal Water Conservation District Number One & SBH Zanjero Trails, LP; and Maricopa County. This agreement serves as part of the subdivision’s assurance as required by Arizona Revised Statutes §11-821(C) and must be approved by the Board of Supervisors prior to approval of the Final Plat for the Zanjero Trails Parcel 34D Subdivision (case number S2020006). This agreement to be recorded as required pursuant to A.R.S. §11-1101. The subdivision assurance agreement shall become effective on the date it is recorded with the Maricopa County Recorder. JOHNSON STEWART MATERIALS Case #: Z2017085 Supervisor District: 1 Applicant / Owner: Gammage & Burnham PLC / Johnson Stewart Materials Request: Rezoning from Rural-43 and IND-3 IUPD to IND-3 IUPD Site Location: Generally located 845’ southwest of the southwest corner of Loop 202 and Alma School Rd. in the Mesa area Commission Recommendation: On 10/8/20, the Commission voted 6-0 to recommend approval of Z2017085 subject to conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “Johnson Stewart Materials Plan of Development”, consisting of 3 full-size sheets, dated revised May 13, 2020, and stamped received August 7, 2020, except as modified by the following conditions. Within 30 days of Board of Supervisors approval, the applicant shall provide Planning and Development with an updated site plan with the IUPD standards. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Johnson Stewart Materials”, consisting of 12 pages, dated revised August 20, 2020, and stamped received August 21, 2020, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. The submitted plan shows extensive grading within ADOT right-of-way. A permit or other written approval from ADOT must be provided prior to building permit approval. 2. Prior to building permit approval, evidence of City of Mesa approval of the proposed fill over the reclaimed water line must be provided. 3. The site is located in a Special Flood Hazard Area (FEMA Floodplain Zone A). A floodplain use permit will be required for storage of materials in the floodplain, unless previously addressed as part of a Sand and Gravel Permit issued by the Flood Control District. 4. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 5. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the MCDOT Roadway Design Manual. 6. Detailed Grading and Drainage Plans showing the new site improvements must be submitted for the acquisition of building permits. d. The following IND-3 IUPD zoning district standards shall apply: 1. Front Yard (along eastern property line of 001B & 014): 0’ 2. Side Yard (along southern zoning boundary of 003J & 001B): 0’ 3. Parking Spaces: Standard parking and ADA parking provided at administration parcels on 135-06-003M & 003L. 4. Screening: Solid masonry or similar-type opaque wall not less than 6-feet in height shall be provided along, adjacent to, or within the Front Yard (Alma School Rd. parcel 135-06-003J). Screening adjacent to all other property lines shall not be required. e. The owner shall obtain as-builts permits on all existing unpermitted canopies identified as Structures A, B, D, E, F and G as shown on the site plan dated revised May 13, 2020. The owner shall obtain a final status on the as-built permits by March 31, 2021 deadline date as established in the associated Compliance Agreement. f. The zone change IUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires such. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. The following Luke Air Force Base condition shall apply: Marbella Ranch shall notify future occupants/tenants that they are located near a military airport with the following language: “You are locating in a residential dwelling inside the State Statute defined “territory in the vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly as low as 1,500 feet above the ground. You will be subject to direct overflights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. For further information, please check the Luke Air Force Base website at www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and Development Department.” Such notification shall be permanently posted on not less than a 3 foot by 5 foot sign in front of all leasing offices and be permanently posted on the front door of all leasing offices on not less than 8½ inch by 11 inch sign. f. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of the application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of the application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in the value of the property from the value it held on the date of application due to such revocation. Development of the site shall comply with the Zoning Exhibit entitled “Legal Description Marbella Ranch North Stip Mod and CPA Mod Limits”, consisting of 3 pages, dated revised June 2, 2020, and stamped received July 27, 2020, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Project Narrative Rezone Marbella Ranch North Stipulation Modification”, consisting of 11 pages, dated September 1, 2020, and stamped received September 1, 2020, except as modified by the following conditions. c. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and ARS §11-814. The term of this conditional zoning is approval of a final plat or plan of development, as applicable, for the initial phase of development within five years of Board of Supervisors approval of Z2014011, and then an additional five years to obtain final plat or plan of development approval as applicable for each successive phase of development. While not a term of the conditional zoning, the applicant shall submit a written report every five years from the date of Board of Supervisors approval of Z2014011 which details the status of the project, including progress on obtaining necessary entitlements, licenses, and permits; compliance with the conditions of approval; compliance with the approved narrative report; compliance with the approved land use plan; and justification as to how the approved zoning still represents appropriate land use planning for the property and unincorporated Maricopa County in accordance with the goals and policies in its comprehensive plan and applicable area plan and land use plans. The status reports to be administratively reviewed by Planning and Development with the ability administratively to accept or carry the status report to the Board of Supervisors (Board), upon recommendation by the Planning and Zoning Commission (Commission) for consideration of amendments or revocation of zoning for undeveloped parcels. Status reports will be required until completion of all final plats and/or plans of development. d. The following R-5 RUPD Zoning District standards for Single Family Traditional products shall apply: 1. Max. Height: 30’/2 stories for detached single family residential, 40’/3 stories for attached single family residential townhome 2. Min. Rear Yard: 5’ for detached single family residential, 5’ for attached single family residential townhome 3. Min. Lot Area: 4,000 sq. ft. 4. Min. Lot Width: 40’ for detached single family residential and 30’ for attached single family residential townhome 5. Min. Min. Rear Yard: 15’ g. Not less than 34 acres shall be developed as recreational open space to include playgrounds, tot lots, mini-parks and amenities. At the time of each preliminary plat submission, the developer shall include a description of the status, cumulative acreage and proposed amenities as identified with this condition. The 34 acres of required open space may be shared between both the north and south Marbella Ranch developments. h. All transformers, back-flow prevention devices, utility boxes and all other utility related ground mounted equipment shall be painted to complement the development and shall be screened with landscape material where possible. i. The following Planning Engineering conditions shall apply: 1) Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2) Condition noted on the attached memo from MCDOT Traffic Engineering dated 10/6/20: i. A traffic signal at the Collector Road & El Mirage Road intersection, and auxiliary turn lanes with appropriate storage lengths at access roads shall be provided in the infrastructure plans as part of Parcels 5 and 6. 3) Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. j. All interior streets within the proposed development are to be constructed to minimum County standards. k. Prior to issuance of any permits for development of the site, the applicant/property owner shall obtain the necessary encroachment permits from the Maricopa County Department of Transportation (MCDOT) for landscaping or other improvements in the right-of-way. l. Prior to any Final Plat approval, the applicant shall submit to the Maricopa County Planning and Development Department a “will serve” letter and verification of approval of a Maricopa Association of Governments (MAG208) amendment from Liberty Utilities which demonstrates a willingness and capability to serve Marbella Ranch. m. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. n. Development of the site shall be in compliance with all applicable Maricopa County Air Quality rules and regulations. o. An archeological survey shall be submitted to and approved by the Arizona State Historic Preservation Office prior to the issuance of a grading permit. The applicant must contact the State office prior to initiating disturbance of the site. The applicant shall provide the Planning and Development Department with written proof of compliance with this stipulation. p. The Final Plat shall have a note that the property is within an area of known land subsidence and/or earth fissuring. No development including paved roadways or residential lots within 100’ of the mapped confirmed fissure, drainage and storm runoff should not be concreted or directed towards the fissure or offsite area. Further, notice that the property is in area of known land subsidence and/or earth fissuring and a definition of both land subsidence and earth fissures shall be prominently displayed in the sales office, in the covenants, conditions and restrictions (CC&Rs), and in any disclosure statements for conveyance documents. However, if said report concludes negative impact regarding land subsidence and/or earth fissuring the required notification can include such results. q. Prior zoning clearance or Final Plat approval, developer(s) and/or builder(s) shall establish emergency fire protection services, covering all real property contained within the project area during course of construction and shall obtain a ‘will serve’ letter substantiating coverage from the appropriate Fire District, servicing the site. r. The following Maricopa County Sherriff’s Office (MCSO) conditions shall apply: 1) Prior to any final plat, the master developer shall enter into a development agreement with the Maricopa County Sherriff’s Office (MCSO) to provide law enforcement services to Marbella Ranch and surrounding areas. 2) This development agreement shall include, but not necessarily be limited to, the master developer’s requirement to pay their proportionate share for start-up costs (vehicle purchase and patrol equipment, e.g. radios, tasers, and vehicle laptops); and interim fees for law enforcement services associated with the property unless it is annexed into an incorporated municipality or until full law enforcement service contract is otherwise implemented. The development agreement may also include, but not necessarily be limited to the master developer’s requirement to donate to the County, for use by the MCSO, their proportionate share of separate office space complete with tenant improvements or land (the size to be determined in the development agreement), or payment of fees when a permit is issued. 3) This development agreement shall include the terms listed in this stipulation unless otherwise mutually agreed to by MCSO and the master developer; furthermore, the development agreement shall be signed by both the master developer and the MCSO and provided to the Maricopa County Planning and Development Department for public record. s. The following Drainage Review conditions shall apply: 1) Drainage review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the Maricopa County Drainage Policies and Standards. 2) All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. t. Variations to the development standards as indicated in the approved Unit Plan of Development (UPD) table may be varied by the Board of Adjustment in accordance with Article 303.2.2 of the Maricopa County Zoning Ordinance (MCZO). u. All habitable buildings constructed within this subdivision shall be constructed to attain a noise reduction level as per ARS § 28-8482(B). v. Amendments to the site plan and narrative report shall be processed as a revised application in accordance with Maricopa County Zoning Ordinance Article 304.9. w. Noncompliance with the conditions of approval will be treated as a violation in accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of approval may be grounds for the Planning and Zoning Commission to take action in accordance with Chapter 3 (Conditional Zoning). x. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. y. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of the application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of the application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in the value of the property from the value it held on the date of application due to such revocation. FUNDING FROM ARIZONA ATTORNEY GENERAL’S OFFICE FOR FY 2021 LAW ENFORCEMENT EQUIPMENT Approve the Agreement and acceptance of $50,000 in advance grant funding from the Arizona Attorney General’s Office (AG), for Law Enforcement Equipment. This one-time funding award was a result of a competitive process and there is no cash or in-kind matching requirement. The Sheriff’s Office indirect cost rate for FY21 is 14.6%. Unrecoverable indirect costs associated with this Agreement are estimated to be $7,300 and will be absorbed by the General Fund. There is no match and there are no future or on-going cash contributions required. This funding supports the Sheriff Office public safety mandate. 27. ADDITION OF VEHICLES TO JUDICIAL BRANCH SECURITY FLEET Approve a permanent addition to the fleet of two (2) vehicles for Judicial Branch Security. These vehicles will be purchased using non-recurring funds that exist within Superior Court’s (D800) approved General Fund (Fund 100) non-recurring (1001) budget at an estimated cost of $60,000. The purpose of Amendment No. 1 is to address the following: A. ADOH will provide the County with Low Income Home Energy Assistance Program (LIHEAP) Coronavirus Aid, Relief, and Economic Security (CARES) Act funds in the amount of $618,009. The LIHEAP-CARES Act funding is to be expended prior to other LIHEAP funding. The funds will be utilized to provide Weatherization Assistance Program measures in dwellings occupied by low-income households in Maricopa County outside of the City of Phoenix and the City of Mesa. The County will be required to serve eighty-one (81) units with LIHEAP-CARES Act funds. B. The Human Services Department utilizes the provisional indirect rate of 22.2% by the U.S. Department of Health and Human Services for FY2021 for salaries and employee related expenses. The total Amendment funds are $618,009 of which $40,558 is for salaries and benefits. The total estimated indirect costs are $9,004, and fully recoverable. Receipt of the funds from ADOH does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provides a benefit to the citizens by providing assistance to low-income residents with weatherization measures to reduce their energy burden and improving health and safety concerns. Additional recreational services, among other items, includes on-shore and offshore rental cabins and other short-term lodging facilities, including additional support facilities and amenities related to the provision of lodging services. The addition of 22 acres of land (Exhibit A-1) will allow Concessionaire to construct a dry boat storage complex. Administrative changes, among other items, include an increase in Concessionaire’s payment fees (Exhibit C-1) and Concessionaire’s reimbursement of certain utilities fees to the County. The Concessionaire shall also be responsible for any and all upgrades, future expansion or upgraded services to the well water delivery system as required due to future improvements, at the Concessionaire’s sole expense. Pursuant to Uniform Terms and Conditions, Provision (6) Contract Changes, (6.1) Amendments, Purchase Orders, and Change Orders, it is mutually agreed that the IGA referenced is amended as follows: 1.1 The Price Sheet is revised and replaced by the Price Sheet of this Amendment Three (3); and 1.2 Scope of Work, Page Nineteen (19), Provision 4.12, added item 4.12.2 that is hereby revised in this Amendment Three (3) to read: 4.12.2 Provide Supplemental Adult Flu activities as defined by the County Health Department and approved by the Immunization Program Office, to increase the flu vaccination rates for adults, especially high-risk adults, within the county. These efforts are intended to help keep hospitalization rates for flu down during the COVID-19 pandemic. All other terms of this agreement remain unchanged. This Amendment is in the additional amount of $1,005,000 for the budget period July 1, 2020 through June 30, 2021, bringing the total not to exceed amount from $4,514,555 to $5,519,555 for the cumulative period from July 1, 2018 through June 30, 2021. The term of this IGA is January 1, 2018 through December 31, 2022. The Department of Public Health’s indirect rate for FY20-21 is 18.8%. Indirect is estimated at $159,040, all of which is recoverable. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation This grant award is reoccurring and has been awarded to the department since 1993. The grant does not require an in-kind match; indirect cost is fully recoverable; and ongoing cash contributions are not required. The grant award is a mandated function and provides a benefit to the citizens by ensuring that immunization coverage levels in the County’s child, adolescent, and adult populations improve for both public and private health care recipients. The grant award is not competitive. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. IGA WITH THE CITY OF LITCHFIELD PARK TO WAIVE TRAFFIC CONTROL PERMIT FEES Approve the Intergovernmental Agreement between Maricopa County and City of Litchfield Park to waive traffic control permit fees in certain situations. Under the Intergovernmental Agreement, the agencies will agree to reciprocally waive traffic control permit fees for projects meeting specific requirements. The Agreement will remain in effect through June 30, 2022 unless extended by appropriate actions by the County and City. Either party may terminate this Agreement at any time prior to the expiration date by furnishing the other party with a thirty (30) day written notice. This Agreement will allow for traffic control permit fees to be waived when the City has a project adjacent to or near County right-of-way, the County is not a partner to the project, and the City needs to place traffic control in County right-of-way for appropriate notice and safety. The traffic control permit fees would be waived for County projects meeting the same conditions. Both parties are required to submit traffic control plans and follow standard permitting requirements. The Project will re-construct the 1,500 ft. long channel along the north side of Olive Ave., from 103rd Ave. to 99th Ave. The existing trapezoidal gunite lining, built in the 1960’s, is in a distressed condition and will be removed and replaced with a fiber reinforced shotcrete lining. The project improvements also include a maintenance access ramp to the channel bottom and safety railing; temporary construction perimeter fencing will be required. This channel is owned and maintained by the Flood Control District of Maricopa County (FCDMC), and the project is 100% funded by FCDMC. This Agenda Item impacts Supervisor District 4. IGA WITH THE UNITED STATES GEOLOGICAL SURVEY FOR WATER RESOURCES INVESTIGATIONS Approve the annual Intergovernmental Agreement (IGA) FCD 2020A024, between the United States Geological Survey [Agreement #21ZFJFA1800 (USGS)] and the Flood Control District of Maricopa County (District), for the period through September 30, 2021, for collection of stream flow data on local watersheds throughout Maricopa County. The total cost of the IGA is $390,750. The District’s costs under this agreement will be $237,000, with the USGS contributing the remaining $153,750. Payments from the District are to be made quarterly. The agreement covers costs associated with the maintenance, collection, and publication of stream flow data and river reach characteristics at nine continuous stream flow monitoring stations and 22 peak flow monitoring sites throughout Maricopa County. This agreement further will develop and evaluate long term flood histories on watercourses in Maricopa County, and provide information critical to the determination of the risk of flooding in these watercourses. The information generated by the USGS’s ongoing work is vital to the safety of Maricopa County residents, and to the continuing hydrologic studies performed by the District.
