7. APPLY AND ACCEPT CONSTABLE TRAINING GRANT Approve the application and acceptance of grant funds from the Constables Ethics, Standards and Training Board, (CESTB CNA09-86), in the amount of $9,600.00 for the purpose of providing training funds for the Maricopa County Constables Department. This grant will provide travel, lodging, per diem and registration expenses for the Constables attending the National Constable Association Conference in Dallas/Ft. Worth on March 10 – 14th, 2010. The training sessions will cover mandatory training as required by A.R.S. 22-137 (D). The grant period begins on the date the agreement is signed by both parties and ends on June 30, 2010. Pursuant to A.R.S. 42-17106(B), approve revenue and expenditure appropriation adjustments to the FY 2009-10 Constables (250) General (100) Non-Recurring/Non Project (0001) budget in the amount of $9,600 for FY 2009-10. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant allows a 0% rate for indirect costs or $0 which may be incurred by the Constables or Maricopa County for administration of this grant. The Maricopa County Department of finance has calculated the Constables’ composite cost rate at 10.9% or $1,047.00. The non-recoverable indirect cost is $1,047.00. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-25-10-005-G-00)

8. EXEMPTION TO THE COUNTY PURCHASING FREEZE AND TECHNOLOGY FINANCE PROGRAM FOR DIGITAL EVIDENCE PROGRAM Approve an exemption to the Maricopa County FY 2009-10 purchasing freeze for the acquisition of computer equipment and software for use as part of a pilot program to test the effectiveness of criminal trial electronic evidence presentation software. As part of the FY 2009-10 adopted budget, the Board of Supervisors approved the use of one-time non-recurring appropriated fund balance in the County Attorney (190) Criminal Justice Enhancement Fund (267) for the purchase of hardware and software to organize, prepare, and present evidence at trial. Equipment to be purchased includes 12 laptop computers and 20 hard drives (for departmental storage arrays). The laptops are of a specification that complies with the requirements of the evidence presentation software and Maricopa County Office of Enterprise Technology standards. The cost for the laptops will not exceed $17,200. These laptops will not be replaced at the end of their useful life. The hard drives will be used in existing departmental enterprise virtual storage arrays to store documents, images, video, and other digital evidence in support of digital evidence presentation. The cost of the hard drives will not exceed $19,300. Purchase of the hardware will made using existing technology equipment contracts. The County Attorney will absorb the cost of any future maintenance of the hardware. The County Attorney will use the equipment to be purchased above in conjunction with a software product offered by Sanction Solutions called Verdical. This software allows prosecutors to store, digitize, organize, and present digital evidence during trial. This software was selected after a review and test of the two major products that matched the Office’s requirements. The cost for the software, maintenance and training is expected to cost approximately $29,000. Purchase of the software will be accomplished in accordance with Article 3 of the Maricopa County Procurement Code. The County Attorney will absorb the cost of any future maintenance of the software. Also, approve an exemption to the Maricopa County Technology Finance Program (TFP) for the purchase of this equipment. Funding for the purchase of this equipment is only approved for FY 2009-10 and therefore not eligible for lease purchase under the TFP. Criminal prosecutors have experienced for several years now the phenomenon among jurors know as the "CSI Effect." Courtroom experience has shown that jurors no longer accept the presentation of evidence using traditional methods of mounting photographs, drawings, diagrams, maps, and charts on large posters that are displayed in the courtroom on easels. Recent experience shows that jurors who are exposed to many television shows like "CSI", "Bones", "NCIS", and others, have higher expectations for the presentation of evidence during trial. Digital preparation of such evidence requires the use of specialized software to electronically store and organize a great volume of documents, photographs, audio, and video evidence. 9. ACCEPT FUNDING FROM STATE OF ARIZONA Pursuant to Laws 2009, Chapter 11, Sec. 7, 49th Legislature, 1st Regular Session, Senate Bill 1188, approve the receipt of $1,430,000 by the Maricopa County Attorney’s Office from the State of Arizona to enforce immigration related matters and the provisions of Laws 2008, Chapter 152, 48th Legislature, 2nd Regular Session, House Bill 2745. This funding is effective July 1, 2009, and is exempt from the provisions of A.R.S. 35-190, relating to lapsing of appropriations. This funding is not a grant, but rather is direct funding received from the State of Arizona through the Arizona Department of Administration. The Department of Finance has established an indirect cost recovery rate of 14.4% for the County Attorney's Office. In accordance with Maricopa County grant policy, the County Attorney will recover 14.4% in indirect costs from this funding, totaling $205,920. This funding does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Senate Bill 1188 appropriates money from the state general fund to be distributed to all county attorneys to enforce the state laws that imposes sanctions on employers who knowingly or intentionally hire unauthorized aliens. The Legal Arizona Workers Act, originally passed in 2007, was amended in accordance with House Bill 2745. Senate Bill 1188 provides that the Maricopa County Attorney’s Office receive the sum of $1,430,000.00. It is anticipated that a portion of these funds will be transferred to the Sheriff’s Office on a reimbursement basis to fund investigation and enforcement efforts in connection with violations of A.R.S. 23-212. 10. SOUTHWEST BORDER PROSECUTION FUNDS FROM U.S. DEPARTMENT OF JUSTICE Approve the acceptance of grant funds from U. S. Department of Justice, for the Southwest Border Prosecution Initiative Program in the amount of $1,060,424. These grant funds are for the reimbursement of the County Attorney for prosecution of federally declined criminal cases. The grant award begins on July 1, 2009 and ends on September 30, 2010. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney's Office or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the County Attorney's Office composite indirect cost rate at 14.4%, or $152,701. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $152,701. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, budget law does not prohibit expenditure of the funds. These funds are for cases that were investigated by federal law enforcement agencies, declined for prosecution by the U.S. Attorney, and were subsequently prosecuted by the Maricopa County Attorney's Office under state law because the crimes were committed in Maricopa County. These cases are already prosecuted and therefore there are no indirect costs to accepting this grant money. The Federal government has funded this program through September 30, 2010 under 2009 Public Laws 110-329. There are no agreements and therefore, no signatures are required. Funding to be received under the following awards: 2009BWBX08A03875, 2009BWBX08A03877, 2009BWBX08C04320, and 2009BWBX08D04322. (C-19-10-022-G-00)

42. PROPOSED RECONFIGURATION OF COMMUNITY ACTION PROGRAM (CAP) COMMUNITY SERVICES AREAS Approve the plan to reconfigure the Maricopa County Community Action Program Community Service areas as recommended by the Maricopa County Community Services Commission. This plan was approved on June 22, 2009 by the Commission to improve the efficiency and effectiveness of CAP services. Maricopa County Human Services Department, Community Services Division, is designated as a Community Action Agency (CAA), as defined in the Community Services Block Grant Act (42 U. S. C. 9901 et. seq.), for Maricopa County, exclusive of the cities of Phoenix, Mesa and, effective July 1, 2010, the City of Glendale. The current service area boundaries were established in 1971. The Maricopa County Community Services Commission, a tripartite board appointed by the Board of Supervisors, has policy and oversight responsibility for the CAA. Because of changes in population, demographics, and the economy, the Commission undertook a study of current service boundaries in order to identify ways to improve efficiency and effectiveness of CAP services. Using the services of an outside consultant and input from stakeholders in the community, the Commission evaluated several options, which has resulted in the final recommended changes listed below: - Maintain separate community services areas with CAP offices in Wickenburg, Gila Bend, Buckeye, Guadalupe and Tempe due to size, geographic location, and cultural uniqueness. - Combine El Mirage and Peoria CAP service areas. - Combine Tolleson and Avondale CAP service areas. - Combine Chandler and Gilbert CAP service areas. The impact of the recommended changes will result in the consolidation of CAP offices effective July 1, 2010, reducing the number of community service areas to eight. This recommended consolidation will help maintain CAP services throughout the County despite loss of funds and uncertainty in local, state and federal budgets. Proposed service area configurations can be seen in the attached maps. (C-22-10-046-M-00)

70. UTILIZE PROCUREMENT METHOD UNDER ARIZONA LAW BUT NOT INCLUDED IN THE MARICOPA COUNTY PROCUREMENT CODE Approve and authorize a use of the two-step Construction-Manager-at-Risk project delivery method, as outlined in Laws 2009, adopted by the Arizona State Legislature with an effective date of October 1, 2009, to procure contracts for construction services whenever funds are received from the United States Government as allowed by the American Recovery and Reinvestment Act of 2009 (ARRA). The Facilities Management Department has received ARRA funds to install solar thermal units for domestic hot water at the Lower Buckeye Jail and the 4th Avenue Jail. Both facilities are located in District 5. In Laws 2009, Chapter 187, effective at midnight September 30, 2009, the Arizona State Legislature authorized the utilization by government entities of the two-step Construction-Manager-at-Risk (CMR) construction delivery method for projects funded by the American Recovery and Reinvestment Act of 2009 (ARRA). This new method will expand the current use of the CMR delivery method for use by the County when federal regulations require a price competition for construction projects utilizing federal funding. The language for the new session law reads, in pertinent part, as follows: "Sec. 62. Construction-manager-at-risk contracts; requests for qualification; price competition; delayed repeal "A. Notwithstanding any other law, if the American Recovery and Reinvestment Act of 2009 (P.L. 111-5) is a source of monies for a construction project and price competition is required by the funding federal agency or by applicable federal law, price competition may be included as part of the selection criteria in a request for qualifications selection process for a construction-manager-at-risk contract to be negotiated as follows: "2. By an agent under section 34-602, Arizona Revised Statutes, if the request for qualifications is issued by the agent on or before December 31, 2014." As currently approved, Article 5 of the Maricopa County Procurement allows for use of the CMR delivery method. This is a qualifications-based selection only and there is no statutory provision for a price competition. The new session law allows for selection by qualifications and also by price competition in the second step. Maricopa County received funding through the first disbursement of ARRA funding in part to install solar thermal units for domestic hot water on the 4th Avenue Jail and the Lower Buckeye Jail. Facilities Management wishes to utilize the two-step CMR delivery to complete these two projects in the most expedient, cost-effective manner possible. (C-91-10-121-5-00)

71. EXCEPTION TO TECHNOLOGY FINANCING PROGRAM FOR PURCHASE OF TWO SERVERS Approve an exception to the Technology Financing Program (TFP) and capital purchasing freeze to allow the Department of Transportation to purchase two servers for regional and MCDOT Intelligent Transportation Systems (ITS) using federal grant funding. The total estimated purchase price of the Reverse Proxy Servers is $22,144.00, to be paid 100% with reimbursable federal AZTech Integrated Transportation and Emergency Communication Network Grant funding. On June 24, 2004, the Board approved Agenda Item No. C-64-08-250-2 that authorized the acceptance of Federal Grant monies to accomplish the AZTech Intelligent Transportation Systems Integrated Transportation and Emergency Communications Network. The enhancements will provide significantly improved real-time data and camera exchange between transportation and public safety agencies. As an established regional leader, MCDOT has deployed and operates numerous regional Intelligent Transportation Systems (ITS) that address the growing demand on the County’s transportation network. In support of this effort, MCDOT monitors and manages more than 300 communication devices using a single computer, the Network Management Workstation (NetMgmt). Notably, the Network Management Workstation plays a key role in operating and maintaining traffic signal communication on regional corridors such as the Bell Road, Riggs Road, MC 85 and Olive Avenue besides other traffic signals on MCDOT roadways On November 16, 2009, the NetMgmt computer suffered a catastrophic motherboard failure. Since the system has been in operation for several years, and is no longer under warranty, a new server must be procured and installed. In addition, MCDOT operates a Video Distribution Workstation (VideoDist) which serves as a regional video distribution point and camera control system. This system not only provides video sharing to Peoria and Surprise, but also routes all MCDOT video to the ADOT Video Distribution System and all regional partners. The current VideoDist system is a desktop-class computer whose power-saving measures have caused numerous failures with video sharing and camera control. Although this power-saving feature has been disabled, the software vendor, ICx 360 Surveillance, has recommended for years that the video distribution software be operated on a server-class computer; this would allow for more efficient and robust video distribution and camera control. With the expectation that the number of cameras to be controlled will only increase, the recommendation is to procure and install a server-based VideoDist system. All items are 100% funded by the Federal Grant. Thus for the two servers, the total estimated purchase price is $22,140, to be paid fully with reimbursable federal grant funding. A-1. APPLY AND ACCEPT GRANT FOR THE SECOND CHANCE ACT ADULT AND JUVENILE OFFENDER REENTRY DEMONSTRATION PROJECT Approve the application for and the acceptance of a grant award from the U.S. Department of Justice (DOJ) for the Second Chance Act Adult and Juvenile Offender Reentry Demonstration Projects. The grant application and award is in an amount not-to-exceed $500,000 to Maricopa County, through the County Manager’s Office/Justice System Planning and Information (JSPI). This grant will fund a pilot reentry program for adjudicated juveniles in Maricopa County’s detention facilities who are from the South Mountain area zip codes (85040, 85041and 85042). The program will follow the eligible youth through all phases of the reintegration continuum (from pre-release at Southeast Facility and Durango through community placement/aftercare to community integration). The program’s overall goal is to increase public safety and reduce recidivism, which aligns with the Crime Prevention Plan approved by the Board of Supervisors. The term of the grant is one year from the date of award with the option for two one-year no-cost extensions. The grant requires a 50% non-federal match, of which 25% is a cash match and 25% is in-kind match. Based on guidance from DOJ, a request for a partial or full waiver of the cash match may be requested. Such a request will not affect the application’s competitive ranking. If a waiver is not approved, cash match of $125,000 will be allocated from one-time crime prevention general funds. The in-kind match of $125,000 will be generated from appropriate general fund positions /expenditures within Maricopa County Departments that will participate in the program (e.g., JSPI, Juvenile Probation, Superintendent of Schools) along with non-federal funds allocated from partnering community organizations. The recoverable indirect cost of administering this grant is 16.5% (as determined by the Department of Finance for JSPI), for an amount not-to-exceed $70,815. Pursuant to A.R.S. 42-17106(B), approve revenue and expenditure appropriation adjustments to the FY 2009-10 County Manager (200) Non Departmental Grant Fund (249) Non-Recurring/Non-Project (0001) budget in the amount of $500,000. A-4. APPROPRIATION ADJUSTMENT FOR SHERIFF'S RICO FUND Approve per A.R.S. 42-17106,B. an increase in the FY 2010 revenue and expenditure operating (0000) appropriation of $1,500,000 for the Sheriff’s RICO Fund (212). F-2. AMENDMENT TO RESOLUTION FOR SADDLEBACK FLOOD RETARDING STRUCTURE MODIFICATIONS PROJECT Adopt Amendment No. 1 to Resolution FCD 2009R008 for the Saddleback Flood Retarding Structure (FRS) Modifications Project (PROJECT [#331]). This Amendment No. 1 authorizes and directs the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to negotiate with landowners and/or appropriate agencies to obtain the necessary rights-of-entry, property and/or easements and all other necessary land rights appropriate for the continued operation and maintenance of the Saddleback FRS and the operation and maintenance of the PROJECT; and to hire and retain legal counsel to initiate and prosecute action and proceedings in the manner required by law to condemn any and all rights-of-entry, easements or property required for the continued operation and maintenance of the Saddleback FRS and the operation and maintenance of the PROJECT which cannot be obtained by donation or purchase. Amendment No. 1 additionally authorizes and directs the Chief Engineer and General Manager of the District to budget funds in the District’s Capital Improvement Program to effect the acquisition of these land rights. This Amendment No. 1 increases the estimated cost of the PROJECT by an estimated $430,000 to a total estimated PROJECT cost of $3,730,000. Saddleback FRS has experienced the formation of numerous erosion holes and longitudinal cracking along the length of centerline of the dam crest. The issue cannot be addressed by normal maintenance work and has developed into a dam safety issue which is continuing to worsen over time. This requires implementation of structural dam safety corrective measures in the interest of public safety. The District has identified a need to repair/modify the central material zone of the dam known as the central filter, to mitigate erosion hazards and to construct concrete control sections at roadway crossings. Subject to Board ratification and approval, the District authorized the negotiation of intergovernmental agreements and contracts for engineering and construction, and the budgeting of Capital Improvement Program funds, for the PROJECT under Resolution FCD 2009R008, dated 17 June 2009 (C-69-09-073-6-00). Under the authority of this Resolution, the District has initiated the design of recommended modifications. In addition to the authorities granted under the original Resolution FCD 2009R008, the continued operations and maintenance of the Saddleback FRS, prior and subsequent to the completion of the PROJECT, will require the District to obtain additional land rights, replacing easement rights due to expire in calendar year 2010. This Agenda Item authorizes the pursuit of those land rights. This Agenda Item impacts Supervisory Districts 4 and 5. (C-69-09-073-6-01)
