12. TRANSFER INTERNET DOMAIN NAMES TO PARTNERSHIP FOR DRUG FREE AMERICA, ARIZONA AFFILIATE Pursuant to A.R.S. §§ 11-201;11-251(57)-(58), and for valuable consideration received, the Maricopa County Board of Supervisors (BOS) conveys to the Partnership for a Drug-Free America, Arizona Affiliate, four internet domain names, licensed and registered to the Maricopa County Attorney’s Office (the Office). These domain names are: www.DrugFreeAZ.com, www.DrugFreeAZ.org, www.DrugFreeAZ.net, and www.DrugFreeAZ.us, and are valued at approximately $280.00. Further, authorize the Chairman to sign any necessary documents to accomplish the conveyance of the above-mentioned domain names to the Partnership for a Drug-Free America, Arizona Affiliate. The Partnership for a Drug-Free America, Arizona Affiliate shall pay no less than $100.00 and agrees to promote a drug prevention strategy by continuing to use these internet domain names in furtherance of their drug prevention and awareness mission. The Office currently owns the registration to four internet domain names: www.DrugFreeAZ.com, www.DrugFreeAZ.org, www.DrugFreeAZ.net, and www.DrugFreeAZ.us. These domain names have been used to administer websites aimed at increasing public awareness within Maricopa County of the dangers of drug and alcohol abuse. During the past four years, the Office combined several stand-alone websites into one thus making the four internet domain names listed above superfluous to the Office’s crime prevention strategy. The Partnership for a Drug Free America, Arizona Affiliate, is a not-for-profit organization under Section 501(c)(3) of the U. S. Internal Revenue Service Code. They operate in Arizona providing statewide drug prevention and awareness messages. It is in the best interest of Maricopa County that this organization utilize these internet domain names to promote drug prevention in the county. The Board of Supervisors is authorized under statute, specifically A.R.S. § 11-251(57)-(58), to sell intellectual property at less than fair market value to another governmental entity or benevolent non-profit organization. Such a conveyance does not violate the Arizona Constitution’s gift clause, A.R.S. Const. Art. 9, § 7, as long as Maricopa County receives due consideration. This conveyance constitutes a public purpose and the Partnership for Drug Free America, Arizona Affiliate, will provide consideration of an amount no less than $100 and agrees to promote a drug prevention strategy using these internet domain names, for the benefit of Maricopa County’s citizenry. This item was continued from the August 4, 2010 meeting. THIS ITEM REQUIRES UNANIMOUS CONSENT OF THE BOARD. (C-19-11-002-M-00)

19. IGA WITH THE DEPARTMENT OF PUBLIC SAFETY CONCERNING ILLEGAL IMMIGRATION AND HUMAN SMUGGLING Approve an intergovernmental agreement (IGA) between Maricopa County, on behalf of the Sheriff's Office, and the Department of Public Safety (DPS) that enhances law enforcement services concerning illegal immigration and human smuggling by providing increased funding to MCSO as intended by Law 2009, Chapter 1, 1st Special Session, Section 2. This agreement provides up to $1.6 million of funding to investigate, disrupt, or deter crimes relating to illegal immigration and human smuggling and takes effect July 1, 2010 through June 30, 2011. Also approve 15 critical position exceptions for the following positions that are necessary to this program: 1 Enforcement Lieutenant: 2 Enforcement Sergeants; 9 law enforcement officers; and 3 detention officers. These positions will be established in the Sheriff's Grant Fund (251) and will be abolished at the end of the funding period. Also per A.R.S. 42-17106 approve an increase of $1,600,000 to the Sheriff 's FY2011 (500) Grant Fund (251) operating (0000) revenue and expenditure budgets. These revenues are not “local revenues” for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. A 25% in kind match on actual expenditures is required. This match will be met primarily from the Sheriff's General Fund (100) appropriation from a combination of effort from various enforcement positions. The Sheriff's Office indirect cost rate for FY 2011 is 14% and this funding does not support indirect costs. The unrecoverable indirect costs for this funding are $224,000. A-1. APPOINTMENT OF CARLOS LINGARD AS IS ARCHITECT Approve an exception to the Maricopa County Compensation Placement in Range Strategy for the appointment of Carlos Lingard to the position of IS Architect in the County Manager’s Office. The requested rate associated with the approval of this request is $53.00/hour ($110,240 annually) effective August 2, 2010. This will be fully funded within the department’s current budget this fiscal year and in subsequent fiscal years. Carlos Lingard has specialized training and experience in the networks, security, and computer systems Integrated Criminal Justice Information Systems (ICJIS) uses to ensure the integration and communication of state, county, and local justice and law enforcement agencies. His skills in networks and programs were relied upon prior to a reduction in force in 1998, and ICJIS continued to utilize his services through a contract over the past two years. Carlos is being re-hired into this position with expanded responsibility at a rate that is half the contract rate. ICJIS will also benefit from being able to rely on his skills full-time, whereas his time was previously divided among other J&LE clients. He is currently certified with Department of Public Safety, which is a vital requirement for this position. The Office of Management and Budget has reviewed and validated that the financial impact of this request can be fully funded within the department’s current budget this fiscal year and in subsequent fiscal years. IGA WITH NATURAL RESOURCES CONSERVATION SERVICE FOR POWERLINE FRS FISSURE RISK ZONE MITIGATION PROJECT Approve Intergovernmental Agreement (IGA) FCD 2010A002 for the Powerline Flood Retarding Structure (FRS) Fissure Risk Zone Mitigation Project (Project[#310]) between the Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District). This IGA establishes the cost-share for the design, land acquisition, construction, and operation and maintenance of the Project. NRCS will pay for 100% of the NRCS eligible construction costs. The District will pay for the design, construction management, land acquisition and operation and maintenance. The estimated total eligible Project construction cost is $5,000,000, paid entirely by NRCS. The District will be responsible for funding Project design and non-eligible construction cost, estimated to be $1,289,000. The IGA shall become effective when signed by NRCS and shall expire five years from the date of signing by NRCS. Powerline FRS is one of a system of three flood retarding structures (Powerline FRS, Vineyard Road FRS and Rittenhouse FRS) that were constructed by the U.S. Soil Conservation Service (now Natural Resources Conservation Service or NRCS). Powerline FRS was constructed in 1967 and 1968. The structure was constructed with federal assistance under the PL-566 Watershed Protection & Flood Protection Act. The District operates and maintains the structure and is the local sponsor for this Project. District staff identified a fissure risk zone associated with the structure, and near term action is required to mitigate the associated dam safety and public safety concern. In July 2008, the District submitted this Project to the District's Capital Improvement Program Prioritization Procedure for fiscal year 2009-2010, and the District’s Flood Control Advisory Board, with staff concurrence, recommended the project for future implementation. In January 2009, the Board of Directors adopted Resolution 2008R015 authorizing and directing the Chief Engineer and General Manager to proceed with the Project. The Resolution was amended on April 6, 2009 (C-69-09-056-6-00) authorizing an Intergovernmental Agreement between NRCS and the District. The District has initiated final design, and construction is anticipated to begin by early 2011. This Agenda Item impacts Supervisory District 1. (C-69-11-003-3-00)
