The Civil Rights Act of 1968, the Fair Housing Amendments Act of 1988, and 24 CFR 5.10(a)2 ensure full and fair access to housing opportunity and makes it unlawful to discriminate in the sale or rental of housing on the basis of the characteristics as prescribed by the law. The Fair Housing Act covers all real estate related transactions including the sale or rental of housing, insurance, appraisals, lending, redlining, block busting, and, due to the civil rights issues, hate-related crimes. It is also unlawful to retaliate against a person who exercises their rights under the law, or any person who assists them in exercising their rights. Maricopa County is a recipient of Housing and Urban Development (HUD) grants. HUD program activities are administered by the Human Services Department – Housing and Community Development Division. The standards set forth by HUD (through laws and regulations) state that HUD grantees shall affirmatively further fair housing. Supervisory District: All (C-22-19-024-M-00)

45. IGA WITH THE TOWN OF GILBERT FOR THE EXCHANGE OF SERVICES (ENTENTE) Approve the Intergovernmental Agreement between Maricopa County and the Town of Gilbert for the exchange of services or reimbursement of services (Entente). Either party may terminate this Agreement at any time prior to the expiration date of this Agreement by furnishing the other party with a thirty (30) day written notice. The purpose of this Intergovernmental Agreement is to identify and define both Parties’ respective roles in the execution of the responsibilities of specific maintenance tasks in areas that cross jurisdictional boundaries. The Agreement provides the opportunity to focus on specific maintenance tasks or emergency highway projects and the availability of the most economical resources by extending beyond jurisdictional or geographical boundaries. The application of the Agreement will benefit areas in the County and the Town where certain types of routine maintenance or emergency highway project activities could be completed by the other party based on scheduled work within the area. Individual tasks performed by either party will be executed upon completion of a Letter of Agreement (LOA) approved and signed by the County Department of Transportation Director and the Town Manager, or their designees. If the value of goods or services exchanged by the Parties is not of equal value, the total aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If no services are exchanged, there is no financial impact. An accounting mechanism will be utilized to track each LOA, as applicable, to identify specific tasks and services and to ensure the exchange of these services is of similar value. This IGA is a no-cost IGA, and defines responsibilities for the District to take fill dirt from the District’s Channel Project to the County’s Fill Project. The purpose of this IGA is to identify and define the responsibilities of the County and District with respect to Fill Project. The IGA shall become effective the date it is approved by both the County Board of Supervisors and the District’s Board of Directors, and remain in full force and effect until all stipulations are met or the sooner of ten (10) years from the effective date OR should the IGA be terminated. The Channel Project is part of the District’s McMicken Dam Rehabilitation Project, and consists of replacing an existing levee with a below-grade earthen channel. The Channel Project will excavate the base channel and move dirt on-site to landscape mounds and also to the County’s Fill Project. This is advantageous to the District, because no fill material will need to be hauled off-site, and advantageous to the County, because the fill material will be at no cost.
