PZ-1. CPA2013006 – SAN TAN AUTO BODY Supervisor District: 1 Applicant: Associated Architects, Inc. for Jerry Smith Request: Comprehensive plan amendment (CPA) to change the Queen Creek Area Plan land use designation from Neighborhood Commercial and Suburban Residential to Community Retail Center. CPA case approval is by Resolution. Site Location: 18415 East San Tan Boulevard, on the southeast corner of San Tan Boulevard and Power Road in the Queen Creek area. Site Size: Approximately 1.66 acres Commission Recommendation: By a vote of 7-0, recommended approval subject to conditions ‘a’ – ‘c’ as follows: Provided the following conditions are met: a. Development and use of the site shall comply with the narrative report entitled, “A Comprehensive Plan Amendment for San Tan Auto Body”, including all exhibits dated stamped received on January 13, 2014, except as modified by the following conditions. b. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. c. That the following conditions from MCESD are met: 1. The new onsite septic system design will be submitted to MCESD for approval. Wastewater discharge from San Tan Auto Body to the septic system will consist of typical sewage only, and will not include any motor oil, gasoline, paint, varnish, solvent, pesticide, fertilizer, or other material not generally associated with toilet flushing, food preparation, laundry, or personal hygiene (AAC R18-9-A309.7a). 2. Any wastewater that is non-typical sewage shall be routed to an interceptor tank and removed from the site by an industrial waste disposal service (as is done for the existing non-typical sewage wastewater from the existing building). 3. The owner will abandon the septic system, connect to a public sewer system when one is available, and participate in a fair share of the public system funding. 4. Development and engineering design shall be in conformance with the Maricopa County Stormwater Quality Management and Discharge Control Regulation. The owner/developer shall prepare a SWPPP and obtain approval by MCESD prior to construction. (A separate submittal to MCESD is required.) Upon completion of construction, the owner shall fulfill MCESD requirements and obtain a post-construction stormwater permit. 5. The site plan shall contain a note designating the entity responsible for operation and maintenance of the on-lot stormwater management facilities consistent with an approved operation and maintenance plan. 52. DELEGATION OF AUTHORITY TO THE DIRECTOR OF TRANSPORTATION TO REQUEST ROADWAY ABANDONMENTS OF STATE ROUTES OR HIGHWAYS FROM ARIZONA DEPARTMENT OF TRANSPORTATION Authorize the Maricopa County Department of Transportation (MCDOT) Director/County Engineer to request abandonment of state routes or highways from the Arizona Department of Transportation (ADOT) to the County in accordance with Arizona Revised Statues (A.R.S.) Section 28-7209. Staff requests that the Board of Supervisors allow the Maricopa County Department of Transportation (MCDOT) Director/County Engineer to act as their representative to request abandonment of portions of a state route or state highway pursuant to A.R.S. Section 28-7209. As the road system in Arizona grows and changes to meet land development demands and population growth, the functions of the roads must adapt to the needs. Conversely, local roads that primarily serve regional and statewide through trips or connect to state roadway facilities may be candidates for transfer to the state highway system. A transparent and cooperative process is needed to determine which agency is best suited to provide long-term ownership and management of the road. A.R.S. Section 28-304 authorizes the State Transportation Board to vacate or abandon a portion of a state route or state highway to a local jurisdiction, provided that, pursuant to A.R.S. Section 28-7209, four years advance notice is provided by the State to the local jurisdiction and the road surface is in such condition that surface treatment and major maintenance will not be required for five years. The statute allows for a waiver of the four year notice requirement if the State Transportation Board and the local jurisdiction both agree to the waiver. For transfers of roadways in unincorporated areas, the abandonment must be made by the state to the county. Sometimes, when a municipality expresses interest in annexing such a roadway, Maricopa County receives a request from the city or town asking that Maricopa County request a waiver of the 4-year advance notice requirement to ADOT so that the city or town can proceed to annex the roadway expeditiously. Imminent planned developments may make such expedited abandonments and annexations desirable. This requested action would allow the MCDOT Director/County Engineer to request waivers of the four year notice requirement for abandonment. This could facilitate cooperative transfers with municipalities as described above. Supervisory Districts: All (C-64-14-109-M-00)

53. IGA BETWEEN MARICOPA COUNTY AND FLOOD CONTROL DISTRICT FOR THE MOUNTAIN ROAD/ERIE STREET DRAINAGE IMPROVEMENTS DESIGN CONCEPT REPORT Approve Intergovernmental Agreement (IGA) between the Flood Control District of Maricopa County (District) and Maricopa County (County) for the Mountain Road/Erie Street Drainage Improvements Design Concept Report (DCR). This Agreement identifies and defines the rights and responsibilities of the District and County for the cost sharing, development and preparation of the Mountain Road/Erie Street Drainage Improvements Design Concept Report (DCR). The County’s estimated cost share contribution is $62,500. Funds are budgeted in the Transportation Department (640) Transportation Capital Project Fund (234) Safety Improvement (SAFE), Sub-project No. T480. The DCR is anticipated to be completed by the end of Fiscal Year 2015. The East Mesa Area Drainage Master Plan (ADMP) Update identified flooding problems in the southeastern portion of Maricopa County. In particular, the homes and roadways located in the unincorporated area abounded by Williams Field Road, Ray Road, Meridian Road and the Signal Butte alignment flood during every rain event. The East Mesa ADMP Update developed three preliminary solutions to address the frequent flooding issues. This IGA will fund the development of a DCR to analyze and refine the preliminary solutions and select a recommended alternative. The end result of the DCR will be 15% level design drawings and a plan to implement the recommended solution to the flooding problems. Supervisory District No. 2 (C-64-14-108-M-00)

54. RESOLUTION TO APPROVE AMENDMENTS TO THE MCDOT ROADWAY/LIVESTOCK INCIDENT MITIGATION POLICY Adopt a Resolution to approve amendments to the MCDOT Roadway/Livestock Incident Mitigation Policy. The MCDOT Roadway/Livestock Incident Mitigation Policy was originally adopted in 2009 to establish guidelines for the reporting and tracking of vehicle incidents involving livestock and to establish criteria for the implementation of traffic control devices at identified livestock locations providing for the safest circumstances. (Please see attached 2009 resolution and policy.) The policy is necessary in order to provide the safest circumstances when drivers approach identified livestock areas. Arizona is an “open range” state which means that in most areas not under the jurisdiction of a municipality or other government agency, livestock are not enclosed onto property with fences, but are allowed to graze freely. The Traffic Management Division will continue to record and track livestock incidents and accidents as received from the Maricopa County Sheriff’s Office. The tracking of these reports provides information for the implementation of appropriate traffic control devices, signage or striping. The proposed amendments will allow for a broader range of engineering solutions to be applied. This will include an option for quieter, alternative rumble strip treatments that will be effective for livestock incident mitigation as well as sensitive to nearby residential areas. The proposed amendments also remove some unnecessary administrative language. Supervisory Districts No. 1, 2, 3, 4 and 5 (C-64-14-110-6-00)

F-2. IGA BETWEEN MARICOPA COUNTY AND THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY FOR THE MOUNTAIN ROAD/ERIE STREET DRAINAGE IMPROVEMENTS DESIGN CONCEPT REPORT Approve Intergovernmental Agreement (IGA) FCD 2013A016 to identify and define the responsibilities of the Flood Control District of Maricopa County (District) and Maricopa County for the cost sharing, development and preparation of the Mountain Road/Erie Street Drainage Improvements Design Concept Report (DCR) . The total project cost is estimated at $100,000 to $125,000. The District’s contribution is estimated to be between $50,000 - $62,500. The DCR is anticipated to be completed by the end of Fiscal Year 2015. The IGA shall become effective as of the date it is approved by both parties, and shall remain in effect until all stipulations have been satisfied or until it is terminated. The East Mesa Area Drainage Master Plan (ADMP) Update identified flooding problems in the southeastern portion of Maricopa County. In particular, the homes and roadways located in the unincorporated area bounded by Williams Field Road, Ray Road, Meridian Road and the Signal Butte alignment flood during nearly every rain event. The East Mesa ADMP Update developed three preliminary solutions to address the frequent flooding issues. This IGA will fund the development of a DCR to analyze and refine the preliminary solutions and select one recommended alternative. The end result of the DCR will be 15% level design drawings and a plan to implement the recommended solution to the flooding problems. This agenda item impacts Supervisorial District 1.
