The fee increases will affect the fees charged for Arizona vital records. The proposed fee increases are attributed to an anticipated fee increase to be adopted by Arizona Department of Health Services (ADHS). Use of the fee schedule will be based on the following Board of Health recommendation. According to A.R.S. 36-341 (A), a Local Registrar (County Health Officer) may establish their own fees to be charged for services provided by Vital Records. The fee schedule is as follows: State Approved Surcharges to County Vital Records Offices as of July 01, 2011: Record Type Approved Additional Approved Total Surcharge Per Copy Surcharge Per Copy Certified Copy $4.00 $5.00 Non-certified Copy $1.00 $1.00 The proposed MCDPH Office of Vital Registration Fee Schedule will be consistent with the new State and County fees as of July 1, 2011. 11. PUBLIC HEARING FOR RULE 280 (FEES) The Maricopa County Air Quality Department (department) is proposing to amend Rule 280 (Fees) to change the fees the department charges to owners and operators of sources of air pollution. The fees being amended include fees for billable permit actions, annual administrative and emission based fees for Title V sources, annual administrative fees for non-Title V sources, application and annual administrative fees for general permits, subcontractor registration fees and training fees. The goal of this rulemaking is to provide sufficient revenue to cover the costs of the air quality program, maintaining compliance with federal and state law. The current fee structure does not generate sufficient revenue to cover the operating expenses for department permit and plan approval activities. The department’s fee fund revenue in fiscal year 2011 is projected to be $8.8 million while the corresponding expenditures are projected to be $11.1 million. For fiscal year 2011, the department will be relying on its existing air quality fund balance and general fund revenues (a temporary allocation) to subsidize the program. Without corrections to the fee structure, the department will not be able to operate on a structurally balanced budget as is required by County policy and will deplete all reserves. The proposed fee changes would become effective on July 1, 2011 and are expected to result in annual fee revenue for fiscal year 2012 of approximately $10.9 million corresponding to the department’s annual expenditures. The fee revenue with proposed fees includes approximately $1.5 million from the Title V program, $3.5 million from the dust control compliance program, $731,000 from the asbestos/NESHAP compliance program, and $5.1 million from the balance of the non-Title V programs. The remaining $5.8 million of the department’s $16.7 million in total expenditures are considered to be non-recoverable by fees and are expected to be funded by other sources such as grants or county general funds. The department anticipates that this proposed rulemaking would directly impact approximately 4,000 sources that are permitted by the department, 3,600 individuals and entities involved in performing ancillary services on a dust control permitted site (subcontractor registration fee), and 1,600 individuals required to attend a basic or comprehensive dust control training class (dust control training class fees). Entities impacted include Title V facilities, non-Title V facilities and general permit sources; individuals and entities involved in performing ancillary services on a dust control permitted site (subcontractor registration fee); individuals and entities required to complete dust control training; and trainers required to be certified by Maricopa County to conduct dust control training classes. Department requested item to be continued . (C-85-11-020-7-00)

31. VACATION BUY BACK PILOT PROGRAM FUNDING On February 10, 2011, the Board of Supervisors approved the “Vacation Buy Back Pilot Program”. The program will be funded through the employee’s default accounting string on file. The Department will absorb the cost of the vacation buy back. through the savings from the department’s Premium Gainsharing Rebate and other budget savings. If, at year-end, the Department ’s budget is unable to absorb this cost, the Department may request assistance from the Non-Departmental Budget through their OMB Budget Analyst. In accord with A.R.S 42-17106(b), approve the following FY 2011 expenditure appropriation adjustments: Transfer expenditure authority in an amount not to exceed $958,270 within Non Departmental (470) General Fund (100) Non Recurring/Non Project(0001) from Contingency (4711) to Other Programs (4712) to a new line “Vacation Buy Back Pilot Program”. Transfer expenditure authority in an amount not to exceed $4,441 within Non Departmental (470) Detention Fund (255) Non Recurring/Non Project(0001) from Contingency (4711) to Other Programs (4712) to a new line “Vacation Buy Back Pilot Program”. Transfer expenditure authority in an amount not to exceed $153,296 from Non Departmental (470) Non Departmental Grants (249) Non Recurring/Non Project(0001) Potential Expenditures from Fund Balance (4711) to non-general non detention fund appropriations as would be required at year-end to allow for the expenditure of special revenue fund balances to cover the cost of the vacation buy-back that was not able to be absorbed in the operating appropriation for the fund. 32. FUND TRANSFER CORRECTION FOR SALE OF VEHICLES Approve a fund transfer of $9,694 from the Air Quality Fees Fund (504) to the Detention Operations Fund (255). Per A.R.S. 42-17106(B), approve an increase to the FY 2010-11 Air Quality (850) Air Quality Fees Fund (504) Non-Recurring/Non-Project (0001) expenditure appropriation of $9,694, and an increase to the FY 2010-11 Non Departmental (470) Detention Operations Fund (255) Non-Recurring/Non-Project (0001) revenue appropriation of $9,694, with offsetting expenditure and revenue adjustments in Eliminations (980) Eliminations Fund (900) Non-Recurring/Non-Project (0001). These actions are necessary because Air Quality’s vehicle #71513 was included in a large transfer of vehicles and associated fund transfers as part of the FY 2011 vehicle replacement schedule. It was unnecessary to transfer the Air Quality vehicle because the receiving department had already replaced the vehicle that vehicle #71513 was intended to replace. This action returns the purchasing funds back to the detention operations fund as the vehicle was not actually transferred out of Air Quality. (C-49-11-042-2-03)

An Access Point is defined as a network of faith-based and community based organizations that provide community residents with a location where job seekers can access abbreviated One Stop Career Center services. The Arizona National Guard will provide a location and ensure staff are available to assist National Guard members and their family members to access employment-related services to assist them in obtaining employment. This IGA is a non-financial Agreement and is effective upon signature by both parties and will expire June 30, 2013. In 2002, the U.S. Department of Labor (USDOL) invested in pilot programs to increase universal access to the One-Stop Career Center System, by building partnerships between faith-based and community organizations (FBCOs) and Workforce Investment Areas (WIA). The Access Point model emerged from these pilot programs. Access Points consist of faith-based or community organizations where job seekers can go in their own neighborhoods or communities to look for jobs. Maricopa County Human Services Department Workforce Development Division (MWC) has established the SHARE Network Access Point program. F-4. IGA WITH CITY OF PHOENIX FOR 43RD AVENUE AND BASELINE ROAD AND 27TH AVENUE AND SOUTH MOUNTAIN AVENUE BASINS PROJECT Approve Intergovernmental Agreement (IGA) FCD 2011A002 for the 43rd Avenue and Baseline Road and 27th Avenue and South Mountain Avenue Basins Project (Project #117) between the City of Phoenix and the Flood Control District of Maricopa County (District). This IGA establishes a cost share for the Project and establishes responsibilities with respect to Project design, rights-of-way acquisition, construction, construction management, operations and maintenance. The estimated total Project cost is $7,000,000; the cost share will be 70% District ($4,900,000, estimated) and 30% City of Phoenix ($2,100,000, estimated). The IGA shall become effective when recorded at the office of the County Recorder and shall expire 10 years from the date of recording or upon Project completion, whichever comes first. The South Phoenix Drainage Improvement Project Feasibility Study evaluated the watershed generally bounded by 43rd Avenue to the west, 16th Street to the east, South Mountain to the south and the Salt River to the north. The study identified and compared alternative solutions to mitigate flooding hazards in the watershed and selected a recommended plan. Plan elements included several detention basins and a storm drain system to provide an outfall to the Salt River. The proposed Project includes a detention basin located at 27th Avenue and South Mountain Avenue and a detention basin located at 43rd Avenue and Baseline Road that will discharge into the previously-constructed storm drain system and, combined with collective plan features, will further mitigate flooding hazards in the subject area with a goal of providing an overall 100-year level of protection. Under the terms of this proposed Agreement, the District will act as the lead agency for all Project responsibilities and the City of Phoenix will own, operate and maintain the Project upon completion. F-5. REQUEST FOR QUALIFICATIONS AND AWARD CONTRACT FOR CONSTRUCTION MANAGER AT RISK FOR BUCKEYE FLOOD RETARDING STRUCTURE #1 - PHASE 1 Authorize the Flood Control District of Maricopa County (District) 2011C009 to issue a Request for Qualifications for a qualified construction manager/general contractor to provide Construction Manager at Risk (CMAR) for the Buckeye Flood Retarding Structure #1 – Phase I (Project) and award a Pre-Construction and a Construction Services contract to the successful respondent for a Project total not-to-exceed $5,000,000. This is a qualification-based selection in accordance with Maricopa County Procurement Code, Article 5, Paragraph 504(F) and Article IV of the Maricopa County Procedures Manual. Buckeye Flood Retarding Structure (FRS) No.1 is the westernmost of a series of three flood control dams designed and built by the Soil Conservation Service (now the Natural Resources Conservation Service, or NRCS) between 1973 and 1975. The dam is located along the southern slopes of the White Tank Mountains and parallels the north side of Interstate 10 for 7.1 miles west to the Hassayampa River. The dam is operated and maintained by the District and is regulated by the Arizona Department of Water Resources (ADWR). Several non-emergency dam safety deficiencies have been identified at Buckeye FRS No.1. During the planning phase, which was completed in July 2009, the District identified overall rehabilitation as the selected alternative. NRCS has authorized federal assistance for this Project and the District anticipates entering future IGA’s with NRCS for Project cost-sharing. Phase 1 construction of the project involves placing a central filter within a portion of the dam west of Johnson Dam and removing an existing irrigation outlet.
