6. PRIMITIVE CAMPGROUNDS PROPOSED REVISIONS TO CHAPTER XII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (ES-2016-002) Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), convene a public hearing to solicit comments and consider the adoption of proposed revisions to Maricopa County Environmental Health Code (MCEHC) Chapter XII (EROP Case ES-2016-002/Primitive Campgrounds). This item will become effective upon Board of Supervisors approval. The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC Chapter XII (EROP Case ES-2016-002/Primitive Campgrounds) as an EROP expedited case at a public meeting held on Monday, January 23, 2017, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at ES-2016-002/Primitive Campgrounds Staff Report. This revision will align MCEHC Chapter XII with the recently enacted Primitive Campgrounds statutory update, Arizona Revised Statute (A.R.S.) §36-183.02. A.R.S. §36-183.02 includes an exemption for Primitive Campgrounds, which by definition are remote in nature. To mesh with the A.R.S. update, new MCEHC Chapter XII language is proposed that will exempt Primitive Campgrounds from water, electricity and sewer public infrastructure requirements. This MCEHC revision proposal is following the EROP policy and workflow process, without added fees. This item will be withdrawn. (C-88-17-008-L-00)

7. FARMERS MARKET PROPOSED REVISIONS TO CHAPTER VIII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (ES-2016-003) Pursuant to A.R.S. § 11-251.05 and A.R.S. §36-184(B)(5), convene a public hearing to solicit comments and consider the adoption of proposed revisions to Maricopa County Environmental Health Code (MCEHC) Chapter VIII (EROP Case ES-2016-003/Farmers Market). This item will become effective upon Board of Supervisors approval. The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC Chapter VIII (EROP Case ES-2016-003/Farmers Market) as an EROP expedited case at a public meeting held on Monday, January 23, 2017, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at ES-2016-003/Farmers Market Staff Report. This proposal adds a farmer’s market coordinator and increases business owner market opportunities. The coordinator will submit documentation to the Department, be present during farmers market operating hours, and ensure certain sanitary measures are applied. Coordinator oversight of sanitary measures (e.g. hand sink design and application), will provide food venders the opportunity to utilize temporary hand wash stations in lieu of having installed units. By allowing greater flexibility under coordinator direction; this proposal increases opportunities for business owners while ensuring public health and safety are maintained. This MCEHC revision proposal is following Maricopa County’s Enhanced Regulatory Outreach Program (EROP) policy without added fees. This item will be withdrawn. (C-88-17-007-L-00)

8. CERTIFIED FOOD MANAGER (CHAPTERS I AND VII CFM) PROPOSED REVISIONS TO CHAPTER VIII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (ES-2016-004) Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), convene a public hearing to solicit comments and consider the adoption of Enhanced Regulatory Outreach Program (EROP) Case ES-2016-004/Chapters I and VII Certified Food Manager (CFM). Upon Board approval, this item will become effective March 8, 2017. The Maricopa County Board of Health (BOH) reviewed and approved revisions to Maricopa County Environmental Health Code (MCEHC) Chapters I and VII (EROP Case ES-2016-004/Chapters I and VII CFM) as an EROP expedited case at a public meeting held on Monday, January 23, 2017, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at ES-2016-004/Chapters I and VII CFM Staff Report. The MCEHC Chapters I and VII CFM proposal eliminates Department issued Certified Food Manager cards. Also, this proposal clarifies when food establishments are exempt from the Certified Food Protection Manager requirement. Currently, a card is issued by the Department after each manager travels to a regional office and shares his/her certificate for passing an approved Food Protection Manager training. Upon this proposal’s BOS approval, the Certified Food Manager card and $5 fee will be discontinued; thereby, saving food managers $5 and a commute while ensuring public health and safety are maintained. Additional proposal updates include eliminating the Certified Food Protection Manager duplicate card with the $3 fee, and adding certificate text for training clarification. This MCEHC revision proposal is following Maricopa County’s Enhanced Regulatory Outreach Program (EROP) policy without added fees; it will eliminate a fee. This item will be withdrawn. REQUEST FOR REVIEW OVER BASELINE Per the Board approved FY 2018 Budget Guidelines and Priorities, permit the Office of Management & Budget to review the following request over baseline: • Replacement of non-functioning or end-of-useful life air monitoring equipment and vehicles, $308,080 (Operating expense, Fund 100) The Air Quality department is requesting $308,080 over baseline in operating General Fund expenditures for the routine replacement of non-functioning or end-of-useful life air monitoring equipment including gas analyzers, calibrators, data loggers, and a vehicle. For the past several fiscal years the department has depended on non-recurring General Fund monies for this recurring expense. For FY 2018, the department is again requesting that General Funds be utilized for this purpose, but requests the funds be designated as operating funds due to the recurring and routine nature of the expenditures. The primary driver for historically funding the replacement of air monitoring equipment with General Fund instead of Air Quality Fee Fund was a concern expressed by the regulated community that as the Air Monitoring Program benefits the general public at large, maintenance of the air monitoring network should not be fully funded by fees that are paid by the regulated community. 34. PARTICIPATION IN ARIZONA MEDICAID ELECTRONIC HEALTH RECORD INCENTIVE PROGRAM Authorize the Maricopa County Manager or Designee to execute the Electronic Funds Transfer (EFT) Authorization to enable Correctional Health Services (“CHS”) to participate in the Arizona Medicaid Electronic Health Record (EHR) Incentive Program (“Program”). The Program provides incentive payments to eligible professionals and eligible hospitals as they demonstrate adoption, implementation, upgrading, (“AIU”) or meaningful use of certified EHR technology. Also, subject to legal review, authorize the Chair or his designee to execute any other documentation necessary for CHS to register, attest, and demonstrate eligibility for EHR incentives. The last opportunity for providers to join the Program and submit AIU attestations is March 30, 2017. The County has executed a Group Biller Participation Agreement (C-26-17-003-3-00) authorizing the County to submit data to AHCCCS proving eligibility for the incentives and other payment(s). The EFT Authorization will authorize the County to accept those payments. The Program is administered voluntarily by states and will pay incentives through 2021. Eligible professionals are eligible for incentive payments for 6 years, and participation years do not have to be consecutive. Incentive payments for eligible professionals under the Medicaid EHR Incentive Payments Program are up to $63,750 over 6 years. Eligible professionals can receive an incentive payment for adopting, implementing, or upgrading (AIU) certified EHR technology in their first year of participation. In subsequent years, eligible professionals can receive incentive payments for successfully demonstrating meaningful use. CHS anticipates its eligible providers will receive an initial incentive reimbursement for first year of participation, Program Year 2016, for a sum total amount of not to exceed $425,000 once the Program attestation process is complete. Eligible professionals can be reimbursed $21,250 for first year participation and twenty (20) CHS professionals are participating. (C-26-17-005-M-00)

40. REQUEST FOR REVIEW OVER BASELINE Per the Board approved FY 2018 Budget Guidelines and Priorities, approve allowing the Office of Management & Budget to review the following request over baseline: • Homeless Program dedicated position and three year operational support in the amount of $386,773 (Non-Operating expense, Fund 100) This position will continue to manage and coordinate the contract partnerships as well as the $1,074,473 in funding received (including $750,000 in General Funds) homelessness initiatives throughout Maricopa County. The recent contract management from this dedicated position has increased partner agency performance, and has ensured more housing placement opportunities for those who are homeless in Maricopa County. The position also provides critical staff support to the Director as a member of the multi-agency Funders Collaborative, a member of the Human Services Campus Board, the Maricopa County Continuum of Care (countywide HUD homeless planning and funding), and the management of the Temporary Overflow shelter. HSD’s participation in these activities ensures coordinated funding, priorities, and effective service delivery. The continuation of the homeless program position will allow HSD to increasingly link efforts to the County’s Smart Justice Initiative in FY 2018. This includes preventing those leaving the County jails in being homeless and also preventing recidivism. Led by this dedicated homeless program position, this work will be accomplished through a number of methods, including the development of a data sharing strategy amongst key stakeholders and increasing rapid rehousing opportunities for those involved in the criminal justice system. The General Fund position for homelessness will also be coordinating with Maricopa County’s Correctional Health Services and the major stakeholders who provide services for the Severely Mentally Ill (SMI) population. Through data sharing with this community, this position will be able to determine how many people on the Human Services Campus could be receiving services from other non-campus entities. In addition, this homeless program position will be able to redirect non-profit and community sourced funding into mental health initiatives for those who are homeless. HSD’s homeless program position is crucial in establishing and maintaining effective partnerships with entities who provide services to the homeless, coordination activities involving those who are both homeless and who are SMI and/involved in the criminal justice system, and in reducing homelessness throughout Maricopa County. The Transportation System Plan is a long range planning document identifying capacity needs for the county roadway system in the present and three horizon years (2020, 2025 & 2035). The results of the capacity analysis are used in recommending projects for the Transportation Improvement Program. The last update to the Transportation System Plan was 2007. Based upon changing economic and population trends, as well as region wide planning. Utilizing a methodology to determine identification of growth potential on roadways compared to level of service standards, a capacity based roadway analysis was performed to determine current and projected roadway needs. The TSP 20-35 sets overall goals, objectives, and strategies for current and future transportation needs and investments, and compliments the County’s Comprehensive Plan. Upon Board approval, this item will become effective April 12, 2017. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at http://www.maricopa.gov/3563/Active-Regulatory-Process. This revision will align MCEHC Chapter XII with the recently enacted Primitive Campgrounds statutory update, Arizona Revised Statute (A.R.S.) §36-136. A.R.S. §36-136 includes an exemption for Primitive Campgrounds, which by definition are remote in nature. To mesh with the A.R.S. update, new MCEHC Chapter XII language is proposed that will exempt Primitive Campgrounds from water, electricity and sewer public infrastructure requirements. This MCEHC revision proposal is following the EROP policy and workflow process, without added fees. (C-88-17-014-L-00)

Upon Board approval, this item will become effective April 12, 2017. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at http://www.maricopa.gov/3563/Active-Regulatory-Process. This proposal adds a farmer’s market coordinator and increases business owner market opportunities. The coordinator will submit documentation to the Department, be present during farmers market operating hours, and ensure certain sanitary measures are applied. Coordinator oversight of sanitary measures (e.g. hand sink design and application), will provide food vendors the opportunity to utilize temporary hand wash stations in lieu of having installed units. By allowing greater flexibility under coordinator direction; this proposal increases opportunities for business owners while ensuring public health and safety are maintained. This MCEHC revision proposal is following Maricopa County’s Enhanced Regulatory Outreach Program (EROP) policy without added fees. (C-88-17-013-L-00)

Upon Board approval, this item will become effective April 12, 2017. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at http://www.maricopa.gov/3563/Active-Regulatory-Process. This MCEHC revision proposal is following Maricopa County’s Enhanced Regulatory Outreach Program (EROP) policy without added fees; it will eliminate fees. (C-88-17-012-L-00)
