ACCEPT FUNDING FROM US DEPARTMENT OF JUSTICE, FEDERAL BUREAU OF INVESTIGATION FOR THE JOINT TERRORISM TASK FORCE Approve the Notice of Limits for FY20 State and Local Overtime Reimbursements and acceptance of up to $18,649 in reimbursement funding from the US Department of Justice, Federal Bureau of Investigation for officers assigned to FBI managed task forces. The FBI Joint Terrorism Task Force agreement commenced February 27, 2007 and will continue for an indefinite period until terminated by one or both parties. Acceptance of this agreement was most recently approved by the Board of Supervisors on December 10, 2014 under C-19-15-017-G-00. The FY20 reimbursement funding began retroactively October 1, 2019 and will terminate September 30, 2020. In accordance with paragraph 3 of the agreement, the agreement allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the administration of this agreement. This agreement is non-competitive and does not require a match. The agreement does not require on-going cash contributions after the period end date. Approval of this agreement allows for reimbursement of overtime paid to the detective assigned to the FBI Joint Terrorism Task Force. The purpose of the agreement is to ensure that a capability exists in Maricopa County to deter, defeat, and respond vigorously to terrorism through the joint investigation of suspected terrorist threats and sharing of information and intelligence. 8. TRANSFER OF RETIRING K-9 TO HANDLER Approve the transfer of ownership of retiring K-9, Bach, #K141, to his handler, Detective J. Minka S1053. Bach is 5 ½ years old and has had a serious tendon tear from which has been unable to fully recover. Additionally, he has become difficult to manage around other people. Bach's early retirement is recommended so that Detective Minka can safely handle and manage him. Bach came to MCSO in 2016 and during his tenure in the Special Investigations Division, Bach helped seize $279,940 in currency; 8.3 pounds of heroin; 1760 pounds of marijuana; 149.8 pounds of methamphetamine and 34.6 pounds of cocaine. ACCEPTANCE OF FFY 2019 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) FUNDING Approve acceptance of $711,355 Federal FY2019 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-20-026-G-00), on November 6, 2019. This has been a reoccurring grant to the County for over 20 years and there is no cash or in-kind matching requirement. Indirect costs are not applicable or recoverable since the reimbursement formula calculation only allows for staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates. This funding is not competitive. There are no future or ongoing contributions required. This grant reimburses a portion of the costs for a mandated requirement--incarcerating undocumented criminal aliens who are convicted of felony offenses. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as designated by the County Budget Office, will be Technology – Offender Management Software to be stated in the electronic request to drawdown the funds not later than February 10, 2020. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. AMENDMENT TO LICENSE AGREEMENT FOR USE OF REAL PROPERTY Approve and authorize the Chairman to execute Amendment No. 2 to License Agreement for Use of Real Property (P-50220) with the Town of Fountain Hills for the continued operation of air quality monitoring equipment at 16426 E. Palisades Boulevard, Fountain Hills, AZ 85268. This amendment is the second of two options to renew for an additional 3-year term. The current term will expire January 31, 2020. The new term will commence February 1, 2020 and expire January 31, 2023. The Agreement allows for operation and maintenance of air quality monitoring equipment on approximately 100 square feet. The annual license fee of $300.00 will increase to Four Hundred Dollars ($400.00). The County is responsible for utility fees. 12. NEW HOPE AGREEMENT WITH ALL ABOUT ANIMALS RESCUE, INC. Approve an agreement between All About Animals Rescue, Inc. and Maricopa County, administered by Maricopa County Animal Care and Control, to allow said rescue to transfer animals that have been deemed eligible for the New Hope program. Maricopa County will provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year of transfer for each dog three months of age or older at no cost to the Contractor. The cost for these services is $52 for each animal transferred in FY 2020 and thereafter. Animal Care and Control estimates forty-four (44) New Hope transfers over the term of the agreement for a total of $2,288. AGREEMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR SWG WEATHERIZATION ASSISTANCE PROGRAM Approve a Funding Agreement between the Arizona Department of Housing (ADOH) and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the County to administer the Southwest Gas (SWG) Weatherization Assistance Program. Through this Agreement, ADOH will provide the County with $86,219. The Agreement shall be effective beginning January 1, 2020 through December 31, 2020 and upon signature by both Parties. ADOH contracts with the County on an annual non-competitive basis to provide installation/repair of energy efficiency measures to dwellings occupied by low-income households who are SWG customers in Maricopa County outside of the City of Phoenix and the City of Mesa. The Human Services Department is utilizing the provisional indirect rate of 22.2% by the U.S. Department of Health and Human Services for FY2020 for salaries and employee related expenses. The total Agreement amount is $86,219 of which $6,414 is for salaries and benefits. The total estimated indirect costs are $1,424 and fully recoverable. Budget adjustments will be made when the Indirect rate costs has been fully negotiated and shall be effective as of January 1, 2020. Receipt of the funds from ADOH does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provides a benefit to Maricopa County citizens by providing energy efficient measures in dwellings occupied by low-income residents, which will assist in reducing energy burdens. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation. Therefore, expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. AMENDMENT TO AGREEMENT WITH ARIZONA PUBLIC SERVICE FOR ENERGY WISE LOW-INCOME WEATHERIZATION PROGRAM Approve revenue Amendment No. 015 (No. 15) to the Agreement between Arizona Public Service (APS) and Maricopa County, administered by its Human Services Department. The purpose of this Amendment is for the County to administer of the Energy Wise Low-Income Weatherization Program. Through this Amendment, APS will provide the County with $650,000. The funding period of availability shall begin on January 1, 2020 through December 31, 2020. APS contracts with the County on an annual non-competitive for service delivery of the Energy Wise Low-Income Weatherization Program. The funds will be utilized to provide weatherization measures in dwellings occupied by low-income households in Maricopa County outside of the City of Phoenix and the City of Mesa, who are APS customers. Amendment No. 15 amends the following areas of the Agreement: 1. Defined Terms. Defined terms not otherwise defined herein shall have the meaning set forth in the Original Contract. 2. Term. Section 1 of the Agreement is hereby amended to provide that the Original Contract terminates on December 31, 2020. This Agreement is subject to cancellation by the Parties in accordance with the provisions of Arizona Revised Statutes § 38-511. 3. Allocation. The Allocation amount set forth in Section 3.A. shall be increased by $650,000.00. The funds provided are for provision of the Energy Wise Low-Income Weatherization Program. However, if the Arizona Corporation Commission does not approve the APS 2020 DSM Implementation Plan Energy Wise Low-Income Weatherization Program budget as stated in APS’ filing, then the allocation amount for the 2020 calendar year shall be adjusted based on the ACC’s ruling. 4. For Lack of Regulatory Approval. In the event that the Program is not approved by the Arizona Corporation Commission ("ACC") or in the event that such approval is subsequently withdrawn or significantly changed, then the Company may immediately terminate this agreement upon written notice to Supplier. 5. Subsequent Year Allocation. Per the original Agreement, Section 3.A, the Allocation may be amended from time to time by APS. With regards to cost Allocation plans, APS reserves the right to review sufficient verification and pertinent reporting data as of November 1st of the 2020 program year and based on the percent of the Allocation spent, authorize the subsequent year Allocation forecast on this basis by November 15, 2020. However, if the 2020 year spend is equal to or more than 80% of the Allocation by November 1st, then the subsequent year Allocation shall be based on 100% of the Allocation as specified in the APS 2021 DSM Implementation Plan, subject to approval by APS or the “ACC”. 6. Scope of Services. Add Section 2.I.4. The Contractor will save REM files from every home audited utilizing Architecture Energy REM software and weatherized during the course of the contract year and in their original electronic format. The Contractor will provide the REM files in a suitable electronic format for analysis and audit within 15 days of a request by APS. To ensure and secure the data, the Contractor will be required to maintain an electronic backup. Data must be retained for a minimum of three years. 7. Payment Term. The payment terms established under Section 3.F (Compensation/Taxes) of the Original Contract shall be modified to indicate that APS will make payment to the Contractor within 15 days of receipt of the invoice from the Third Party Coordinator. 8. Final Invoice. A final invoice for the Term shall be submitted to the third party coordinator and APS by December 15, 2020. For work performed after that date and to the end of the term, the Agency must email an estimate of expenses to the APS program coordinator and the third party coordinator no later than January 4, 2021. Reimbursement for late invoices for work performed in 2020 will be considered on a case by case basis. 9. Remaining Terms Unchanged. Except as modified in this Amendment No. 015, all other terms and conditions of the Original Contract shall remain unchanged. The Human Services Department is utilizing the provisional indirect rate of 22.2% by the U.S. Department of Health and Human Services for FY2020 for salaries and employee related expenses. The total Amendment amount is $650,000 of which $106,383 is for salaries and benefits. The total estimated indirect costs are $23,617 and fully recoverable. Budget adjustments will be made when the Indirect rate costs has been fully negotiated and shall be effective as of January 1, 2020. Receipt of the funds from APS does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provides a benefit to the citizens by providing assistance to low income residents by reducing their energy burden and improving health and safety concerns. The County changed the scope of the work by adding eight (8) feet of length to two (2) boathouses to accommodate the County’s two (2) navigational-aid boats. The change in the scope of work described herein resulted in an increase in construction costs in the amount of nineteen thousand four hundred eighty dollars and seven cents ($19,480.07). Therefore, the revised Construction Costs shall not exceed nine hundred eighteen thousand one hundred eighty dollars and seven cents ($918.180.07). This is located in Supervisory District #4. 34. PURCHASE ORDER FOR IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR DENTAL SEALANT SERVICES PROGRAM Approve a retroactive Purchase Order (PO) No. PO0000160986 for Intergovernmental Agreement (IGA) No. ADHS18-175153 between Arizona Department of Health Services (ADHS) and Maricopa County through its Department of Public Health (MCDPH), Office of Oral Health (OOH). The PO effective period is from January 1, 2020 through December 31, 2020, for the total not to exceed amount of $344,527. The IGA term is January 1, 2018 through December 31, 2022. The Dental Sealant grant award is reoccurring and has been awarded to MCDPH in previous years. This grant does not require an in-kind match, indirect cost is fully recoverable, and ongoing contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by providing the dental sealant services necessary to promote oral health and provide authorized preventive dental services to at-risk children in Maricopa County. The grant award is competitive. All program costs are allocated to the grant so there will be no additional burden on the department’s operating budget. MCDPH’s indirect rate for FY 2019-20 is 19.2%. The indirect costs are estimated at $ 55,494 all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and future indirect costs will be collected at the corresponding rate. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This IGA does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. 36. AMENDMENT TO LEASE AGREEMENT L-7381 Approve and authorize the Chairman to execute amendment 4 to Lease Agreement L-7381 Public Health Department use of 50,810 rentable square feet of office space at 4041 N. Central Avenue, Phoenix, 85012. And, since the agreement will require administrative action, including execution of documents from time to time, the Deputy County Manager or the County Real Estate Director each are hereby given the authority and charged with the responsibility for proper administration of this Agreement. Amendment 4 will increase the rentable square feet by adding suites 840 and 850 (5,088sf) for a total of 55,898 square feet. Lessor, at Lessor expense, will provide turn-key space on or before April 30, 2020. Per the rent schedule within the lease, rates for existing space will remain the same and the new space rents will follow the existing rent schedule and escalations. Six (6) months will be added to the term of the lease and expire December 31, 2023. The lease rate for the remaining 6 months will escalate another $0.50 per square foot. This rate includes the appropriate share of operating expenses and applicable rental tax. An additional 10% is added to cover any miscellaneous or unforeseen, resulting in an anticipated cost of $5,491,537 through end of lease term. Total expense may vary depending on date of occupancy and rent begin date. This lease may be terminated pursuant to A.R.S. § 38-511 or for non-appropriation of funds at the end of a county or federal fiscal years end. TRANSPORTATION RESEARCH BOARD’S ROUNDTABLE/FORUM AND PAYMENT OF ANNUAL DUES Approve continued participation by the Maricopa County Department of Transportation (MCDOT) for the next 3 years on the Transportation Research Board’s (TRB) Roundtable/Forum on Preparing for Automated Vehicles (AV) and Shared Mobility Services. This requested action also includes payment of dues annually of $5,000 for the next 3 calendar years (CY2020, CY2021 and CY2022), for a maximum total of $15,000. Funds for participation are programmed in the Department of Transportation Operating Fund (fund 232), MCDOT Director’s Office. The Transportation Research Board is a unit of the National Academy of Sciences. As a continuing TRB stakeholder, MCDOT will have affiliation with, and access to, the National Academies and TRB. The TRB Forum will entitle MCDOT to participate as a partner to identify and facilitate research needed to deploy AV and shared mobility services. IGA WITH TOWN OF CAVE CREEK FOR OPERATION AND MAINTENANCE OF TRAFFIC SIGNALS Approve the Intergovernmental Agreement between Maricopa County and the Town of Cave Creek (Cave Creek) for the operation and maintenance of certain traffic signals. The term of the Agreement will not exceed five (5) years unless extended by appropriate actions by the County and Cave Creek. Either Party may terminate this Agreement at any time prior to the expiration date by furnishing the other Party with a thirty (30) day written notice. The purpose of this Agreement is to extend the authorization for the County to operate and maintain Cave Creek owned traffic signals and define the responsibilities of each Party related to such signals. Currently, the County operates and maintains four (4) traffic signals within Cave Creek. The number of Cave Creek owned signals operated and maintained by the County shall not exceed seven. Through this Agreement, any change in the number of County-operated and maintained signals (up to the maximum of seven) will be accomplished through a Letter of Agreement (LOA). The LOA will specify which signals are being removed or added and be approved by the County Transportation Director and the Cave Creek’s Public Works Director, or their designees. The County shall invoice Cave Creek at least annually for all costs associated with the operation and maintenance of identified signals. This includes all costs for routine operation and maintenance and costs associated with signal failures and reconstruction of damaged equipment. The estimated cost to relocate the private ditch facilities is $1,394,810. Funds are budgeted in Transportation System Management (TMAN) project, Sub-Project TT0511 MC 85: 95th Avenue to 107th Avenue. All property owners have been compensated for a temporary construction easement in order for the work to take place. MCDOT has coordinated the work in partnership with SRP Irrigation (the water provider), BWCDD, DBA Contractors, the farmer and the property owners. All of the work to relocate this private irrigation ditch is necessary for the road work to occur, therefore MCDOT is responsible for all costs related to the construction and relocation of these facilities. Approval of this agreement will allow relocation of the private ditch facilities during the January – February 2020 dry-up period, in advance of MCDOT roadway construction. ROAD DE-ANNEXATION FROM THE CITY OF AVONDALE TO MARICOPA COUNTY Pursuant to A.R.S. §9-471.03, set a hearing for Wednesday, February 12, 2020 to determine if the public interest is served by de-annexing road right-of-way from City of Avondale jurisdiction to Maricopa County in accordance with City of Avondale Ordinance No. 1711-1219 and direct Maricopa County Department of Transportation (MCDOT) to prepare an analysis of the requested action. At the hearing, if after reviewing the analysis and hearing those that may appear for or against the action, the Board determines that the public interest is served by this de-annex/annexation action, the Board shall file in the Clerk of the Board’s Office an ordinance setting forth the legal description of the public right-of-way and declare the return of the right-of-way contingent on the fulfillment of the additional conditions of the statute which would include setting a second public hearing on this matter. Right-of-way location: West side of 107th AVE from 150’ N of Roeser RD to Broadway RD. Supervisory District No. 5.
