6. proposed revisions to RULES 317, 321, 360, 370, 371 AND APPENDIX G Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of proposed revisions to the following Maricopa County Air Pollution Control Regulations: Rule 317 – Hospital/Medical/Infectious Waste Incinerators, Rule 321 – Municipal Solid Waste Landfills, Rule 360 – New Source Performance Standards, Rule 370 – Federal Hazardous Air Pollutant Program, Rule 371 – Acid Rain, and Appendix G - Incorporated Materials. Following the public hearing, the Board is requested to adopt proposed revisions to Maricopa County Air Pollution Control Regulations Rules 317, 321, 360, 370, 371, and Appendix G. The Maricopa County Air Quality Department (department) is proposing to incorporate by reference various federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA) and published in the Federal Register, including actions related to New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 of the Code of Federal Regulations (CFR). These rules implement federal requirements according to each federal program identified or applicable source type subject to these regulations. The proposed action will include amending the incorporation by reference date from “2008” to “2009” in each of the rules to remain current with federal regulations. This incorporation by reference is necessary before requesting the EPA’s delegation of authority to Maricopa County for the implementation and enforcement of the federal rules documented in the Maricopa County Air Pollution Control Regulations Rules 317, 321, 360, 370, 371, and Appendix G. In addition, the proposed amendments will also correct typographical or other clerical errors; make minor grammatical changes to improve readability or clarity; modify the format, numbering, order, capitalization, punctuation, or syntax of certain text to increase standardization within and among rules; or make various other minor changes of a purely editorial nature. As these changes do not alter the sense, meaning, or effect of the rule, they are not described in detail here, but can be readily discerned in the “strikeout and underline” version of the rule contained in Item 14 of the notice of expedited rulemaking. 55. TRADE-IN OF TWO STREET SWEEPERS Approve the trade-in of two Freightliner street sweepers, County Asset Numbers M0800632 and M0800633. These two street sweepers could not be repaired. Norwood Equipment Inc. and Elgin Sweeper Co. agreed to exchange these two units for two new 2010 models with the International chassis at no cost to Maricopa County. In addition, approve a capital freeze exception so that Equipment Services could release the sweepers to MCDOT and the sweepers could be put into service, and direct Equipment Services to add the sweepers. This action has zero impact to the budget. On January 6, 2010, Norwood Equipment Inc. notified Materials Management that both Norwood Equipment Inc. and Elgin Sweeper Co. have agreed to replace the two Freightliner street sweepers that MCDOT uses for roadway maintenance with brand new 2010 models. The equipment issues that MCDOT reported are beyond repair. Equipment Services has confirmed that the two new sweepers were delivered and received. Supervisory District No(s). All (C-91-10-192-M-00)

56. AMENDMENT TO THE IGA WITH THE TOWN OF BUCKEYE FOR THE EXCHANGE OF SERVICES (ENTENTE) Approve Amendment No. 1 to the Intergovernmental Agreement (IGA) between Maricopa County and the Town of Buckeye for the Exchange of Services (Entente). The original Agreement was approved by the County Board of Supervisors on October 4, 2004 (C-64-05-073-2-00) and recorded on the 18th of October, 2004 (Recorder’s # 2004-1216088). The original Agreement outlined measures for the Parties to enter into a joint effort to provide a more seamless transportation system through a cooperative roadway maintenance program (Entente). The Amendment is for an additional five year period, and will only be extended by appropriate actions by the County and the Town. Either party may terminate this Agreement at any time prior to the end of its duration by furnishing the other party with 30 days written notice. This Agreement looks beyond jurisdictional or geographical boundaries and instead focuses on the maintenance task and availability of the most economical resources. It provides the traveling public with a more seamless transportation system via a cooperative highway maintenance program. This Agreement could occur with “routine” or “emergency” conditions. Each individual maintenance task performed by or for the Town shall be handled via a “Letter of Agreement” (LOA) approved and signed by the Town’s Manager and the County’s Department of Transportation Director or their designate. The individual LOA would institute a tracking/accounting mechanism that would specify the particular services contracted for and show that services exchanged are of similar value, or that the reimbursement cost would not exceed the $200,000.00 threshold. Nothing in this Amendment shall be interpreted to enlarge or expand the authority of either party. Both parties, at all times are subject to existing County and Town policies, such as planning, budgeting, purchasing, etc. Supervisory District No. 4 (C-64-05-073-2-01)

58. IGA WITH THE CITY OF PHOENIX FOR IMPROVEMENTS TO MC85 FROM 107TH AVENUE TO 75TH AVENUE Approve the Intergovernmental Agreement (IGA) between Maricopa County and the City of Phoenix for Improvements to MC 85 from 107th Avenue to 75th Avenue. MC 85 between 107th Avenue and 75th Avenue is currently a County roadway. It is a four lane roadway with a striped two-way left turn lane that divides Phoenix city limits from Tolleson city limits. The surrounding land use is residential, industrial and agricultural with plans for future commercial use. In an effort to serve a regionally growing area, the County will improve MC 85 to the City of Phoenix standards, which consists of 6 lanes, raised median, bike lanes, curb, gutter and sidewalk and a drainage system. The City will annex the project once it is completed. Funding for the roadway improvements is in the Public Works (910), Transportation Capital Projects Fund (234), County Arterials (ARTS) Project, Sub-Projects T112 and T113. The County will act as the lead agency and incur all costs for the design and construction of the project, utilizing City design standards. The County will operate and maintain all signalized intersections and associated signs that are mounted on signalized poles within the project limits. The City will annex the project, once it is completed and accepted by the County. The City will waive any or all permit fees required to design and construct the portion of the project that resides within the City’s jurisdictional boundaries, plus be responsible for striping the project. The City authorizes the County to purchase, and if necessary condemn required properties within the City for the purpose of this project. Supervisory District No. 5 (C-91-10-195-M-00)

59. AMENDMENT TO IGA WITH THE STATE OF ARIZONA REGARDING AMERICAN RECOVERY AND REINVESTMENT ACT FUNDS FOR A COUNTYWIDE PAVEMENT PRESERVATION PROJECT Approve Amendment No. 1 to the Intergovernmental Agreement (IGA) between the State of Arizona, by and through the Arizona Department of Transportation (ADOT), and Maricopa County through its Department of Transportation (MCDOT), regarding the acquisition and distribution of federal American Recovery and Reinvestment Act of 2009 (ARRA) funds for pavement preservation projects throughout the County. The Amendment would allow MCDOT to remit to the State the amount of $765,652 upon receipt of an invoice from ADOT for Construction Administration services required for Pavement Preservation (PAVE) Project, Sub-Project T322, utilizing an ADOT Consultant Contract. The IGA will be in effect from the date of recording by the Secretary of State and will remain in effect until the terms of the IGA are satisfied. The purpose for this amendment is to authorize MCDOT to remit $765,652 to ADOT in order for ADOT to pay AMEC, the consultant hired for construction administration of this project. ADOT is requiring MCDOT to pay ADOT the full cost of construction administration upon initiation of the project. However, the IGA previously approved by the Board of Supervisors on August 5, 2009 (Agenda Item # C-91-10-004-M-00) could not have anticipated this unique need, so it did not authorize direct payment to ADOT. Upon completion of the work, MCDOT would then request reimbursement of these funds through the normal federal process. Supervisory Districts: All (C-91-10-004-M-01)

The City will act as the lead agency for this project, with the County financially contributing 50% of the repair costs, but not-to-exceed $120,000.00. Funding is available in the Public Works (910) Transportation Capital Projects Fund (234) Bridge Preservation (BRIG) Project bin. Sub-Project T325, Peoria Ave/New River Bridge Repairs, will be used to identify the expenditures related to this project. The Peoria Avenue Bridge at New River was constructed in 1970. The bridge is a 4 span – Type III AASHTO Girder Bridge. The bridge structure was annexed by the City of Peoria in April, 2007. At the time of the annexation, the County Bridge Engineer had identified deficiencies in the bridge bearing pads. 62. CONTRACT WITH D & O CONTRACTORS FOR RUBBERIZED BITUMINOUS SURFACE TREATMENT PROJECT Authorize the Maricopa Department of Transportation to award the contract for the Rubberized Bituminous Surface Treatment 2011 Project to D & O Contractor, the lowest, responsive, responsible bidder for the project. D & O’S bid of $2,330,508.31 exceeded the Engineer’s estimate by more than 10% so Board approval is being requested to allow MCDOT to award the contract to this vendor. Funding for the project is available in the Public Works (910) Transportation Operations Projects Fund (232) Roadway Maintenance (ROAD) Project Number 30050086. On May 12, 2010, the Board approved Agenda Item C-91-10-173-5-00 for the solicitation of bids for the Rubberized Bituminous Surface Treatment 2011 Project. The Board also approved the award of the contract to the lowest, responsive, responsible bidder provided that the lowest, responsive, responsible bidder does not exceed the Engineer’s estimate by more than 10%. The lowest bid for the Rubberized Bituminous Surface Treatment 2011 Project came in at 23.5 percent higher than the Engineer’s estimate of $1,886,739.22. The cost of rubber asphalt binder climbed from approximately $640 per ton in March to $837 per ton. This increase was unexpected in so short a time period. This increase in costs is not considered unreasonable given the fact of the fluctuation of asphalt binder. Supervisory Districts: 1, 4, and 5 (C-91-10-173-5-01)

F-3. RESOLUTION FOR GRANITE REEF WASH DRAINAGE IMPROVEMENTS Adopt Resolution FCD 2010R002 for the Granite Reef Wash Drainage Improvements (Project [265]), authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to advertise, select, negotiate, and award contracts for engineering and construction services; negotiate Intergovernmental Agreements; include funding in the District’s Five-Year Capital Improvement Program, subject to Board ratification and approval. Flooding hazards threaten the developed area bounded approximately by the Central Arizona Project (CAP) to the north, Loop 101 to the east, Hayden Road to the west and the Salt River to the south. Flooding of property has occurred in the area, and 1,081 residential or commercial properties are located in the Granite Reef Wash floodplain. The City of Scottsdale completed a study of the area drainage features in January 2009, and the study concluded drainage capacity is insufficient. To mitigate this hazard, the study recommended the implementation of this Project, tentatively consisting of a large diameter conduit in Pima Road extending from Chaparral south to McKellips with associated laterals and inlets, and an outlet to the Salt River. This Agenda Item impacts Supervisory Districts 1 and 2. (C-69-10-078-6-00)
