33. SOLE SOURCE FOR ADP AND PEOPLESOFT INFORMATION TECHNOLOGY SUPPORT Approve the following actions to provide for the support to PeopleSoft, the current enterprise payroll system, to insure that the bi-weekly payroll needs are completed in a timely manner and to support the ADP transition. These contractors have specific corporate knowledge critical to the ADP tasks, and the go-live date. The knowledge transfer to new contractors can pose a significant risk to the PeopleSoft payroll system. This action is necessary due to the extension of the ADP go-live date to June 30, 2011. 1. Approve the following three sole source purchases from bid serial 05115-S contracts in an aggregate amount not-to-exceed (NTE) $560,574 for contracted hours during this extended time period and extend the contracts from January 1, 2011 through June 30, 2011. • Meridian Technology Group (C-41-10-012-3-00), for contractors – Abdul Salaman Mohammed (NTE $115,920) & Brahm Alavala (NTE $113,904) • Technology Staffing Solutions (C-41-10-013-3-00), for contractor Matt Brinkman (NTE $165,375) • Vault Digital LLC (C-41-10-014-3-00) for contractor James Ellis (NTE $165,375) 2. Approve two new sole source purchases from 08070-IGA with the State for the following vendors for the term of January 1, 2011 through June 30, 2011 for an aggregate contract value in an amount not-to-exceed $291,375. • Comsys (C-41-10-010-3-00) - Contractor Name – Ryan Ellis (NTE $165,375) • Hudson Global Resources (C-41-10-011-3-00), Contractor Name – Radha Krushna Murthy (NTE $126,000) 3. Approve an Administrative Correction to the action taken on June 23, 2010 (C-41-10-016-3-ZZ) in which “sole source purchases” under bid serial 05115-S for several vendors including Comsys (C-41-10-010-3-00) and Hudson Global Resources (C-41-10-011-3-00) were approved. The reference to bid serial 05115-S for these two vendors was incorrect and should have been 08070-IGA with the State. Comsys and Hudson were acquired under County contract 08070-IGA which is an intergovernmental agreement that permits the County to use State contract EPS070113 which provide IT staffing personnel. 35. MARICOPA COUNTY EMPLOYEE LEAVE PLAN (“MASTER LEAVE PLAN”) CHANGES Approve an amendment to the Maricopa County Employee Leave Plan (“Master Leave Plan”) changing the way Holiday Pay is calculated. The current policy states that Employees with regular work schedules of 40 hours per week shall receive eight (8) hours of compensation for a Legal Holiday, and an employee’s regular work schedule will be determined by taking the average of the employee’s four (4) prior work weeks. The recommendation is to remove “An employee’s regular work schedule will be determined by taking the average of the employee’s four (4) prior work weeks..” since employees work schedules will be entered into the system and used to calculate Holiday Pay. The Master Leave Plan contains the rules for paid and unpaid leave that apply to unclassified and contract employees, and on a limited basis to temporary employees. The Master Leave Plan also applies to classified employees who are not covered by Rule 12 of the Maricopa County Employee Merit Rules. (C-31-09-018-6-01)

Also, approve and authorize the Chairman to execute, Amendment No. 1 to Lease Agreement L-7357 between HTA-Thunderbird Medical, LLC, a Delaware limited liability company (f/k/a NNN Healthcare/Office REIT Thunderbird Medical, LLC), as successor in interest to 5410 & 5422 W. Thunderbird Road, LLC, an Arizona limited liability company, and PEA Enterprises, LLC, a California limited liability company, as tenants in common, and Lessee, Maricopa County, for approximately 4,292 square feet of replacement premises at 5422 West Thunderbird Rd., Suites 3, 4 & 5, Glendale, Arizona. At the request of the landlord, this Lease Amendment No. 1 replaces the existing leased premises of the Thunderbird WIC facility with a new leased premises at the landlord’s property. 65. GRANT BUDGET APPROPRIATION ADJUSTMENTS Approve increases in the appropriated budget for Public Health (860) Public Health Grant Fund (532) Operating (0000) in the amount of $10,203,757 in revenues and $10,203,757 in expenditures as identified on the Fiscal Year 2010-2011 Grant Summary Worksheet on file in the Office of the Clerk of the Board. This appropriation adjustment brings MCDPH’s grant budget to the amount of $48,726,606. The appropriation adjustment is necessary because the carry forward amounts of prior year grants and award amounts of new grants differ from the amount approved in the FY 2010-2011 Budget Appropriation. This action is in accord with the action plan developed by the Office of Management and Budget and MCDPH to insure compliance with the Board approved Budgeting for Results Accountability Policy. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The indirect cost rate is 17%, as calculated by the Department of Finance. Most of the grants for FY 2010-2011 allow for indirect cost recovery, as reflected in the funding agreements. The status of the indirect costs for each grant is noted on the Grant Summary Worksheet on file in the Office of the Clerk of the Board. (C-86-11-031-2-00)

73. RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY REGARDING THE ATTAINMENT OF ONE MILLION SAFE WORK-HOURS ON THE MARICOPA COUNTY DOWNTOWN COURT TOWER Approve the Resolution of the Board of Supervisors of Maricopa County Regarding the attainment of one million safe work-hours on the Maricopa County Downtown Court Tower. Whereas, each year, more than 5,500 American workers die of workplace related injuries and another 4,400,000 are injured from occupational accidents or illnesses; Whereas, the construction industry employs 8% of the American workforce but accounts for 22% of all workplace fatalities, the highest percentage of all industry sectors; Whereas, the Bureau of Labor Statistics estimates that in the construction industry, nationwide, roughly one work-day is lost per 100,000 work-hours completed from a workplace accident; Whereas, on November 30th, 2010, the Maricopa County Downtown Court Tower project achieved one million work-hours without a single worker missing a day of work due to a workplace accident; Whereas, reaching this extraordinary milestone is the direct result of the collaborative effort between Maricopa County and the Gilbane Building Company in association with the Ryan Companies, Inc. (Gilbane/Ryan) to make worker safety a key priority, including fastidious adherence to the Downtown Court Tower site Safety Plan and implementation of the “Gilbane Cares” program making safety performance a working value; and Whereas, the Gilbane Cares program advocates an environment where everyone on the Downtown Court Tower site is empowered to engage their fellow trades, direct supervisors and construction management regarding safety, leading to nearly 50,000 independent observations that identified and corrected more than 1,200 potentially unsafe conditions; and Whereas, Gilbane/Ryan in conjunction with Maricopa County adopted a Site Safety Plan that established requirements in excess of what the Federal Occupational and Safety Health Administration (OSHA) requires, including an aggressive drug and alcohol program that covers pre-employment, random, post-accident and probable cause testing, a six-foot fall rule, special tower crane/scissor lift requirement and many more; and Whereas, the success of the Gilbane/Ryan total Safety Program would not be possible without the complete and sustained commitment of all trade contractors working on-site as well as the leadership and management of Gilbane/Ryan; Now, therefore be it resolved that the Maricopa County Board of Supervisors recognizes and congratulates Gilbane/Ryan, their trade contractors and the entire Project Team on achievement of this enviable and important milestone. Powerline FRS is one of a system of three flood retarding structures (Powerline FRS, Vineyard Road FRS and Rittenhouse FRS) that were constructed by the U.S. Soil Conservation Service (now Natural Resources Conservation Service or NRCS). Powerline FRS was constructed in 1967 and 1968. District staff identified a fissure risk zone associated with the structure, and near term action is required to mitigate the associated dam safety and public safety concern. In July 2008, the District submitted this Project to the District's Capital Improvement Program (CIP) Prioritization Procedure for fiscal year (FY) 2009-2010, and the District’s Flood Control Advisory Board, with staff concurrence, recommended the project for future implementation. The Project was authorized by Resolution 2008R015 on April 1, 2009 (C-69-09-056-6-00) and 2008R15A on, March 17, 2010 (C-69-10-060-6-00). The Board approved Intergovernmental Agreement (IGA) FCD 2010A005 on August 18, 2010 (C-69-11-003-3-00) between the District and NRCS for cost sharing, design, rights-of-way acquisition, construction, construction management, operation and maintenance of the Project. The IGA was signed by NRCS on September 24, 2010. Per the IGA, 100% of the eligible cost of construction of the project will be paid by NRCS. S-3. TEMPORARY CONSTRUCTION EASEMENT, LIMITED BLANKET EASEMENT, AND ASSIGNMENT OF TENANT AREAS UNDER THE REAL ESTATE MANAGEMENT AGREEMENT 1) Approve, in substantially the form presented, upon final legal review and approval, an easement to the benefit of AT&T Corporation on behalf of AT&T WiFi Services Inc, and New Cingular Wireless PCS, LLC, a Delaware limited liability company managed by AT&T Mobility Corporation, (collectively referred to herein as “AT&T”) for the purpose of installing, operating and maintaining equipment necessary to provide a new public and private wireless networking capability and enhanced cell phone coverage and reception at Chase Field. Upon final legal approval and execution, the easement will be effective as of December 15, 2010 and will run concurrently with agreements entered into by the ballpark Facility Manager and Real Estate Manager with AT&T for the provision of these services. The proposed easement is at nominal cost to AT&T because the easement is ancillary to a lease between New Cingular Wireless and the Chase Field Real Estate Manager (the Lease Agreement) to provide enhanced cell phone coverage within the Facility and an agreement between the Facility Manager and AT&T WiFi Services, Inc. to provide wireless internet connectivity within the Facility. The proposed wireless networking installation, operation and maintenance will be at no cost to the District. This item was recommended by the Maricopa County FRC. 2) Authorize the Executive Director or Executive Director Representative to designate areas included in the forgoing easement as may be appropriate as Tenant Areas under the Real Estate Management Agreement between the District and the Real Estate Manager and related entities (the REMA). The areas included in the easement and Lease Agreement are not currently designated as Tenant Areas; however REMA Section 5.1 allows for additional areas of the ballpark to be designated as Tenant Areas upon mutual agreement of the Real Estate Manager and District.
