Development of the site shall comply with the site plan entitled, “Military Compatibility Permit Case No. MCP2014001 for Desert Gardens Mini Storage”, consisting of one (1) full-size sheet, dated April 22, 2004, and stamped received August 12, 2014, except as modified by the following conditions. b. Development and use of the site shall comply with the narrative report entitled, “Military Compatibility Permit for Property Commonly Known as Desert Gardens Mini Storage”, consisting of four (4) pages, dated August 12, 2014 and date stamped received August 27, 2014 except as modified by the following conditions. c. Development and use of the site shall comply with the landscape plan entitled, “Preliminary Landscape Plan – Mini Storage for Desert Gardens” consisting of one full-size sheet, dated revised November 11, 2004 and stamped received August 12, 2014 except as modified by the following conditions. d. The hours of operation shall be limited to Monday through Friday, 9 a.m. to 6 p.m., Saturday, 9 a.m. to 5 p.m., and Sunday, 12 p.m. to 5 p.m. e. Signage will be limited to what is indicated on the approved site plan. f. All habitable buildings constructed shall be constructed to attain noise reduction as per A.R.S. § 28-8482. g. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. h. Amendments shall be processed as a revised application per the Maricopa County Zoning Ordinance. i. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning Ordinance. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the underlying zoning existing on the date of application, subject to conditions. It is, therefore, stipulated and agreed that revocation of this Military Compatibility Permit due to the failure to comply with any condition does not reduce any rights that existed on the date of application to use, divide, sell, or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Military Compatibility Permit enhances the value of the property above its value as of the date the Military Compatibility Permit is granted and revocation results in the same value of the property as if the Military Compatibility Permit had never been granted. 28. AZ MUTUAL AID COMPACT (AZMAC) Approve the Arizona Mutual Aid Compact (AZMAC) between the State of Arizona and the Arizona Department of Emergency and Military Affairs, School Districts, Tribal Nations, Maricopa County and all other participating municipal corporations in the State. The other participants are signing this agreement simultaneously. This mutual aid agreement provides a mechanism for Maricopa County and the other participants in Arizona to assist each other in the event that a disaster should occur. The agreement also provides a means to decline rendering assistance if doing so is not in the best interest of the County. If the agreement is put into effect as a result of a disaster, there could be either a cost to the County for assisting another participants or a gain from receiving assistance from other participants, depending on the location of the damaged area. Assistance rendered during a state-declared disaster is eligible for reimbursement according to the terms of A.R.S. 35-192 and A.R.S. 26-311. Assistance rendered during a federally-declared disaster is eligible for reimbursement according to federal guidelines. There is no cost to Maricopa County for participating in the agreement. This Compact shall be effective on the date it is recorded with the Secretary of State and shall terminate ten years after the effective date. The Arizona Mutual Aid Compact being submitted for the Board of Supervisors' approval will provide a mechanism for Maricopa County and other participants to assist one another if a large-scale disaster causes widespread damage that is beyond the capability of a single participant to handle. This compact does not force Maricopa County to assist other participants in the agreement in the event of a disaster, it simply outlines the terms under which such assistance is to be provided. This supersedes the previous AZMAC. • Changes include verbiage specific to School Districts entering into the agreement. • The ability for AZMAC to be used for exercising adopted emergency plans in addition to being used at times of emergency. • Language in the cost recovery area has been cleaned up to match current trends. The funding for this program is “as needed” based on client visits/enrollments, which allows ADHS greater flexibility in allocating funds; based on the services being provided, without the need for a contract amendment should adjustments be required. The contract funding amount is $466,221 for the effective period from July 1, 2014 to June 30, 2015. The Contract effective term is from July 1, 2014 to June 30, 2017. The Department of Public Health indirect rate for FY2014-15 is 14.8%. The indirect costs are estimated at $60,105, which are fully recoverable. MCDPH NICP program has been awarded the RFP Contract pursuant to the ADHS Solicitation ADHS14-00003830 for HRPP/NICP Community Health Nursing Services on July 1, 2014. Also the Purchase Order (PO) No. (ADHS1-074958:1) indicates the allocated amount of $466,221 for the contract effective period from July 1, 2014 to June 30, 2015. ADHS’s standard practice is to post a $1 on a budget line item to keep the budget line open for future use. Instead of notating a $1, the revised award letter indicated “Issued as needed”. The Purchase Order is for $466,221 and the letter totals to $466,220 plus the implied $1. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this grant will be provided by ADHS and will not affect the County’s general fund. (C-86-15-021-3-00)

F-5. RESOLUTION FOR GUADALUPE FLOOD RETARDING STRUCTURE REHABILITATION PROJECT Adopt Resolution FCD 2014R001 for the Guadalupe Flood Retarding Structure (FRS) Rehabilitation Project (Project [#205]), authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to negotiate Project Intergovernmental Agreements; include Project funding in the District’s current and future Five-Year Capital Improvement Programs; advertise, select, negotiate, and award contracts for Project Engineering and Construction Services; conduct permitting and public involvement activities and acquire temporary land rights, subject to the ratification and approval of the Board. The Project’s current estimated cost is $2,500,000 and Project implementation is expected to occur over a 2 to 3 year period. The District anticipates entering agreements with the NRCS who is the federal funding partner on the Project. The Guadalupe FRS, completed in 1976, protects the Town of Guadalupe and portions of Phoenix and Tempe from flooding. Concept plans for the Project include the replacement of the intake structure, slip lining of the dam outlet pipe and installation of a filter diaphragm around the outlet pipe in the dam. The total project cost is currently estimated to be $2,500,000. The federally eligible cost will be cost shared by the NRCS and the District at 65% and 35%, respectively. NRCS does not cost share on outlets downstream of a dam embankment, therefore the estimated total Project cost that is eligible for federal cost share funding is $1,154,000. The estimated NRCS cost share for this agreement is $750,100 and the Districts are $403,900. The total District cost is estimated to be $1,749,900 for the Project. Project timing is dependent upon funding availability. This Agenda Item impacts supervisorial districts 1 & 5. (C-69-15-015-6-00)
