The term of this grant began on July 1, 2010 and ends on June 30, 2015. The term of Amendment #3 is July 1, 2011 to June 30, 2012. The purpose of Amendment #3 is to increase the reimbursement ceiling for Case Management services by $1,496,509.00, and also increase the reimbursement ceiling for Community Services by $645,957.00. With Amendment #3, the cumulative reimbursement ceiling for this Agreement over the grant period is increased by $2,142,466.00 to $12,168,778. Amendment #3 revises Terms and Conditions, Section 4.5 to amend the definition for “equipment”, and includes revised Itemized Service Budgets Attachments A & B for Case Management and Community Services, respectively. The Human Services Department negotiated indirect rate for FY2011-12 is 16.1%. Total grant indirect costs are estimated to be $63,546. $1,684,224 of grant funds will be passed through to subrecipients, or to clients for direct pay vouchers, and are not subject to indirect cost recovery. Funding for this Amendment does not impact the County General Fund. The overall grant budget will be adjusted as necessary to accommodate this Amendment through a future reconciliation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of these revenues by Maricopa County is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-22-10-083-3-03)

37. PROGRAMMATIC AGREEMENT WITH CITY OF SCOTTSDALE FOR HUD-FUNDED PROGRAM ACTIVITIES Approve, as a concurring party, the programmatic agreement between the City of Scottsdale and the State Historic Preservation Office (SHPO) governing the environmental clearance of U.S. Department of Housing and Urban Development (HUD) grant-funded program activities, which involve properties of potential historical significance. Concurrence by the Board of Supervisors is required by SHPO because the City of Scottsdale receives HUD HOME Investment Partnership Program (HOME) grant funds through the Maricopa HOME Consortium. Maricopa County is the lead agency of the Maricopa HOME Consortium and, as such, serves as the certifying agency on all environmental clearances under the HOME program. Signing the document as a concurring party does not subject the Board of Supervisors to any additional responsibility or liability under the HUD regulations. This is a non-financial agreement and does not affect County general funds. HUD regulations require an environmental clearance on any activities undertaken with HOME funds. For all properties that are 50 years old or older, or that are listed on a historical register, SHPO must be consulted in order to determine whether the property is of historical significance and whether the property will be adversely affected by the investment of the HOME funds. SHPO allows any local government that has its own Historic Preservation Office or Commission to enter into a programmatic agreement that will allow the local Historic Preservation Office or Commission to determine the historical significance of local properties without a specific concurrence from SHPO. VEHICLE DONATION Pursuant to A.R.S. 11-251-9, approve the sale to a qualifying non-profit for one dollar of a County owned 2001 Ford Windstar, equip. number 91101, serial number - 2FMZA504X1BB22476, located at 3325 W. Durango Street, Phoenix, Arizona, via quitclaim deed to Phoenix Opportunities Industrialization Center, a 501c(3) tax exempt, non-profit. Based on the vehicle’s age (2001), depreciation value ($0.00), and salvaged title, it has no value and would create a negative cost to the County. Therefore, Waste Resources & Recycling (formerly Solid Waste Department) has determined that the most cost efficient way to dispose of the vehicle is to pass all interest, rights, and obligations via quitclaim title to the user, Opportunities Industrialization Center, to benefit veterans’ job programs. F-2. BIDS AND AWARD FOR POWERLINE FRS INTERIM DAM SAFETY MEASURE PROJECT Authorize the Flood Control District of Maricopa County (District) to issue an Invitation for Bids for Contract FCD 2011C018, Powerline FRS Interim Dam Safety Measure (IDSM) (Project [#310]) located southeast of the intersection of Baseline Road and Ironwood Drive in Apache Junction, and to award the contract to the lowest responsive, responsible bidder if the bid is not more than 10% over the engineer’s estimate. Powerline FRS is one of a system of three flood retarding structures (Powerline FRS, Vineyard Road FRS and Rittenhouse FRS) that were constructed by the U.S. Soil Conservation Service (now Natural Resources Conservation Service or NRCS). Powerline FRS was constructed in 1967 and 1968. District staff identified a fissure risk zone associated with the structure, and near term action is required to mitigate the associated dam safety and public safety concern. In July 2008, the District submitted this Project to the District's Capital Improvement Program Prioritization Procedure for fiscal year (FY) 2009-2010, and the District’s Flood Control Advisory Board, with staff concurrence, recommended the Project for future implementation. The Project was authorized by Resolution 2008R015 on April 1, 2009 (C-69-09-056-6-00), subsequently amended as 2008R015A on March 17, 2010 (C-69-10-060-6-00). The Board approved Intergovernmental Agreement (IGA) FCD 2010A005 on August 18, 2010 (C-69-11-003-3-00) between the District and NRCS for cost sharing, design, rights-of-way acquisition, construction, construction management, operation and maintenance of the Project. The IGA was signed by NRCS on September 24, 2010. Per the IGA, 100% of the eligible cost of construction of the Project will be paid by NRCS. The District will be the lead agency for construction of the Project. The Agenda Item impacts Supervisorial District 1. (C-69-12-022-5-00)
