ROAD DE-ANNEXATION FROM THE CITY OF AVONDALE TO MARICOPA COUNTY Pursuant to A.R.S. § 9-471.02 and 9-471.03 convene the public hearing to determine if the public interest is served by de-annexing road right-of-way from City of Avondale jurisdiction to Maricopa County in accordance with City of Avondale Ordinance No. 1711-1219, and the analysis of the impact of the requested de-annexation. Right-of-way location: West side of 107th AVE from 150’ N of Roeser RD to Broadway RD. Supervisory District No. 5. A portion of land being situated within the Northeast Quarter of Section 30, Township 1 North, Range 1 East of the Gila and Salt River Meridian, Maricopa County, Arizona, being more particularly described as follows: COMMENCING at a found brass cap in hand hole accepted as the Northeast corner of said Section 30 from which a found brass cap in hand hole accepted as the North Quarter corner thereof bears South 89°12'39” West, 2599.41 feet; Thence South 89°12'39” West, 33.00 feet along the north line of said Northeast Quarter to the POINT OF BEGINNING; Thence leaving said north line, South 01°08'51" East, 2505.58 feet along a line that is parallel with and 33.00 feet west of the east line of said Northeast quarter; Thence South 89°21'06” West, 32.00 feet; Thence North 01°08'51” West, 2505.50 feet along a line that is parallel with and 65.00 feet west of the east line of said Northeast quarter; Thence North 89°12'39" East, 32.00 feet along the north line of said Northeast quarter to the POINT OF BEGINNING. The above described parcel contains a computed area of 80,178 sq. ft. (1.8406 acres) more or less and being subject to any easements, restrictions, rights-of-way of record or otherwise. MCDOT Analysis: The roadway and shoulders are already being maintained by the County. Deannexing the remaining portion of the shoulders will make maintaining this roadway easier and safer for road crews. MCDOT is in support of the deannexation. Financial Status: No added cost to the County anticipated. The Board action will result to add 0.0029 square miles to County ownership and enable the County to assume responsibility for road maintenance. After reviewing the analysis and hearing those that may appear for or against the request, if the Board determines that the public interest is served by this de-annex/annexation action, a vote of approval shall direct the following: 1. File an ordinance setting forth the legal description of the public right-of-way and declaring the return of the right-of-way contingent on the fulfillment of the additional conditions of the statute in the Office of the Clerk of the Board. 2. Pursuant to ARS § 9-471.03, set a public hearing for Wednesday, March 11, 2020 to de-annex road subject right-of-way from City of Avondale jurisdiction to Maricopa County in accordance with City of Avondale Ordinance No. 1711-1219, and the Ordinance approved by the Board of Supervisors on this date. 3. Send notice of the date, time and place of the hearing on the requested action to each owner of real property subject to taxation adjacent to the subject public right-of-way at least twenty (20) days prior to the hearing . 11. NATIONAL CRIMINAL HISTORY IMPROVEMENT PROGRAM (NCHIP) GRANT FROM THE ARIZONA CRIMINAL JUSTICE COMMISSION Approve receipt of grant funds from the Arizona Criminal Justice Commission (ACJC) for the National Criminal History Improvement Program in the amount of $406,581.00. These grant funds are provided to enhance efforts to improve criminal history records and information. This grant agreement, ACJC number NCP 19-21-001, will commence on January 1, 2020 and will terminate on December 31, 2021. In accordance with the agreement, page 6, paragraph 35, these funds will not be used for any indirect or administrative costs that may be incurred by the Maricopa County Attorney’s Office or Maricopa County for the administration of this grant. Thus, the grant allows a 0% rate for indirect costs, or $0 that may be incurred for the administration of this grant. The Maricopa County Attorney’s Office FY 2020 composite indirect cost rate is 15.8%, or $71,377. The recoverable indirect cost of administering this grant is $0 and the non-recoverable indirect cost is $71,377. Non-recoverable indirect costs will be covered by the departmental general fund budget. This grant is competitive and does not require on-going cash contributions after the grant period end date. Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents related to this award. Grant revenues are not "local revenues" for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This award agreement is in the amount of $406,581.00 in Federal dollars under CFDA 16.554 awarded to the Arizona Criminal Justice Commission by the U. S. Department of Justice. This grant requires a 10 percent match, which the County Attorney can provide through the salary and benefits of various personnel, totaling $45,175.00. The total project cost is $451,756.00. These funds are used to support mandated services to reduce the agency’s backlog of arrest disposition records. This grant is a one-time award with no expectation of continued funding. However, the County Attorney’s Office has received funding under this grant program since 2009. This grant will expire at the end of the award period unless prior written approval for an extension has been obtained from the Arizona Criminal Justice Commission. IGA WITH ARIZONA DEPARTMENT OF AGRICULTURE (LIVESTOCK) FOR SWORN TRAINING ACADEMY Approve an Intergovernmental Agreement (IGA) between Maricopa County on behalf of the Sheriff’s Office and Arizona Department of Agriculture (Livestock) regarding the Maricopa County Sheriff’s Office Sworn Basic Training Academy. This Agreement allows Arizona Department of Agriculture (Livestock) law Enforcement recruits to participate in scheduled MCSO Sworn Basic Training Academies at a cost of $500 per registrant January 1, 2020 through June 30, 2020 and $750 per registrant beginning July 1, 2020. The term of this Agreement is January 1, 2020 to June 30, 2021 and it is effective when signed by the parties. This agreement can be terminated at any time with two months written notice. Arizona Department of Agriculture (Livestock) does not have its own training academy and this Agreement will allow MCSO to provide training space, when available, to the Department’s Law Enforcement recruits in MCSO scheduled sworn training academies. Arizona Department of Agriculture (Livestock) is responsible for providing worker’s compensation insurance, salary, benefits, weapons, ammunition and uniforms for its recruit participants. 14. IGA WITH CITY OF PHOENIX FOR MAINTENANCE ON CONSOLE UNITS (POSITIONS) USED BY ADULT PROBATION Approve an IGA between the City of Phoenix and Maricopa County through the Sheriff’s Office in the not-to-exceed amount of $54,000 per year. This is a renewal of an IGA approved in May 2016 (C-50-16-105-3-00) and March 2017 (C-50-16-105-3-01) that expires June 30, 2020. The purpose of this IGA is to provide hardware maintenance, preventative maintenance, and help desk support for nine (9) consoles units (“positions”) located in the Sheriff’s 911 Center that are used by the County Adult Probation Department. This IGA is effective from July 1, 2020 and will continue until June 30, 2025 or until terminated by formal act of the Parties. MCSO’s current use of positions includes an understanding that positions will be commandeered for use as emergency 9-1-1- positions in a declared emergency. In 2016 the County Adult Probation Department dispatch function was located to the Maricopa County Sheriff’s Office Communications Division/911 Center. The “positions” that are assigned to Adult Probation do not meet the emergency criteria for those that are covered by Regional 9-1-1 resulting in a monthly service charge per “position” to the Sheriff’s Office by the City of Phoenix. The cost is $500 per month (12 months) per “position” (9 positions) for an annual total of $54,000 and a five-year contract value of $270,000. This cost represents a reduction from the current IGA’s annual cost of $81,000. As a regional 9-1-1 Center, the Sheriff’s Office is billed annually for service to these “positions, ” that are not covered by the regional funding because they are not assigned to first responders. 17. NEW HOPE AGREEMENT WITH BIG BULLY RESCUE, INC Approve an agreement between Big Bully Rescue, Inc. and Maricopa County, administered by Maricopa County Animal Care and Control, to allow said rescue to transfer animals that have been deemed eligible for the New Hope program. Maricopa County will provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year of transfer for each dog three months of age or older at no cost to the Contractor. The cost for these services is $52 for each animal transferred in FY 2020 and thereafter. GRANT FUNDS FROM ARIZONA STATE DEPARTMENT OF HOMELAND SECURITY FOR RENEWAL OF EMERGENCY PLANS SOFTWARE Authorize Emergency Management to apply for grant funds from Arizona State Department of Homeland Security, (FFY20 SHSGP), in the not-to-exceed amount of $85,000 for the MaricopaRegionPrepares.com subscription renewal. This is a Continuity of Operations Planning (COOP) software package for all jurisdictions within Maricopa County. The grant period for this grant is October 1, 2020 through September 30, 2021. The Maricopa County Department of Finance has calculated the Department of Emergency Management's composite indirect cost rate at 10% or $8500. The Department will not be recovering indirect costs off of this grant. The amount of unrecoverable indirect cost is $8500. Emergency Management will absorb these indirect costs within their general budget. The grant award is non-recurring, the department has to apply every year however, we have received the grant for the past four years. The department does not have an in-kind match requirement for this grant. The grant award is not a mandated function but it is a department strategic goal to have all county departments with a viable Continuity of Operations Plan (COOP). The grant is awarded through the Arizona State Homeland Security Department-State Homeland Security Grant Program (SHSGP), which is a competitive grant program. Maricopa County jurisdictions compete for projects based off the State grant initiatives. Maricopa County has spear headed the grant for the Emergency Operations Plans (EOP)/COOP software project for all county departments and jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring cost of the software maintenance and training funds. Maricopa County does not have to fund any additional costs for the program. The grant is intended to renew the MaricopaRegionPrepares.com subscription. This software tool benefits Maricopa County in developing Emergency Operations Planning (EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG) Planning for local government. The Department was awarded a grant for the software in 2015, we are applying for a grant to cover the cost associated with the maintenance of the system. Funding for this agreement is provided by a grant from the State of Arizona Department of Homeland Security in the amount not to exceed $85,000. The overall grant budget will be adjusted as necessary to accommodate this grant through future reconciliation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. 20. GRANT FUNDS FROM ARIZONA STATE DEPARTMENT OF HOMELAND SECURITY FOR TRAINING AND EXERCISES FOR LOCAL GOVERNMENT Authorize Emergency Management to apply for grant funds from the Arizona State Department of Homeland Security, (FFY19 SHSGP), in the not-to exceed amount of $150,000 for the regional use of training and exercise funds for all the jurisdictions within Maricopa County. The effective period is October 1, 2020 to September 30, 2021. This grant will be MOU'd to the Arizona Department of Emergency and Military Affairs (DEMA) upon receipts of award letter. Indirect costs are not applicable since Maricopa County Department of Emergency Management (MCDEM) will not accept the grant funding. DEMA will retain and manage the grant during the performance period. It is the intent of MCDEM to MOU the grant funds to DEMA to retain and manage the money. The grant is intended to support training and exercises for local government within Maricopa County. DEMA has offered to be the fiduciary manager of the local training funds for the local government within Maricopa County since they have a Training and Exercise Division dedicated to the developing, maintaining, and managing all training classes and exercises for the State of Arizona. REVISIONS TO CHILD AND ADULT CARE FOOD PROGRAM PERMANENT AGREEMENT WITH ARIZONA DEPARTMENT OF EDUCATION CHILD NUTRITION PROGRAMS Approve revisions to the Child and Adult Care Food Program (CACFP) Permanent Agreement (“Agreement”) with Arizona Department of Education (ADE), Child Nutrition Programs, (A.G. Contract No. KR02-1170-ALS) administered by Maricopa County Human Services Department, Early Education Divisions, Head Start Program. The revised Agreement identifies the individuals authorized to sign any documents that relate to the CACFP activities. Also request authorization for the Chairman to sign the Permanent Agreement and request authorization for the Human Services Department Director to sign all documents related to CACFP activities to include ADEConnect Entity Administration Account documents, which designates the individuals authorized to submit reports to ADE. The Maricopa County Board of Supervisors entered into the Permanent Agreement with ADE on September 25, 2013. Due to staff changes in the Head Start program, a revision to the Permanent Agreement must be submitted to ADE. The revised Permanent Agreement will allow for the County to continue to receive CACFP funds for meals and snacks that meet 1/3 to 2/3 of program participants’ daily nutritional needs. AMENDMENT TO THE IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR COMMUNITY ACTION ACTIVITIES Approve revenue Amendment No. 14 to the Intergovernmental Agreement (Agreement) between Arizona Department of Economic Security (DES) and Maricopa County, administered by its Human Services Department. The purpose of Amendment No. 14 will address a reduction in funds from DES as follows: • Revise Section 32.0 (Levels of Service), the Case Management service reimbursement ceiling for the period of July 1, 2019 through June 30, 2020 is revised from $5,388,470 to $5,371,931.63, a decrease of $16,538.37. • Revised Case Management Service Budgets are added to the Agreement. The Agreement ceiling amount shall be changed from $6,289,777.75 to $6,273,239.38 a difference of $16,538.37. The reason for the decrease in funding is due to reconciliation of FY19 budget and FY20 carryforward funding. The purpose of the Amendment is to increase Salt River Project (SRP) funding amount by $35,000 for the Program Year (PY) 2019-20. The Agreement shall be increased from $271,220 to $306,220. The increased funds shall be utilized: $5,833.34 for Program Delivery and $29,166.66 for Direct Services. The Amendment limits program expenditure funds to 5% or $15,311 to be used to address Health & Safety concerns. The period of availability for the increased funds shall be January 1, 2020 through March 30, 2020. The term of the Agreement remains unchanged May 1, 2015 to March 30, 2020. Receipt of the funds from ACAA does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. APPLY AND ACCEPT TITLE IV-E FEDERAL ENTITLEMENT FUNDING FROM THE DEPARTMENT OF HEALTH AND HUMAN SERVICES THRU THE ARIZONA DEPARTMENT OF CHILD SAFETY Approve the application and acceptance of Title IV-E federal entitlement funds from the Department of Health and Human Services thru the Arizona Department of Child Safety in the amount not to exceed $5,000,000 per year for the purpose of supplementing the costs of dependency in Public Defense Services. Authorize the Chairman of the Board of Supervisors to sign all documents related to this award. This grant is an open-ended entitlement. Per the IGA, 75% of the funding must be invested in dependency to supplement Public Defense Services. The other 25% may be used to offset costs to the County. The 25% (approximately $1,250,000) will be used to offset General Fund expenditures. Also, approve the waiver of indirect costs. Public Defense Services will receive a total of up to $5,000,000 annually; at the indirect rate of 11.69%, the indirect costs are estimated at $584,500, all of which will be waived. These indirect costs are not being sought so that the grant funds can be used for contract attorney costs previously funded by the General Fund. The entitlement is re-occurring and is a new award to the department. There are no in-kind match requirements and requires no ongoing cash contributions. This grant award supplements a mandated function. Public Defense Services is the only eligible entity to receive this award. The department will come back to the Board for appropriation adjustments once the actual amount is known. A change in the Child Welfare Policy Manual now allows states to claim federal matching funds through Title IV-E of the Social Security Act to reimburse half the cost of attorneys for children who are eligible for Title IV-E foster care benefits and half the cost of attorneys for their parents. This reimbursement can then be used to supplement the dependency system as outlined in the IGA with the Arizona Department of Child Services. The policy change allows the state to claim reimbursement retroactively for actual expenditures in the period January 1, 2019 to December 31, 2019 and every quarter thereafter. This grant provides for the collection of cancer data as well. The opportunity was not competitive. The Department of Public Health’s indirect rate for FY20 is 19.2%. Full indirect costs are estimated at $43,369, all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates.
