8. PUBLIC HEARING FOR RULE 280 (FEES) The Maricopa County Air Quality Department (department) is proposing to amend Rule 280 (Fees) to change the fees the department charges to owners and operators of sources of air pollution. The fees being amended include fees for billable permit actions, annual administrative and emission based fees for Title V sources, annual administrative fees for non-Title V sources, application and annual administrative fees for general permits, subcontractor registration fees and training fees. The goal of this rulemaking is to provide sufficient revenue to cover the costs of the air quality program, maintaining compliance with federal and state law. The current fee structure does not generate sufficient revenue to cover the operating expenses for department permit and plan approval activities. The department’s fee fund revenue in fiscal year 2011 is projected to be $8.8 million while the corresponding expenditures are projected to be $11.1 million. For fiscal year 2011, the department will be relying on its existing air quality fund balance and general fund revenues (a temporary allocation) to subsidize the program. Without corrections to the fee structure, the department will not be able to operate on a structurally balanced budget as is required by County policy and will deplete all reserves. The proposed fee changes would become effective on July 1, 2011 and are expected to result in annual fee revenue for fiscal year 2012 of approximately $10.9 million corresponding to the department’s annual expenditures. The fee revenue with proposed fees includes approximately $1.5 million from the Title V program, $3.5 million from the dust control compliance program, $731,000 from the asbestos/NESHAP compliance program, and $5.1 million from the balance of the non-Title V programs. The remaining $5.8 million of the department’s $16.7 million in total expenditures are considered to be non-recoverable by fees and are expected to be funded by other sources such as grants or county general funds. The department anticipates that this proposed rulemaking would directly impact approximately 4,000 sources that are permitted by the department, 3,600 individuals and entities involved in performing ancillary services on a dust control permitted site (subcontractor registration fee), and 1,600 individuals required to attend a basic or comprehensive dust control training class (dust control training class fees). Entities impacted include Title V facilities, non-Title V facilities and general permit sources; individuals and entities involved in performing ancillary services on a dust control permitted site (subcontractor registration fee); individuals and entities required to complete dust control training; and trainers required to be certified by Maricopa County to conduct dust control training classes. This item was continued from the June 22, 2011 Meeting . (C-85-11-020-7-00)

The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $14,198.00. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. 12. MODIFICATION TO COOPERATIVE LAW ENFORCEMENT AGREEMENT/EXHIBIT A - FY11 OPERATING AND FINANCIAL PLAN WITH U.S. DEPARTMENT OF AGRICULTURE, FOREST SERVICE, TONTO NATIONAL FOREST Approve Modification #1 to the Cooperative Law Enforcement Agreement/Exhibit A-FY11 Operating and Financial Plan between the U.S. Department of Agriculture, Forest Service, Tonto National Forest and Maricopa County Sheriff’s Office, increasing funding for the FY2011 Financial and Operating Plan in the amount of $1,000. This will increase the Operating and Financial Plan portion of funding from $118,000 to $119,000. This modification does not impact the funding that would be used for deputies working enforcement situations relating to fire emergencies. Exhibit A-FY2011 Operating and Financial and Operating Plan was approved by the Board of Supervisors on September 1, 2011, (C-50-11-008-G-00) with term of October 1, 2010 through September 30, 2011. This modification also addresses three minor non-financial changes: 1) states the reimbursement for Patrol Activities; 2) adds the word, "Supplies" to the Equipment section; and 3) limits the amount for quarterly billings. Indirect cost for the Sheriff’s Office for FY2011 is 14%. Unrecoverable indirect costs associated with this increase are estimated to be $140. (C-50-11-008-G-01)

13. IGA AND ACCEPT FUNDS FROM THE ARIZONA GAME AND FISH COMMISSION Approve the Intergovernmental Agreement (IGA) and acceptance of $281,000 in continued funding from the Arizona Game and Fish Commission. The term of this Agreement is the date signed by all parties through September 30, 2012. This IGA and acceptance of funds will reimburse salary, overtime, employee related expenses (ERE), equipment purchase, maintenance/repair and or replacement of watercraft patrol boat(s) to continue effectively patrolling the waterways in Maricopa County. Also approve an increase to the Sheriff’s Office grant fund (251) revenue and expenditure appropriations for FY 2011/2012 by $231,000. These revenues are not “local revenues” for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The Sheriff’s indirect cost rate for FY12 is 14.7% ($41,307) and the unrecoverable indirect costs are estimated to be $36,897.00. There will be capital equipment purchases that are excluded from the indirect cost calculation ($4,410). (C-50-11-104-G-00)

This reduction results in the elimination of six deputy sheriff positions originally established for the Town Queen Creek Contract. 25. ACCEPT FUNDING AND MEMORANDUM OF UNDERSTANDING FOR 2011 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT 1. Approve the acceptance of grant funding from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance for the Edward Byrne Memorial Justice Assistance Grant (JAG) Program FY 2011 Local Solicitation in the total amount of $1,841,662. 2. Approve a Memorandum of Understanding (MOU) between Maricopa County; and the Cities of Avondale, Chandler, Glendale, Goodyear, Mesa, Peoria, Phoenix, Scottsdale, Surprise and Tempe; and the Town of Gilbert. This MOU is required pursuant to the grant application requirements. This MOU also includes a negotiated reallocation to Maricopa County of $335,788 and $1,505,874 in funds to be reallocated to the Cities of Avondale - $34,471; Chandler - $72,227; Glendale - $122,631; Goodyear - $10,047; Mesa - $181,003; Peoria - $27,193; Phoenix - $903,974; Scottsdale - $39,318; Surprise - $10,220; and Tempe - $84,698; and the Town of Gilbert - $20,092. Grant awards are to be expended within a four (4) year period of time, starting October 1, 2010 and ending September 30, 2014. The JAG grant does allow up to 10 percent of the award for costs associated with administering JAG funds which includes indirect costs, and Maricopa County has been designated as the fiscal agent for this consortium of municipalities. 3. Approve the waiver of administration costs above 5% of funding allocated to County Manager/Justice System Planning and Information. Administrative costs over 5% are being waived so that a majority of the grant funding can be sub-granted to partner agencies, per the Memorandum of Understanding. Recovery of Indirect costs for remaining county departments (Adult Probation, County Attorney, Juvenile Probation, and Sheriff’s Office) and subrecipients are not allowed. 4. County Manager/Justice System Planning and Information FY11 indirect rate is 12.4%. Department will receive a total of $92,084 (5%) for administration, which includes $4,385 indirect cost recovery and $92,084 (5%) waived for administration. The Local Law Enforcement Block Grants (LLEBG) preceded JAG. LLEBG procedures included a provision to protect counties from major funding disparities that resulted from the block grant formula. The formula allocated funds to communities by rate of violent crime arrests (predominantly by municipal police agencies), failing to reflect the substantial responsibilities of counties for adjudicating these high level crimes (including incarceration, prosecution, defense, and court processing). If declared disparate, communities were required to concur in a reallocation of the award amounts or no distribution of LLEBG funds occurred. As a result of the request for consideration by Maricopa County, in FY 2004 the Arizona Attorney General certified that the cities of Phoenix, Mesa, and Glendale were scheduled to receive an award twice as much as the projected County award. As the County allocates more than 50% of the local incarceration or prosecution expenditures for Part I, violent crimes, the Attorney General declared that the local funding of LLEBG dollars was disparate. Because of this decision, the 2011 JAG grant again requires a collaboration of all named cities and towns with Maricopa County. The following is the result of the negotiation process whereby Maricopa County will be allocated $335,788 of the total award. (C-20-11-133-3-00)

61. WAIVER TO POLICY B7002 - SALARY ADVANCEMENTS Approve an exception to the Maricopa County Salary Advancement Policy Section VI.D. to allow a salary advancement to be effective retroactively to January 3, 2011 for Robert Fedorka, an Engineer in Planning & Development, as a result of an equity review, changing his hourly rate from $31.25 to $33.07. Upon hire on January 3, 2011, Robert Fedorka was offered a rate of $31.25 that did not take into consideration some experience that should have been credited which would have resulted in a higher offer of $33.07. Because of this, there is an inequity in the department and the department has been limited in making offers to more recent hires. Correcting this rate will allow the department to make appropriate offers for future hires in this Market Range Title and will also pay Mr. Fedorka the rate that is appropriate given his experience. Upon Board approval, this item will become effective August 17, 2011.
