9. AMENDMENT TO THE REPLACEMENT OF FLEET VEHICLES AND EXEMPTION FROM MARKINGS Approve the acquisition of five vehicles, two vehicles as permanent additions to the fleet, and three replacements for permanent vehicles with vehicles of similar style using funds from the County Attorney (D190) Racketeering Influenced Corrupt Organization (RICO) fund (213). The cost of the vehicles to be paid from RICO funds shall not exceed $250,000 for the five vehicle s. The net impact on the County Attorney fleet is zero. The purchase of the vehicles is deemed critical due to excessive mileage and/or the age of the vehicles making it cost-prohibitive to acquire replacement parts with which to maintain the vehicles. Due to longer than expected wait times to acquire the replacement vehicles and unanticipated vehicle make, model, and probable pricing changes, amend the agenda language to allow greater flexibility in vehicle selection and purchase. The total budget amount a pproved remains the same at $250,000 for five vehicles. As these vehicles will be permanent additions to the fleet, they will be disposed of according to forfeiture regulations, and the General Fund will not be used to replace these vehicles. 10. SUPPLEMENTS TO THE AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA PROGRAM INITIATIVE XXXI Approve Supplements #5 for ($54,540.63) and #6 for ($8,617.16) to the Agreement with the Office of National Drug Control Policy (ONDCP) Award Number G21SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program resulting in a net overall change of ($63,157.79) for an updated amount of $639,038.14. The term of this funding was extended from December 31, 2022 to February 28, 2023. This funding supports the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over 12 years. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. The Sheriff’s Office indirect cost rate for FY23 is 12.30%. SUBGRANTEE REIMBURSEMENT AGREEMENT WITH CITY OF SCOTTSDALE FOR FUEL REDUCTION Approve a subgrantee reimbursement Agreement between City of Scottsdale and Maricopa County through the Department of Emergency Management, in the not-to-exceed amount of $20,000.00. This Agreement is funded by a grant from Department of Forestry through Title III Forestry Fee. 18. FY 2023 BUDGET ADJUSTMENT FOR FACILITIES MANAGEMENT Pursuant to A.R.S. §42-17106(B), authorize the following appropriation adjustments to the FY 2023 budget: 1. Increase the expenditure authority in the Facilities Management Department (D700) Genera l Fund (100) Operating (OPER) budget by an amount not to exceed $2,000,000. 2. 20. RESOLUTION TO APPLY FOR TRIBAL GAMING FUNDS FROM GILA RIVER INDIAN COMMUNITY Pursuant to the Board’s Resolution regarding Processing of Tribal Gaming Fund Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the administrative pass-through for tribal gaming applications (“Applications”) received pursuant to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek funds for services that benefit the g eneral public , including public safety, mitigation of the impacts of gaming, or promotion of commerce and economic development. Pursuant to the Board’s Gaming Resolution, Maricopa County defers substantive review of the Applications to the Tribal authoriti es and places these matters on the consent agenda. Pursuant to the Compact, Sections 12(b) and (d), the Tribe shall perform the substantive review of applications and ensure 12% of its contributions under the Compact go to services that benefit the general public . AGREEMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR WEATHERIZATION ASSISTANCE PROGRAM Approve revenue Agreement between Arizona Department of Housing (ADOH) and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the County to administer the Weatherization Assistance Program (WAP). ADOH shall provide the County to administer the WAP. ADOH will provide the County with funding for the Weatherization Assistance Program: • $71,984 Southwest Gas Corporation, Weatherization Assistance Program (“SWG WAP”) • $961,000 Arizona Public Service, Weatherization Assistance Program (“APS WAP”) The Agreement total amount i s $1,032,984. The funding availability period is retroactive to January 1, 2023, through December 31, 2023. The County shall provide installation/repair of energy efficiency measures to dwellings occupied by low-income households who are APS and/or SWG cu stomers in Maricopa County, Arizona outside the Cities of Phoenix and Mesa The priority population for the Weatherization Assistance Program is persons who are particularly vulnerable such as the elderly, persons with disabilities, families with children, high residential energy users, and households with high-energy burdens. The funds will be utilized: a. APS: eighty-nine (89) completed units passing final inspection and ADOH WAP monitoring; and b. SWG: twenty-six (26) completed units passing final inspe ction and ADOH WAP monitoring. Acceptance of this Agreement will not impact the County General Fund. 24. ADMINISTRATIVE CORRECTION TO SUBMITTAL OF CHILD CARE PROVIDER APPLICATION TO ARIZONA DEPARTMENT OF ECONOMIC SECURITY AND DELEGATION OF AUTHORITY Request approval of an Administrative Correction. On January 25, 2023 the Board of Supervisors approved the submittal of childcare provider applications to A rizona Department of Economic Security (DES) and Delegation of Authority. A Head Start Program site location was inadvertently not included in the list of site approved. With this correction, the Department is requesting permission to add Valor On 8th, 10 01 E. 8th St, Tempe, AZ 85281. By approving this item, the Human Services Department Head Start Program will submit eleven (11) applications to DES to become a registered DES Child Care Provider at eleven (11) Head Start sites. 25. APPLICATION TO THE U.S. DEPARTMENT OF HEALTH AND HUMAN SERVICES FOR A NON-FEDERAL SHARE WAIVER FOR THE HEAD START/EARLY HEAD START GRANT Approve the submittal of an application to the U.S. Department of Health and Human Services (DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS), Grant No. 09CH012079 for a Non-Federal Share (NFS) Waiver. The Maricopa County Head Start program will request a reduction to the grant’s required Non-Federal Share (NFS). Also request authorizati on for the Chairman to sign the Application for Federal Assistance SF-424 to be submitted to OHS. The current Grant required NFS is $4,941,192. The Wavier application proposes to reduce the NSF by $3,672,067. If the reduction is approved, the new NFS sh all be $1,269,125. The reduced NFS is for the grant period of July 1, 2022 to June 30, 2023. If the application for this waiver is approved, the grant award will not be impacted and will remain at the current amount of $20,285,449 for the period of July 1, 2022 to June 30, 2023. AMENDMENT TO ARIZONA PUBLIC SERVICE AGREEMENT FOR THE APS SPECIAL CRISIS BILL ASSISTANCE PROGRAM Approve and execute financial Amendment No. 1 between Arizona Public Service (APS) and Maricopa County, administered by its Human Services Department (MCHSD). The purpose of the Agreement is for APS to provide the County with funding for the delivery of cr isis utility bill assistance to eligible low-income households residing in the APS’s service territory. The purpose of the Amendment No. 1 is to address the following: A. Extend the agreement term retroactively from January 1, 2023, to December 31, 2023. The funding amount for the Amendment term is $250,000 for the provision of services. B. Revise and replace Section C.2. Scope of Services with the same except for the following: a. A Household or individual who meets all eligibility requirements set for above may receive up to $1,000. C. Add new section under General Terms and Conditions, 6.S, UYGHUR FORCED LABOR PREVENTION ACT (UFLPA). APS provides funding on an annual basis for the crisis bill assistance program and reserves the right to extend or allow expiration of this Agreement into the future. APS selected to contract, through a non-competitive process, with the County because the Human Services Department Community Services Division provides utility assistance to low-income households. The Com munity Services Division is best situated to provide APS’s Special Crisis Bill Assistance Program services to eligible individuals and households in Maricopa County. The Agreement is for the City to provide owner-occupied housing rehabilitation, single-family housing construction program with homebuyer assistance, and Tenant Based Rental Assistance. The County will provide the City with funds to conduct U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME) funded activities. I. The Parties agree to enter into this Amendment No. 5 to the Agreement as follows: A. Change Lead Agency Point of Contact. B. Extend the Agreement term from September 30, 2023, through September 30, 2025 C. Revise Section 3 (Work Statements) to Address the Following: 1. Add an additional Work Statement hereinafter referred as “Work Statement A 2020”. This Work Statement is for the City to acquire land and construct three s ingle-family homes in the City and provide down payment assistance to eligible homebuyers. If the City has completed the required Environmental Review, payments for expenditures may be retroactive to July 1, 2022. All work performed, or costs incurred, or expenses shall be reimbursable through September 30, 2025. The County shall provide the City with $266,197 for the Work Statement activities. The funding for this Work Statement is provided by PY2020 HOME Investment Partnerships Program through HUD funds, under ALN 14.239. 2. Add an additional Work Statement hereinafter referred to as “Work Statement B 2020 and 2021 TBRA”. Work Statement B is for the City to provide Tenant Based Rental Assistance (TBRA) to 55 eligible households in the City of Glendale. If the City has completed the required Environmental Review, expenditures may be retroactive to July 1, 2022. All work performed, or costs incurred expenses shall be reimbursable through September 30, 2025. The County shall provide the City with $1,124,946.0 0 (PY 2020: $438,450 and PY2021: $686,496) for these Work Statement activities. The funding for this Work Statement is provided by HOME Investment Partnerships Program through the HUD funds, under ALN 14.239. 3. Add an additional Work Statement hereinafte r referred to as “Work Statement C 2021 HOME-ARP”. The Work Statement is for the City to provide Section VI.D.3.a (McKinney-Vento Supportive Services) and Section VI.D.3.b (Homelessness Prevention Services) but excluding Housing Counseling Services [delete d] under Section VI.D.3.c, to an estimated 1,000 eligible residents. If the City has completed the required Environmental Review, payments for expenditures may be retroactive to July 1, 2022. All services provided, or costs incurred, or expenses shall be r eimbursable through September 30, 2025. The County shall provide the City with $2,876,844 for these Work Statement activities. The funding for this Work Statement is provided by HOME-ARP HUD funds, under ALN 14.239. 4. Add an additional Work Statement her einafter referred to as “Work Statement D 2022 Acquisition and/or New Construction of Multi-Family Rental Housing”. The Work Statement is for the City to acquire land and construct a multi-family rental Housing unit. If the City has completed the required Environmental Review, payment for expenditures may be retroactive to July 1, 2022. All work performed, or costs incurred, or expenses shall be reimbursable through September 30, 2025. The County shall provide the City with $764,833 for these Work Statement activities. The funding for this Work Statement is provided by PY 2022 HOME Investment Partnerships Program through the HUD funds, under ALN 14.239. 5. Funding for Amendment No. 5 is $5,032,820. The original estimated not to exceed amount of the contract was $2,600,000. It is being requested that an additional $5,290,000 be added to the contract, bringing the total not to exceed amount to $7,890,000. The contract term began December 20, 2021, thro ugh June 30, 2024. ACCEPTANCE AND USE OF GIFT CARDS FOR THE TUBERCULOSIS CONTROL INCENTIVE PROGRAM Approve the acceptance and use of Bashas’ grocery vouchers and Chevron gas cards provided by Arizona Department of Health Services (ADHS), to Maricopa County by and through its Department of Public Health (MCDPH), Tuberculosis Control Program. For FY23, t he MCDPH TB Clinic received a donation of 100 grocery vouchers at $10 each for a total value of $1,000 and 203 gas cards at $10 each for a total value of $2,030, for a combined value of $3,030. Gift card and voucher donations have been received by the TB program for a number of years. We expect they will reoccur. Cash and/or in-kind match is not applicable nor are ongoing cash contributions required should they cease to be provided to the program. TB Services are a mandated function and donations such as these incentivize the treatment program. Awareness and treatment of TB patients is a benefit to our citizens. To our knowledge, the donations to the TB program are not given in a competitive manner. Program costs associated with the donations are absorbed by the TB programs grant budget. Administration costs are absorbed by the department’s operating budget. MCDPH’s indirect rate for FY23 is 17.24%. This in-kind donation does not allow for indirect, therefore, indirect expense estimated at $445.56 are not recoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This donation does not alter the budget constraining expend itures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this donation through a future reconciliation. AMENDMENT TO REQUEST FOR PROPOSAL CONTRACT WITH DELTA DENTAL PLAN OF ARIZONA FOR DENTAL INSURANCE SERVICES Approve an amendment to Request for Proposal (RFP) Contract 190140 between the Delta Dental Plan of Arizona (DDPA) and Maricopa County through its Department of Public Health (MCDPH). This amendment shall extend the Expiration Date to February 28, 2024. The Annual Maximum Benefits from March 1, 2023, through February 28, 2024, shall remain at $2,500.00 per person per benefit year. These services wi ll be funded with grant funds received through the Ryan White HIV/AIDS Treatment Extension Act of 2009. The maximum amount of reimbursement of this contract is not to exceed $2,000,000 over the next year. 42. APPLY FOR GRANT FUNDING OPPORTUNITY FROM VITALYST HEALTH FOUNDATION Approve MCDPH to apply for an anticipated funding opportunity from the Vitalyst Health Foundation Medical Assistance Grant. The term date of this g rant will be July 1, 2023-June 30, 2026. The anticipated funding has yet to be determined. The estimated award will be issued June 2, 2023 with the final amount and terms. Grant indirect costs are fully recoverable in the amount o f $120,052.54. AQ-2022-002-RULE 245 (CONTINUOUS SOURCE EMISSION MONITORING) Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for April 26, 2023, at 9:30 a.m. to solicit comments on the proposed revision of Maricopa County Air Pollution Control Regulations, Rule 245 (Continuous Source Emission Monitoring) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed amendments to the rule and to approve submission of the amended rule as a revision to the Arizona SIP. The purpose of Rule 245 is to set forth continuous source emission monitoring requirements for fossil fuel-fire d steam generators, nitric acid plants, sulfuric acid plants, and fluid bed catalytic cracking units. Rule 245 was adopted to address Arizona SIP requirements in 40 CFR 51.214. Per 40 CFR 51.214, each SIP must contain legally enforceable procedures to requ ire stationary sources subject to emission standards as part of an applicable plan to install, calibrate, maintain, and operate equipment for continuously monitoring and recording emissions. Per Appendix P of 40 CFR 51, the requirements in 40 CFR 51.214 ap ply to owners and operators of fossil fuel-fired steam generators, nitric acid plants, sulfuric acid plants, and fluid bed catalytic cracking units. The purpose of this rulemaking is to revise Rule 245 since it has not been approved into the Arizona SIP b ecause of rule approvability issues identified by the U.S. Environmental Protection Agency (EPA), such as control officer discretion. Consequently, the precursor rule to Rule 245, Rule 41 (Monitoring) which was adopted in 1979, remains in the SIP. The Mari copa County Air Quality Department is proposing to revise Rule 245 to address rule approvability issues identified by EPA and to replace Rule 41 with the revised rule. Replacing Rule 41 with Rule 245 will update the SIP. (C-85-23-033-X-00)

AQ-2021-004-RULE 205 (EMISSION OFFSETS GENERATED BY VOLUNTARY MOBILE SOURCE EMISSION REDUCTION CREDITS) Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for April 26, 2023, at 9:30 a.m. to solicit comments on the propos ed creation of Maricopa County Air Pollution Control Regulations, Rule 205 (Emission Offsets Generated by Voluntary Mobile Source Emission Reduction Credits). Following the public hearing, the Board is requested to adopt the proposed rule and to approve su bmission of the rule as a revision to the Arizona SIP. The purpose of this rulemaking is to create a new economic development rule to meet the federal New Source Review (NSR) offset requirements in the Clean Air Act for mobile source emission reduction cr edits (MERCs). Currently, insufficient emission reduction credits exist in the Arizona Emissions Bank to permit large new or existing modified projects. This rule will, through voluntary fleet vehicle replacement or retrofit, allow for the generation, cert ification, and use of MERCs as federal NSR emission offsets. In providing a mechanism for the voluntary generation of MERCs, Maricopa County will continue to move towards attainment of the national ambient air quality standards while still allowing for ind ustrial growth. AQ-2022-005-RULE 311 (PARTICULATE MATTER FROM PROCESS INDUSTRIES) Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for April 26, 2023, at 9:30 a.m. to solicit comments on the proposed rescission of Maricopa County Air Pollution Control Regulations, Rule 311 (Particulate Matter from Process Industries) and the associated proposed rescission from the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed rescission of the rule and to approve submission of the rule rescission as a revision to the Arizona SIP. The purpose of Rule 311 is to limit the discharge of particulate matter into the atmosphere by establishing emiss ion rates based on process weight. It was originally adopted on July 13, 1988, and the most current version was adopted in 2003. The Maricopa County Air Quality Department is proposing to rescind Rule 311 because it is an obsolete rule. AQ-2022-007-APPENDIX B (STANDARD PERMIT APPLICATION FORM AND FILING INSTRUCT IONS) Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for April 26, 2023, at 9:30 a.m. to solicit comments on the proposed revision of Maricopa County Air Pollution Control Regulations, Appendix B (Standard Permit Application Form and Filing Instructions). Following the public hearing, the Board is requested to adopt the proposed amendments to the appendix. Appendix B is part of Maricopa County Air Quality Department’s (MCAQD’s) Title V permit program. It pr ovides prospective Title V permit applicants with the filing instructions and standard application form. MCAQD is proposing to revise Appendix B by removing the filing instructions and standard permit application form from the appendix. Since the adoption of Appendix B, improvements have been made to the Title V permit application process. The process has evolved by implementing an online filing platform, providing easily accessible permitting resources, and ensuring all application forms are fillable and c ompatible with the online platform. The current version of Appendix B is outdated and obsolete, with prospective Title V permit applicants referring to the MCAQD website to obtain all current versions of application forms and instructions. While changes ha ve been made to the Title V permit application process, the information required in the application remains the same to abide by requirements set forth in 40 CFR 70.5(c). The revision will include the addition of a statement providing the website link to t he MCAQD webpage which includes all current Title V permit application forms and instructions. REASONABLY AVAILABLE CONTROL TECHNOLOGY STATE IMPLEMENTATION PLAN FOR THE 2015 8-HOUR OZONE NATIONAL AMBIENT AIR QUALITY STANDARD Set a public hearing for April 26, 2023, at 9:30 a.m. to solicit comments on the Reasonably Available Control Technology State Implementation Plan (RACT SIP) for the 2015 8-Hour Ozone National Ambient Air Quality Standard and submittal of the RACT SIP to the U.S. Environmental Protection Agency (EPA) for approval into the Arizona State Implementation Plan . Following the public hearing, the Board is requested to approve submittal of the RACT SIP to the EPA. On November 7, 2022, portions of Maricopa County were reclassified to a moderate nonattainment area with respect to the 2015 8-hour ozone national ambi ent air quality standard. Sections 182(b)(2) and (f) of the Clean Air Act require jurisdictions that are classified as “moderate” or higher nonattainment for ozone to implement reasonably available control technology (RACT) for all sources subject to a Con trol Techniques Guideline (CTG) as well as for all non-CTG major sources of volatile organic compounds (VOCs) or nitrogen oxides (NOx). Non-CTG major sources of VOCs or NOx are those sources that emit, or have the potential to emit, 100 tons per year of VO Cs or NOx. In response to the reclassification, the Maricopa County Air Quality Department (MCAQD) evaluated all local controls (rules and permit conditions) associated with CTG source categories and non-CTG major sources of VOCs or NOx to determine if the controls implemented RACT. The results of the evaluation are detailed in the RACT SIP which MCAQD will submit to the EPA upon approval from the Board. (C-85-23-034-X-00)
