Development of the site shall be in substantial conformance with the Narrative Report entitled “83rd Avenue and Broadway Road”, consisting of 14 pages, dated and stamped received on September 10, 2021, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. A traffic impact study must be submitted with the preliminary plat or plan of development application. 3. Dedication of right-of-way along the following roadway alignments will be required prior to any development on the site: a. Broadway Road: 65 feet (ultimate half-width) b. 83rd Avenue: 65 feet (ultimate half-width) and/or 130 feet (ultimate full width) Note that the above widths are considered minimum widths. Additional dedication may be required pending improvements that may be required by the MCDOT approved Traffic Impact Study. 4. The preliminary plat application must indicate the realignment of 83rd Avenue to its section line alignment to remove the offset at Broadway Road. Any associated right-of-way abandonment must be performed in accordance with MCDOT requirements. 5. The applicant must notify ADOT about development through the Red Letter Process due to proximity of the SR30 alignment and potential interchange, RedLetter@azdot.gov. 6. The applicant is advised that coordination between County Real Estate, the Bureau of Reclamation and SRP will be required related to the irrigation facilities crossing 83rd Avenue as part of any improvements to 83rd Avenue. 7. A Warrant Study will need to be provided in the TIA for Broadway Road and 83rd Avenue. 8. If the internal roadways are planned to be dedicated to the county, any straightaways longer than 1000ft may need speed humps to mitigate potential speeding concerns within the development. 9. Offsite improvements and any additional right-of-way will be determined by MCDOT Traffic Design and MCDOT Permits based on submittal of a TIA/TIS. 10. Applicant to contact the City of Phoenix to notify them of work adjacent to their jurisdiction. 11. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 12. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the MCDOT Roadway Design Manual. d. The following R-5 RUPD standards shall apply: For Neo-Traditional (Detached SFR or Attached Townhomes): 1. Front Yard: 0’ 2. Side Yard: 0’ 3. Street Side Yard: 0’ 4. Rear Yard: 0’ 5. Lot Width: 30’ 6. Lot Area: 2,300 sq. ft. 7. Average Lot Area Per Dwelling Unit: 2,300 sq. ft. 8. Lot Coverage: 65% For Single-Family Traditional (Detached SFR or Attached Townhomes): 1. Height: 40’ / 2 stories 2. Front Yard: 18' (with a front loaded garage)/10' for side loaded garage or livable area of dwelling unit 3. Street-Side Yard: 5’ 4. Rear Yard: 12’ 5. Lot Area: 3,500 sq. ft. 6. Lot Width: 30’ e. Three-story residential homes shall be prohibited. Revised exhibits to be submitted within 30 days of Board approval. f. Prior to approval of the initial final plat or precise plan of development approval, the applicant shall provide the Maricopa County Planning and Development Department with an executed pre-annexation service agreement with the City Phoenix that identifies the detail for when the proposed project will be annexed and the provision of water and sewer service. In lieu of pre-annexation service agreement the developer must provide a ‘will serve’ letter from the certificated water and sewer provider(s). g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. i . The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. j. Development shall include a 10-foot non-vehicular multi use trail within an open space tract along the north perimeter of the R-5 RUPD and C-2 zoned properties abutting Broadway Road. However, since the Commission hearing the applicant provided a revised narrative report and zoning exhibit to address the Commission’s recommendation in condition ‘e’ for updated documents addressing the prohibition against 3-story buildings. Staff concurs and offers the following revisions to conditions ‘a’, ‘b’ and ‘e’ from the Commission recommendation:: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “83rd & Broadway”, consisting of one full-size sheet, dated and stamped received on September 10, 2021 October 26, 2021, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “83rd Avenue and Broadway Road”, consisting of 14 pages, dated and stamped received on September 10, 2021 October 26, 2021, except as modified by the following conditions. e. Three story residential homes shall be prohibited. Revised exhibits to be submitted within 30 days of Board approval. 13. ACCEPT FUNDING FROM US DEPARTMENT OF JUSTICE, FEDERAL BUREAU OF INVESTIGATION FOR THE JOINT TERRORISM TASK FORCE - FFY22 Approve the Notice of Limits for FFY22 State and Local Overtime Reimbursements and acceptance of up to $19,372.00 in reimbursement funding from the US Department of Justice, Federal Bureau of Investigation for officers assigned to FBI managed task forces. The FBI Joint Terrorism Task Force agreement commenced February 27, 2007 and will continue for an indefinite period until terminated by one or both parties. Acceptance of this agreement was most recently approved by the Board of Supervisors on December 10, 2014 under C-19-15-017-G-00. The FFY22 reimbursement funding began retroactively October 1, 2021 and will terminate September 30, 2022. In accordance with paragraph 3 of the agreement, the agreement allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the administration of this agreement. The County Attorney’s indirect cost rate for FY22 has been calculated as 20.3%, or $3,933.00. The non-recoverable indirect cost of $3,933.00 will be covered by the department general fund. This agreement is recurring, non-competitive and does not require a match. The agreement does not require on-going cash contributions after the period end date. This funding indirectly supports the overall mandated function of prosecution of criminal cases. Approval of this agreement allows for reimbursement of overtime paid to the detective assigned to the FBI Joint Terrorism Task Force. The purpose of the agreement is to ensure that a capability exists in Maricopa County to deter, defeat, and respond vigorously to terrorism through the joint investigation of suspected terrorist threats and sharing of information and intelligence. 15. MCAO FLEET CHANGES Approve a reduction in the County Attorney’s Office fleet and direct Equipment Services to dispose of vehicle #76601 a 2006 GMC Envoy. Approve the permanent addition of five previously approved one-time additions to the County Attorney’s Office Fleet (C-19-11-035-V-00). On January 12, 2011, the Board of Supervisors approved the one-time addition purchases of multiple vehicles used for law enforcement investigative purposes. Approve the acquisition of three of the five above mentioned vehicles that are ready for replacement using funds from the County Attorney (D190) RICO fund (213). Approve the acquisition of one vehicle from agenda item C-19-09-037-V-00 that is ready for replacement using funds from the County Attorney (D190) RICO fund (213). The costs of these four replacement vehicles will not exceed $150,000. Approval of this agenda will not have any General Fund impact. Pursuant to A.R.S. 38-538-03 and §28-2511(A), approve the issuance of non-governmental license plates and exemptions from county markings for four undercover vehicles. These vehicles are replacing four vehicles that are used for law enforcement investigative purposes. 19. AMENDMENT TO AGREEMENT WITH TOWN OF QUEEN CREEK Approve amendment #2 to the Agreement for Law Enforcement Services with the Town of Queen Creek concerning termination. The MCSO will terminate law enforcement services with the Town of Queen Creek at the end of the last shift on January 10, 2022. Also approve the sale and transfer of 27 vehicles, including 2 ATVs, itemized in the Amendment, for $1 each; the transfer of devices and equipment; and credits to the town for devices and equipment that will be retained by the Sheriff’s Office. US IMMIGRATION AND CUSTOMS ENFORCEMENT FUNDING FOR OVERTIME IN RELATION TO JOINT OPERATION EXPENSES Approve for FY22, acceptance of up to $30,000 in reimbursement funding from US Immigration and Customs Enforcement Treasury Forfeiture Fund for officers assigned to the Joint Operation. The US Immigration and Customs Enforcement agreement commenced February 29, 2008 and will continue for an indefinite period until terminated by one or both parties. Acceptance of this agreement was approved by the Board of Supervisors on February 20, 2008 under C-50-08-546-2-00. The FY22 reimbursement funding began retroactively October 1, 2021 and will terminate September 30, 2022. The Sheriff’s Office indirect cost rate for FY22 is 14.74%. Unrecoverable indirect costs have been calculated as up to $4,422. The unrecoverable indirect cost of up to $4,422 will be covered by the department General Fund. This agreement is recurring, non-competitive and does not require a match. The agreement does not require on-going cash contributions after the period end date. This is not a mandated function although it supports the MCSO public safety mandate to identify and target for prosecution criminal activity. POSITION REASSIGNMENT FROM QUEEN CREEK CONTRACT Authorize the permanent addition of five positions that were originally established for the Sheriff’s Office (MCSO) Law Enforcement Contract Services operations in Queen Creek which is terminating effective January 11, 2022. These five positions were budgeted through December 31, 2021 and need to be retained for reassignment in the MCSO’s re-organized Investigations Bureau. 31. WAIVER TO DONATION POLICY A2508 FOR ANIMAL CARE AND CONTROL Approve a waiver for the Animal Care and Control Department (790) to section IV.B. of Maricopa County Internal Policy A2508 - Receiving Donations, requiring monthly reporting of donated funds to the Board of Supervisors for FY 2021-22. On September 15, 2021, Animal Care and Control was approved by the Board of Supervisors to create a budgeted Animal Care Donations Fund (575) to allow further transparency recognizing and accounting for materiality of in-kind donations, and the use of restricted and unrestricted funds donated by citizens and groups, for the benefit of Community and Shelter cats and dogs. The Animal Care and Control maintains segregated fund (575) approved annually by the Board during the budget cycle and requests a waiver to the monthly reporting policy under A2508 section IV.C. Per policy A2508, section IV.C. “Any Department that maintains a budgeted Donation fund may request an annual waiver to this policy utilizing the Board of Supervisors agenda process.” Animal Care and Control Department maintains the Animal Care Donations Fund (575), strictly for the receipt of funds gifted to Animal Care and Control. Public donations are used to support a variety of programs and services such as providing supplies or equipment to the shelter to support shelter pets, underwriting of public adoptions or return to owner fees, including microchips, adoption events, and other public outreach activities. Approval of the waiver will allow annual reporting which will include the date of the donation, the donor name, a description of the time, the value and whether the donation was restricted or non-restricted, as outlined in Attachment A of the policy. By August 1, 2022, Animal Care and Control will provide an annual report of all donations accepted during FY 2021-22 to the Board of Supervisors, the Clerk of the Board, Internal Audit and OMB. ASPCA TRANSPORT PROGRAM GRANT CARRY-OVER AND BUDGET ADJUSTMENT In accordance with A.R.S. §42-17106(B), authorize the increase of expenditure authority in the FY 2022 Animal Care and Control (D790) Animal Care and Control Grant Fund (573) Non-Recurring Non-Project (NRNP) by $20,730. Grant funds from the American Society for the Prevention of Cruelty to Animals (ASPCA) was previously awarded/approved in FY 2020 in the amount of $60,000 to support the relocation of animals to collaborating shelters with available space and a community need for adoptable pets. Due to relocation challenges during the Covid-19 Pandemic and the recent Distemper outbreak, animal relocations between shelters have been difficult and delayed. The one-time expenditure adjustment will allow Animal Care and Control to spend the remaining grant fund balance in FY 2022. The grant allows a 0% rate or $0 for indirect costs to administer this grant. The Maricopa County Department of Finance has calculated the Fiscal Year 2022 indirect rate at 14.30%. Total grant indirect costs on this carry-over are estimated to be $2,964.00 and are not recoverable. Costs will be absorbed into the Animal Care and Control Fund 572 Operating Budget. The grant award was a one-time, non-recurring funding opportunity. Grant funds are provided using the advance funding method where funding is received in advance of actual expenditures. The grant award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. The grant award does provide funding for a mandated service, which is to provide adequate care of animals that are sheltered with the Animal Care and Control Department. This grant was competitively bid. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-79-22-029-X-00)

APPROPRIATION ADJUSTMENT FOR GRANT FUNDING FROM ARIZONA DEPARTMENT OF HOMELAND SECURITY Approve and authorize the Elections Department for the application of the Homeland Security Grant Program Award administered by the Arizona Department of Homeland Security (AZDOHS) and authorize the Chairman to approve the receipt of any and all such funds awarded. In accordance with A.R.S.42-17106(B), approve a revenue and expenditure appropriation adjustment increasing the FY 2022 Elections Department (210) Elections Grant Fund (248) Non-Recurring/Non-Project (NRNP) in the amount of $132,000. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The program will support the continued hardening of Maricopa County’s critical election equipment and data infrastructure. The acquisition of hardware, software, and critical services will harden security for both hard and cyber targets. The request represents the Office's efforts to continue to strengthen elections infrastructure and the mitigation and/or elimination of any security gaps identified during the 2020 election cycle and subsequent audits. Elections remain the cornerstone of American democracy and funding from the AZDOHS Homeland Security Grant Program will aid in the department’s mandate to provide fair, safe, and secure elections. The total amount of funds requested is $132,000. The grant period will cover the periods October 1st, 2021 through September 30th, 2022. The grant does not allow for indirect costs for which the County is eligible. The Maricopa County Elections Department composite indirect cost rate for FY 22 is 69.66% or $91,951.20. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $91,951.20. Non-recoverable indirect costs will be covered by the departmental general fund budget. This grant is competitive and does not require a match or on-going cash contributions after the grant period end date. The grant award is nonrecurring and has not been awarded to the department in past years. Maricopa County and the Elections Department are eligible to apply for and receive grant funding through various state agencies. FY 2022 MARKET ADJUSTMENTS FOR 11/15 IMPLEMENTATION Approve an increase to the FY 2022 transfer of funds from the General Fund to the Detention Fund for the Jail Excise Maintenance of Effort Above Base Transfer Out in the amount of $411,554. Pursuant to A.R.S. §42‐17106(B), approve the following transfer of expenditure authority in the FY 2022 Budget for market adjustments impacts beginning 11/15/2021. 1. If granted, this waiver means the potential employee, a Medical Examiner, does not have to return to his home country for two years (a condition of the J1 visa he was granted as a student). ACCEPTANCE AND USE OF GIFT CARDS FOR THE TUBERCULOSIS CONTROL INCENTIVE ROGRAM Approve the acceptance and use of gift cards provided by Arizona Department of Health Services (ADHS), to Maricopa County by and through its Department of Public Health (MCDPH), Tuberculosis Control Program. The MCDPH TB Clinic has received a donation of 400 cards, including 200 Bashas’ and 200 Chevron, at $10 each for a total value of $4,000. Gift card and voucher donations have been received by the TB program for several years. We expect them to continue. Cash and/or in-kind match is not applicable, nor will ongoing cash contributions be required should they cease to be provided. TB Services are a mandated function and donations such as these incentivize the treatment program. Awareness and treatment of TB patients is a benefit to our citizens. To our knowledge, the donations to the TB program are not given in a competitive manner. Program costs associated with the donations are absorbed by the TB programs grant budget. Administration costs are absorbed the department’s operating budget. MCDPH’s indirect rate for FY21 is 17.97%. The Contract term is modified to read May 1, 2017 through March 31, 2022. The NFP MIECHV IGA award is reoccurring and has been awarded to the department for many years. This grant does not require an in-kind match, indirect cost is fully recoverable and ongoing cash contributions are not required. The IGA award is not a mandated function but provides a benefit to the citizens of Maricopa County by providing evidence-based home visiting models to communities identified to be at risk. The award is competitive. MCDPH indirect rate for FY22 is 17.97%. The pass thru amount to sub-recipient Southwest Human Development is not subject to indirect and is in the amount of $249,615.50. Indirect cost on the eligible amount of $566,146 at 17.97 is $86,239 is recoverable. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Either Party may terminate this Agreement at any time before the expiration date of this Agreement by furnishing the other Party with a thirty (30) day written notice. The purpose of this Intergovernmental Agreement is to identify and define both Parties' respective roles in the execution of the responsibilities of specific maintenance tasks in areas that cross jurisdictional boundaries. The Agreement provides the opportunity to focus on specific maintenance tasks or emergency highway projects and the availability of the most economical resources by extending beyond jurisdictional or geographical boundaries. The Agreement's application will benefit areas in the County and the Town where the other Party could complete specific types of routine maintenance or emergency highway project activities based on scheduled work within the area. IGA WITH CITY OF PHOENIX TO ACCEPT 5307 GRANT FUNDING TO IMPROVE LOWER BUCKEYE ROAD FROM 125TH AVENUE TO EL MIRAGE ROAD Approve the Intergovernmental Agreement between Maricopa County and the City of Phoenix to accept 5307 Grant Funding to improve Lower Buckeye Road from 125th Avenue to El Mirage Road. The Federal Award Identification Number (FAIN) No. AZ-2021-049 is designated to the city of Phoenix for distribution to other entities based upon transit needs in the region. Maricopa County is responsible for accessibility to transit stops on roads owned and operated by MCDOT. This one-time pass-thru grant is designated to provide ADA facilities to two transit stop locations. Under this Intergovernmental Agreement, the Board of Supervisors will authorize the Maricopa County Director of Transportation, or her designee, to accept federal grant funds for $140,000, as a pass-through from the City of Phoenix Public Transit Department. Lower Buckeye Road from 125th Avenue to El Mirage Road is a Maricopa County maintained road in an unincorporated strip of land bordered by the City of Avondale on the north, south, and east. There are two bus stops in this segment serving the Avondale Zoom through the Valley Metro Regional Public Transportation Authority and are identified in the MCDOT ADA Transition Plan. The County will improve the segment by adding sidewalk, curb and gutter, and ADA ramps to meet the 2010 ADA Accessibility Standards. The Americans with Disabilities Act of 1990 requires accessible routes to all public facilities. This grant provides funding to install sidewalks to two transit stops along Lower Buckeye Road that are identified in the MCDOT ADA Transition Plan. The County will lead the efforts to design and construct the sidewalk, curb, and gutter. The total amount of the improvements is $175,000. The County will be financially responsible for $35,000 of the local match of the 5307 Grant funds budgeted in FY2022 Transportation Department (640) Transportation Capital Project Fund (234) Five Year Program in the Transportation System Management Project, sub-project TT0700. The grant will fund the remaining $140,000. This was non-competitive bid process. The transit stops are located within MCDOT rights of way and any and all improvements are the sole responsibility of MCDOT. Work will be done utilizing a Jobs on Contract agency which was established through a competitive process. Indirect costs are not refundable. Any indirect cost will be funded through the Transportation Improvement Program, TMAN bin. There are no ongoing contributions related to the grant. Routine sidewalk maintenance will be performed as part of regular roadway maintenance and covered by the Operation Budget. Grant revenues are not local revenues for the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. The terms of the agreement are in effect as of the Board of Supervisors' approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by all parties. REGIONAL ARCHIVED DATA SYSTEM (RADS) UPGRADES AND DATA MANAGEMENT PROGRAM Authorize the Maricopa County Department of Transportation (MCDOT) to accept federal funding reimbursements and expend the grant funds for the Department of Transportation: Transportation System Management Project, sub-project TE064 Regional Archived Data System (RADS) Upgrades and Data Management Program. Estimated cost of the project is $354,200. Federal Highway Administration (FHWA) has authorized $334,011 in federal reimbursement funds which are available in FY 2021-22. MCDOT’s local match portion is $20,189 and will be absorbed by the department operating budget from Operation funds. The grant awarded is a one-time award. 74. CIVIL PENALTY APPEALS – FOR APPROVAL Pursuant to A.R.S. §42-12052, for property owners who timely satisfied the requirements of primary residence status: 1. Approve property owners' appeals of a civil penalty assessment, direct the Assessor to reclassify the subject properties to class three, and waive the civil penalty. 2. This policy provides for Spanish language assistance at formal Board of Supervisors meetings to persons with limited English language proficiency. These revisions update instructions and policy language for consistency with the current policy format. This Policy applies to all employees of Maricopa County elected offices and appointed departments as well as the Flood Control District of Maricopa County and the Maricopa County Library District (Special Districts). IGA WITH THE UNITED STATES GEOLOGICAL SURVEY AND THE FCD FOR WATER RESOURCES INVESTIGATIONS Approve Intergovernmental Agreement (IGA) FCD 2021A010, between the United States Geological Survey [Agreement #22ZFJFA00079400 (USGS)] and the Flood Control District of Maricopa County (District), for the period of October 1, 2021 to September 30, 2022, for collection of stream flow data on local watersheds throughout Maricopa County. The total cost of the IGA is $387,340. The District’s costs under this agreement will be $242,990, with the USGS contributing the remaining $144,350. Payments from the District are to be made quarterly. The agreement covers costs associated with the maintenance, collection, and publication of stream flow data and river reach characteristics at nine continuous stream flow monitoring stations and 22 peak flow monitoring sites throughout Maricopa County. This agreement further will develop and evaluate long term flood histories on watercourses in Maricopa County, and provide information critical to the determination of the risk of flooding in these watercourses. The information generated by the USGS’s ongoing work is vital to the safety of Maricopa County residents, and to the continuing hydrologic studies performed by the District.
