GILA HYDROGEN FACILITY Case #: Z2023059 Supervisor District: 4 Applicant & Owners: Stephen Anderson, Gammage & Burnham / Jae Koo Huh and Miriam Huh Family Trust Request: Zone change with overlay from Rural-43 to IND-3 IUPD Site Location: Generally located 1,000’ north and 3,200’ west of the NWC of Interstate 10 and Salome Highway in the Tonopah area Commission Recommendation: On 10/19/23, the Commission voted 8-0 to adopt a motion recommending the Board of Supervisors approve Z2023059 subject to conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “Gila Hydrogen“, consisting of 2 full-size sheets, dated August 17, 2023, and stamped received August 17, 2023, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Gila Hydrogen Facility”, consisting of 41 pages, dated August 17, 2023 and stamped received August 17, 2023, except as modified by the following conditions. c. The following conditions as per Arizona Game and Fish recommendations shall apply: 1. The applicant shall coordinate with Arizona Game and Fish to come up with an acceptable plan of removal if any evidence of Sonoran Desert Tortoise or the Western Burrowing Owl are found on site. 2. Deterrent measures shall be in place to prevent birds and other wildlife gathering at the evaporation pond. 3. All other recommendations provided by Arizona Game and Fish shall be adhered to, whenever possible, as per the letter dated June 2, 2023. d. The following Planning Engineering Conditions shall apply: 1. Without submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed buildings, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. Dedication of right-of-way across the Salome highway site frontage (both parcels) is required to provide 65’ half-width from center. Dedication shall occur prior to the issuance of building permits. 3. Right-of-way preservation along the east side of 523rd Ave shall be 25’ 4. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; floodplain Regulations for Maricopa County; MDOT Roadway Design Manual; and current engineering policies standards, and best practices at the time of application for construction. e. The following IND-3 IUPD standards shall apply to the site: 1. Maximum Height: 150’ 2. Parking: one stall per 10,000 sq ft floor area 3. Carpool Parking Stalls: Minimum 10 dedicated carpool stalls 4. Site Screening: minimum 6’ chain link fence topped with barbed wire 5. Loading and Unloading spaces: one loading/unloading space per 100,000 sq feet of floor area 6. Use: use of site shall be limited to production of hydrogen and ancillary uses f. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. Withdrawn by Applicant: In a letter dated 10/27/23, the applicant has withdrawn the special use permit request. Staff Alternative: The staff report presented to the Commission included staff recommendation for denial. However, in the event the Board motions for approval of Z2022097, staff suggests conditions ‘a’ – ‘l’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Juniors Recycling“, consisting of one full-size sheet, dated August 15, 2023, and stamped received August 16, 2023, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Juniors Recycling”, consisting of three pages, dated August 8, 2023, and stamped received August 9, 2023, except as modified by the following conditions. c. The following Planning Engineering comments shall apply: 1. The applicant shall be responsible for coordinating any requirements that may be imposed by ADOT for access to Apache Trail (redletter@azdot.gov). 2. Any new development shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards, and current engineering policies, standards, and best practices at the time of application for construction. d. This special use permit shall be valid for ten years and shall expire on November 15, 2033, or upon termination of the use for a period of 90 or more days, whichever occurs first. All improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. Daily operations of the facility shall only take place during the hours of operation listed in the applicant’s narrative report, which are 7:00 a.m. to 5:00 p.m. every day. f. The property owner or applicant must submit as-built building permits for any structure that has been built on-site that has a footprint over 200 square feet or a height more than ten feet, including fences and any signage, that has been constructed without permits. g. Any stored materials shall be placed behind an eight-foot-tall screening wall around the perimeter of the site behind the front plane of the building, and no material stored on site shall exceed the height of a screening wall or the existing rear storage shed. h. There shall be no required sight-visibility triangles on this site. i. Any outdoor lighting shall be in conformance with the provisions of Section 1112 of the Zoning Ordinance and shall be placed so as to reflect light away from any adjoining rural or residential zoning district. j. The excavator machinery that is used to crush recycled materials shall be removed from the site. k. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this special use permit as set forth in the Maricopa County Zoning Ordinance. l. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the special use permit, the property shall revert to the zoning that existed on the date of application. 30. TREASURER’S BUDGET APPROPRIATION FOR CLASS ACTION LAWSUIT In accordance with A.R.S. § 42-17106(B), request consideration and approval for the following adjustments to the Treasurer’s Office FY 2024 budget for the Qasimyar class action lawsuit. 1. Increase the Treasurer (D430) General Fund (100) Qasimyar Implementation (QMYR) expenditure appropriation by $5,523,486. 2. Decrease the Non-Departmental (D470) General Fund (100) Non Recurring (NRNP) Contingency (4711) expenditure appropriation by $5,523,486. These actions will have a County-wide net impact of zero, and they do not alter the budget constraining the expenditures of local revenue duly adopted by the Board pursuant to A.R.S. § 42-17105. It is anticipated that the Tax Court will issue their final judgment in December 2023 in which the budget request will be used to fulfil the Treasurer’s Office compliance requirements. The Budget request includes temporary staff, overtime pay, special work assignment, postage, etc., and is estimated to take between 23-41 months depending upon the requirements of the final judgment. The volume of resolutions to be processed is approximately one million, or fifty-times our normal processing of resolutions within one-year. Approval of the budget appropriation in November 2023 will allow the Treasurer’s Office to hire and train temporary staff during December 2023 so that the internal processes can be established for resolution processing. 31. PERMANENT ADDITIONS TO THE FLEET Approve a permanent addition to the fleet of two Ford Explorer Sport Utility Vehicles (SUV) to be used by the Adult Probation Department (APD). As the sex offender probation population has continued to grow, APD has identified existing positions that can be reassigned to this case type, along with sufficient funding to purchase the required vehicles. The two new vehicles will be used by APD staff in support of the growth supervision teams, as is standard practice in the Sex Offender program. The estimated cost is $53,000.00 for each vehicle, for a total cost of $106,000.00 which includes taxes and onboarding costs. As permanent additions to the County vehicle fleet, the Judicial Branch is requesting that future replacements be addressed by County Equipment Services through established policies and procedures. WITHDRAWAL OF THE ARIZONA STATE IMPLEMENTATION PLAN (SIP) SUBMITTAL TO REMOVE RULE 41 (MONITORING) FROM THE SIP AND REPLACE IT WITH RULE 245 (CONTINUOUS SOURCE EMISSION MONITORING) The Maricopa County Air Quality Department (MCAQD) requests approval to withdraw the May 4, 2023 SIP submittal requesting the rescission of Rule 41 from the Arizona SIP and approval of Rule 245 into the Arizona SIP. On April 26, 2023, the Maricopa County Board of Supervisors adopted revisions to Rule 245 and approved submittal of the revised rule into the Arizona SIP as a replacement for Rule 41 as a revision to the Arizona SIP. On May 4, 2023, MCAQD through the Arizona Department of Environmental Quality submitted the SIP revision to the U.S. Environmental Protection Agency (EPA). In July 2023, EPA recommended that MCAQD withdraw the SIP submittal since the revised Rule 245 only applies to nitric acid plants, sulfuric acid plants, and fluid bed catalytic cracking units and is not required to fulfill EPA SIP requirements. In addition, EPA advised that Rule 41 can be removed from the SIP without replacement because it is not required to fulfill EPA SIP requirements and is duplicative to other provisions in the Arizona SIP. 41. AMEND PREMIUM PAY RATES Approve the Maricopa County Premium Pay Rates effective 11/15/2023. Human Resources recommends dropping the 2-hour requirement for shift differentials and clarifying CHS weekend differentials are from 3 pm Friday to 7 am Monday. These premium pay rates apply to the County’s elected offices, appointed departments, Judicial Branch of Maricopa County, which receives funding from Maricopa County, the Flood Control District of Maricopa County, and the Maricopa County Library District (Special Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on April 11, 2018. AFFILIATION AGREEMENT WITH EAST VALLEY INSTITUTE OF TECHNOLOGY FOR INTERNSHIP PROGRAM Approve a non-financial Affiliation Agreement (Agreement) with East Valley Institute of Technology District #401 ("EVIT") and Maricopa County (“County”) administered by the Human Services Department Early Education Division – Head Start Program (“Program”). The Agreement is concerning internships and hands-on training experiences for students enrolled in the EVIT Early Childhood Education program (“Students”). EVIT seeks to place selected Students in internship experiences provided by the Department (collectively, the “Program”) as part of their overall education, to ensure competence and promote quality early childhood education opportunities for mutual benefit. AMENDMENT TO THE IGA WITH THE TOWN OF GILBERT Approve financial Amendment No. 3 to the Intergovernmental Agreement between the Town of Gilbert (Town), and Maricopa County administered by its Human Services Department. AMENDMENT TO IGA WITH CITY OF CHANDLER FOR HOME INVESTMENT PARTNERSHIPS ACTIVITIES Approve financial Amendment No. 5 to the Intergovernmental Agreement between City of Chandler (“Subrecipient”) and Maricopa County (“County”) administered by its Human Services Department. The purpose of the Agreement is for the City of Chandler to provide single-family owner-occupied housing reconstruction and tenant based rental assistance programs. The County provided the City with U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME) funds. The Parties agree to enter into this Amendment No. 5 to amend the Agreement as follows: A. Revise Section III (Work Statement) to address the following: 1. 53. SUN PONDS II ADMINISTRATIVE CORRECTION Approve an administrative correction to the action taken November 1, 2023 with regard to Sun Ponds II Z2023025 (C-44-24-075-X-00). The Board approved Z2023025 subject to the recommendation of the Planning and Zoning Commission. However, the conditions of approval recommended by the Commission were incorrectly listed on the published agenda with references to “Sun Pond I” instead of “Sun Pond II”. The correct conditions ‘a’ – ‘o’ are noted below: a. Development of the site shall be in substantial conformance with the site plan entitled “Sun Pond 2 Solar Project”, consisting of nine full-size sheets, dated July 2023, and stamped received July 19, 2023, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the narrative report entitled “Sun Pond II Solar Project”, consisting of 18 pages, dated July 2023, and stamped received July 19, 2023, except as modified by the following conditions. c. A Plan of Development is approved subject to a site plan entitled “Sun Pond 2 Solar Project” consisting of nine full-size sheets, dated July 2023, and stamped received July 19, 2023. The Plan of Development may be amended administratively under a separate application as long as the amendment complies with the established IUPD development standards as approved by the Board of Supervisors. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. d. Prior to the submission of building permits the developer must conduct a Class I Cultural Resources Inventory of the site to determine the extent of any known cultural resources. The developer shall take measures to avoid and minimize the impact of any known or found cultural resource during the construction of any phase of the development. e. Prior to the submission of building permits the developer shall provide a letter from the State Historic Preservation Office (SHPO) stating if or if not, the site is located in an area of historical or cultural significance. f. The landowner or developer shall coordinate with the Arizona Game & Fish Department in each phase of development to determine best management practices to minimize impacts on the area’s wildlife. The landowner or developer shall coordinate with the Arizona Game & Fish Department to determine the appropriate wildlife and habitat surveys that will need to be conducted during the development of the site. g. The following Planning Engineering comments shall apply: 1. Detailed Grading and Drainage Plans must be submitted with the application for Building Permit(s) indicating that runoff from each solar field area will be directed to a retention basin. 2. Building permit submittals shall include analysis to determine stabilization requirements for perimeter channels to meet County requirements. 3. Any retention and spreader basins shall drain within 36 hours. 4. Drainage Waiver case DRB2023007 must be approved prior to issuance of building permit(s). 5. If permitted or constructed together, a consolidated drainage design is required at the southeast corner of Sun Pond I site and the southwest corner of Sun Pond II site. 6. Prior to the issuance of building permits, the Traffic Statement must be approved by MCDOT’s Traffic Branch. 7. A Solar License is required from MCDOT for any private utility company that will occupy the County right-of-way (i.e. transmission facilities). 8. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards, and best practices at the time of application for construction. 9. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of solar arrays may be necessitated by the final engineering design of the site’s drainage infrastructure. h. The following MCDOT Planning comments shall apply: 1. The landowner or developer shall provide a reserved minimum right-of-way of 55 feet relative to the roadway’s centerline along the site’s east, north, and south frontage. i. The following IND-2 IUPD zoning district development standards shall apply: 1. There shall be no required yards. 2. There shall be an average perimeter setback along reserved right-of-way and along boundaries without reserved right-of-way of 20 feet. 3. There shall be no parking requirements. 4. There shall be no required loading/unloading spaces. 5. Photovoltaic solar panel arrays shall not contribute to lot coverage calculations. 6. Chain link fences without screening materials shall exceed two feet in height but shall not exceed the maximum fence height of eight feet inside a 25-foot by 25-foot sight-visibility triangle. 7. Photovoltaic solar panel arrays shall not be enclosed in a building. 8. Alternative surfacing materials or other methods approved by Maricopa County Air Quality to minimize dust pollution shall be allowed in driveways and parking areas. 9. A minimum of six-foot tall chain link fences and gates without screening materials shall be allowed adjacent to any zoning district. 10. Attached barbed wire or concertina wire shall be permitted under a height of eight feet for fences and gates. 11. The landowner or developer shall coordinate with the Arizona Game & Fish Department to determine fencing design and layout to provide appropriate wildlife access and maintain wildlife connectivity across the project area. j. The IUPD overlay instrument is applied to restrict the use of the site and this IND-2 IUPD shall limit the use of the site to a photovoltaic electric generation facility including any ancillary uses of the facility. The IUPD may be amended to entitle additional uses via Modification of Condition application to the Planning & Development Department, but will require legislative approval by the Board of Supervisors after recommendation of the Planning & Zoning Commission. k. All outdoor lighting shall be in compliance with Section 1112 of the Maricopa County Zoning Ordinance. Any outdoor lighting shall be placed so as to reflect light away from any adjoining rural or residential zoning district. l. Prior to the issuance of a building permit, written confirmation shall be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. m. Amendment to the zone change shall be processed as a revised application in accordance with Maricopa County Zoning Ordinance requirements. n. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. o. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell, or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. 54. SUN PONDS III ADMINISTRATIVE CORRECTION Approve an administrative correction to the action taken November 1, 2023 with regard to Sun Ponds III Z2023026 (C-44-24-080-X-00). The Board approved Z2023026 subject to the recommendation of the Planning and Zoning Commission. However, the conditions of approval recommended by the Commission were incorrectly listed on the published agenda with references to “Sun Pond I” instead of “Sun Pond III” and to an incorrect number of pages in the referenced documents. The correct conditions ‘a’ – ‘o’ are noted below: a. Development of the site shall be in substantial conformance with the site plan entitled “Sun Pond 3 Solar Project”, consisting of eight full-size sheets, dated July 2023, and stamped received July 19, 2023, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the narrative report entitled “Sun Pond III Solar Project”, consisting of 11 pages, dated July 2023, and stamped received July 19, 2023, except as modified by the following conditions. c. A Plan of Development is approved subject to a site plan entitled “Sun Pond 3 Solar Project” consisting of eight full-size sheets, dated July 2023, and stamped received July 19, 2023. The Plan of Development may be amended administratively under a separate application as long as the amendment complies with the established IUPD development standards as approved by the Board of Supervisors and Maricopa County Zoning Ordinance requirements. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. d. Prior to the submission of building permits the developer must conduct a Class I Cultural Resources Inventory of the site to determine the extent of any known cultural resources. The developer shall take measures to avoid and minimize the impact of any known or found cultural resource during the construction of any phase of the development. e. Prior to the submission of building permits the developer shall provide a letter from the State Historic Preservation Office (SHPO) stating if or if not, the site is located in an area of historical or cultural significance. f. The landowner or developer shall coordinate with the Arizona Game & Fish Department in each phase of development to determine best management practices to minimize impacts on the area’s wildlife. The landowner or developer shall coordinate with the Arizona Game & Fish Department to determine the appropriate wildlife and habitat surveys that will need to be conducted during the development of the site. g. The following Planning Engineering comments shall apply: 1. Detailed Grading and Drainage Plans must be submitted with the application for Building Permit(s) indicating that runoff from each solar field area will be directed to a retention basin. 2. Building permit submittals shall include analysis to determine stabilization requirements for perimeter channels to meet County requirements. 3. Any retention and spreader basins shall drain within 36 hours. 6. Prior to the issuance of building permits, the Traffic Statement must be approved by MCDOT’s Traffic Branch. 7. A Solar License is required from MCDOT for any private utility company that will occupy the County right-of-way (i.e. transmission facilities). 8. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR DIETETIC INTERNSHIP PROGRAM Approve Amendment No. 5 to Intergovernmental Agreement (IGA) Contract No. CTR046145 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) to provide continued funding for the Dietetic Internship Program. The price sheet is effective October 1, 2023, through September 30, 2024, for the not-to-exceed amount of $186,725.72. The term of this Agreement is October 1, 2019, through September 30, 2024. It is mutually agreed that the referenced IGA is amended as follows: 1. Pursuant to Terms and Conditions, Provision Six (6), Contract Changes, Section 6.1, Amendments, Purchase Orders and Change Orders, the following changes are hereby made under this Amendment Five (5); 1.1 The Price Sheet is hereby revised and replaced; and 1.2 Exhibit A is revised and replaced. This grant award is reoccurring and has been awarded to the department for many years. There is no cash or in-kind match required and indirect costs are fully recoverable. Ongoing cash contributions will not be required. The grant award is not a mandated function but provides a benefit to the citizens by increasing the number of Women, Infant and Children (WIC) Registered Dieticians to provide nutrition counseling for the community. The grant award is not competitively bid, and the department’s operating budget is not required to absorb any costs. The Department of Public Health’s Indirect Rate for FY2024 is 15.65%. Indirect costs are budgeted at $25,268.12 which are fully recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Board Required Information: Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. CONTRACT WITH PHOENIX CHILDREN’S HOSPITAL FOR COMMUNITY HEALTH NEEDS ASSESSMENT REPORT Approve a Contract for Services between Phoenix Children’s Hospital and Maricopa County by and through its Department of Public Health (MCDPH) for participating in a Community Health Needs Assessment (CHNA). Phoenix Children’s Hospital shall pay the County for the services described, in the amount of $15,600 per year, for three years, for a total not-to-exceed amount of $46,800. The term of this Contract is from July 1, 2023, through June 30, 2026. The Contract may be extended by mutual written and signed agreement of the Parties for additional terms up to three-years each. The Department of Public Health's standard indirect rate for FY24 is 15.65%, The fee fund rate for FY24, however, is 18.67%. This CHNA contract will fall under the fee fund rate of 18.67%. IGA WITH ARIZONA BOARD OF REGENTS ON BEHALF OF ARIZONA STATE UNIVERSITY Approve an Intergovernmental Agreement (IGA) between the Arizona Board of Regents for and on behalf of Arizona State University (ASU) and Maricopa County by and through its Department of Public Health (MCDPH) to provide funding for epidemiology services. The purpose of this IGA is for MCDPH to gain the capacity to rapidly scale and respond to emergency public health events with trained investigators. This Agreement will also allow ASU students to gain practical experience in public health. TERMINATE IGA WITH CITY OF PHOENIX TO ACCEPT 5307 GRANT FUNDING Terminate the Contract Amendment between Maricopa County and the City of Phoenix to accept 5307 Grant Funding to improve Lower Buckeye Road from 125th Avenue to El Mirage Road. Under this request, the Board of Supervisors will terminate the Contract Amendment and the authority of the Maricopa County Director of Transportation, or their designee, to accept federal grant funds for $140,000, as a pass-through from the City of Phoenix Public Transit Department. The Parties have mutually agreed to terminate the Contract as Valley Metro/RPTA has chosen to reroute transit services in the area. The project was never started nor were there any monetary funds exchanged between the Parties. The County’s financial contribution and a local match of $35,000 will be dissolved back into the department’s budget, FY2022 Transportation Department (640) Transportation Capital Project Fund (234) Five Year Program in the Transportation System Management Project, Sub-Project TT0700. Grant revenues are not local revenues for the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The termination of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. The City is seeking streamlined Real Estate support from the County to acquire right-of-way and related easements within unincorporated Maricopa County required for the Project. The City will pay for all costs associated with the right-of-way acquisition, including condemnation costs. The proposed improvement will complete the minor arterial standard in places not completed by private development. The improvements will include four vehicular travel lanes (two lanes in each direction), raised medians, bike lanes, curb, gutters, sidewalks, ADA ramp upgrades, traffic signal upgrades, street lighting, undergrounding SRP 12kV, drainage improvements, landscaping, dual left turn lanes at Riggs Road, water, sewer, and private utility improvements. The Intergovernmental Agreement requires the City to annex the Project upon completion. The City will be authorized to hire outside counsel, on behalf of the County, for condemnation cases. While the majority of the work will be done by the City and outside counsel, settlement agreements will still need to be approved by the Board of Supervisors. IGA WITH CITY OF TEMPE FOR COMMUNITY SERVICES BLOCK GRANT INITIATIVES Approve an Intergovernmental Agreement (“Agreement”) between the City of Tempe (“City or Contractor”) and Maricopa County, administered by its Human Services Department (“County”). The City and County are collectively referred to here as the “Parties” and individually as a “Party.” The County seeks to support the City’s Expanded Food Security Initiative (the “Initiative”) to expand access to food and nutrition for recurrent users of food pantry services by providing emergency food boxes, nutritional education, and community resource navigation to improve economic security and physical health and wellbeing in the City of Tempe and surrounding area. The County shall provide the Contractor with Community Service Block Grant (CSBG) funds for Initiative activities in the amount of $62,500; period of funding availability and term of the Agreement shall be retroactive to November 1, 2023, through June 30, 2024. BIDS AND AWARD FOR SUPERSTITION SPRINGS GOLF COURSE LAKE Authorize the advertisement of the Invitation for Bids of the Superstition Springs Golf Course Lake project and the award of the contract to the lowest responsible bidder if the bid is not more than ten percent (10%) over the engineer’s estimate. The proposed improvements at the project area include filling in the existing lake to re-establish flow through the channel, construction of a concrete low-flow channel and maintenance access ramps, redirecting an existing drainage pipe outfall further upstream, constructing shallow basins to capture rainwater, and the use of drought-tolerant native plantings. The project is intended to manage nuisance water, eliminate vector issues, restore conveyance of stormwater within the EMF, and provide a landscape treatment that is acceptable to stakeholders and the general public while increasing potential rainwater capture and minimizing District maintenance activities. 83. IGA BETWEEN US GEOLOGICAL SURVEY AND THE FLOOD CONTROL DISTRICT FOR WATER RESOURCES INVESTIGATIONS Approve Intergovernmental Agreement (IGA) FCD 2023A009, between the United States Geological Survey (USGS) [Agreement #23ZFJFA00079410 (USGS)] and the Flood Control District of Maricopa County (District), for the period of October 1, 2023, to September 30, 2024, for collection of streamflow data on local watersheds throughout Maricopa County. The total cost of the IGA is $319,390. The District’s costs under this agreement will be $209,640, with the USGS contributing the remaining $109,750. In addition, USGS will facilitate Federal Priority Stream gaging Funds of $52,410. Payments from the District are to be made quarterly. The agreement covers costs associated with the maintenance, collection, and publication of stream flow data and river reach characteristics at seven continuous stream flow monitoring stations and 14 peak flow monitoring sites throughout Maricopa County. This agreement will further develop and evaluate long-term flood histories on watercourses in Maricopa County and provide information critical to determining the risk of flooding in these watercourses. The information generated by the USGS’s ongoing work is vital to the safety of Maricopa County residents and the continuing hydrologic studies performed by the District. 84. CHANGE ORDER NO. 7 TO CONTRACT FOR THE VINEYARD FLOOD RETARDING STRUCTURE REHABILITATION PROJECT Approve Change Order No. 7 to Contract FCD 2014C014 for Pre-Construction Services CMAR for Vineyard Flood Retarding Structure (FRS) Rehabilitation Project. Change Order No. 7 for Pre-Construction Services CMAR Contract FCD2014C014 adds funds in the amount of $900,000.00 to the existing contract, increasing the value of the contract to $3,150,000.00. The additional funds are required to proceed with developing acceptable filter compaction requirements for District dams that are reasonable and acceptable to the Arizona Department of Water Resources. Additionally, it will allow the District to construct an acceptable test filter that meets the requirements of the Arizona Department of Water Resources. Part of this funding will also allow the District to potentially use this CMAR for Vineyard FRS Phase 3. Change Order No. 7 will not add additional days to the contract. Contract FCD 2014C014 ends on August 30, 2025. Vineyard Road FRS is one of three earthen FRSs located in northwestern Pinal County, east of the Central Arizona Project (CAP) canal and south of Baseline Road. These three FRSs work as a hydraulically connected system, where the impoundment water from all three FRSs discharges to one outlet, the Powerline Floodway. The Powerline, Vineyard Road, and Rittenhouse FRSs Rehabilitation or Replacement Project was a District sponsored planning study that analyzed alternatives and selected a preferred alternative that would correct the dam deficiencies, maintain the flood control benefits to downstream properties, and comply with NRCS and state dam safety requirements. The selected alternative for Vineyard Road FRS involves raising and rehabilitating the structure. The raising and rehabilitation of the 5-mile-long Vineyard Road FRS involves reconstructing 2 emergency spillway reinforced concrete structures, raising the embankment, constructing a filter for the entire length of the structure, reconstructing the principal outlet, and erosion protection measures. This Agenda Item impacts Supervisorial District 1 & 2. (C-69-15-008-5-03)

88. FY2024 BUDGET APPROPRIATION ADJUSTMENT Approve and direct the Maricopa County Stadium District (District) to remit to the Arizona Sports and Tourism Authority (Authority) all District-held Car Rental Surcharge Revenues in accordance with Section 4 of Amendment No. 1 to the Intergovernmental Agreement dated November 1, 2023 (C-68-04-001-2-01). The District-held Car Rental Surcharge Revenues are estimated at $5.4M. Authorize an increase in the expenditure authority in the Stadium District (D680) Cactus League Operations Fund (250) Non Recurring (NRNP) by $5,400,000. This action will adjust the District budget to reflect the disbursement of the District-held Car Rental Surcharge Revenues in accordance with Amendment No. 1 of the Agreement. District revenues are not local revenues for the purpose of the constitutional expenditure limitation and therefore expenditures of these revenues are not subject to the constitutional expenditure limitation. The approval of this action requested does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105.
