The Plan of Development may be amended administratively under separate application as long as the amendment complies with the established IUPD development standards as approved by the Board of Supervisors. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the zone change. The zone change enhances the value of the property above its value as of the date the zone change is granted and reverting to the prior zoning results in the same value of the property as if the zone change had never been granted. FROM 8/21/24) Case #: Z2023014 Supervisor District: 1 Applicant & Owner: Rodney Jarvis / Greenfield Properties LLC Request: Special Use Permit (SUP) for a wedding venue / events center within the Rural-43 zoning district Site Location: Generally located SE of the SEC of San Tan Village Parkway & Greenfield Rd. Commission Recommendation: On 5/9/24, the Commission voted 7-1 to adopt a motion recommending the Board of Supervisors approve Z2023014 subject to conditions ‘a’ – ‘l’: a. Development of the site shall be in substantial conformance with the site plan entitled “White Barn Wedding Venue“, consisting of 8 full-size sheets, dated June 24, 2023 and stamped received October 2, 2023 except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the narrative report entitled “White Barn Events Center”, consisting of 8 pages, dated March 20, 2024 and stamped received March 20, 2024 except as modified by the following conditions. c. This special use permit shall expire on June 12, 2034, or upon termination of the use for a period of 90 or more consecutive days, whichever occurs first. All site improvements associated with the SUP shall be removed within 90 days of such expiration or termination of use. d. The project shall require a 6’ CMU wall on the north, east and south property lines for noise attenuation purposes. e. All outdoor lighting shall be shielded so that illumination does not trespass onto neighboring properties and is directed downward at a minimum 20-degree angle beneath the horizontal plane of the bottom of the shielding f. All commercial outdoor activity shall be moved indoors by 9:00 PM. g. Amplified music and dancing are prohibited in outdoor areas. Further, any amplified noise must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15, 2006 and is regulated by the MCSO. Section IV Noise: C. Radios and Sound Amplification Devices It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, or other sound producing, sound reproducing, or sound amplification equipment that emits noise that can be heard from within closed residential structures located within 500 feet of the boundary of the property from which such noise emanates. h. Prior to issuance of initial building permits, all parcels shall be combined to create a single parcel matching the SUP area. i. The following Planning Engineering conditions: 1. Unpermitted walls/fences on the subject property shall be addressed with the submittal for building permits for the site development. It shall be demonstrated that the walls/fences do not create an adverse drainage impact to the site or surrounding properties. 2. Prior to the issuance of building permits for development of the site, the owner/applicant must provide evidence that the Town of Gilbert has approved the Traffic Report. 3. Access to the site shall be via a one-way entrance (north) and one-way exit (south), or as otherwise approved by the Town of Gilbert. 4. Owner/applicant shall coordinate with the Town of Gilbert for any offsite improvements, ROW requirements and access. Provide County of TOG approved offsite improvement plans during building permit phase. 5. SWPP provided during building permit phase. 6. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 7. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the SUP. The SUP enhances the value of the property above its value as of the date the SUP is granted and reverting to the prior zoning results in the same value of the property as if the SUP had never been granted. l. AQ-2024-006-RULE 510 (AIR QUALITY STANDARDS) Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on incorporating the recently revised primary annual PM2.5 National Ambient Air Quality Standard (PM2.5 NAAQS) into Maricopa County Air Pollution Control Regulations, Rule 510 (Air Quality Standards) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed revision to the rule and to approve submission of the revised rule as a revision to the Arizona SIP. On February 7, 2024, the U.S. Environmental Protection Agency (EPA) revised the primary annual PM2.5 NAAQS from 12 micrograms per cubic meter (µg/m3) to 9.0 µg/m3. In response to the primary annual PM2.5 NAAQS revision, MCAQD is proposing to revise Rule 510 to incorporate the new standard of 9.0 µg/m3. The purpose of Rule 510 is to establish ambient air quality standards per § 110(a) of the Clean Air Act (CAA), which are necessary to protect human health and public welfare. The standards implemented in Rule 510 incorporate the NAAQS as codified in 40 CFR 50 “National Primary and Secondary Ambient Air Quality Standards”. States are required to submit an infrastructure SIP under Section 110(a) of the CAA that implements, maintains, and enforces new or revised NAAQS within three years of the EPA issuing the standard. Rule 510 supports the Maricopa County portion of Arizona’s infrastructure SIP. (C-85-25-014-X-01)

AQ-2024-001-INCORPORATION BY REFERENCE - RULE 360 (NEW SOURCE PERFORMANCE STANDARDS), RULE 370 (FEDERAL HAZARDOUS AIR POLLUTANT PROGRAM), RULE 371 (ACID RAIN), AND APPENDIX G (INCORPORATED MATERIALS) Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on incorporating federal standards into Maricopa County Air Pollution Control Regulations: Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Following the public hearing, the Board is requested to adopt the proposed incorporations into the Maricopa County Air Pollution Control Regulations. The Maricopa County Air Pollution Control Regulations contain several rules, Rules 360, 370, 371, and Appendix G, which incorporate by reference federal regulations from Title 40 of the Code of Federal Regulations (CFR). These federal regulations include New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Acid Rain regulations. Every July 1, the U.S. Environmental Protection Agency (EPA) codifies revisions made to these federal regulations during the preceding year. The purpose of this rulemaking is to incorporate by reference the applicable federal regulations as codified on July 1, 2024, and thereby update Rules 360, 370, 371, and Appendix G with any revisions made to the corresponding federal rules during the preceding year. This is necessary in order to continue to comply with the Maricopa County Air Quality Department’s delegated authority from EPA to implement and enforce NSPS, NESHAP, and acid rain programs in Maricopa County, except for those specific authorities retained by the EPA. After the rules are adopted by the Board of Supervisors, the MCAQD will request delegation authority from the EPA to implement and enforce the federal standards. COMMUNITY SOLUTIONS FUNDING FOR THE TOWN OF GUADALUPE Authorize the Community Solutions Funding Proposal request in the amount of $452,200 to be provided to the Town of Guadalupe for reconstruction of the Guadalupe Town Hall parking lot located at 9241 S. Avenida Del Yaqui, Tempe. This parking lot is critical not only in support of the essential operations the Town provides at this campus on a routine basis and is utilized as a centralized location in cases of emergencies. Parking lot reconstruction is anticipated to be completed by December 31, 2025. The Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover the cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals and provide a clear public benefit for Maricopa County residents. The associated Maricopa County Strategic Goal is: Regional Services. A. Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 2025 budget: 1. Decrease the expenditure authority in the Non-Departmental (D470) General Fund (100) Non-Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by $452,200. 2. Increase the expenditure authority in the Non-Departmental (D470) General Fund (100) Non-Recurring (NRNP) budget in the line “D5 – Community Solutions Funding” (4765) by $452,200. Donation funds are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 57. AMEND PREMIUM PAY RATES Approve the Maricopa County Premium Pay Rates effective 11/6/2024. Human Resources recommends increasing the Behavioral Health Technician, Emergency Medical Technician, and Medical Assistant 1st shift weekend differential, adding a non-correctional health care weekend differential to address harder-to-staff weekend shifts, and adding MCSO licensed clinicians (Behavioral Health Co-responders) to Correctional Healthcare 3rd shift, weekend, and day off differentials. These premium pay rates apply to the County’s elected offices, appointed departments, the Judicial Branch of Maricopa County, which receives funding from Maricopa County, the Flood Control District of Maricopa County, and the Maricopa County Library District (Special Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on April 11, 2018. Hollyhock Street, Surprise, AZ. The improvements were purchased by Maricopa County Head Start Program in June 2016 utilizing grant funds from U.S. Department of Health and Human Services/Administration for Children and Families/Office of Head Start. Improvements to the location were required to ensure Head Start performance standards were met. The grant award is not a mandated function but provides a benefit to the citizens by strengthening the readiness of the community, to prepare for, respond to, and recover from a public health emergency and/or disaster. The grant award is non-competitive and a 10% in-kind or soft match is required. Maricopa County accomplishes this through the use of general funded employees, professional and outside service contracts, epidemiological data software and warehouse space. Awards were funded by grants from the Centers for Disease Control and Prevention (CDC) of the U.S. Department of Health and Human Services (HHS). Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. AQ-2024-002-RULE 335 (ARCHITECTURAL COATINGS) Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for December 11, 2024, at 9:30 a.m. to solicit comments on the proposed revision of Maricopa County Air Pollution Control Regulations, Rule 335 (Architectural Coatings) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed amendments to the rule and to approve submission of the amended rule as a revision to the Arizona SIP. Rule 335 establishes limits for emissions of volatile organic compounds (VOCs) from architectural coatings. Rule 335 applies to any person who supplies, sells, offers for sale, or manufacturers any architectural coating for use within Maricopa County, as well as any person who applies or solicits the application of any architectural coating within Maricopa County. The rule was adopted in July 1988 and has gone through one revision in September 2013. The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 335 to lower many of the VOC content limitations in the rule and to add additional VOC content limitations to the rule to reflect standards in the Ozone Transport Commission Model Rule “Architectural and Industrial Maintenance (AIM) Coatings”. Revised Rule 335 will be considered a contingency measure for achieving the 2015 National Ambient Air Quality Standards (NAAQS) for ozone as required by Section 172(c)(9) of the Clean Air Act. As such, the revised rule will become effective upon a determination by the EPA that either the Phoenix-Mesa nonattainment area failed to attain the 2015 ozone NAAQS by the attainment date or failed to make reasonable further progress. The purpose of Rule 313 is to limit particulate matter emissions from incinerators, burn-off ovens, and crematories. This rule was last revised in 2012 and was adopted into the SIP in 2014. The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 313 to update, enhance, and clarify the rule. Additionally, MCAQD plans to replace SIP Rule 35 (Incinerators) and SIP Rule 313 with the revised rule to update the SIP. This action is related to the September 2017 Arizona SIP revision submittal titled “Revisions to the Arizona’s State Implementation Plan” which requested the withdrawal and replacement of MCAQD’s two-digit SIP approved rules with current three-digit rules to update the Arizona SIP. AQ-2024-008-RULE 203 (EMISSION REDUCTION CREDIT (ERC) GENERAL REQUIREMENTS) Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for December 11, 2024, at 9:30 a.m. to solicit comments on the proposed creation of Maricopa County Air Pollution Control Regulations, Rule 203 (Emission Reduction Credit (ERC) General Requirements). Following the public hearing, the Board is requested to adopt the proposed rule. In response to a shortage of ERCs in Maricopa County, the Maricopa County Air Quality Department (MCAQD) recently revised Rule 204 (Emission Reduction Credit (ERC) Generation, Certification, and Use) and created Rule 205 (Emission Offsets Generated by Voluntary Mobile Source Emission Reduction Credits). The purpose of the Rule 204 revision and the Rule 205 creation was to implement mechanisms for the generation and certification of ERCs from nontraditional (non-permitted) sources in Maricopa County. While the two rules regulate different nontraditional sources of ERCs they contain many similar provisions that address general ERC requirements. In an effort to consolidate general ERC requirements into one rule MCAQD is proposing to create a new rule, Rule 203. MCAQD is proposing to include general use, fee, and Arizona Emissions Bank registration requirements in Rule 203. In addition, MCAQD is proposing to include the application and certification provisions for ERCs created through traditional (permitted) sources in Rule 203. Currently, these provisions are contained in Rule 204. Removing them from Rule 204 and incorporating them into Rule 203 will improve the overall county ERC program. Rules 204 and 205 will include ERC provisions for nontraditional sources while Rule 203 will include ERC provisions for traditional sources. (C-85-25-020-X-00)

116. IGA WITH THE CITY OF MESA FOR PECOS ROAD BASINS AND STORM DRAIN IMPROVEMENTS Approve an Intergovernmental Agreement (IGA) FCD 2024A005 for Design, Rights-of-Way Acquisitions, and Utility Relocations of the Pecos Road Basins and Storm Drain Improvements (PROJECT) between the City of Mesa (CITY) and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date, or upon PROJECT completion, whichever occurs first. Pecos Road Basins and Storm Drain Improvements (PROJECT) is located in the developed urban area within the City of Mesa (CITY). The PROJECT is intended to mitigate excess stormwater runoff that impacts existing and proposed residences and businesses by using new storm drains, basins, and other drainage features to convey stormwater to the Ellsworth Channel. The proposed improvements were studied as part of the East Mesa Area Drainage Master Plan Update (EMADMPU) prepared in November 2013, and in 2015 with a concept design contracted by the DISTRICT. The EMADMPU and the concept design provided solutions to mitigate the flood hazards in the area including the drainage improvements along Pecos Road from the Meridian Road alignment to Ellsworth Road. Project design, right of way acquisition and utilities relocation are the next steps for implementing the drainage improvements for this area, with the CITY as the lead agency. On January 25, 2023, the Board of Directors adopted Resolution FCD 2022R002 (C-69-23-030-X-00) to prepare an IGA for this project. The estimated cost for this Project is $16,000,000 and the PROJECT cost will be shared between the DISTRICT and the CITY 65%/35% making the DISTRICT cost share $10,400,000. The Library District and the City of Litchfield Park are entering into a new IGA to establish the terms and conditions under which the parties will continue providing library services at the existing library.
