Anderson, Anderson Development Engineering / Secure RV & Boat Storage, LLC Request: Special Use Permit (SUP) for an RV and boat storage facility in the Rural-43 zoning district Site Location: Generally located south of Durango St. and east of Tuthill Rd. in the Buckeye area Commission Recommendation: On 12/04/25, the Commission voted 8-0 (motion by Commissioner Leighton D4, seconded by Commissioner Toma D4) to adopt a motion recommending the Board of Supervisors approve SU250004 subject to conditions ‘a’ – ‘m’: a. Development of the site shall be in substantial compliance with the site plan entitled Secure RV and Boat Storage consisting of two (2) full size sheets dated October 20, 2025 and stamped received October 31, 2025, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the narrative report entitled Buckeye Secure RV & Boat Storage consisting of ten (10) pages dated October 20, 2025, and stamped received October 31, 2025, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 3. Detailed Grading & Drainage Plans and Final Drainage Report must be submitted with the application for Building Permit. d. Prior to issuance of building permits, a lot combination shall be processed for all four (4) parcels. e. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. The Special Use Permit is valid for a period of 25 years and shall expire on January 28, 2051, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. g. Shade canopies for RV storage shall be limited to a max. 25 height. h. The SUP shall be subject to the following amended development standards: 1. Minimum Front Yard Setback 3 Feet 2. Minimum Side Yard Setback 3 Feet 3. Minimum Rear Yard Setback 3 Feet 4. Minimum Lot Width 48 Feet 5. Maximum Lot Coverage 90% (Only allowed for the use of shade canopies) 6. Site Enclosure/Screening Min. 6’ Chain Link Fence with 80% opacity 7. Permitted Uses Outdoor RV and Boat Storage with ancillary uses. i. All lighting associated within the special use permit area shall be in conformance to the Maricopa County Zoning Ordinance Section 1112. All outdoor lighting, including lights underneath shade canopies, must be shielded so that illuminated is directed downward at 20 degree angle or less beneath the horizontal plane at the bottom of the light source and so that light does not trespass onto adjacent properties. All shielding must be proximate to and within one foot of the light source. Lighting shall be shut off by 9pm nightly. j. All signage associated to the special use permit shall be in conformance with the Maricopa County Zoning Ordinance Section 1401 k. Non-Compliance with any Maricopa regulations will be grounds for possible revocation of this special use permit pursuant to the process set forth in the Maricopa County Zoning Ordinance. l. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. m. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning exiting on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the special use permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with conditions, or the expiration of the special use permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the special use permit. The special use permit enhances the value of the property above its value as of the date the special use permit is granted and reverting to the prior zoning results in the same value of the property as if the special use permit had never been granted. The site contains areas of regulated floodplains (FEMA Zone AE). 3. The impact of the extensive quantity of fill in the floodplain will require analysis to determine its impact on the current floodplain delineations. Development of the site for the intended use may require re-delineation of the floodplain through the FEMA CLOMR/LOMR process (administered through the Flood Control District). Regulatory flood elevations remain effective until such time that LOMRs become effective. 5. Traffic Study/Statement must be submitted with future plan of development entitlement application(s). See following link to MCDOT Traffic Impact Manual. (RDM 7.1.4) https://www.maricopa.gov/DocumentCenter/View/303. 6. Off-site roadway improvements, including additional R/W dedication(s) may be required pending the MCDOT approved Traffic Impact Study/Statement. 7. The above comments do not include identification of utilities or underground facilities within or adjacent to the required right-of-way that may have prior rights and/or require relocation. 8. Given the sites proximity or access to I-10, the applicant should inquire about any concerns with ADOT via their red-letter process (e-mail redletter@azdot.gov). 9. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. d. Prior to any precise plan of development approval, the applicant shall submit to the Maricopa County Planning and Development Department confirmation of service by Hassayampa Utility or other water and sewer service provider for the site an approved Certificate of Convenience and Necessity (CC&N) issued by the State of Arizona. e. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. The applicant or developer shall coordinate with both Arizona Game & Fish Department and the State Historic Preservation Office throughout the development of this site conducting any requested study deemed necessary by these organizations. g. Any access easement though state trust land to access any part of the site must be coordinated and applied for with ASLD at https://land.az.gov/applications-permits. h. The following IND-3 IUPD development standards shall apply to this site: 1. There shall be a maximum height of 40’ for commercial buildings. 2. There shall be a maximum height of 60’ for hotels, resorts, amusement parks, and other hospitality oriented buildings. 3. There shall be a maximum height of 80’ for industrial structures. 4. There shall be a maximum height of 150’ for energy production structures. 5. There shall be a maximum lot coverage of 75%, and solar panel arrays, battery storage containers, ancillary electric generation structures, and outdoor data center cooling equipment shall not contribute to lot coverage calculations. 6. There shall be one loading/unloading space for every 250,000 square feet of data center floor area. 7. A solid masonry wall not less than 6’ in height shall be required to screen industrial outdoor uses and perimeter of industrial sites only when adjacent to rural/residential zoning districts, public streets, or state trust land. 8. There shall be one parking space for every 5,000 square feet of floor area for data centers. 9. Billboards shall only be permitted in a designated area 300’ on either side of the Interstate-10 freeway only in the southeast arm of the site identified in the attached legal description. 10. Any heavy industrial land use or uses involving industrial outdoor storage shall be prohibited within a quarter of a mile of the Interstate-10 freeway. 11. Structures used for energy production, storage, or the cooling of data centers may take place outside of an enclosed building. 12. All uses that do not require a special use permit shall be allowed on this site, including data centers. i. Noncompliance with any of the conditions assigned to the approval of this Zone Change by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. j. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. This must include dust control, regular maintenance and repair of road surfacing. f. Use of the hay squeeze is limited to on-site between the two haybale storage areas, weekdays only between 8AM 4PM. g. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. h. 10. ASSESSOR DATA SALES FEE SCHEDULE ELIMINATION Approve the elimination of the Assessor’s Office Data Sales fee schedule. Currently the Assessor’s Office charges a fee for data provided to our customers based on a fee schedule adopted by the Board in 2008. Historically the Assessor’s Office budgets $50,000 for Data Sales revenue yearly. This action would eliminate that fee schedule and the Assessor’s Office will provide complimentary data directly accessible on Assessor’s website for customer use. ABSTRACT OF THE ROLL CONTAINING THE VALUATIONS BY TAXING JURISDICTIONS OF ALL PROPERTY IN THE COUNTY Pursuant to A.R.S. §42-15155, receive the filing by the Clerk of the Board of the abstract of the roll containing the valuations by taxing jurisdictions of all property in the County including the total personal property tax roll as provided by A.R.S. §42-17053. The abstract was prepared by the Assessor's Office and transmitted to the Clerk of the Board. The complete assessment of all parcels of real estate in Maricopa County was compiled by the Assessor's Office. Notification of the completed roll including all detailed information was received in the Clerk of the Board's Office on December 19, 2025. The complete roll for tax year 2026 is available on the Assessor's secured database, and on microfiche, and is available upon request. ACCEPT FUNDS FROM ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR REIMBURSEMENT OF TITLE IV-D CHILD SUPPORT ACTIVITIES Accept the FY 2026 grant and associated revenue in the amount of $1,200,000 for the purpose of reimbursement from Arizona Department of Economic Security for Title IV-D child support activities performed by the Clerk of the Superior Court. The grant award begins on July 1, 2025 and ends on June 30, 2026. Authorize the Chair to sign all documents related to these grant funds, as applicable. The Clerk of the Superior Court indirect rate for FY26 is 44.62%, but the grantor has a cap of 66% of the total indirect cost recovery. Total grant indirect costs are estimated to be $370,239.25 recoverable and $190,729.31 not recoverable. Funds are all utilized for personal services. Also, pursuant to A.R.S. §42-17106, approve appropriation adjustments resulting in a net increase to revenue and expenditures of $200,000 in FY2025-26 Clerk of the Court (160) Grants Fund (216) Operating (OPER) budget. Approval of this item will result in an overall grant funds appropriation of $1,200,000 for revenues and expenditures in the Clerk of the Court (160) Grants Fund (216) Operating (OPER) budget. Grant revenues are not local revenues for the purpose of constitutionals expenditure limitation, and therefore, expenditure of these revenues is not prohibited by the budget law. This request does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable. Future ongoing cash contributions are not required after the grant period. The grant award is a mandated function, the Clerk’s Office statutorily prescribed duties includes providing programs to assist in the establishment, modification, and enforcement of child support. The Clerk’s Office engages in court-related records management and financial services to support the court in the administration and processing for support-related activities. The award is non-competitive, as we are the only entity statutorily prescribed to perform these activities. If awarded, the department will absorb the costs of the grant award totaling $190,729.31. FY26 ARIZONA DEPARTMENT OF PUBLIC SAFETY ANTI-HUMAN TRAFFICKING GRANT Approve the application and acceptance of grant funds from the Arizona Department of Public Safety to enhance law enforcement services and programs that reduce human trafficking within the state, as allowed in Senate Bill 1735, not exceeding $400,000. These grant funds are intended to be used exclusively to reimburse personnel, travel, training, and software expenditures related to the prosecution of human trafficking. The grant award begins on July 1, 2025 (retroactively), and ends on June 30, 2026. Authorize the Board of Supervisors Chair, or designee, to sign all documents related to these grant funds, as applicable. Grant revenues are not ”local” revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The Maricopa County Attorney’s Office’s indirect rate for FY26 is 18.850%. The grantor allows 0% for indirect cost recovery. Total grant indirect costs are estimated to be $75,400 for this award. Total grant indirect costs are estimated to be $0 recoverable and $75,400 not recoverable. The grant is a one-time award with no expectation of continued funding. This is MCAO’s third grant award from this grantor for human trafficking. There is no match requirement for this funding. No future contributions are required with this funding. This grant provides funding for a Prosecutor, Paralegal, and Criminal Intelligence Analyst within MCAO to prosecute human trafficking cases. It will also fund training and travel for grant-funded staff and software to assist in prosecution efforts. This grant award is competitive. INTERDEPARTMENTAL AGREEMENT WITH MARICOPA COUNTY DEPARTMENT OF PUBLIC HEALTH FOR FELONY DIVERSION PROGRAM EXPANSION Approve the Interdepartmental Agreement (IDA) between the Maricopa County Attorney’s Office (MCAO) and the Maricopa County Department of Public Health (MCDPH) to support the Felony Diversion Program Expansion (FDP Expansion). This agreement formalizes collaboration to deliver coordinated, evidence-based services that promote recovery, reduce recidivism, and improve public health outcomes for individuals referred by MCAO for Felony Diversion. Under the FDP Expansion framework, MCAO and MCDPH will jointly support treatment, harm reduction, and case management through approved providers. Term: December 1, 2025 – November 30, 2026 (with option to extend). Funding: Not-to-exceed $245,470.92 for all program activities, including case management, harm reduction, family support, administrative coordination, and related expenses. MCDPH funding is only applicable to participants residing in Maricopa County at the time of service initiation. MCAO and MCDPH have a long-standing partnership addressing substance use disorders, including the Opioid Use–Felony Diversion Program Pilot (C-19-23-051-X-00). GRANT FUNDING FROM ARIZONA STOP VIOLENCE AGAINST WOMEN GRANT FOR SAFE DOMESTIC VIOLENCE INVESTIGATOR YEAR 3 Approve the application and acceptance of grant funds from the State of Arizona Governor’s Office Youth, Faith, and Family for the Arizona STOP (Services, Training, Officers, and Prosecutors) Violence Against Women Grant for $149,927. These grant funds provide a third year of funding for an Investigator position within MCAO’s Family Violence Bureaus. This grant agreement, GR-STOP-GOYFF-010124-11Y3, will commence on January 1, 2026 (retroactively), and terminate on December 31, 2026. The grant allows a 15% rate for administrative or indirect costs. The Maricopa County Attorney's Office FY 2026 composite indirect cost rate is 18.850%, or $28,261.24. The recoverable indirect cost is 0 due to budget constraints, and $28,261.24 is non-recoverable. The non-recoverable indirect costs will be covered by the departmental general fund budget. MCAO has a cash equivalent match of $49,976 during the grant award period and has general fund resources to provide this match. This grant is competitive and does not require ongoing cash contributions after the grant period end date. Authorize the Board of Supervisors Chair, or designee, to sign all documents related to this award. The FY26 reimbursement funding begins October 1, 2025, and will terminate September 30, 2026. The Sheriff’s Office indirect cost rate for FY26 is 27.66%. Unrecoverable indirect costs have been calculated as up to $49,025.14 The unrecoverable indirect cost of up to $49,025.14 will be covered by the department General Fund. This agreement is recurring, non-competitive and does not require a match. The agreement does not require on-going cash contributions after the period end date. This is not a mandated function although it supports the MCSO public safety mandate to identify and target for prosecution criminal enterprise groups responsible for drug trafficking, money laundering, alien smuggling, crimes of violence such as murder and aggravated assault, robbery, and violent street gangs, as well as to intensely focus on the apprehension of dangerous fugitives where there is or may be a federal investigative interest. The FFY26 reimbursement funding begins October 1, 2025 and will terminate September 30, 2026. The funding award is recurring and was awarded to the Sheriff’s Office the last six years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY26 is 27.660%, applicable to the award amount of $22,155.25. There are no capital expenses, for an indirect cost base of $22,155.25 and indirect costs of $6,128.14. The $6,128.14 in indirect costs will be absorbed by the General Fund. The grant award begins upon approval and ends on January 31, 2027. In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-Recurring Non-Project (NRNP) appropriation group by $15,000 in Fiscal Year 2026. The grant allows a 0% rate or $0 for indirect costs. The Maricopa County Department of Finance has calculated the Fiscal Year 2026 indirect cost rate at 12.83% or $1,924.50. The recoverable cost rates for administering this grant are $0 and the Animal Care and Control will absorb the non-recoverable indirect cost of $1,924.50 into the department’s operating budget in the current fiscal year. This grant is non-recurring, and a cash or in-kind contribution is not applicable. There are no future or ongoing contributions required following the grant period. Funding for this agreement is provided by a grant from PetSmart Charities and was competitively bid. The grant cannot be used in any way that decreases the allocation or budget of governmental funds for animal welfare purposes. This request will increase the grant budget appropriation in the Animal Control Grants Fund (573) to accommodate revenues and expenditures authorized by the grant. GRANT FUNDS FROM ARIZONA STATE DEPARTMENT OF HOMELAND SECURITY FOR EMERGENCY PLANS SOFTWARE Authorize Emergency Management to apply for grant funds from Arizona State Department of Homeland Security, (FFY26 SHSGP), in the not-to-exceed amount of $68,000 for the MaricopaRegionPrepares.com subscription renewal. This is a Continuity of Operations Planning (COOP) software package for all jurisdictions within Maricopa County. The grant is intended to renew the MaricopaRegionPrepares.com subscription. This software tool benefits Maricopa County in developing Emergency Operations Planning (EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG) Planning for local government. The Department was awarded a grant for the software in 2015, we are applying for a grant to cover the cost associated with the maintenance of the system. The grant period for this grant is October 1, 2026 through November 30, 2027. The Maricopa County Department of Finance has calculated the Department of Emergency Management's composite indirect cost rate at 6.98% or $4,746.40. The Department is not allowed to recover indirect costs off of this grant. The amount of unrecoverable indirect cost is $4,746.40. Emergency Management will absorb these indirect costs within their general budget. The grant award is non-recurring, the department has to apply every year however, we have received the grant for the past eight years. The department does not have an in-kind match requirement for this grant. The grant award is not a mandated function, but it is a department strategic goal to have all county departments with a viable Continuity of Operations Plan (COOP). The grant is awarded through the Arizona State Homeland Security Department-State Homeland Security Grant Program (SHSGP), which is a competitive grant program. Maricopa County jurisdictions compete for projects based off the State grant initiatives. Maricopa County has spear headed the grant for the Emergency Operations Plans (EOP)/COOP software project for all county departments and jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring cost of the software maintenance and training funds. Maricopa County does not have to fund any additional costs for the program. Transportation services shall be provided by Valley Metro and administered by Public Transportation Authority (RPTA). Grant application requested amount is $804,040, which funds shall be utilized for the provision of transportation services and do not contain Administrative or Indirect funds. The Human Services Department shall submit the grant application on behalf of the County. If the grant application is approved and Maricopa County is awarded the ALF grant, funds shall be held in trust and RPTA shall administer the grant funds on behalf of the County and will oversee the delivery of transportation services provided by Valley Metro. Receipt of grant funds are recurring on an annual basis and awarded through a competitive process. A cash or in-kind match is not required. Indirect costs are not recoverable as all funds are designated for service delivery. Future or ongoing contributions are not required after the grant period ends. The not-to-exceed amount for this NOA is $3,015,037.00, for a total not-to-exceed amount of $48,806,099.00. The non-competing continuation award period began on December 01, 2025, and runs through November 30, 2026. The original term of this grant began on December 01, 2022, and runs through November 30, 2027. This is a competitive grant award that has been awarded in the past, but at this time, it has not been determined if it will be recurring. There is no cash or in-kind matching requirement. Should the grant cease, ongoing contributions would not be required. All future year funding is based on satisfactory programmatic performance and the availability of funds. This grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 15% indirect cost reimbursement. The MCDPH indirect rate for FY26 is 16.69%. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR DOMESTIC MEDICAL EXAMINATIONS Approve a retroactive Amendment Two (2) by and through the Arizona Department of Economic Security (ADES) and Maricopa County by and through its Department of Public Health (MCDPH) for Intergovernmental Agreement (IGA) DI24-002411 for Domestic Medical Examinations (DME) for legal newly arrived refugees resettling in Maricopa County. Effective upon signature, it is mutually agreed that the Intergovernmental Agreement referenced is amended as follows: 1. PURSUANT TO THE INTERGOVERNMENTAL AGREEMENT (IGA) SECTION 17 AMENDMENTS, THE PARTIES HEREBY AGREE TO AMEND THE AGREEMENT AS FOLLOWS: 1.1 Pursuant to the Scope of Work, Section 17.0, Amendments, the purpose of this amendment is to add the service reimbursement ceiling for the period of October 01, 2025, through September 30, 2026. The IGA term is January 01, 2023, through December 31, 2028. The Dental Sealant grant is competitive and does not require a cash or in-kind match and it is unknown if it will be awarded again. Indirect cost is fully recoverable, and ongoing contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by providing dental sealant services necessary to promote oral health and provide preventive dental services to eligible children in Maricopa County. All program costs are allocated to the grant so there will be no additional burden on the department's operating budget. MCDPH's indirect rate for FY26 is 16.69%. The indirect costs are estimated at $5,941.37, all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year, and the future indirect rates will be collected at the corresponding rate. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. AMENDMENT TO IGA WITH THE CITY OF MESA FOR PECOS ROAD BASINS AND STORM DRAIN IMPROVEMENTS (Supervisorial District No. 2) Approve Amendment No. 1 FCD IGA 2024A005A to Intergovernmental Agreement FCD 2024A005 for the Pecos Road Basins and Storm Drain Improvements project (PROJECT) between the City of Mesa (CITY) and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date. The PROJECT is located in the developed urban area within the City of Mesa along the Pecos Road corridor and is intended to mitigate excess stormwater runoff that impacts existing and proposed residences and businesses by using new storm drain basins and other drainage features to convey stormwater to the Ellsworth Channel. The proposed improvements were studied as part of the East Mesa Area Drainage Master Plan Update (EMADMPU). The proposed project will be designed and constructed for a 10-year level of protection. The PROJECT will consist of basins, storm drains, and other conveyance improvements in the vicinity of Pecos Road from the Meridian Road alignment to Ellsworth Road. IGA WITH CITY OF SCOTTSDALE AND CITY OF PHOENIX FOR DEER VALLEY CHANNEL CROSSING AT SCOTTSDALE ROAD PROJECT (Supervisory District No. 2) Approve Intergovernmental Agreement (IGA) FCD 2025A013 for the Deer Valley Channel Crossing at Scottsdale Road (PROJECT) between the City of Scottsdale (SCOTTSDALE), the City of Phoenix (PHOENIX), and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date, or upon Project completion, whichever occurs first. The PROJECT area is located within the City of Scottsdale. As the design for the Paradise Ridge Drainage Improvements Project evolved, it was determined that further improvements at and on the east side of Scottsdale Road were necessary to capture flows from the Deer Valley Wash and contain and convey them to the Paradise Ridge Improvements project channel, thereby further reducing the existing floodplain west of Scottsdale Road. The work at Scottsdale Road will require a new intergovernmental agreement amongst the DISTRICT, PHOENIX, and SCOTTSDALE to memorialize the roles and responsibilities of the PROJECT PARTNERS for the design and construction, and related activities for a box culvert crossing of Scottsdale Road and necessary improvements upstream of the box culvert including restoration of impacted landscaping and irrigation in the HOA rights-of-way pertaining to the PROJECT. Construction of this PROJECT is the next step in implementing the drainage improvements for this area. The estimated PROJECT cost SCOTTSDALE, PHOENIX, and DISTRICT are sharing is $3,800,000, and will be shared 50%/25%/25% between the DISTRICT and both Cities. Note that pursuant to Arizona Open Meeting Law, Board members may not discuss matters raised under this public comment portion of the meeting; however, an individual Board member may respond to criticism made by those who have addressed the Board, ask staff to review an issue raised or may ask that the matter be placed on a future agenda. Written comments will be summarized at the meeting noting the topic or topics. All written comments will be forwarded to each Board Office for their review.
