7. RULES 321, 360, 370, 371 AND APPENDIX G Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of proposed amendments to Maricopa County Air Pollution Control Regulations, Rule 321: Municipal Solid Waste Landfills; Rule 360: New Source Performance Standards; Rule 370: Federal Hazardous Air Pollutant Program; Rule 371: Acid Rain; and Appendix G: Incorporated Materials. Upon Board approval, this item will become effective March 26, 2014. The Maricopa County Air Quality Department (department) is proposing to revise Rule 321: Municipal Solid Waste Landfills; Rule 360: New Source Performance Standards; Rule 370: Federal Hazardous Air Pollutant Program; Rule 371: Acid Rain; and Appendix G: Incorporated Material by incorporating by reference federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA) and published in the Federal Register: New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2011, to July 1, 2013, in each of the rules and appendix to remain current with federal regulations. The adoption of the proposed amendments to Maricopa County Air Pollution Control Regulations Rules 321, 360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of authority to the department for the implementation and enforcement of the federal regulations and documents. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rule or law was proposed and adopted. The department did not receive any public comments during the public comment period. (C-85-14-009-7-00)

16. ADDITION OF PERMANENT VEHICLES TO THE FLEET Approve a one-time addition to the County fleet for four (4) vehicles to be purchased by the Equipment Services Department for use by the Juvenile Probation Department (JPD) for a total cost not to exceed $96,000. These vehicles are additions to the fleet. Additional operating costs are estimated to be approximately $5,000 per fiscal year per vehicle totaling $20,000 per fiscal year. Vehicle and operating costs will be absorbed in the JPD General Fund operating budget. In addition, approve an exemption from County markings and issuance of non-governmental license plates per A.R.S. § 38-538.03 as these vehicles will be utilized in surveillance operations. Markings are detrimental to the mission. Upon approval of this agenda item and the purchase of these vehicles, vehicle information including year, make, model and vehicle identification number will be provided to the Clerk of Board. These vehicles will be retired at the end of their useful life with no funding from the general fund for the replacement. Two of the vehicles will be assigned to the Juvenile Intensive Probation Supervision Unit (JIPS) and the Juvenile Electronic Technological Surveillance Unit (JETS). Vehicles will be used daily as Probation Officers and Surveillance Officers make daily client contacts in the field. These vehicles will be utilized at the fringes of Maricopa County where officers will have to navigate through dirt and gravel roads and many miles of unpaved roads. The two other vehicles will be utilized as loaner vehicles at the Southeast Facility and Durango Facility. These vehicles are necessary as part of the JPD fleet because they can be used on any given day when other vehicles are being serviced for regular maintenance or biannual inspections. In any given month there are upwards 12-15 vehicles that are due for some type of service; this means that the officers have to utilize a loaner vehicle while their assigned vehicle is in the shop. The services may take anywhere from a day to several weeks at a time. Officer safety comes into play with these loaner vehicles as well. Officers may have to utilize a loaner vehicle when there are circumstances surrounding a field visit where they need to use a car that is unknown to the probationers in that particular area. These loaner vehicles are an essential part of our fleet for the reasons listed. These vehicles are replacements for State of Arizona non-County fleet vehicles that are being retired; thus, these vehicles will now become part of the County fleet. (C-27-14-006-2-00)

18. APPROPRIATED BUDGET ADJUSTMENT Approve increases in the appropriated budget for the Assistant County Manager (950) Department Non-Departmental Grant Fund (249) Non-Recurring, Non-Project (0001) in the amount of $1,116,262 in revenues and expenditures. This appropriation adjustment brings the Assistant County Manager's Department grant revenues and expenditures to the amount of $1,433,950. The appropriation adjustment is necessary because the award amount of the 2013 Edward Byrne Memorial Justice Assistance Grant (JAG) differs from the amount approved in the FY2013-14 Budget Appropriation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, therefore, expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget containing the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-31-14-028-G-00)

31. TERMINATION OF AGREEMENT WITH THE BOEING COMPANY FOR WORKFORCE INVESTMENT ACT EMPLOYED WORKER TRAINING PROGRAM Accept the termination of the financial Agreement with the Boeing Company and Maricopa County, administered by its Human Services Department (HSD) for Workforce Investment Act - Employed Worker Training Program. The agreement is being terminated by mutual agreement because the Boeing Company does not anticipate having additional individuals participate in the Planner Job Role training program as identified in the agreement. Terminating this Agreement will allow the funds to be de-obligated and will be used in other areas of program delivery. Although the agreement with the Boeing Company will be terminated, a partnership will continue as Boeing is an essential partner in the strategic initiatives in the aerospace industry. The termination is effective upon acceptance by the Maricopa County Board of Supervisors. Funds for the agreement were provided through an Intergovernmental Agreement with Arizona Department of Economic Security (DES DE111009001) IGA (C-22-11-021-3) Workforce Investment Act of 1998 (WIA). As such, the funds are subject to all provisions of Public Law 111-5 as well as any guidance issued by the U.S. Department of Labor. The agreement did not contain any County General Funds. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary through a future reconciliation. The agreement amount was $12,000 of which $1,010 was expended, balance remaining is $10,990. De-obligated funds will be diverted to other WIA program activities. (C-22-13-042-3-02)

52. IGA WITH THE TOWN OF GILBERT FOR THE ABANDONMENT OF HIGLEY ROAD NORTH OF STATE ROUTE 202L Authorize the Maricopa County Department of Transportation (MCDOT) Director/County Engineer to request abandonment of Higley Road north of State Route 202L (SR202L) from the Arizona Department of Transportation (ADOT) to the County in accordance with Arizona Revised Statues (A.R.S.) Section 28-7209. The Town of Gilbert is seeking to make improvements to Higley Road approximately 650 feet extending north from SR202L in the fall of 2014. To accomplish this project in a timely manner, the Town needs to acquire Higley Road right of way that is currently under the control of ADOT. However, due to the provisions in state law related to annexation (A.R.S. 9-471), ADOT may not abandon the right of way directly to the Town, but must first be abandon the right of way to the County, and then the Town can subsequently annex the right of way from the County. The first step is to accomplish the ADOT abandonment of Higley Road to the County in a timely manner. Normally under A.R.S Section 28-72029, ADOT must provide four years advance of abandonment to an affected jurisdiction and the pavement must be in such a condition that additional surface treatments and major maintenance are not required for at least five years. However, the same statute allows ADOT and the affected local jurisdiction to waive these requirements by mutual agreement. These waivers are needed to ensure the Town of Gilbert can acquire the right of way to complete their project on Higley Road. Therefore, MCDOT is requesting the Board of Supervisors to authorize the MCDOT Director/County Engineer to official ask ADOT for and agree to waivers from these requirements for the abandonment of Higley Road. The waivers would ultimately be agreed to by the State Transportation Board. The second step will be Gilbert’s annexation of Higley Road approximately 650 feet north of State Route 202L (SR202L) interchange, which will be administered through the normal statutory process and facilitated under a separate agenda item for Higley Road. The Town of Gilbert is the lead agency for the Higley Road project and will be responsible for 100 percent of the cost of the project. The County will have no responsibility, financial or otherwise, for any aspect of this Higley Road design and construction project. Supervisory Districts No. 1 and 2 (C-64-14-100-M-00)

A-3. BUDGET ADJUSTMENT FOR TRANSPORTATION IMPROVEMENT PROGRAM Approve the transfer of FY 2014 expenditure authority from Department of Transportation (640) Transportation Capital Projects Fund (234) Pavement Preservation (PAVE) to Department of Transportation (640) Transportation Capital Projects Fund (234) Transportation Administration (TADM) in the amount of $2,570,000. The subproject Improvements to Buckeye Yard (T387) has been incorrectly associated with the Pavement Preservation class of projects and needs to be associated with the Transportation Administration class of projects. The Buckeye Yard is the Department of Transportation’s facility in the southwest that houses staff and equipment, which is more administrative in nature. This action will resolve an audit finding. F-1. AMENDMENT TO IGA WITH DESERT RESEARCH INSTITUE FOR RAINFALL INFILTRATION LOSSES Approve Amendment No.2 (Intergovernmental Agreement [IGA] FCD 2010A015B) to IGA FCD 2010A015 for the Desert Soil Hydraulic Characterization Project For Rainfall Infiltration Losses between the Desert Research Institute (DRI) and the Flood Control District of Maricopa County (District), revising the terms of the Agreement to remove annual expenditure limits, and increase the total expenditure limit from $320,000 to $363,000. This Amendment No. 2 shall become effective when executed by all parties. This Agreement is a continuing professional relationship and cooperative activity between the District and DRI. The DRI will be responsible for completion of all work items under this IGA. The purpose is 1) to evaluate runoff potential and physically measure infiltration rates on test watersheds in Maricopa County, 2) to develop Green and Ampt parameters using the measured data and compare the results with the District’s current method and a new method for estimating Green and Ampt parameters developed by the USDA Agricultural Research Service, and 3) to apply the developed parameters to test watersheds with the goal of updating the current District procedures for estimating rainfall infiltration. The results are expected to be published and may be used in refining the District’s current hydrologic methodology, if appropriate. To date, three watersheds have been studied: Rainbow Wash, Seven Springs Wash, and Rawhide Wash (still in progress). As an added benefit, the results of these studies have been used to support hydrologic model calibration in the Gillespie ADMS, the Hohokam ADMP, and the Guadalupe FRS Emergency Action Plan update. The Rawhide Wash study will be used to support hydrologic model calibration in the Pinnacle Peak West ADMS and the Lower Indian Bend Wash ADMS. The final watershed to be studied under this IGA is Daggs Wash in western Maricopa County. The results will be used to support the hydrologic model for floodplain delineation studies planned for Daggs Wash and others in the vicinity. An additional $43,000 is needed to accomplish the Daggs Wash study. The DRI is a recognized authority for water resource data collection and analysis in the arid southwest. The information generated by the DRI's ongoing work in conjunction with the U.S. Army Corps of Engineers is vital to the safety of Maricopa County residents, and to the continuing hydrologic studies performed by the District and the maintenance of its flood control structures. Of the District’s current $320,000 cost share under this IGA, $140,446 was paid in Fiscal Years 2011 through 2013. The District the cost share in Fiscal Year 2014 is estimated to be $113,000; and in Fiscal Year 2015 to be $109,540. To accomplish the Daggs Wash study, the IGA not to exceed amount is requested to be increased by $43,000 to a total of $363,000. Payments are to be made monthly. This agenda item impacts all Supervisorial Districts. (C-69-11-026-3-02)
