Development of the site shall be in conformance with the Site Plan entitled “Enchanted Garden”, consisting of two pages, dated August 8, 2021, and stamped received August 10, 2021, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Enchanted Garden”, consisting of seven pages, dated June 15, 2021, and stamped received June 21, 2021, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. At the time of acquisition of building permit(s), retention basin(s) must be designed to drain within 36 hours. If drywells are needed to meet the 36-hour de-watering requirement, dual-chamber drywells will be required because the retention basin stores both offsite and onsite flows. 2. At the time of acquisition of building permit(s), the driveway connection to Carver Road shall be in accordance with the fourth site plan submitted on 8/10/2021. 3. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the MCDOT Roadway Design Manual. 5. Detailed Grading and Drainage Plans showing the new site improvements must be submitted with building permit(s). d. This special use permit is valid for a period of 15-years and shall expire on October 20, 2036, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. The following Hillside and Rural-43 development standards shall apply: 1. Reduced required yards to zero feet only in areas of the lot classified as Hillside to accommodate screening walls, landscaping, and retention along these property lines. And, Rural-43 base required yards in portions of the lot not classified as Hillside. 2. An increase of the maximum allowed height for the reception hall’s tower to 44-feet above original natural grade. 3. Allow use of six-foot tall wrought iron fences without screening materials along the south property line and along 145-feet of the east and west property lines from the south property line northwards, then six-foot high solid block wall extending north on both these sides up to and including the north boundary line. 4. Permit the use of alternative materials in parking areas that conform to County and Maricopa County Department of Air Quality requirements to minimize dust pollution from driveways and parking areas, in lieu of asphalt pavement or concrete. f. The applicant/developer shall submit a “Will-Serve” letter from the City of Phoenix prior to Building Permits, ensuring that the City will provide public water to the site. g. Sound attenuation shall be incorporated in the construction of the reception hall building to maintain exterior sound buffering of 45 decibels from the edge of the property lines. h. Events shall be limited to 8 a.m. to 10:00 p.m. Monday through Thursday and 8 a.m. to 11:00 p.m. Friday through Sunday. There shall be no multiple events occurring on site simultaneously and events shall be spaced a minimum of one hour between each event. i . Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. k. There shall be no outdoor amplified music and the south doors of the reception hall shall be closed during events. l. The east side doors of the reception hall shall be screened by walls and dense landscaping for sound mitigation. m. Outdoor live performances shall be limited to string instruments and/or vocal. Following the public hearing, the Board is requested to adopt the incorporations into the Maricopa County Air Pollution Control Regulations. The Maricopa County Air Pollution Control Regulations contain several rules, Rules 360, 370, 371, and Appendix G, which incorporate by reference federal regulations from Title 40 of the Code of Federal Regulations (CFR). These federal regulations include New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Acid Rain regulations. Every July 1, the U.S. Environmental Protection Agency (EPA) codifies revisions made to these federal regulations during the preceding year. The purpose of this rulemaking is to incorporate by reference the applicable federal regulations as codified on July 1, 2021, and thereby update Rules 360, 370, 371, and Appendix G with any revisions made to the corresponding federal rules during the preceding year. This is necessary in order to continue to comply with the MCAQD’s delegated authority from EPA to implement and enforce NSPS, NESHAP, and acid rain programs in Maricopa County, except for those specific authorities retained by the EPA. After the rules are adopted by the Board of Supervisors, the MCAQD will request delegation authority from the EPA to implement and enforce the federal standards. The FY22 reimbursement funding began retroactively October 1, 2021 and will terminate September 30, 2022. The funding award is recurring. There is no match requirement. The Sheriff’s Office indirect cost rate for FY22 is 14.74%, applicable to the award amount of $19,372. There are no capital expenses, for an indirect cost base of $19,372 and indirect costs of $2,855.43. The $2,855.43 in indirect costs will be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends. This is not a mandated function. The funding supports the MCSO public safety mandate and will be used for response to serious incidents involving hostages and/or individuals which are identified as being involved in serious criminal offenses and/or terrorist activities. ACCEPT FUNDING FROM US DEPARTMENT OF JUSTICE, FEDERAL BUREAU OF INVESTIGATION FOR THE DESERT HAWK VIOLENT CRIME TASK FORCE Approve acceptance of funding per the annual Notice of Limits for FY22 State and Local Overtime Reimbursements for a maximum total amount of up to $154,976 in reimbursement funding from the US Department of Justice, Federal Bureau of Investigation for officers assigned to FBI managed task forces. The FY22 reimbursement is retroactive to October 1, 2021 and will terminate September 30, 2022. The FBI Desert Hawk Violent Crime Task Force (DHVCTF) agreement commenced October 1, 2017 and continues for an indefinite period until terminated by one or both parties and was approved by the Board of Supervisors on December 13, 2017 under C-50-18-038-G-00. The Sheriff’s Office indirect cost rate for FY22 is 14.74%. Unrecoverable indirect costs have been calculated as up to $22,843.46. GOLF CART PERMANENT ADDITIONS TO THE FLEET Approve a permanent addition to fleet of two Golf Carts for the Southeast Complex and the Downtown Complex as follows: Two gas-powered, street legal, four-seat golf carts, with lockable storage to be used by Judicial Branch Security Department (JBSD) with an estimated cost of $18,500 each, plus taxes and any make-ready costs. The original acquisition costs and estimated annual operating costs of $700.00 for each golf cart are to be paid by the existing General Fund, Superior Court budget. As permanent additions to the County vehicle fleet, the Judicial Branch is requesting that future replacements be addressed by County Equipment Services through established policies and procedures. The permanent addition to the fleet of the requested golf carts will allow Judicial Branch Security to more efficiently respond to requests for services and emergencies throughout the Judicial Branch locations at both the Southeast and Downtown Complexes. The Judicial Branch Southeast Court Complex is comprised of three facilities and five parking lots in a four-city block radius (Southeast Main, Southeast Juvenile Court, Southeast Detention, three secured staff parking areas and two public parking lots). The Southeast Campus is also in the middle of an expansion project, and when complete it will include four Maricopa County Justice Courts and two Adult Probation Office sites consolidated into the existing campus. The need for enhanced mobility for that large Court Complex is even more apparent. The golf cart will be secured in a security-controlled, fenced-in parking lot on the Campus wen not in use. A second golf cart is required for the Judicial Branch Downtown Court Complex which is comprised of seven facilities and three secured parking areas in a 10-city block radius ( Southcourt Tower, East Court Building, Central Court Building, West Court Building, Old Courthouse, Downtown Justice Center, and Luhrs Adult Probation Office). AMENDMENT TO AGREEMENT FOR DONATION FROM THE ARIZONA PROPANE GAS ASSOCIATION (APGA) FOR THE PROPANE FIRE PIT PROGRAM Approve and authorize the Chairman to execute an Amendment 3 to the Agreement between the Maricopa County Air Quality Department (MCAQD) and the Arizona Propane Gas Association (APGA) for APGA to provide a restricted donation of matching funding to MCAQD for the Propane Fire Pit Program and accept the funds. This Agreement will provide for continued matching funds to support MCAQD’s Propane Fire Pit Program which encourages the exchange of wood burning fire pits for cleaner burning propane gas devices, to aid in the reduction of particulate matter 2.5 (PM 2.5) during the wood burning season. This program will be marketed to all County residents and will offer through e-mail a voucher which can be taken to select Home Depot stores within Maricopa County for a discount on a propane fire pit. There will be a $50.00 discount provided by the County and a $25.00 discount provided by the APGA, for a total of $75 per program participant. The term of this Amendment shall commence on the Effective Date and end no later than April 1, 2022. PM 2.5 is an EPA pollutant that is known to cause damaging health issues, including acute asthma symptoms leading to hospitalization and heart disease, as the tiny pollutant can deposit deep into the lungs and enter the blood stream. THE PETSMART CHARITIES GRANT AGREEMENT AND BUDGET ADJUSTMENT Approve the application and acceptance of grant funds from The PetSmart Charities Grant Agreement (the “Agreement”) in the amount not-to-exceed $5,000 for the purpose of supporting the response to the impact of the recent Monsoon storms to Maricopa County Animal Care and Control 's facility. The grant award begins upon execution through 03/23/2022. Authorize the Chairman to sign the Agreement and authorize the Animal Care and Control appointed authority and/or designee to sign other grant-related documents, such as reporting requirements, etc., as applicable to administer the grant. AMENDMENT TO IGA WITH ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM FOR PAYMENT SERVICE Retroactively approve Amendment No. 13 to an Intergovernmental Agreement between Arizona Health Care Cost Containment System (AHCCCS) and Maricopa County by and through the Department of Correctional Health Services (CHS) in the not-to-exceed amount of $240,000. The purpose of this amendment is to extend the IGA for one year. This amendment is effective from July 1st, 2021 through June 30th, 2022. All other terms and conditions of the Intergovernmental Agreement remain in full force and effect. This agreement is for third party claims payment services provided by AHCCCS to CHS. AHCCCS processes all outside provider claims incurred due to the incarcerated patient population needing medical services from a health care provider outside of the jail system. These patients are currently booked into the jail and under the care of CHS. 40. COVID 19 VACCINE INCENTIVE EXTENSION Extend the COVID 19 vaccine incentive that was approved by the Board on 9/1/21 (C-31-22-118-X-00) to 11/30/21. Employees must submit proof of being fully vaccinated to Human Resources by close of business 12/8/21. For employees who submit proof of being fully vaccinated by the original deadline of 11/10/21, it is anticipated that the $100 incentive and credit for the recognition leave will appear on the 11/24/21 paycheck. For employees who submit their proof by 12/8/21, it is anticipated that the $100 incentive and credit for the recognition leave will appear on the 12/22/21 paycheck. Recognition Leave given under this incentive will not count towards a department’s 10% cap granted under the Employee Leave Policy (HR2415). This Recognition Leave must be used by 12/31/2022. The County Manager or designee may approve administrative exceptions to this incentive that are consistent with the intent of the incentive program. This incentive applies to the County’s elected offices, appointed departments, and the Flood Control District of Maricopa County and the Maricopa County Library District (Special Districts). NOTICE OF AWARD WITH HEALTH RESOURCES AND SERVICES ADMINISTRATION FOR HEALTHY START INITIATIVE (HSI): ELIMINATING DISPARITIES IN PERINATAL HEALTH Approve Notice of Award (NOA) No. 3 H49MC00174-21-01 for Healthy Start Initiative (HSI): Eliminating Disparities in Perinatal Health, from Health Resources and Services Administration (HRSA) to Maricopa County through its Department of Public Health (MCDPH), South Phoenix Healthy Start (SPHS), for the Healthy Start Supplement: Community Based Doulas. The award is in the additional amount of $120,581 for the budget period April 1, 2021 through March 31, 2022. The project period is April 1, 2019 through March 31, 2024. The Department of Public Health’s indirect rate for FY22 is 17.97%. Indirect is estimated at $18,368, all of which is recoverable. Departmental Indirect Rates are reestablished at the beginning of each fiscal year and the future Indirect Rate will be collected at the corresponding rates. The HSI grant award is reoccurring and has been awarded to the department since 2002. This grant does not require an in-kind match, indirect cost is fully recoverable and ongoing cash contributions are not required. Healthy Start services are not a mandated function but provide a benefit to the citizens in perinatal case management services, health education events and learning opportunities, and community referrals to women and their families in the large urban Maricopa County communities of South Phoenix, Maryvale, and Laveen. The grant award is competitive. All program costs are allocated to the grant so there will be no additional burden on the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. ACCEPTANCE AND USE OF GIFT CARDS FOR THE TUBERCULOSIS CONTROL INCENTIVE PROGRAM Approve the acceptance and use of gift cards provided by Arizona Department of Health Services (ADHS), to Maricopa County by and through its Department of Public Health (MCDPH), Tuberculosis Control Program. The MCDPH TB Clinic has received a donation of 50 Bashas cards at $10 each for a total value of $500. Gift card and voucher donations have been received by the TB program for a number of years. We expect them to continue. Cash and/or in-kind match is not applicable, nor will ongoing cash contributions be required should they cease to be provided. TB Services are a mandated function and donations such as these incentivize the treatment program. Awareness and treatment of TB patients is a benefit to our citizens. To our knowledge, the donations to the TB program are not given in a competitive manner. Program costs associated with the donations are absorbed by the TB programs grant budget. Administration costs are absorbed the department’s operating budget. MCDPH’s indirect rate for FY22 is 17.97%. This in-kind donation does not allow for indirect, therefore, indirect expense estimated at $90.00 are not recoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This donation does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. AGREEMENT WITH MARICOPA ASSOCIATION OF GOVERNMENTS (MAG) ARTERIAL LIFE CYCLE PROGRAM PROJECT FOR CONSTRUCTION OF NORTHERN PARKWAY: DYSART AND EL MIRAGE OVERPASSES Approve the Project Agreement (No.22-ACI-NOR-10-03-H) between Maricopa County Department of Transportation (MCDOT) and Maricopa County and Maricopa Association of Governments (MAG) for the construction of Northern Parkway Overpasses at Dysart Road and El Mirage Road. Approval of this request will authorize the acceptance and expenditure of the funds in the amount of $18,797,676. In November 2003, the Maricopa Association of Governments (MAG) approved a Regional Transportation Plan (RTP) consisting of highway and public transit projects, among other projects. Some of the projects are funded through a transportation excise tax, approved by the Maricopa County voters in November 2004. Other projects are funded with federal-aid highway funding, based on their eligibility. MAG is required by law to adopt a program that provides for life cycle management of the funding and programming of the Arterial Life Cycle Program (ALCP), as part of the RTP. This project is the continuation of the Northern Parkway corridor and is eligible for regional funding (Surface Transportation Program Funds) on a reimbursable basis. This portion of the project includes an arterial capacity improvement for the construction of the overpasses at Dysart and El Mirage Roads along Northern Parkway. The total reimbursement amount is eligible in fiscal years 2021 and 2022. This agreement identifies and defines the responsibilities of MCDOT and MAG for the construction and financing of the project as established in the Alternative Life Cycle Program (ALCP) which allows for the reimbursement of the federal funds distributed through MAG for this portion of the Northern Parkway project. IGA WITH THE CITY OF BUCKEYE FOR CASE MANAGEMENT SERVICES Approve a financial Intergovernmental Agreement between the City of Buckeye (“Subrecipient”) and Maricopa County, administered by its Human Services Department. Through this Agreement the Subrecipient will provide long-term case management services related to rental and utility assistance and other Department services. The County shall provide the Subrecipient with $75,000 for the services. Also request authorization for the Chairman to sign Administrative Change Orders as outlined in Section 5.0 Administrative Change Orders: 5.1 The Chairman of the Board of Supervisors is authorized upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change shall be approved and fully executed by the Chairman of the Board of Supervisors and the City. Administrative Change Orders may address any of the following areas: 5.1.1 Modifications to the project timeline if the last day of the project timeline is within the Agreement term; 5.1.2 Modifications to Budget line items if the Agreement Amount remains unchanged; 5.1.3 Modifications required by federal, state, or County regulations, ordinances, or policies; and 5.1.4 Modifications to Administrative requirements such as changes in reporting periods, frequency of reports, or report formats required by the U.S. Department of Treasury or local regulations, policies, or requirements. The Agreement term shall be retroactive to October 1, 2021 through June 30, 2022. The funding for this Agreement is provided by the Catalog of Federal Domestic Assistance (CFDA) 21.023 American Rescue Plan Act Emergency Rental Assistance allocated to Maricopa County. APPROPRIATION ADJUSTMENT FOR A.R.S. § 42-1733 In accordance with A.R.S. §42-17106(B), authorize the following budget appropriation adjustment(s): Increase the revenue and expenditure appropriation in the FY 2022 Sheriff’s (D500) Grant Fund (251) Non Recurring (NRNP) budget by $2,085,800. The MCSO is designated to receive a State funding appropriation for FY 2021-2022 per S.B. 1823 of the Fifty-fifth Legislature to use in accordance with A.R.S. § 41-1733 for a school safety pilot program for interoperability. The State Treasurer is charged with administering this fund and funds are eligible to the sheriff of a county that establishes a school safety pilot program and may be used only for a school safety pilot program that meets criteria outlined in the Statute (attached). This will be pass through funding for authorized school interoperability projects. This state appropriation for a pilot school safety program may be reoccurring. There is no cash or in-kind match for this appropriation, nor is it applicable. Indirect cost recovery is not applicable. Future ongoing cash contributions are not applicable or are unknown.
