This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-20-10-084-G-00)

30. EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT AND MEMORANDUM OF UNDERSTANDING 1. Approve the acceptance of grant funding from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance for the Edward Byrne Memorial Justice Assistance Grant (JAG) Program FY 2010 Local Solicitation in the total amount of $1,925,549. 2. Approve a Memorandum of Understanding (MOU) between Maricopa County; and the Cities of Glendale, Mesa, and Phoenix. This MOU is required pursuant to the grant application requirements. This MOU also includes a negotiated reallocation to Maricopa County of $306,460 and $1,619,089 in funds to be reallocated to the Cities of Glendale - $164,499; Mesa - $242,540; and Phoenix - $1,212,050. Funds received by Maricopa County will be used to support projects in Adult Probation, County Attorney’s Office, Juvenile Probation, and the Sheriff’s Office. Further, grant awards are to be expended within a four year period of time, starting October 1, 2009 and ending not more than 48 months later. The JAG grant does allow up to 10 percent of the award for costs associated with administering JAG funds, and Maricopa County has been designated as the fiscal agent for this consortium of municipalities. The overall grant budgets for the departments receiving funding will be adjusted as necessary to accommodate this grant through a future reconciliation. 3. Approve the waiver of indirect costs above 10% of funding allocated to County Departments (Adult Probation, County Attorney, Juvenile Probation, and Sheriff’s Office). Adult Probation will receive a total of $67,421; at their FY 2010-11 indirect rate of 10.8%, their indirect costs are $6,619.52 of which $6,129.18 is recoverable and $490.33 is unallowable/waived. The County Attorney’s Office will receive a total of $117,700; at their FY 2010-11 indirect rate of 15.3%, their indirect costs are $16,371 of which $10,700 is recoverable and $5,671 is unallowable/waived. Juvenile Probation will receive a total of $53,918; at their FY 2010-11 indirect rate of 32.8%, their indirect costs are $16,077.37 of which $4,901.64 is recoverable and $11,175.73 is unallowable/waived. Sheriff’s Office will receive a total of $67,421; at their FY 2010-11 indirect rate of 14%, their indirect costs are $8,580.85 of which $6,129.18 is recoverable and $2,451.67 is unallowable/waived. Total indirect costs are $47,648.74 of which $27,860 is recoverable and $19,788.73 is unallowable/waived. Indirect costs over 10% are being waived so that a majority of the grant funding can be sub-granted to partner agencies, per the Memorandum of Understanding. The Local Law Enforcement Block Grants (LLEBG) preceded JAG. LLEBG procedures included a provision to protect counties from major funding disparities that resulted from the block grant formula. The formula allocated funds to communities by rate of violent crime arrests (predominantly by municipal police agencies), failing to reflect the substantial responsibilities of counties for adjudicating these high level crimes (including incarceration, prosecution, defense, and court processing). If declared disparate, communities were required to concur in a reallocation of the award amounts or no distribution of LLEBG funds occurred. As a result of the request for consideration by Maricopa County, in FY 2004 the Arizona Attorney General certified that the cities of Phoenix, Mesa, and Glendale were scheduled to receive an award twice as much as the projected County award. As the County allocates more than 50% of the local incarceration or prosecution expenditures for Part I, violent crimes, the Attorney General declared that the local funding of LLEBG dollars was disparate. Because of this decision, the 2010 JAG grant again requires a collaboration of all named cities and towns with Maricopa County. The following is the result of the negotiation process whereby Maricopa County will be allocated $306,460 of the total award. Adult Probation will receive $67,421 for the Community Restitution Program. The County Attorney’s Office will receive $117,700 for an adult felony warrants reduction program. Juvenile Probation will receive $53,918 for an Outstanding Warrants Apprehension program. The Sheriff’s Office will receive $67,421 for the Maricopa County Neighborhood Narcotics Enforcement Team (MCNNET). (C-20-10-083-3-00)

33. IGA WITH PHOENIX POLICE DEPARTMENT Approve an Intergovernmental Agreement (IGA) between Maricopa County and the City of Phoenix Police Department authorizing payment for apprehending and /or transport of mental health patients pursuant to Superior Court Orders. This IGA shall become effective upon signature of both parties and shall remain in effect until terminated pursuant to the provisions of this Agreement. A.R.S § Title 36-545.04 provides that the county in which the mental health patient resides or was found prior to hospitalization is responsible for cost of court proceedings. Maricopa County has used the City of Phoenix Police Department for several years to comply with delivery of Superior Court Orders. Past payment for these services was through the use of a Sole Source Provider purchase order. These Sole Source purchase orders have a cap of Fifty Thousand Dollars per fiscal year. This year’s expenses (Fiscal year 2009-2010) are projected to be Fifty Four Thousand dollars and increase nominally over future years; therefore requiring the use of competitive bid contract or Intergovernmental Agreement. Budget for these services has been and is included in Agency 390 fund 100 (Health Care Programs) (C-49-10-056-2-00)

34. REVENUE AND EXPENDITURE ADJUSTMENTS FOR THE OFFICE OF ENTERPRISE TECHNOLOGY Pursuant to A.R.S. Section 42-17106(B), approve an increase in revenue and expenditures for the Office of Enterprise Technology (410) Telecommunications Fund (681) Operating (0000) for Fiscal Year 2009-10 in the amount of $2,000,000. This increase is due to the increased demand in customer driven work orders and carrier services provided. Revenue from charges for parts and services will offset the increased expense. This adjustment will require offsetting revenue and expenditure adjustments to Elimination Department (980) Eliminations Fund (900) Operating (0000) of $2,000,000, resulting in a countywide impact of zero. Also, approve a transfer of expenditure authority increasing the expenditure appropriation in the Office of Enterprise Technology (410) Telecommunications Fund (681) Non Recurring Non Project (0001) for Fiscal Year 2009-10 in the amount of $1,000,000 and decreasing the expenditure appropriation in Non Departmental (470) Grant Fund (249) Non Recurring/Non Project (0001) for Fiscal Year 2009-10 in the amount of $1,000,000. This adjustment is necessary to complete the restoration of the White Tank Radio facility after it was destroyed by fire. (C-41-10-017-2-00)

35. SOLE SOURCE FOR ADP AND PEOPLESOFT INFORMATION TECHNOLOGY SUPPORT Approve sole source purchases from bid serial 05115-S for the purpose of supporting ADP and PeopleSoft due to the extension of the ADP go-live date. As a result of the extension date, the county payroll function needs to be supported by the current PeopleSoft HRMS application. Contractors will be released after the ADP go-live date and transition period support the PeopleSoft payroll system. Since PeopleSoft is the current enterprise payroll system, the bi-weekly payroll needs to be completed in a timely manner as the knowledge transfer to new contractors can pose a significant risk to the PeopleSoft payroll system. The contractors also work on the ADP transition, have specific corporate knowledge critical to the ADP tasks, and go-live date. This purchase will fund the contractors through December 2010, (the anticipated go-live and transition timeframe) for a total not-to-exceed amount of $721,360 for FY 2011. The vendors are Comsys (C-41-10-010-3-00), Hudson Global Resources (C-41-10-011-3-00), Meridian Technology Group (C-41-10-012-3-00), Technology Staffing Solutions (C-41-10-013-3-00), and Vault Digital LLC (C-41-10-014-3-00). 90. EXEMPTION TO POST EMPLOYMENT HEALTH ENHANCEMENT (RETIREMENT) PROGRAM Approve the creation of one classified position (Inspector) in Public Works/Transportation. This position request is necessary due to the participation of the previous Inspector in the Post Employment Health Plan Enhancement Program (PEHPEP) which requires that the position (#11084) be eliminated. Creation of the new position is necessary to support business operations and continuity. The loss of this position has created a staffing hardship. The Project Management & Construction division consistently has between 10 and 15 projects in the construction phase. The work not covered by in-house staff is assigned to consultant staff. In-house inspectors allow flexibility and quick response to changes in the program and public needs. Consultant inspectors cost approximately $90/hourly, while in-house inspectors cost $34/hourly. Former incumbent's position was: MRT: Inspector Status: Classified Budgeted Rate: $23.28 Due to the nature of this position and the negative budget impact, Public Works/Transportation has determined it is necessary to replace position #11084 with a new Inspector position. MRT: Inspector Status: Classified Budgeted Rate: $20.95 Public Works/Transportation will achieve savings through hiring a new employee at a lower rate of pay than the retiring employee. This will result in $4,842 annual savings for the position as required under the 2010 Retirement Health Enhancement Program. (C-91-10-193-M-00)

F-3. RESOLUTION FOR WHITE TANKS FLOOD RETARDING STRUCTURE NO. 4 OUTLET FACILITY Adopt Resolution FCD 2010R003 for the White Tanks Flood Retarding Structure No. 4 Outlet Facility (PROJECT [#201]), authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to advertise, select, negotiate, and award contracts for engineering and construction services; negotiate Intergovernmental Agreements; and to acquire rights-of-way. White Tanks Flood Retarding Structure (FRS) No. 4, which is located between Jackrabbit Trail and the Tuthill Road alignment near the Van Buren Street alignment, does not have a facility to convey outlet flows to the Gila River. Such a facility is necessary to complete the flood protection goals for the White Tanks FRS No. 4 watershed, which includes much of the eastern slopes and foothills of the White Tank Mountains. The District has completed a design concept study for this outlet facility. The resulting selected-concept is a storm drain within the right-of-way of Van Buren Street, from the White Tanks FRS #4 to the proposed Loop 303 Outfall Channel near Cotton Lane, for a PROJECT length of approximately 3 miles. This Agenda Item impacts Supervisory District 4. (C-69-10-077-6-00)
